#### 47 Applications 47 Applications > > (1) A licence holder or applicant for a licence may, in a form approved by the EPA, apply for a load reduction agreement with the EPA of a maximum term of 4 years. > > > (2) The EPA may— > > > > > (a) enter into the agreement, or > > > > > (b) decline to enter into the agreement if— > > > > > > > (i) the agreement is unlikely to produce a load-based fee reduction of at least $2,000 over the term of the agreement, or > > > > > > > (ii) the licence holder or applicant proposes to reduce the discharge under the licence by the end of the agreement only because the licence holder or applicant proposes to close or reduce the scale of operations being conducted at the time, or > > > > > > > (iii) otherwise. > > > (3) In this section— > > > > load reduction agreement means an agreement entered into by a licence holder, where the licence holder agrees that the reported load of an assessable pollutant discharged while carrying out an activity to which the licence applies will not be more than a specified load during the final licence fee period for the licence that is covered by the agreement.
