79Functions and powers

79 Functions and powers (1) An authorised officer has the following functions: (a) to ensure this Act is being complied with; (b) the other functions imposed on the officer by this or another Act. (2) An authorised officer appointed under section 74 may only exercise a power or perform a function if it is necessary for the proper exercise of a power, or proper performance of a function, delegated to the enforcement agency who appointed the officer. (3) The CHO may impose conditions and limitations on the exercise of powers, or the performance of functions, by an authorised officer or a class of authorised officers. (4) When exercising a power or performing a function, an authorised officer is: (a) if appointed under section 76(2) – subject to the CHO's directions; or Public and Environmental Health Act 2011 46 (b) if appointed under section 74 – subject to the directions of the enforcement agency; or (c) if a police officer – subject to the directions of the Commissioner of Police. (5) However, if an emergency declaration is in force, authorised officers mentioned in subsection (4)(b) are subject to the CHO's directions.
