Protective Custody Act 2000

The Act rests on a handful of statutory concepts, each defined in s 3 or elaborated in Parts 2-7. Those concepts drive both what officers may do and what obligations follow.

• Intoxicant and intoxicated. "Intoxicant" includes alcohol, drugs, volatile and other substances capable of intoxicating (s 3). "Intoxicated" is defined as affected by, or apparently by, an intoxicant to such an extent that there is a significant impairment of judgment or behaviour (s 3). This definition is subjective and fact driven, and it is the statutory threshold that authorises apprehension (s 6) and other powers.
• Authorised officer. This term aggregates community officers appointed under s 27, police officers, and security officers as defined in the Public Transport Authority Act 2003 (s 3). The Act imposes limits on who may exercise particular powers, for example security officers’ powers are restricted to Authority property (ss 5(1a), 6(1a)).
• Apprehended. A person is "apprehended" only when apprehended under s 6(1) (s 3 definition). Several duties and protections apply only to an "apprehended person", including the prohibition on charging and forensic procedures (s 24).
• Public place and trespass. The statutory trigger for the powers in s 6 is presence in a public place or trespassing on private property (s 6(1)). "Public place" is broadly defined to include places where the public are admitted on payment, schools and universities except private parts, and privately owned places accessible without the owner’s occupation or with implied approval (s 3). The place-based limitation constrains the spatial reach of the regime.
• Appropriate facility and approved place. "Approved place" is to be prescribed by Ministerial notice in the Gazette (s 26(1)). The Act differentiates between "appropriate facility", which is an approved place to which the person may be taken according to a notice (s 3), and the statutory restriction that nothing in the Act permits detention in an approved place (s 26(3)). That means approved places are for transfer and care, not lawful detention per se, and detention rules (s 7) still apply.
• Powers of search, seizure and destruction. Searches of apprehended persons are authorised for items described in s 9 and must be conducted by a person of the same sex (s 8). Seizure powers encompass intoxicants and any article that could endanger health or safety, including prescribed drugs that belong to the person (s 9(1)). Alcohol may be destroyed immediately (s 9(2)); other intoxicants may be destroyed if the officer reasonably suspects returning them would result in further intoxication (s 9(3)). Seizure of intoxicants from children has its own provision (s 5).
• Release and non-conditional release. The Act prescribes mandatory release options for children and adults, with different hierarchies (ss 11-13). Release must be unconditional under the Act; an apprehended person may not be required to give bail or recognisance before release (s 16). The Act requires written acknowledgements and record entries on release (s 15).
• Judicial oversight and remedies. There are routes to immediate judicial review by a JP (ss 17-19), an after-the-fact declaration in the Magistrates Court that a person was not intoxicated at the time of apprehension (with the Act noting that such a declaration does not establish unlawfulness) (s 20), and express time triggers and recording obligations for delay in presenting a person to a JP (s 21).
• Non-use of detention for evidence gathering. The Act creates a strict separation between detention under this statutory regime and criminal investigative procedures. While detained, a person cannot be charged, questioned about suspected offences, or subjected to forensic procedures; contraventions render statements or information inadmissible, and the Commissioner of Police must ensure destruction of improperly obtained material (s 24).

These concepts combine to create a statutory framework aimed at temporary protective custody for intoxicated people outside the ordinary criminal processes. The Act assigns discretion at several points: reasonable suspicion thresholds (ss 5(1), 6(1)), reasonable force (ss 6(2), 8(3)), the "reasonable belief" that a person applying to take charge of an adult is capable (s 13(1)(b)), a JP’s discretionary directions (s 19), and the Minister’s discretion to approve places and specify classes (s 26). The Act therefore embeds both specific duties and broad discretionary judgments that must be recorded in many circumstances.

The Act identifies several classes of affected persons and institutions; their roles and burdens are explicit in the text.

