171 After subsection 31(3)
(3A) If subsection (1) or (3) would have caused the termination of a person’s return rights at a particular time after the commencement of this subsection if the Public Service Act 1922 had not been repealed, then section 6 or 7 of the Public Employment (Consequential and Transitional) Amendment Act 1999 does not apply to the person after that time.
(3B) The reference in subsection (3A) to the termination of a person’s return rights is a reference to any of the following ceasing to apply to the person:
(a) Part IV of the Public Service Act 1922;
(b) Division 3 of Part IV of the Public Service Act 1922;
(c) the Officers’ Rights Declaration Act 1928.
