Protection of the Sea (1992 Fund) Regulations 1994

These Regulations implement procedural and administrative rules under the Protection of the Sea (Oil Pollution Compensation Funds) Act 1993 for two linked fields: (a) registration and enforcement in Australia of foreign judgments for compensation for pollution damage under the 1992 Fund regime established by the 1992 Fund Convention (the 1992 Convention), and (b) contribution‑reporting, record‑keeping and payment mechanics for contributors and the Fund. They also prescribe where federal jurisdiction for registration matters will sit and set court practice details.

Mechanically, the regulations:

Define key terms and say that expressions used in the Regulations and the 1992 Convention bear the same meaning for the Regulations as in the Convention (r 3(1), r 3(2)).
Invest jurisdiction for registration matters in the Supreme Court of each State, the Supreme Court of each internal Territory and the Federal Court of Australia (r 4). Fees payable are those prescribed in the Rules of the Court (r 5).
Create a mandatory written registration application process for holders of foreign judgments given under Article 7 of the 1992 Convention (r 6). A Court must order registration on written application but only where specified conditions are satisfied (r 6(2) and (3)).
Specify documentary and affidavit requirements to support registration, including authenticated certified copies of the foreign judgment and, where necessary, certified translations (r 10).
Prescribe how the sum for registration is to be calculated, to include the whole judgment amount (or balance remaining), costs, interest up to registration and reasonable registration costs (r 7); require conversion into Australian currency using the Reserve Bank of Australia official rate as at the date of the foreign judgment (r 8).

Notes

Part 1 Preliminary

1 Name of Regulations [see Note 1]

These Regulations are the Protection of the Sea (1992 Fund) Regulations 1994.

2 Commencement [see Note 1]

These regulations commence on the day on which Chapters 1, 2 and 4 of the Act commence.

3 Interpretation

(1) In these regulations, unless the contrary intention appears:

Act means the Protection of the Sea (Oil Pollution Compensation Funds) Act 1993.

compensation for pollution damage means compensation for which provision is made under Article 4 of the 1992 Convention.

Court means a court that is invested or conferred with jurisdiction under regulation 4 for matters arising under Part 2.

judgment means a judgment or order given or made by a court against the Fund for compensation for pollution damage in a foreign country to which the 1992 Convention applies.

judgment creditor:

(a) means the person in whose favour a judgment was given; and

(b) includes a person in whom the rights under a judgment are vested by succession, assignment or otherwise.

judgment debtor:

(a) means the person against whom a judgment was given; and

(b) includes a person against whom a judgment is enforceable under the law of the country in which the original court is situated.

original court, in relation to a judgment, means the court by which the judgment is given.

registered means registered under Part 2.

(2) Unless the contrary intention appears, an expression used in these regulations and in the 1992 Convention has the same meaning in these regulations, as they relate to the 1992 Convention, as in the 1992 Convention.

Note Words and expressions used in these regulations that are defined in the Act have the same meaning in these regulations as they have in the Act (see Acts Interpretation Act 1901, s. 46 (1) (a)). For example, section 3 of the Act contains definitions of the 1992 Convention and the 1992 Fund.

Part 2 Registration of foreign judgments

4 Jurisdiction of Courts

For the purposes of section 34 of the Act:

(a) the Supreme Court of each State is invested with federal jurisdiction; and

(b) federal jurisdiction is conferred on the Supreme Court of each internal Territory; and

5 Court fees

For the purposes of section 34 of the Act, the fees to be paid to a Court in respect of a matter under this Part are the fees prescribed in relation to the matter in the Rules of the Court.

6 Application for registration of foreign judgment

(1) A judgment creditor may apply to a Court to have the judgment registered in the Court.

(2) Subject to these regulations, on written application, a Court must order the judgment to be registered.

(3) A judgment must not be registered unless it:

(a) was given by a court having jurisdiction of the kind referred to in Article 7 of the 1992 Convention; and

(b) was given in respect of an incident that occurred after Australia and the country in which the original court is situated became countries to which the 1992 Fund applies; and

(d) is no longer subject to ordinary forms of review under the law of the country in which the original court is situated.

7 Sum for which judgment may be registered

The amount for which a judgment may be registered is the total of:

(a) the whole amount payable under the judgment of the original court, or, if the judgment has been partly satisfied, the balance payable under the judgment at the date of the application for registration, including:

(i) any costs awarded to the judgment creditor; and

(ii) any interest that, by the law of the country in which the original court is situated, becomes due under the judgment up to the time of registration; and

(b) the amount of the reasonable costs of, and incidental to, registration, including the costs of obtaining a certified copy of the judgment from the original court.

8 Judgment sum to be expressed in Australian currency

If the sum payable under a judgment is expressed in the currency of a foreign country, the amount for which the judgment may be registered is the amount that the sum payable represents in Australian currency calculated at the official rate of exchange determined by the Reserve Bank of Australia as at the date of the judgment of the original court.

9 Judgment in respect of pollution damage and other matters

If a judgment, for which registration is sought, appears to the Court to be in respect of proceedings for compensation for pollution damage and for other matters, the judgment may be registered in respect of provisions contained in it that relate to compensation for pollution damage but not in respect of provisions relating to the other matters.

10 Evidence in support of application to register judgment

(1) An application for registration must have with it an affidavit:

(a) to which is attached:

(i) a certified copy of the judgment of the original court authenticated by the seal of that court; and

(ii) if the judgment is not in English — translation of the judgment into English that is certified by a notary public or authenticated by affidavit; and

(b) that states to the best of knowledge of the applicant:

(i) that, at the date of the application, the judgment of the original court has not been satisfied, or, if the judgment has been partly satisfied, the sum for which it remains unsatisfied; and

(ii) that, at the date of the application, the judgment of the original court is enforceable by the applicant by execution in the country in which the original court is situated; and

(iii) that, if the judgment is registered, the registration will not be, or be liable to be, set aside; and

(iv) that the judgment of the original court is no longer subject to ordinary forms of review under the law of the country in which the original court is situated; and

(v) that the judgment was given by a court having jurisdiction of the kind referred to in Article 7 of the 1992 Convention; and

(vi) that the judgment was given in respect of an incident that occurred after Australia and the country in which the original court is situated became countries to which the 1992 Fund applies; and

(c) that specifies the rate at which interest (if any) accrues on the judgment under the law of the country in which the original court is situated.