• Apprehended persons. People who are apprehended under section 6 and any person to whom the seizure power in section 5 applies (children using intoxicants) are immediately affected. Apprehended persons are subject to temporary detention, search, seizure of intoxicants and potentially medical examination, but enjoy specific protections: they must be released as soon as practicable if not intoxicated (s 7(2)), they may not be charged or questioned while not released (s 24), and they have rights to prompt review by a JP (ss 17-19) and to apply to the Magistrates Court for a declaration they were not intoxicated (s 20). Children have a tailored release hierarchy prioritising parents and guardians and the child’s welfare (s 11).
• Authorised officers. This group comprises community officers, police officers and security officers. They are the decision-makers with power to apprehend, detain, search and seize (ss 3, 5, 6, 8, 9). Police officers retain special responsibilities such as the power to delay release overnight between midnight and 7.30 a.m. if release is not in the person’s best interests and must record reasons for that decision (s 7(4)-(5)). Authorised officers must record times of apprehension (s 6(3)), details of seizures and how seized items were dealt with (s 9(5)), details of medical examinations arranged (s 10(3)), and release records and acknowledgements (s 15).
• Community officers. Community officers are appointed in writing by the Commissioner of Police, their appointment can be limited in geography or circumstance, they receive a certificate of appointment, and their appointment may be amended or cancelled by the Commissioner (s 27). The performance of functions by community officers under the Act is voluntary and for no pay (s 27(8)). For workers compensation purposes they are to be treated as employees of the Crown while performing functions under the Act and the Minister may set reasonable weekly earnings for such purposes (s 27(9)). Community officers are not public service officers by virtue of appointment (s 27(7)). These provisions affect recruitment, training, exposure to liability and access to workers compensation.
• Security officers for Public Transport Authority property. Security officers as defined by the Public Transport Authority Act 2003 are included in the authorised officer definition but certain powers only apply on Authority property (ss 5(1a), 6(1a)). That confines their practical exercise of powers in transits and transport lands.
• Parents, legal guardians and responsible persons. The Act affects parents and guardians of apprehended children and any private person who consents to take custody of an adult under s 13. For children, the officer must release into the care of a parent or legal guardian if practicable, or another responsible person who consents and is capable, or the person in charge of an appropriate facility (s 11). Adults may be released into the care of another person at the officer’s discretion if the adult does not object and the officer reasonably believes the applicant is capable of taking care of the adult; refusal may be reviewed by a JP (s 13).
• Ministers and administrators. The Minister has power to approve places by Gazette as approved places and may restrict which classes of apprehended people may be taken to a place, and may amend or cancel notices (s 26). The Governor may make regulations prescribing matters necessary for giving effect to the Act, including the form and manner of records (s 29). These powers create administrative responsibilities for policy and operational oversight.
• Custodial service providers and authorised persons under other Acts. Section 23 permits authorised persons under the Court Security and Custodial Services Act 1999 to perform certain functions listed in the Table, effectively allowing delegation or outsourcing of custodial functions in some circumstances. This affects contract and service arrangements where court security and custodial services are engaged.
• The Crown and insurers. Section 28 provides protection from tort liability for persons acting in good faith in performance or purported performance of functions under the Act, noting this does not relieve the Crown from liability arising from another person’s action. The Crown therefore retains exposure in its own right but provides statutory indemnity for individual actors acting in good faith.

The Act therefore imposes obligations and creates rights across a mix of public authorities, voluntary community officers, private security personnel on Authority property, family members, and custodial service providers. The scheme distributes decision-making authority to front-line authorised officers while providing oversight through JP review and Magistrates Court declarations.

The Act sets out concrete duties for authorised officers and rights for apprehended persons, with specific procedural and recordkeeping obligations.

