38Cancellation of public health notice or order

38 Cancellation of public health notice or order (1) The CHO may cancel a public health notice or public health order: (a) on application of the person issued with the notice or order; or (2) An application for cancellation must: (a) be in the approved form; and (b) be accompanied by the fee prescribed by regulation; and (c) state the action taken to comply with the notice or order; and (d) state a date on which, or a period within which, an appropriate inspection may be made to decide whether the notice or order has been complied with. Public and Environmental Health Act 2011 22 (3) If a person applies for cancellation of a notice or order, the CHO must consider the application and decide whether to cancel the notice or order. (4) The CHO must give written notice to the applicant of: (5) The CHO must not cancel a notice or order unless the CHO is satisfied: (a) an authorised officer has carried out an appropriate inspection; and (b) the notice or order has been complied with.