(2) The affidavit must set out the matters relied on by the applicant as evidence of the matters referred to in paragraphs (1) (b) (v) and (vi).

(3) If the sum payable under the judgment of the original court is expressed in currency other than Australian currency, the affidavit must state the amount that that sum represents in Australian currency calculated at the official rate of exchange determined by the Reserve Bank of Australia as at the date of that judgment.

(4) If the judgment has been given in respect of proceedings for compensation for pollution damage and of other matters, the affidavit must identify the provisions of the judgment:

(a) that relate to compensation for pollution damage; and

(b) for which registration is sought.

11 Security for costs

The Court may order a judgment creditor who applies for registration of the judgment to give security for the costs of the application and of any proceedings that may be brought to set aside the registration of the judgment.

12 Order on application for registration of judgment

(1) If an order is made for registration of a judgment the Court must fix a period that appears to the Court to be appropriate in the circumstances to enable an application to be made to set aside the registration of the judgment.

(2) The order for registration of a judgment must:

(a) specify the period fixed by the Court under subregulation (1); and

(b) include a statement to the effect that the judgment will not be given effect until the end of the period stated in the order.

(3) At any time until a party can no longer apply to have registration of a judgment set aside, the Court may grant an extension of the period during which an application to have the registration set aside may be made.

13 Notice to judgment debtor of registration of judgment

(1) Notice in writing of the registration of a judgment of the original court must be served on the judgment debtor in accordance with the practice and procedure applicable to service of a writ of summons issued by the Court in which the judgment has been registered unless another mode of service is ordered by the Court.

(2) A notice of the registration of a judgment referred to in subregulation (1) must:

(a) specify full particulars of the registered judgment and the order for registration; and

(b) specify the name and address for service of the judgment creditor or his or her solicitor or agent, as the case may be; and

(c) include a notice to the judgment debtor that he or she may apply, within the period specified in the order, for registration of the judgment to be set aside in accordance with these regulations.

14 Effect of registration of foreign judgment

(1) Except to the extent that these regulations provide for the setting aside of registration, a registered judgment has the same effect as a judgment of the Court in which it is registered as if the judgment had been entered in that Court on the date of registration.

(2) For the purpose of any proceedings on a registered judgment, interest on the sum for which the judgment is registered accrues from the date of registration of the judgment as if it were a judgment of the Court in which it is registered.

15 Execution not to issue before period allowed to set aside judgment

Effect must not be given to a registered judgment until:

(a) the end of the period fixed by the Court for making an application to set aside the judgment; or

(b) the end of any further period that is ordered by the Court; or

(c) if an application to set aside the judgment is made during the period referred to in paragraph (a) or (b) — after the application has been finally determined.

16 Procedure to have a registered judgment set aside

(1) A person against whom a registered judgment may be enforced may apply to the Court in which the judgment was registered to have registration of the judgment set aside.

(2) On an application, the Court may set aside registration of a judgment, if:

(a) the rights under the judgment are not vested in the person by whom the application for registration was made; or

(b) the person against whom the judgment was registered is not the person subject to the obligations under the judgment; or

(c) at the date of the application for registration of the judgment, the sum for which the judgment was registered had been paid in whole or in part; or

(d) the judgment was obtained by fraud; or

(e) the judgment debtor, being the defendant in the proceedings in the original court, was not given reasonable notice of those proceedings or a fair opportunity to defend the proceedings; or

(f) before the date of the judgment in the original court, the matter in dispute in the proceedings in that court had been the subject of a judgment of an Australian court exercising jurisdiction in the matter; or

(g) before the date of the judgment in the original court, the matter in dispute in the proceedings in that court had been the subject of a judgment of a court (except an Australian court) exercising jurisdiction in the matter, being a judgment that:

(i) could be registered; and

(ii) if it were registered — would not be liable to be set aside; or

(h) the judgment was registered in contravention of these regulations.

17 Power of Court to set aside registered judgment

(1) If, on application to set aside the registration of a judgment, it appears to the Court that registration of the judgment may be set aside only because at the date of application for registration:

(a) the judgment was not enforceable in the country in which the original court is situated; or

(b) the judgment was subject to an ordinary form of review under the law of the country in which the original court is situated;

the Court may, instead of setting aside the registration of the judgment, order a stay of execution on the judgment on such terms as it thinks just.

(2) If the registration of a judgment is set aside only because part of the sum in respect of which the judgment was registered had, at the date of the application for registration of the judgment, been paid, the Court must, on the application of the judgment creditor, order the judgment to be registered for the balance remaining payable at the date of the last‑mentioned application.

(3) If the registration of a judgment is set aside only because the judgment was registered in respect of proceedings for compensation for pollution damage and for other matters, the Court must, on the application of the judgment creditor, order the judgment to be registered only in respect of the provisions of the judgment that relate to compensation for pollution damage.

18 Further application for registration

The setting aside of the registration of a judgment under these regulations does not prevent a further application to register the judgment being made, unless the Court orders otherwise.

19 Judgment not to be enforceable except by registration

A Court must not hear or determine proceedings, except proceedings by way of registration of a judgment, for the recovery of an amount payable under the judgment.

20 Issue of certificates of judgments

If a judgment has been entered in an Australian court for a claim for compensation under the applied provisions of the 1992 Convention and the person in whose favour such judgment has been entered wishes to enforce the judgment in a country to which the 1992 Convention applies, the Registrar or chief officer of the court must, on application by that person, issue under the seal of the court:

(a) a certified copy of the judgment in the proceedings; or

(b) a certified copy of any document filed with the court in the proceedings; or

(i) any order made by the court in the proceedings; or

(ii) any act or thing done in the proceedings that is recorded in a document forming part of the record kept by the court.