Duties for authorised officers

• Apprehension threshold and recording. An authorised officer may apprehend if the officer reasonably suspects a person in a public place or trespassing is intoxicated and needs to be apprehended to protect health or safety or prevent serious property damage (s 6(1)). The officer must record the date and time of apprehension (s 6(3)).
• Use of force. The officer may use reasonable force and assistance to apprehend (s 6(2)). Reasonable force is also permitted for searches (s 8(3)).
• Detention limits. A detained person must not be detained if not, or no longer, intoxicated (s 7(2)). Detention must be no longer than necessary for the stated protective purposes (s 7(3)). Police may, as an exception, not release a person between midnight and 7.30 a.m. if release in that period is not in the person's best interests, and must record reasons (s 7(4)-(5)). The duty to release as soon as practicable (ss 11(1) and 12(1)) is not affected by the power to detain.
• Search and seizure. Officers must search apprehended persons for items that can be seized under s 9, perform searches by a person of the same sex (s 8(2)), and record seizures and how things are dealt with (s 9(5)). Seized alcohol may be destroyed (s 9(2)); other seized intoxicants may be destroyed if return would likely enable further intoxication (s 9(3)). For children, intoxicants may be seized if consumed or about to be consumed, and the officer reasonably suspects the child would become intoxicated if the item is not seized (s 5(1)-(3)).
• Medical examination. If an apprehended person needs a medical examination, the authorised officer must arrange such an examination as soon as practicable and must continue detention subject to section 7 unless referred under the Mental Health Act or the medical examiner takes charge (s 10(1)-(2)). The officer must record the fact, examiner’s name and date/time of exam (s 10(3)).
• Release duties. Children must be released as soon as practicable into care of parent/guardian, responsible consenting person, or appropriate facility, giving paramount consideration to the child's safety and welfare (s 11(1)-(2)). Adults must be released as soon as practicable into care of another person under s 13, or appropriate facility (s 12(1)). If releasing an adult into the care of another person under s 13(1), the officer must be satisfied the adult does not object and that the applicant is capable of taking care of the adult (s 13(1)). If the officer refuses, the applicant may seek JP review (s 13(2)).
• Recordkeeping and release procedure. On release an apprehended person must acknowledge in writing the release date/time and receipt of any returned things (s 15(1)(a)); the other person taking custody must similarly acknowledge (s 15(1)(b)). If the person refuses, the officer must record the refusal and the date/time of release and any things given or returned (s 15(1)(c)). Release is to be unconditional; officers cannot require bail or recognisance before release under the Act (s 16).
• JP and court presentation. The officer must take, or arrange for the taking of, an apprehended person before a JP on request (s 17), and if detention continues beyond eight hours and it is still not possible to comply with release obligations under s 7, the officer must take the person before a JP (s 18). The officer must do so as soon as practicable and must not delay except for minimum organisational requirements in the police station context, and must record reasons for delay (s 21).

Rights and protections for apprehended persons

• No interrogation or forensic procedures. An apprehended person who has not been released may not be questioned in relation to any suspected offence, subjected to forensic procedures, or charged with an offence (s 24(1)). Evidence obtained in contravention is inadmissible and must be destroyed where required (s 24(2)-(3)).
• Prompt review and access to JP. The person may request to be taken before a JP at any time, and has a right to statutory time-based review if detention continues beyond eight hours (ss 17-18). The JP must direct release if satisfied the person should be released under s 7, may give other directions to ensure health and safety, and any such direction must be complied with by the officer (s 19).
• Application to Magistrates Court. The person may apply to the Magistrates Court within 30 days of release for a declaration they were not intoxicated at the time of apprehension; if the court is satisfied of that fact it is to make a declaration, though such a declaration does not itself establish unlawful apprehension (s 20).
• Return of seized items. Seized items that are not destroyed must be kept in safekeeping and returned to the apprehended person on release, or delivered to the person taking charge if the apprehended person is released into someone else’s care (s 14).
• Protection from conditional release. An apprehended person is not to be required to enter into a bail undertaking or recognisance before being released under the Act (s 16).
• Procedural acknowledgement. The Act mandates written acknowledgement on release (s 15), which creates an evidentiary record of release.

These duties create a compliance-heavy operational regime: numerous specific recording duties (apprehension time s 6(3), seizure records s 9(5), medical exam records s 10(3), recording of reasons for non-release overnight s 7(5), release acknowledgements s 15, and reasons for delay in JP presentation s 21(2)) are imposed on authorised officers. The institutional safety net is supplied by JP oversight, statutory prohibition on using detention to obtain evidence, and court-based declarations.

The Act does not prescribe criminal penalties or fines for non-compliance by authorised officers within its text. Instead, enforcement and remedial mechanisms are procedural, civil and supervisory.

