113A Coughing or spitting on certain workers (a) the person intentionally coughs, spits or expectorates on or at another person; and (b) the other person is: (i) a police officer; or (ii) an emergency worker as defined in section 187(2) of the Criminal Code; or (iii) a worker within the meaning of section 188A of the Criminal Code; and Public and Environmental Health Act 2011 65 (c) the conduct specified in paragraph (a) is likely to cause a reasonable person to fear that COVID-19 will be transmitted to the person specified in paragraph (b). Maximum penalty: 100 penalty units or imprisonment for 12 months. (2) Strict liability applies to subsection (1)(b). (3) Absolute liability applies to subsection (1)(c).