Part 3 Contributions and late payment penalties

21 Recovery of contributions and late payment penalties

For section 42 of the Act, a contribution, or late payment penalty, must be paid:

(a) by a cheque for the amount of the contribution or late payment penalty that is drawn in:

(i) Australian currency; or

(ii) the currency of the place where the 1992 Fund is located; or

(b) by electronic transmission of the amount of the contribution or late payment penalty in:

(i) Australian currency; or

(ii) the currency of the place where the 1992 Fund is located.

Part 4 Record keeping and returns

22 Records to be kept

(1) A person to whom Article 10 of the 1992 Convention applies must keep records for each calendar year of the matters that will enable the person to make a return under regulation 23.

Penalty: 10 penalty units.

(2) A person who is required to keep records must retain the records at the principal place of business of the person in Australia for 5 years after the year to which the records relate.

Penalty: 10 penalty units.

23 Copies of records to be given to Authority

(1) On or before 1 April in a year, a person to whom article 10 of the 1992 Convention applies must give to the Authority a return that relates to the preceding calendar year, in accordance with the form in the Schedule.

Penalty: 10 penalty units.

(2) The return must:

(a) be signed by the person who makes the return; and

(b) specify the date on which the return was completed by that person; and

(3) For subregulation (1), strict liability applies to:

(a) whether the person is a person to whom Article 10 of the 1992 Convention applies, and

(b) whether the form of the return is in accordance with the requirements of the form in the Schedule.

24 Authority may require documents

(1) If a document is relevant to ascertaining the liability of a person to make a contribution to the 1992 Fund, the Authority may, by notice in writing, require the person:

(a) to produce a document to the Authority; or

(b) to make a copy of a document and give the copy to the Authority.

(2) A person must comply with a notice issued by the Authority under subregulation (1) within 30 days of receiving the notice.

Penalty: 10 penalty units.

(3) An offence against subregulation (2) is an offence of strict liability.

Part 1 Preliminary

1 Name of Regulations [see Note 1]

These Regulations are the Protection of the Sea (1992 Fund) Regulations 1994.

2 Commencement [see Note 1]

These regulations commence on the day on which Chapters 1, 2 and 4 of the Act commence.

Core legal concepts set out in the Regulations centre on foreign judgment registration, the formalities for treating a foreign judgment as a domestic judgment, contributor reporting obligations and administrative powers of the Authority.

Key concepts and how the instrument treats them:

Registered judgment: Defined in r 3(1) as a judgment given by a foreign court against the Fund for compensation under the 1992 Convention. A registered judgment, once registered under Part 2, has the effect of a judgment of the Court in which it is registered (r 14(1)). Interest on a registered judgment accrues from the date of registration as if it were a domestic judgment (r 14(2)).
Jurisdictional gatekeeping: The Regulations specify which courts are to exercise federal jurisdiction for registration matters (r 4), directing applicants to Supreme Courts of the States, Supreme Courts of internal Territories and the Federal Court. Court fees follow the Rules of the Court (r 5).
Conditions for registration: A Court must not register a foreign judgment unless it meets the criteria listed in r 6(3): (a) the original court had jurisdiction as required by Article 7 of the 1992 Convention; (b) the incident occurred after both Australia and the foreign country became countries to which the 1992 Fund applies; (c) the judgment is enforceable by execution in the foreign country; and (d) the judgment is no longer subject to ordinary forms of review in the foreign country.
Evidence and authentication: An application must be accompanied by an affidavit attaching a certified copy of the foreign judgment authenticated by the seal of the original court; a certified translation where the judgment is not in English; and statements addressing enforceability, satisfaction, jurisdiction, timing, and interest accrual (r 10(1)-(4)).
Calculation and currency conversion: The amount for which the judgment may be registered includes the full amount payable (or the unsatisfied balance), costs awarded, interest up to registration, and reasonable registration costs (r 7). If expressed in foreign currency, conversion to Australian currency is at the Reserve Bank of Australia’s official rate as at the date of the foreign court judgment (r 8).
Set‑aside mechanics and interim protection: The Court must fix a period for judgment debtors to apply to set aside registration and must state that the judgment will not be given effect until the period ends (r 12). The Court may order stays of execution instead of setting aside registration where the only issue is enforceability in the original country or that the judgment was subject to ordinary review in that country at the date of registration (r 17(1)). Execution is prevented until those periods or determinations are final (r 15).
Limits to registration and enforcement: If the foreign judgment combines pollution compensation claims and other issues, registration is limited to the parts relating to compensation for pollution damage (r 9). A Court is prohibited from entertaining proceedings to recover an amount payable under a foreign judgment other than those proceedings for registration (r 19).
Contributor obligations and Authority powers: Persons to whom Article 10 of the 1992 Convention applies must keep records enabling a return to be made and must deliver the return to the Authority by 1 April in the form set out in the Schedule (r 22-23; Schedule). The Authority may require production or copying of documents relevant to ascertaining contribution liability (r 24). Failure attracts a penalty of 10 penalty units for each prescribed offence and, for some provisions, strict liability applies (r 22(1)-(2); r 23(1); r 24(2)-(3)).
Payment mechanics for contributions and penalties: Payments to the 1992 Fund must be made by cheque drawn in either Australian currency or the currency of the place where the 1992 Fund is located, or by electronic transmission in the same currencies (r 21).

Technical and administrative details are built into the Regulations to align Australian procedure with the international framework under the 1992 Convention, while creating domestic safeguards in the forms of documentary proof, statutory time windows for set‑aside applications and retention and reporting obligations for contributors.

The Regulations create duties and rights for three principal cohorts of actors and several ancillary decision‑makers.