• Judicial oversight by JPs and the Magistrates Court. The Act builds enforcement into the operation of the scheme through review rights. An apprehended person may request to be taken before a JP for review at any time (s 17). If detention continues beyond eight hours, the officer must present the person to a JP unless the person is released prior (s 18). The JP must order release if satisfied the person should be released under s 7, may direct continued detention if appropriate, and may give other directions for health and safety which officers must comply with (s 19). The Magistrates Court may make a factual declaration within 30 days that a person was not intoxicated at the time of apprehension, though the Act clarifies that such a declaration does not establish unlawful apprehension (s 20(4)-(5)).
• Evidentiary exclusion and destruction obligations. The Act creates immediate evidentiary penalties for improper use of detention. If an officer contravenes the prohibition on questioning the apprehended person about suspected offences, any answer given is inadmissible (s 24(2)). If forensic procedures are used contrary to s 24(1)(b), the Commissioner of Police must ensure destruction of any information obtained and any such information is inadmissible in criminal proceedings (s 24(3)). These provisions operate as a practical deterrent because they remove the usefulness of improperly obtained evidence for prosecution.
• Administrative accountability and recordkeeping. Numerous express recording obligations create a paper trail that supports administrative and judicial oversight (ss 6(3), 9(5), 10(3), 15, 21(2)). Failure to record or improper records could be relied upon in JP hearings and court proceedings, and could expose agencies to oversight, though the Act itself does not prescribe penalties for missing records.
• Civil liability and statutory protection. Section 28 provides that an action in tort does not lie against a person for anything done in good faith in performance or purported performance of a function under the Act. The protection extends to omissions and applies even if the act could have been done before the Act’s enactment. However, the section expressly preserves any liability the Crown might have for another person having done the act, and does not affect sections 137 and 138 of the Police Act 1892 (s 28(1)-(5)). Thus individual authorised officers acting in good faith have statutory protection from civil tort claims, shifting exposure to the Crown in some circumstances.
• Delegation and use of other custodial functions. Section 23 permits certain functions to be performed by authorised persons under the Court Security and Custodial Services Act 1999, and the table lists the specific sections, creating a compliance structure for custodial service providers that may be enforced under those statutory regimes and contractual terms.
• Regulatory instruments. The Governor may make regulations prescribing matters necessary to give effect to the Act, including form and manner of recordkeeping (s 29). Regulations, once made, would impose enforceable legal obligations and enable administrative enforcement, though no specific regulations are in the Act itself.

The Act therefore relies on procedural enforcement (judicial review, evidentiary exclusion), administrative recordkeeping and the sovereign liability framework rather than criminal penalties directed at authorised officers. The statutory protection from tort liability for good faith acts is a significant feature affecting potential litigation and the Crown’s responsibility. Enforcement against failure to adhere to duties relies substantially on operational oversight, judicial review, and the subpoena power of courts rather than on internal criminal sanctions.

The Act expressly situates itself alongside and in addition to other Western Australian statutes, and cross-references several statutory frameworks that shape its operation.

• Children and Community Services Act 2004. Section 4(1) states the Protective Custody Act is in addition to and does not affect the operation of section 41 of the Children and Community Services Act 2004. Section 11 (releasing apprehended children) complements that provision by setting immediate release duties and prioritising parental or guardian care, while preserving the separate child welfare regime in the Children and Community Services Act.
• Mental Health Act 2014. Section 4(2) preserves operation of section 156 of the Mental Health Act 2014. Section 10 of this Act interacts with the Mental Health Act by requiring an authorised officer to arrange medical examination as soon as practicable and acknowledging the pathway to referral under the Mental Health Act section 26(2) or (3)(a) for psychiatric examination at an authorised hospital or other place (s 10(1)-(2)). This creates a statutory interface where a medical or psychiatric assessment under the Mental Health Act can supersede continued detention under this Act.
• Public Transport Authority Act 2003. The Act limits powers given to security officers defined under the Public Transport Authority Act 2003 to Authority property (s 5(1a), s 6(1a)). That means powers of security officers are territorially constrained where the Public Transport Authority defines Authority property, aligning enforcement in transit contexts with PTA legislation.
• Court Security and Custodial Services Act 1999. Section 23 provides that authorised persons under that Act may, in specific circumstances listed in a table, perform functions conferred on an authorised officer by various sections of this Act, where they take charge or move a person detained under this Act under the Court Security and Custodial Services Act (s 23). This enables operational delegation to custodial contractors or specialised custodial staff, subject to the duties in the listed sections.
• Police Act 1892. Section 28(5) clarifies that the Act’s protection from tort liability does not affect sections 137 and 138 of the Police Act 1892. Those sections deal with Crown indemnity or other police-specific liabilities and procedures, meaning the standard police liability regime continues to operate alongside the statutory good-faith protection in s 28.
• Workers Compensation and Injury Management Act 2023. Section 27(9) explicitly applies that Act for community officers, treating community officers as Crown employees while performing functions under this Act for workers compensation purposes, and allowing the Minister to determine reasonable weekly earnings for those purposes. This produces a limited employment law interaction that grants community officers workers compensation protections despite their voluntary, unpaid status under s 27(8).
• Magistrates Court and evidentiary law. Section 20 creates a route to the Magistrates Court for a declaration regarding intoxication state at apprehension, and sections 24(2)-(3) govern admissibility of statements and forensic information in criminal proceedings. Those provisions intersect with forensic and criminal procedure regimes by removing improperly obtained evidence from admissible material and mandating destruction of such material.
• Regulations and administrative law. Section 29 empowers the Governor to make regulations, which will interact with administrative law principles and create regulatory duties such as prescribed forms for recordkeeping under the Act. The Act’s cross-references and delegation pathways also mean administrative contracts and service arrangements under the Court Security and Custodial Services Act and other machinery are implicated.

