39 Use of sound systems on vessels

(1) A person must not cause or permit a musical instrument, sound system, megaphone or microphone to be used on a vessel in a way that emits offensive noise.

Maximum penalty—

(a) for an individual—50 penalty units, or

(b) for a corporation—100 penalty units.

(2) This section does not apply in relation to an entertainment activity, within the meaning of the Local Government Act 1993, Chapter 8, Part 3, carried out on a vessel to which a liquor licence under the Liquor Act 2007 applies, but only if the activity is carried out in accordance with—

(a) the liquor licence, including any conditions applying to the licence, and

(b) the Liquor Act 2007.