Principal cohorts:

Judgment creditors seeking to enforce foreign judgments for compensation for pollution damage under the 1992 Convention. The Regulations give judgment creditors a statutory route to register a qualifying foreign judgment in Australian courts (r 6). They impose documentary and affidavit requirements on these creditors at the time of application (r 10), require them to calculate judgment sums including costs and interest and convert foreign currency amounts at the RBA official rate as at the date of the foreign judgment (r 7-8), and expose them to the Court’s power to require security for costs (r 11). Judgment creditors must also supply particulars for service and provide a name and address for service (r 13(2)(b)).
Judgment debtors against whom foreign judgments are registered, principally the 1992 Fund as the regime concerns judgments against the Fund, and potentially other persons who may be liable under judgments falling within the Convention definition. Judgment debtors obtain procedural protections: notice of registration must be served (r 13), the Court fixes a period for applications to set aside (r 12), execution is barred until the set‑aside period (r 15), and there is a list of grounds on which a registered judgment may be set aside (r 16). Judgment debtors may apply to the Court to have the registration set aside (r 16(1)).
Persons to whom Article 10 of the 1992 Convention applies, typically entities that receive “contributing oil” (crude oil and heavy fuel oil) and may therefore bear contribution liability to the 1992 Fund. These persons must keep records for each calendar year that enable them to make the prescribed return (r 22(1)); retain records at their principal place of business in Australia for five years (r 22(2)); deliver an annual return by 1 April for the preceding calendar year in the Schedule form (r 23(1)-(2)); and comply with document production notices issued by the Authority within 30 days (r 24(1)-(2)). Failure to comply attracts a penalty of 10 penalty units (r 22(1)-(2); r 23(1); r 24(2)) and, for certain obligations, strict liability applies (r 23(3); r 24(3)).

Ancillary actors and decision‑makers:

Courts: the Supreme Courts of the States, Supreme Courts of internal Territories and the Federal Court are given jurisdiction to register foreign judgments and supervise set‑aside proceedings (r 4). Court procedures and fees are imported from the relevant Rules of Court (r 5).
The Authority: the Regulations empower the Authority to require production or copies of documents relevant to ascertaining contribution liability (r 24). The Authority also receives the annual returns (r 23).
Registrars and court officers: the Registrar or chief officer of a court must issue certified copies and certificates for the enforcement of Australian judgments abroad on application (r 20).
The Reserve Bank of Australia is given a technical role in determining the official exchange rate to be used for conversion of foreign currency judgments to Australian currency, as at the date of the foreign judgment (r 8).

Behavioural effects and likely operational changes for these groups:

Judgment creditors will now prepare evidence packages matching r 10’s requirements, compute AUD equivalents using the RBA rate, and expect a period fixed by the Court during which enforcement will be stayed (r 10; r 8; r 12-15).
Judgment debtors must monitor for service of registration notices (r 13), gather supporting documents to challenge registration (r 16), and likely centralise records and contacts in Australia if Article 10 applies (r 22-23).
Entities receiving contributing oil must institute systems to capture tonnage and mode of receipt required by the Schedule, keep records for five years in Australia and ensure timely annual submissions to the Authority by 1 April (r 22-23; Schedule).
Administrators of the 1992 Fund and the Authority will exercise document request powers, process annual returns and potentially pursue penalties where returns are missing or records not kept (r 23-24).

The Regulations thus allocate compliance obligations to private entities with reporting duties and create court procedures that affect the timing and mechanics of enforcing foreign pollution compensation judgments in Australia.

This section organises the principal procedural duties imposed on actors and the principal rights the Regulations recognise or create, with direct citations to the provisions that impose or secure them.

Primary duties

Duty to apply for registration in writing (judgment creditor): A judgment creditor may apply and, subject to the Regulations, a Court must order registration on written application (r 6(1)-(2)). The creditor must ensure the judgment meets the registration preconditions (r 6(3)).
Documentary and affidavit obligations on application (judgment creditor): An application must be accompanied by an affidavit attaching (i) a certified copy of the foreign judgment authenticated by the original court’s seal, and (ii) a certified English translation where necessary. The affidavit must state enforceability, outstanding balance, that registration will not be liable to be set aside, that the judgment is no longer subject to ordinary forms of review, the jurisdiction of the original court and the date of the incident, and the rate at which interest accrues under the foreign law (r 10(1)(a)-(c); r 10(2)-(4)).
Calculation and conversion of judgment sums (judgment creditor): The amount for which a judgment may be registered is the whole judgment amount or outstanding balance, costs and interest up to registration, and reasonable registration costs (r 7). If the judgment sum is in foreign currency, the amount to be registered is its Australian currency equivalent calculated at the RBA official rate on the date of the foreign judgment (r 8; r 10(3)).
Duty to provide particulars for service and to serve notice (judgment creditor): The judgment creditor must provide particulars for the notice to the judgment debtor, which must be served in accordance with the Court’s practice (r 13(1)-(2)).
Security for costs (judgment creditor): The Court may require the judgment creditor to give security for the costs of the application and of any set‑aside proceedings (r 11).
Record‑keeping and annual returns (Article 10 persons): Persons to whom Article 10 of the 1992 Convention applies must keep records for each calendar year to enable the return (r 22(1)); retain records at the principal place of business in Australia for five years (r 22(2)); and deliver an annual return to the Authority by 1 April for the preceding calendar year in the specified Schedule form (r 23(1)-(2)). The return must be signed, give completion date and contact details (r 23(2)(a)-(c)).
Compliance with Authority document notices: A person must comply with a written notice by the Authority to produce or make copies of documents relevant to ascertaining contribution liability within 30 days (r 24(1)-(2)).
Payment methods for contributions and penalties: Payments must be by cheque drawn in Australian currency or the currency of the place where the 1992 Fund is located, or by electronic transmission in those currencies (r 21).