Overall, the Act is deliberately framed as complementary to existing child welfare and mental health legislation rather than as a substitute. It relies on cross-referrals to those Acts for handling cases where mental health or child-protection needs predominate. The territorial constraint on security officers ties the scheme to the statutory definition of Authority property under the Public Transport Authority Act. The statutory tort protection balances operational discretion with persistent Crown liability and with the existing Police Act regime. These interactions create a layered legal environment where authorised officers must consider multiple statutory frameworks when deciding on apprehension, detention and treatment pathways.

The statutory text in the compilation table records amendments and commencement dates. Key items in the compilation table, with the provisions in the Act that these amendments amended where specified, are as follows.

• Protective Custody Act 2000, No 50 of 2000, assented 28 November 2000, commenced 1 January 2001 (s 2). This was the original enactment.
• Public Transport Authority Act 2003, No 31 of 2003, s 206: amended provisions in s 3 (definition changes) and ss 5 and 6 to limit operation for security officers to Authority property. The amendment was assented 26 May 2003 and commenced 1 July 2003 (see compilation table).
• Children and Community Services Act 2004, No 34 of 2004, s 251: amendment referenced in s 4(1) to preserve operation of section 41 of that Act in addition to this Act. Assent 20 October 2004, commenced 1 March 2006.
• Workers’ Compensation Reform Act 2004, No 42 of 2004, s 174: amended s 27. Assent 9 November 2004, commenced 4 January 2005.
• Courts Legislation Amendment and Repeal Act 2004, No 59 of 2004, s 141: amended s 20 concerning declaration by court as to state of intoxication. Assent 23 November 2004, commenced 1 May 2005.
• Police Amendment Act 2008, No 8 of 2008, ss 17 and 23(7): amendments to s 3 and related parts, assented 31 March 2008; different commencement dates for the two sections noted in the compilation table.
• Mental Health Legislation Amendment Act 2014, No 25 of 2014, Pt 4 Div 4 Subdiv 20: amendment relevant to s 4 concerning the Mental Health Act cross-reference, assented 3 November 2014, commenced 30 November 2015.
• Workers Compensation and Injury Management Act 2023, No 21 of 2023, s 709: amended s 27(9) to provide current workers compensation treatment for community officers, assented 24 October 2023, commenced 1 July 2024.

The Act also notes specific section amendment citations in the text: s 3 was amended by No 31 of 2003 s 206(2) and No 8 of 2008 s 17 and 23(7); s 5 was amended by No 31 of 2003 s 206(3); s 6 was amended by No 31 of 2003 s 206(4); s 10 was amended by Gazette No 25 of 2014 s 80; s 11 was amended by No 34 of 2004 s 251; s 20 was amended by No 59 of 2004 s 141; s 27 was amended by No 42 of 2004 s 174 and No 21 of 2023 s 709(2). The compilation table records reprint 1 as the Act as at 2 June 2006, incorporating earlier amendments.

Mechanically, the amendments that appear in the compilation table and marginal notes focus on aligning the Protective Custody Act with the Public Transport Authority framework (limiting security officers’ powers to Authority property), clarifying interactions with child welfare and mental health legislation, integrating workers compensation coverage for community officers, and adjusting pathways for judicial declarations regarding intoxication.

There is no indication in the text of any retrospective amendments that alter core custody rules beyond the recorded changes to definitions, cross-references, administrative procedures and workers compensation treatment. The Act includes an omitted section 30 and an omitted Schedule 1 under the Reprints Act 1984, which are editorial matters in the reprint process rather than substantive changes to the custody regime.

For practitioners advising clients or agencies on compliance, the compilation table provides the specific amending instruments and commencement dates to check whether amendments had taken effect at any given historical point.

The legislation text supplied contains no citations to judicial decisions or reported litigation about the Protective Custody Act 2000. The Act itself does not list cases, nor does the compilation table include any judicial interpretation history. The statutory scheme builds internal review mechanisms rather than prescribing penal sanctions, and the statutory remedies and review pathways that could generate litigation are: JP review under sections 17 to 19, an after-the-fact declaration by the Magistrates Court that a person was not intoxicated at the time of apprehension under section 20, and the evidentiary exclusion and destruction obligations in section 24 for improperly obtained information.

