8Application of Part

8 Application of Part (1) This Part does not apply to a person who is authorised by another Act to carry out a declared activity. (2) Without limiting subsection (1), a person is authorised by another Act if: (a) the person is a health practitioner who carries out the activity in the course of practising the health practitioner's profession; or (b) the person is licensed or otherwise authorised under the Radiation Protection Act 2004 to carry out the activity. (3) In this section: health practitioner means: (a) a medical practitioner; or (b) a person registered under the Health Practitioner Regulation National Law: (i) to practise in the dental profession as a dentist (other than as a student); and (ii) in the dentists division of that profession; or (c) a person registered under the Health Practitioner Regulation National Law to practise in the nursing profession (other than as a student); or Public and Environmental Health Act 2011 7 (d) a person registered under the Health Practitioner Regulation National Law to practise in the pharmacy profession (other than as a student).