Enforceable rights and protections

Right to registration (subject to conditions): A judgment creditor has the right to apply for registration and a Court must order registration subject to compliance with the Regulations (r 6(1)-(2)). The statutory route exists where the foreign judgment satisfies the criteria in r 6(3).
Notice and time to respond (judgment debtor): A registered judgment must not be given effect until the end of the period fixed for set‑aside applications (r 12(1)-(2); r 15). Notice of registration must be served with full particulars and the name and address of the judgment creditor for service (r 13(2)(a)-(b)).
Right to apply to set aside registration (judgment debtor): A person against whom a registered judgment may be enforced may apply to the registering Court to have registration set aside on listed grounds including fraud, lack of jurisdiction, lack of reasonable notice of proceedings or prior judgments (r 16(1)-(2)).
Limited set‑aside alternatives (Court discretion): If the only issues are enforceability in the original country or ordinary forms of review in that country at the date of the registration application, the Court may order a stay of execution on such terms instead of setting aside the registration (r 17(1)).
Partial registration: Where a foreign judgment contains provisions for compensation for pollution damage and for other matters, the judgment may be registered only as to the pollution compensation provisions (r 9). If registration is set aside only because part of the sum had been paid, the Court must, on the judgment creditor’s application, re‑register the balance (r 17(2)). If registration is set aside because registration related to mixed proceedings, the Court must, on application, register only the pollution compensation parts (r 17(3)).
Recognition of registered judgment as domestic judgment: Once registered, a foreign judgment has the same effect as a judgment of the registering Court as if entered on the date of registration (r 14(1)). Interest accrues from the date of registration as if the registered judgment were domestic (r 14(2)).

Sanctions and strict liability

Monetary penalties: Failure to keep required records, to retain them in Australia for five years, to furnish the annual return by 1 April, or to comply with an Authority document notice attracts a penalty of 10 penalty units for each contravention (r 22(1)-(2); r 23(1); r 24(2)).
Strict liability: Strict liability is applied to whether a person is subject to Article 10 and whether the return is in the form of the Schedule (r 23(3)(a)-(b)). Strict liability also applies to the offence in r 24(2) (r 24(3)).

Operational consequences

These duties create clear documentary burdens on judgment creditors and corporate bookkeeping and reporting obligations on entities receiving contributing oil. The Regulations shift the timing of potential enforcement to after the set‑aside period and channel enforcement through a registration process with prescribed evidentiary standards and currency conversion rules.

The Regulations set discrete monetary penalties for non‑compliance with record‑keeping, reporting and document production obligations and provide the courts with traditional supervisory powers over registration, enforcement and set‑aside. They do not themselves create criminal penalties beyond the specified monetary penalties and strict liability for particular offences. Enforcement is effected through court processes and the Authority’s investigatory notice power.

Monetary penalties

Prescribed penalty level: The Regulations set the penalty for contravention of record‑keeping and return obligations and a failure to comply with an Authority notice at 10 penalty units (r 22(1)-(2); r 23(1); r 24(2)). The Regulations do not specify the dollar value of a penalty unit; that figure is to be found in the applicable penalty unit legislation (the source does not include that figure).

Strict liability designations

Strict liability for returns and document compliance: The Regulations impose strict liability to establish contraventions of (a) whether the person is subject to Article 10 and (b) whether the annual return matches the Schedule form requirements (r 23(3)). They also make the offence in r 24(2) (failing to comply with an Authority notice to produce or copy documents within 30 days) an offence of strict liability (r 24(3)). Strict liability reduces requirements for the prosecution to prove fault and increases enforcement certainty for the Authority.

Court enforcement and supervisory powers

Registration and effect: The Court must register qualifying foreign judgments on written application subject to r 6(3), and a registered judgment has the same effect as a judgment of the registering Court (r 6(2); r 14(1)). Registration thereby converts foreign judgments into domestic enforceable instruments, subject to the set‑aside process.
Stay and set‑aside proceedings: The Court must fix a period to allow applications to set aside registration and must state that the judgment will not be given effect until that period elapses (r 12(1)-(2); r 15). A person against whom a registered judgment may be enforced may apply to set aside the registration; the Court may set it aside on listed grounds (r 16). If the only basis for likely set‑aside is that the foreign judgment was not enforceable in the original country or was subject to ordinary review, the Court may stay execution on such terms instead (r 17(1)).
Security for costs: The Court may require a judgment creditor to give security for the costs of registration proceedings and any subsequent set‑aside proceedings (r 11). This shifts litigation risk back onto the applicant and can be used to deter weak or vexatious applications.
Limitation of recovery proceedings: A domestic Court must not hear or determine proceedings for recovery of an amount payable under the foreign judgment except by the registration process set out in the Regulations (r 19). This channels enforcement exclusively through the Part 2 procedure.

Administrative enforcement

Authority’s document power: The Authority may, by notice in writing, require production of or copies of documents relevant to ascertaining contribution liability; the person must comply within 30 days (r 24(1)-(2)). Failure attracts a 10 penalty unit fine and is an offence of strict liability (r 24(2)-(3)).
Annual return enforcement: The annual return is mandatory for persons to whom Article 10 applies, due by 1 April for the prior calendar year and in the Schedule form (r 23(1); Schedule). Failure to lodge attracts a 10 penalty unit fine (r 23(1)). The Regulation requires the return to be signed and dated and to record contact details (r 23(2)), and strict liability applies to whether a person is subject to Article 10 and whether the form is in accordance with the Schedule (r 23(3)).

Practical enforcement implications

The combined use of court supervision (registration, set‑aside, and stays), security for costs and administrative enforcement by the Authority forms a two‑track enforcement model. The Authority enforces reporting and document production; courts enforce foreign judgment registration and supervise potential set‑aside arguments.
Strict liability offences and the relatively modest number of specified offences, together with a fixed monetary penalty (10 penalty units), create predictable enforcement outcomes for breaches of reporting and cooperation obligations, but increase the compliance risk for entities that may not be clearly within Article 10’s scope. The Regulations place the onus on the person to ensure they are correctly identified as subject to Article 10 (r 23(3)(a)).
The Court’s discretionary ability to require security for costs (r 11) functions as a gate and a cost deterrent for registration applicants, while the mandatory non‑effect of registered judgments until the set‑aside period expires (r 12(2), r 15) protects judgment debtors from immediate enforcement.

These enforcement mechanisms channel international claims through domestic procedures, attach administrative sanctions for contributor non‑compliance, and vest courts with traditional equitable and procedural instruments (security, stays, set‑aside) to manage fairness and judicial economy.

The Regulations explicitly operate under and in aid of the Protection of the Sea (Oil Pollution Compensation Funds) Act 1993 (the Act) and the 1992 Convention. They also cross‑refer to other identified sources for specific matters. The Regulations do not attempt to re‑state the Act nor the Convention, but they provide procedural and administrative detail for the domestic application of the international regime.