Patterns of potential litigation that the Act’s text contemplates include the following.

• Judicial review and compliance litigation at the JP level. Sections 17-19 provide for immediate review before a Justice of the Peace, with JPs empowered to direct release or continued detention and to give directions to ensure health and safety. Any challenge to the lawfulness of detention could first be ventilated at JP hearings given their statutory role. The Act requires officers to take persons before a JP promptly, and to record reasons for any delay, providing evidential material for such hearings (s 21).
• Declarations in the Magistrates Court. Section 20 provides a limited statutory cause of action enabling a person to apply to the Magistrates Court within 30 days of release for a declaration they were not intoxicated at the time of apprehension. The Act makes clear that a declaration does not itself constitute a finding of unlawfulness of the apprehension (s 20(5)), and permits the apprehending and detaining officers to appear in proceedings (s 20(3)), facilitating adversarial fact-finding.
• Evidence suppression litigation. Section 24 renders any answers given on contravention inadmissible and requires destruction of improperly obtained forensic information. Challenges to prosecutions relying on evidence said to have been obtained in the course of detention under this Act could therefore involve applications to exclude evidence and procedural claims that the evidence should have been destroyed.
• Civil claims against Crown or individuals. Although section 28 removes individual tort liability for persons acting in good faith under the Act, the Crown may still be liable. Litigation concerning Crown liability or whether an individual’s act fell outside the protection of s 28 could therefore arise if the conduct was not done in "good faith" or if other legal duties apply. The Act saves operation of sections 137 and 138 of the Police Act 1892, which could again form part of an enforcement or liability dispute.

Absent textually supplied case names or references, the Act provides the procedural architecture for litigation but the statutory text does not enumerate any reported judicial interpretations. For legal advisers, that means primary sources for litigation history will be external: case law databases, tribunal and court records, and police oversight reports. Practitioners should take the Act’s review mechanisms as the expected first-instance venues for disputes about detention and release, and the Magistrates Court declaration under s 20 as a specifically provided civil route to contest the factual basis of intoxication at apprehension. The Act’s explicit limitation that such a declaration does not establish unlawfulness (s 20(5)) is a statutory constraint on remedies available through that route.

The text of the Act contains several provisions that create traps for operational officers and legal advisers if not carefully observed. These are concrete points to watch rather than value judgments.

• Subjective definition of "intoxicated". "Intoxicated" is defined by impairment of judgment or behaviour to a significant extent (s 3). That is a fact-intensive, subjective threshold. Officers must form a reasonable suspicion under s 6(1), but absence of objective testing in the Act means judicial or civil review will hinge on contemporaneous records and observed indicators. The recording obligations at apprehension (s 6(3)), seizure (s 9(5)) and release (s 15) are therefore essential evidence.
• Limits on where security officers can act. Security officers defined under the Public Transport Authority Act 2003 have restricted exercise of powers only on Authority property (ss 5(1a), 6(1a)). Misapplying powers outside those spatial limits could render actions ultra vires.
• Detention not to be in approved places. The Minister may approve places to which apprehended people may be taken (s 26(1)), but section 26(3) explicitly states that nothing in the Act permits the detention of an adult or a child in an approved place. Practically, that means an approved place can be a reception or care facility but cannot be used as a place of statutory detention, which could be a source of operational confusion when transferring custody.
• Overnight non-release exception and recording. Section 7(4) permits a police officer to decide not to release a person between midnight and 7.30 a.m. if release in that occasion is not in the person’s best interests. That is a narrowly drawn exception to the general duty to release as soon as practicable (ss 11(1), 12(1)), and s 7(5) requires recording of reasons. Failure to record reasons may undermine any later review or court challenge.
• Community officers are unpaid volunteers but treated as Crown employees for workers compensation. Section 27(8) says community officers perform functions voluntarily and for no pay. Section 27(9) treats them as Crown employees for workers compensation while performing functions. This creates a potential mismatch between expectations of volunteers and their exposure to risk and duty; agencies must ensure training and insurance arrangements are clarified.
• Non-use for investigative purposes. While detained under this Act, a person must not be questioned about suspected offences, subjected to forensic procedures, or charged (s 24(1)). Any officer tempted to use an apprehended person to obtain evidence will both violate this statutory rule and risk exclusion of evidence and mandated destruction of information (s 24(2)-(3)). Practically, custody under this Act cannot be a short-cut to investigative detention.
• The statutory tort immunity is limited. Section 28 removes actions in tort against persons acting in good faith under the Act, but preserves Crown liability for another person’s actions and does not affect Police Act provisions (s 28(3)-(5)). Legal advisers must therefore consider Crown potential liability claims even where individual actors have immunity.
• Recordkeeping burdens are extensive. Multiple sections impose specific recording duties: s 6(3) apprehension time; s 9(5) seizure record and disposal; s 10(3) medical exam details; s 15 release acknowledgements and s 21(2) reasons for delay to JP. Missing or inadequate records damage the officer’s defence at JP review or Magistrates Court applications.
• The Magistrates Court declaration does not establish unlawfulness. An application under s 20 can yield a declaration that the applicant was not intoxicated at the time of apprehension, but s 20(5) expressly disclaims that a declaration establishes unlawful apprehension. That distinction affects remedies; a declaration is a factual finding but not a statutory determination that remedies such as damages are owed.
• No express criminal sanctions for officers. The Act does not create explicit criminal penalties for officers’ breaches within its text. Enforcement is via judicial process, admissibility rules, and administrative accountability. This can be a gotcha for those expecting statutory offences for non-compliance rather than procedural remedies.
• Search by same-sex requirement. Section 8(2) mandates the search of an apprehended person must be done by a person of the same sex. In mixed-gender contexts or where same-sex staff are unavailable, authorised officers must either delay until a same-sex searcher is available or otherwise comply with s 8(4)-(5) by authorising others to assist. Failure to comply may render searches unlawful.

