44 Terms and conditions of appointment (1) The Commissioner is appointed on the terms and conditions (including the remuneration and allowances) that are specified in the instrument of appointment. (1A) The remuneration paid to the Commissioner under subsection (1)— (a) must be within the relevant remuneration band in a Determination made by the Tribunal; or (b) may exceed the maximum of the relevant remuneration band only if the employer of the Commissioner has obtained the advice of the Tribunal under section 37 of the **Victorian Independent Remuneration Tribunal and Improving Parliamentary Standards Act 2019**. (2) The terms and conditions may provide for the appointment of the Commissioner on a full-time or part-time basis. (3) Subject to this Part, the Commissioner— (a) holds office for a period of not less than 3 years and not more than 5 years, as specified in the instrument of appointment; and (b) is eligible for re-appointment. (4) Except with the written permission of the Premier, the Commissioner must not— (a) engage in any other employment; or (b) carry on any business, profession or trade; or (c) hold any other office or position, paid or unpaid.