Direct statutory interactions in the instrument

Act: The Regulations are made under the Act, and they implement particular Act provisions. Several Regulations refer to the Act explicitly: Part 2 is made for the purposes of section 34 of the Act (r 4 heading and r 5), and r 21 is made for section 42 of the Act (r 21 heading). The Regulations therefore sit as subordinate implementation detail to the Act.
1992 Convention: The Regulations treat expressions used in them and the 1992 Convention as having the same meaning for the purposes of these Regulations as in the Convention (r 3(2)). Article 7 of the 1992 Convention is central to determining which foreign judgments are registrable and r 6(3)(a) requires the original court to have had the jurisdiction referred to in Article 7.
Acts Interpretation Act 1901: The Notes in r 3 refer to the Acts Interpretation Act 1901, s 46(1)(a), to the effect that words defined in the Act have the same meaning in the Regulations (r 3 Note). The Regulations therefore rely on the Act’s definitions (for example, of the 1992 Convention and the 1992 Fund).
Reserve Bank of Australia: r 8 requires conversion of foreign currency judgment amounts into Australian currency by applying the official rate of exchange determined by the Reserve Bank of Australia as at the date of the foreign court judgment. This brings an external official exchange‑rate mechanism into the calculation.

Procedure and court rules

Rules of Court: r 5 provides that court fees are those prescribed in the Rules of the Court. Service of the registration notice is to follow the Court’s practice and procedure for service of a writ of summons unless the Court orders otherwise (r 13(1)). This ties the Regulations to existing court procedure frameworks.

Limited jurisdictional and enforcement interplay

The Regulations preclude domestic recovery proceedings for a foreign judgment except through the registration process (r 19). That channels disputes into the procedure set out by the Regulations and limits other domestic remedies for recovering amounts payable under foreign judgments.
r 20 enables enforcement of Australian judgments abroad by mandating court registrars to issue certified copies and certificates for use in foreign jurisdictions that are parties to the 1992 Convention. This provision creates a reciprocal enforcement facilitation.

Administrative interface

The Authority: r 23 places reporting obligations on persons subject to Article 10, to be delivered to the Authority. r 24 gives the Authority power to require documents. Those instruments sit alongside the Act’s governance arrangements for the Authority; the Regulations operationalise the Authority’s evidentiary reach for contribution matters.

Amendment and legislative instruments

The Notes record multiple amendments to the Regulations by subordinate instruments (e.g. Statutory Rules 1996 No. 221; 1998 No. 87; 2001 No. 351; 2006 No. 231; 2009 No. 243). Some amendments were made under other enabling statutes where relevant, as indicated in the table of instruments (Notes). Those amendments show the Regulations interact with other maritime or shipping legislation insofar as they were made under multiple Acts (see Note in the table that SR 2001 No. 351 was made under several Acts, including the Navigation Act 1912).

Constraints on cross‑law commentary

The Regulations call for reference to other instruments and authorities (the Act, Article 7 of the 1992 Convention, the RBA rate, Rules of Court). The Regulations do not themselves alter how court jurisdictional boundaries under other federal or state statutes operate beyond specifying which courts shall exercise federal jurisdiction for registration matters (r 4). They do not repeal or restate the Act’s substantive rules governing the 1992 Fund or the Fund’s liabilities; they merely set out procedural and administrative details.

In practical terms these Regulations should be read alongside the Act, the 1992 Convention, court Rules, and the RBA exchange‑rate determinations to understand fully how registration, enforcement and contributor reporting will operate in the overlapping legal frameworks that govern oil pollution compensation in Australia.

The Regulations were made in 1994 (Statutory Rules 1994 No. 126). The compilation includes amendments up to Statutory Rules 2009 No. 243 and a table of instruments and amendments is included in the source Notes. The Notes list dates of notification, commencement and amendment instruments. The manifest changes and the instruments that made them are summarised below exactly as recorded in the source.

How to read this amendment history

The Notes show multiple targeted amendments across the Regulations, and the 2009 No. 243 instrument made a considerable number of amendments (including replacement of headings, and changes across Part 2 and Part 4).
Specific text replacements and the precise content of amendments are reflected in the as‑compiled text of the Regulations this deep dive uses. For full legislative history and the precise previous versions of each regulation, one should consult the underlying instruments (the Statutory Rules listed) and consolidated legislation records.

The Regulations’ Notes themselves form the authoritative record of amendment instruments and dates contained in this compilation.

The Regulations as provided contain no recorded judicial decisions, case citations, or litigation history. The text and Notes do not identify any cases that have interpreted or applied these Regulations. There are no court judgments named in the instrument and no internal references to decided cases.

Practical consequence of the absence of litigation references in the text

The absence of litigation history in the Regulations means that a practitioner should not assume established judicial elaboration of contested points within the Regulations themselves from the source. Where evidentiary sufficiency, the meaning of phrases such as “ordinary forms of review”, or the Court’s exercise of discretion (for example in fixing periods for set‑aside or in granting stays under r 17) are at issue, those points may be governed by principles in broader civil procedure and private international law which the Regulations import by reference, or by later case law not recorded in this instrument.
Where a party anticipates contested registration or set‑aside litigation, the practitioner must prepare to brief the court on (a) the application of Article 7 of the 1992 Convention as incorporated by r 6(3)(a); (b) the factual sufficiency of the affidavit and authenticated judgment (r 10); and (c) the statutory grounds in r 16, as the Regulations themselves specify the exclusive domestic route and grounds for challenge.
Because r 23 and r 24 create strict liability offences and monetary penalties, a person facing enforcement action under those provisions should seek advice on administrative law remedies and any available procedural protections from the Authority’s actions, noting that the Regulations contain no administrative appeal mechanism within their text.

If litigation history is required for a particular dispute, a targeted search of court databases and reported judgments against the Fund, or judgments citing these Regulations or the Act, will be necessary because the Regulations’ text does not supply that material.