Attention to these specifics will affect operational compliance and legal defensibility. The statute pairs broad discretionary language such as "reasonable suspicion" and "reasonable force" with detailed procedural and recording obligations; the latter are crucial to substantiating the former in review or litigation.

A practical compliance checklist for agencies, authorised officers, community officers, security officers, and Ministers, drawn directly from the statutory text, follows. Each step cites the relevant statutory provision.

Operational readiness and appointments

• Ensure authorised officers are properly constituted. Police officers are authorised by office; community officers must be appointed in writing by the Commissioner of Police and issued a certificate of appointment, with appointments reflecting any geographic or circumstance limits in the instrument (s 27(1)-(4)). The Commissioner may amend or cancel appointments and may delegate appointment functions other than delegation power itself (s 27(5)-(6)).
• For security officers, confirm where they are defined as authorised officers under the Public Transport Authority Act 2003 and confine exercise of certain powers to Authority property as required by ss 5(1a) and 6(1a).
• Ministerial notices and approved places. If implementing approved places, ensure Ministerial Gazette notices specify the place and any limits on which classes of apprehended people may be taken there, and maintain current notices and amendments under s 26(1)-(2). Note statutory limitation that approved places cannot be used to detain an adult or child (s 26(3)).

Initial encounter, apprehension and recording

• Establish clear indicators for intoxication consistent with the statutory definition: significant impairment of judgment or behaviour (s 3), and document observed indicators contemporaneously to support "reasonable suspicion" for apprehension under s 6(1). Record the date and time of apprehension as mandated (s 6(3)).
• Exercise proportionate force. Any use of force must be reasonable (s 6(2)), and searches must be by a person of the same sex unless an authorised officer authorises another to search or assist and gives directions, with those persons obliged to obey lawful and reasonable directions (s 8(2), (4)-(5)).

Searches, seizure and handling of seized things

• When searching, limit the search to things that can be seized under s 9, and always record the seizure and how the thing is dealt with (s 9(1), (5)). Alcohol and substances containing alcohol may be destroyed (s 9(2)); other intoxicants may be destroyed only where an officer reasonably suspects returning them would be likely to result in further intoxication (s 9(3)).
• For children, apply section 5 with priority: seize intoxicants if the child is consuming, inhaling, or appears about to and the child is likely to become intoxicated if not seized (s 5(1)-(2)). Officers may destroy seized intoxicants (s 5(3)). Ensure these actions and disposals are recorded.

Medical assessment and Mental Health Act interface

• If a medical examination is needed, arrange it as soon as practicable through a suitably qualified person and record the examiner’s name and the date/time (s 10(1), (3)). If the person is to be referred under the Mental Health Act section 26(2) or (3)(a) for psychiatric examination, do so, noting this supersedes continued detention under this Act (s 10(2)).
• Provide training for officers to recognise situations where Mental Health Act referral is the appropriate pathway rather than continued custodial detention.