The Regulations contain a number of provisions that can create procedural or compliance traps if missed. These are concrete points drawn from the Regulations’ text that practitioners and affected entities should note.

Strict liability on core reporting and production obligations (r 23(3); r 24(3))

The Regulations make strict liability apply to whether a person is subject to Article 10 and to whether the return is in the Schedule form (r 23(3)), and make the offence of failing to comply with an Authority document notice an offence of strict liability (r 24(3)). Strict liability removes the need to prove fault, raising the compliance risk for entities uncertain of their status. Entities cannot rely on lack of knowledge as a defence to these particular contraventions.

10 penalty units is the only stated penalty quantum (r 22(1)-(2); r 23(1); r 24(2))

The Regulations fix the penalty at 10 penalty units for each prescribed contravention but do not state the monetary value of a penalty unit. Practitioners must check the relevant penalty unit legislation to determine the dollar exposure. Failure to do so could understate the financial consequence.

Required certification and authentication formalities are strict (r 10(1)(a)(i))

A certified copy of the foreign judgment must be authenticated by the seal of the original court. If the judgment is not properly authenticated, the Court may refuse registration on technical grounds. Similarly a translation must be certified by a notary public or authenticated by affidavit (r 10(1)(a)(ii)). These formalities can be time consuming and are jurisdictionally exacting.

Currency conversion anchored to RBA official rate as at date of foreign judgment (r 8; r 10(3))

Conversion uses the Reserve Bank of Australia’s official rate at the date of the foreign judgment. Where foreign judgments have long elapsed between judgment and registration application, the conversion basis could produce material volatility and must be calculated carefully on the date of the original foreign judgment.

Registration is conditional and limited where foreign proceedings mix pollution and non‑pollution claims (r 9)

If the foreign judgment covers both pollution compensation and other matters, registration is limited to the pollution compensation parts only (r 9). A practitioner must identify and segregate the relevant provisions in the foreign judgment and specify them in the affidavit (r 10(4)).

Judgment not enforceable domestically except by registration (r 19)

The Court is barred from hearing or determining proceedings for recovery of an amount payable under a foreign judgment except under Part 2 registration. Parties cannot pursue alternative domestic recovery routes. This channels all enforcement attempts into the Part 2 process and means that failing to comply with its procedural rules may foreclose recovery options.

Court will fix a set‑aside period and bar execution until it expires (r 12; r 15)

The Court must fix a period it deems appropriate for an application to set aside (r 12(1)) and the registered judgment may not be given effect until the end of that period (r 12(2); r 15). Judgment creditors must therefore anticipate delay in enforcement even after registration, and judgment debtors gain a guaranteed window to mount a challenge.

Potential for security for costs and costs exposure (r 11)

The Court may require security for costs from a judgment creditor for the registration application and set‑aside proceedings (r 11). This can impose up‑front cash requirements on applicants and influence litigation strategy.

The Authority’s document power has short compliance timing (r 24(2))

A person must comply with a notice to produce or copy documents within 30 days (r 24(2)). Failure is a strict liability offence attracting a 10 penalty unit fine. Corporate groups with records outside Australia must plan for document localisation or timely production to meet this timeframe, noting r 22(2) requires retention at the principal place of business in Australia for five years.

Annual returns must conform to a detailed Schedule and be lodged by a fixed date (r 23; Schedule)

The return is due by 1 April for the preceding calendar year and must follow the Schedule which requires specific fields about receipt of contributing oil, contact details and signatures. Failure to use the Schedule exactly is a strict liability matter (r 23(3)(b)). Entities must familiarise themselves with the Schedule’s fields, including the split of receipts by mode and source, and prepare supporting records.

“Ordinary forms of review” and “enforceable by execution” are statutory conditions (r 6(3)(c)-(d))

A judgment must be enforceable by execution in the original country and must not be subject to ordinary forms of review. These legal status facts are part of the Court’s registration condition and must be addressed in the supporting affidavit (r 10(1)(b)(ii)-(iv)). Determining these foreign procedural statuses can be factually intricate and requires authoritative evidence.

The Regulations refer to the 1992 Convention definitions (r 3(2))

Expressions in the Regulations and in the 1992 Convention have the same meaning for the Regulations as in the Convention, so practitioners must consult the Convention text to resolve definitional questions where the Regulations rely on the Convention’s terms (r 3(2)).

Each of these points represents a concrete procedural risk or operational requirement. Addressing them requires early evidence collection, proper authentication of foreign court documents, timely record retention and returns, careful currency calculation and strategic planning for possible security for costs and set‑aside proceedings.

This section provides a practical, step‑by‑step compliance checklist for the principal actors the Regulations affect: judgment creditors, judgment debtors (including the 1992 Fund), and persons to whom Article 10 of the 1992 Convention applies (entities receiving contributing oil). The checklist is grounded in the specific regulatory provisions.

For judgment creditors seeking registration (r 6, r 10, r 7-8, r 11-15)

Confirm registrability under r 6(3)

Verify the foreign judgment was given by a court with jurisdiction of the kind referred to in Article 7 of the 1992 Convention (r 6(3)(a)). Gather authoritative proof of the foreign court’s jurisdiction.
Confirm the incident occurred after both Australia and the foreign country were parties to the applicable Fund regime (r 6(3)(b)). Document the dates and treaty applicability.
Confirm the judgment is enforceable by execution in the foreign jurisdiction and is no longer subject to ordinary forms of review (r 6(3)(c)-(d)).

Prepare the supporting affidavit and documents under r 10

Obtain a certified copy of the foreign judgment authenticated by the seal of the original court (r 10(1)(a)(i)).
If the judgment is not in English, obtain a certified English translation by a notary public or an affidavit authenticating the translation (r 10(1)(a)(ii)).
Draft an affidavit that states the judgment is unsatisfied (or sets out the unsatisfied balance), that it is enforceable by execution in the foreign country, that registration will not be or be liable to be set aside, that it is no longer subject to ordinary review, that the original court had jurisdiction under Article 7, that the incident date is after both countries became parties to the 1992 Fund regime, and that sets out the foreign law interest rate (r 10(1)(b)(i)-(vi); r 10(1)(c)).
If the judgment covers pollution and non‑pollution matters, identify in the affidavit the provisions for which registration is sought relating to pollution damage (r 10(4)).