Detention limits and release pathways

• Limit detention strictly to what is necessary to protect health or safety or prevent serious property damage (s 7(3)). Do not detain a person who is not, or no longer, intoxicated (s 7(2)).
• For children, release as soon as practicable into the care of parent/legal guardian, or a responsible person who consents and is capable, or failing those, into the care of the person in charge of an appropriate facility. Give paramount consideration to the child’s safety and welfare (s 11(1)-(2), (4)-(5)).
• For adults, release as soon as practicable into the care of another person under s 13 or into the care of an appropriate facility (s 12(1)). When an adult is to be released into the care of another person, confirm the adult does not object and that the applicant is capable of tending to the adult (s 13(1)). If refusing an applicant, inform them they can seek JP review, and arrange prompt JP presentation if it is reasonably practicable (s 13(2)-(3)).
• Do not require bail or recognisance before release under the Act (s 16).

Release procedure and recordkeeping

• On release, obtain written acknowledgement from the apprehended person of the release date/time and receipt of any returned items (s 15(1)(a)). If released into the care of another person, obtain that person’s written acknowledgement of the release date/time and receipt of any returned items (s 15(1)(b)). If the person or the other person refuses to sign, record the refusal and the date/time and any items returned (s 15(1)(c)). Maintain these records as evidence of compliance.
• Maintain the records the Act expressly requires: apprehension time (s 6(3)), seizure and how seized items were dealt with (s 9(5)), medical exam name and date/time (s 10(3)), reasons for overnight non-release (s 7(5)), and reasons for delay in presenting the person to a JP (s 21(2)). Anticipate that these records will be scrutinised in JP hearings and court proceedings.

Judicial review and rights advisement

• Inform detained persons of their right to request being taken before a JP at any time (s 17). Put processes in place to ensure persons are taken before a JP as soon as practicable, including staffing rosters and transport arrangements to meet the statutory timing expectations, and record reasons for any delay (s 21).
• Implement a clear procedure for presenting someone to a JP at the eight-hour trigger if detention persists and it is still not possible to comply with the release provisions (s 18), including an escalation path to senior officers.

Evidence and criminal procedure safeguards

• Do not question or attempt to obtain forensic evidence for criminal prosecution while a person is detained under this Act (s 24(1)). Any statements or forensic material obtained in breach of s 24 must be treated as inadmissible and, for forensic procedures, the Commissioner of Police must ensure the material is destroyed (s 24(2)-(3)).
• Train frontline staff and investigators on the prohibition and on the need to preserve evidence only after lawful release or under separate lawful processes not connected to apprehension under this Act.

Community officer management and welfare

• Given community officers are voluntary and unpaid (s 27(8)) but treated as Crown employees for workers compensation while performing functions (s 27(9)), implement induction training, provide clear role descriptions, issue certificates of appointment, and ensure access to workers compensation arrangements and occupational health measures.
• Maintain records of appointments, any limits on exercise of powers, and processes for amendment or cancellation of appointments in writing as per s 27.

Approved places, Ministerial notices and custodial delegations

• Where approved places are used, ensure the Minister’s Gazette notices are in place, are current, and specify any classes of persons who may be taken there (s 26(1)-(2)). Remember that approved places are for transfer and care rather than detention (s 26(3)).
• If custodial services are delegated to authorised persons under the Court Security and Custodial Services Act 1999, ensure contractual and operational arrangements reflect the specific sections identified in the Act’s Table and that those persons are aware of the duties they will perform (s 23).

Liability and insurance

• Note the statutory protection from tort for persons acting in good faith under s 28, and document training and policies that support a good-faith operational posture. Review Crown liability exposure and insurance arrangements, because s 28 preserves the Crown’s potential liability for another person’s actions (s 28(3)).

Regulatory compliance

• Anticipate regulations under s 29 that may prescribe the manner and form of recording information required under the Act. Monitor Gazette and legislative updates to ensure recordkeeping, forms and operational procedures comply with any regulations once made.

These compliance steps rest on the Act’s own text. Agencies should document policies and training that map each statutory duty to operational tasks and recordkeeping templates, so that, in JP review or Magistrates Court proceedings, contemporaneous records demonstrate lawful exercise of powers, consideration of release pathways, observance of the prohibition on using detention for investigatory purposes, and fulfilment of the Act’s medical and welfare obligations.