Calculate the sum for registration and convert currency (r 7-8; r 10(3))

Calculate the whole judgment amount or the unsatisfied balance as at the date of application, including costs and foreign law interest to the time of registration (r 7(a)(i)-(ii)).
Add reasonable costs incidental to registration, such as costs of obtaining certified court copies (r 7(b)).
Where the judgment sum is in foreign currency, convert to Australian dollars at the Reserve Bank of Australia’s official rate as at the date of the foreign judgment (r 8). Record the RBA source and rate used.

File the written application in an appropriate Court and be prepared to meet court procedural requirements (r 4-5, r 11-12)

Lodge the written application in the Supreme Court of the relevant State, Supreme Court of the internal Territory or the Federal Court as appropriate (r 4).
Pay the Court fees as prescribed in the Rules of Court (r 5).
Be ready to provide security for costs if ordered by the Court (r 11).
Expect the Court to fix a period to allow an application to set aside and to include a statement that the judgment will not be given effect until the end of that period (r 12(1)-(2)). Factor enforcement delays into your strategy.

Serve notice and monitor the set‑aside period (r 13, r 15)

Provide full particulars of the registered judgment and the order for registration, and the name and address for service of the judgment creditor or their solicitor, for inclusion in the notice to the judgment debtor (r 13(2)(a)-(b)).
Serve notice on the judgment debtor in accordance with the practice and procedure applicable to service of a writ of summons in the registering Court, unless the Court orders another mode of service (r 13(1)).
Do not expect to enforce the judgment while the set‑aside period runs or while set‑aside proceedings are pending (r 15).

For judgment debtors (r 13, r 15-17)

Ensure receipt of notice is properly recorded and respond promptly (r 13)

When served with the registration notice, record the particulars, the order and the name and address for service. The notice must include a statement that an application to set aside may be made within the fixed period (r 13(2)(c)). Note the end of the period fixed by the Court and plan any application to set aside accordingly.

Prepare set‑aside evidence and grounds (r 16)

Gather evidence on the specific grounds listed in r 16 that could justify setting aside registration, including evidence that (a) rights under the judgment are not vested in the applicant, (b) the person against whom the judgment was registered is not the person subject to obligations, (c) the sum was paid in whole or in part at the date of the application, (d) the judgment was obtained by fraud, (e) lack of reasonable notice or a fair opportunity to defend, (f) a prior Australian judgment addressing the same dispute, or (g) a prior foreign judgment that could be registered and would not be liable to be set aside (r 16(2)(a)-(g)).

Where the issue is one of enforceability or ordinary review in the original country, consider applying for a stay rather than setting aside (r 17(1))

If the only grounds are matters under r 17(1)(a)-(b) (non‑enforceability in the original country or the foreign judgment being subject to ordinary review at the date of application), seek a stay of execution on just terms as an alternative.

For persons subject to Article 10 (contributors, receivers of contributing oil) (r 22-24; Schedule)

Identify whether Article 10 applies to you (r 23(3)(a))

Determine whether your operations fall within the definition of persons to whom Article 10 applies. Note strict liability applies to this question under r 23(3)(a), so do not assume ignorance as a defence.

Keep records for each calendar year and retain them in Australia for five years (r 22(1)-(2))

Maintain records that will enable you to make the return prescribed in the Schedule. Keep these records at your principal place of business in Australia for five years after the year to which they relate. Note the penalty for breach is 10 penalty units.

Prepare and lodge the annual return by 1 April (r 23; Schedule)

Use the Schedule form in the Regulations. The return must be completed, signed by the person making the return, specify the date of completion, and show the name and contact details including telephone, fax or email (r 23(2)(a)-(c)).
The Schedule requires detail about the State in which oil was received, the year of receipt, which Fund the report is being made to (1992 Fund, Supplementary Fund or both), entity details, contact person, and detailed tonnage breakdown by mode and source. Ensure internal processes capture these fields.

Respond to Authority notices for documents within 30 days (r 24(1)-(2))

If the Authority issues a written notice to produce or copy documents relevant to ascertaining contribution liability, comply within 30 days. The failure to comply is a strict liability offence attracting a 10 penalty unit fine (r 24(2)-(3)).

Systemise data collection and centralise records in Australia

To meet the retention and 30‑day production requirements, centralise or ensure rapid access to records in Australia, including invoices, bills of lading, pipeline receipts and associated documentation that evidence receipt of contributing oil.

For payments to the 1992 Fund (r 21)

Choose acceptable payment methods and currencies

Make contributions and late payment penalties by cheque drawn in Australian currency or the currency of the place where the 1992 Fund is located, or by electronic transmission in those currencies (r 21(a)-(b)). Ensure banking arrangements facilitate transfers in the currency of the Fund location where required.

General operational and documentary best practice

Authentication and translation: Secure authenticated certified copies of foreign judgments and certified translations early. Delays in obtaining seals or notarial certification will delay registration.
Evidence of enforceability and non‑reviewability: Where necessary, obtain a foreign lawyer’s affidavit or certificate on enforcement status and appeal availability in the foreign jurisdiction, and put that material into the r 10 affidavit.
Audit trail for conversions: Keep documentation of the RBA exchange rate used for any conversion (r 8; r 10(3)).
Anticipate security for costs and prepare estimates: When applying for registration, include estimates of anticipated registration costs and be prepared to respond to a Court application for security for costs (r 7(b); r 11).
Track set‑aside periods and preserve evidence: Judgment creditors must track the Court‑fixed period for set‑aside and ensure evidence is preserved. Judgment debtors must assemble evidence and time applications carefully.
Review governance documents and internal workflows: Entities receiving contributing oil should map data flows to the Schedule fields and ensure a single person signs the return and inputs contact details (r 23(2)(a)-(c)).

Following the steps above, tied to the specific regulatory provisions cited, will reduce procedural risk and provide an audit trail in the event of enforcement action by the Authority or registration litigation in the Court.
