Protection of Marine Waters (Prevention of Pollution from Ships) Regulations 2013

The Regulations are structured around the maritime pollution control concepts embedded in the Convention and the 1978 Protocol: record‑keeping, classification and labelling of pollutants, stowage and handling rules for harmful cargoes, garbage management on board, reporting of incidents and formal roles for State authorities and authorised surveyors. The Regulations repeatedly import definitions and standards from the Annexes to the Convention and from the IMDG Code by express reference, creating a compliance regime that depends on external technical instruments (regulation 10(1); regulation 18; regulation 11).

Prescribed officers and the chain of State decision‑making. Regulation 3 defines the State Marine Pollution Controller in terms of the South Australian Marine Spill Contingency Action Plan and the Department responsible for the Act. Regulation 4 prescribes the State Marine Pollution Controller and port managers as prescribed officers for particular sections of the Act (for example sections 8(2), 18(2), 13(3) and (4), 23(5) and (6), 18(6)-(9)). Those appointments constitute the primary points of contact and enforcement for operation of the Act and these Regulations.

Form and content of records. The Regulations do not invent new record formats. They require the oil record book and cargo record book to be in the exact forms set out in the Protocol Appendices (regulations 5 and 7). They also specify which operations and occurrences must be entered in those books (regulations 6 and 8). Garbage record book requirements are likewise imported from Annex V (regulation 21(2)). The use of internationally standardised forms aims to create consistency across jurisdictions and facilitates cross‑border inspection, but it requires owners to obtain and maintain those international forms and to ensure entries conform to the specified operations and occurrences.

Integration of international technical standards. The IMDG Code is made mandatory for packing, marking, labelling, stowage and quantity restrictions for packaged harmful substances (regulations 13 to 15). Garbage management plans must conform to IMO guidelines (regulation 20(3)(c)). Regulation 9 gives Regulation 8 of Annex II of the Convention the force of law for tank washing and links surveying powers and exemptions to international practice and to IMO control procedures (regulation 9(5) and (6)).

Reporting architecture. The Regulations create an immediate notification mechanism and a follow‑up written report process. Notification of a prescribed incident must be by telephone, telex, radio or fax through named channels, the Port Adelaide Signal Station or the Australian Search and Rescue Centre, specifying ship identity and position (regulation 22(1)). A follow‑up report must be furnished within 24 hours in the form in Schedule 1 (regulation 22(2)). For discharges other than from ships, regulations 23 and 24 require reports to the Minister in the form of Schedule 1 within 24 hours of a request (regulations 23(1) and 24(1)).

Criminal sanctions and monetary penalties. The Regulations attach criminal liability and monetary penalties for failing to comply with various obligations. Examples include failure to wash tanks in accordance with Annex II (master guilty; maximum penalty $5,000) (regulation 9(3)), carriage of packaged harmful substances in contravention of the Regulations (maximum penalty $8,000 or 1 year imprisonment for a natural person; $20,000 corporate) (regulation 12), failure to display garbage placards (regulation 19), and failure to carry and maintain garbage management plans and garbage record books with specified penalties (regulations 20 and 21). The Regulations also specify a modest administrative fee for deposit of an oil or cargo record book (regulation 26).

Exemptions and scope. The Regulations preserve statutory exemptions for Defence and foreign State non‑commercial ships (regulation 27). Many obligations are limited to ships “while they are in State waters” (for example garbage management plan and garbage record book obligations in regulations 20 and 21), or to ships to which particular sections of the Act apply (for example oil record book obligations reference section 11 of the Act in regulation 5). Certain technical expressions are defined to have the same meaning as in the relevant Annex to the Convention (regulation 10(1); regulation 18).

In short, the Regulations operationalise international maritime pollution norms in State law by: prescribing exact international forms; making international technical codes mandatory; specifying who enforces and receives reports; and setting penalties and a small administrative fee. The tension built into the instrument is between detailed, internationally harmonised technical compliance and the administrative and operational costs that flow to shipowners, masters and port authorities.

Owners and masters of ships are the primary regulated actors under these Regulations. Multiple provisions explicitly impose obligations on both the master and the owner. For instance, regulation 12 makes both the master and the owner criminally liable for carriage of harmful substances in packaged form in contravention of the Regulations. Record‑keeping obligations for oil and cargo record books fall on ships “to which section 11 of the Act applies” (regulation 5 and regulation 7), and regulation 6 and 8 specify the operations for which entries must be made, bringing masters and sometimes officers on board into compliance roles.

Ship types and size thresholds determine coverage. Oil tankers are subject to enhanced oil record book obligations (regulation 5(1)). Garbage management plans and garbage record books apply to ships of 400 gross tonnage or more and ships certified to carry 15 or more passengers and crew while they are in State waters (regulations 20(1) and 21(1)). Placard requirements apply to ships of 12 metres in length or more (regulation 19(1)). These size and certification thresholds channel regulatory burden towards larger commercial vessels, ferries and passenger ships, while exempting smaller recreational craft from certain documentary duties, though other duties in the Act may still apply.

Port managers and the State Marine Pollution Controller are designated as prescribed officers with statutory functions and role in reporting and enforcement (regulation 4). The State Marine Pollution Controller is a central decision maker and receiver of notices and reports (regulation 3 definition and regulation 22 requirements). Owners loading harmful packaged cargo in the State must deposit a copy of the stowage plan with the port manager before departure (regulation 16(d)(ii)), creating a direct administrative interface between owners and port management.

Surveyors accredited under the Marine Safety (Domestic Commercial Vessel) National Law are authorised to implement Regulation 8 of Annex II for tank washing purposes (regulation 9(2)). Those surveyors have duties to implement IMO control procedures when performing the function (regulation 9(5)), which introduces a practical dependence on the availability and competence of accredited surveyors.

Third parties affected include shippers and freight forwarders. Regulation 16 requires shipping documents supplied by the shipper to include a signed certificate or declaration that packaging and marking conform to the Regulations. Shippers therefore face documentary obligations and potential indirect exposure through certifying packing and labelling.

State agencies and Ministers are affected by administrative duties and discretionary powers. Regulation 25 empowers the Minister to make orders to give effect to Annexes and to prescribe fees, which preserves regulatory flexibility and requires administrative capacity to issue and manage orders and fees.

Exemptions are carved out for Defence vessels and foreign State non‑commercial ships (regulation 27). Those classes are excluded from the Act and these Regulations as provided. The Regulations therefore expressly carve out obligations for operators of state military and certain foreign government vessels.

Finally, the Regulations affect inspectors and enforcement officials who will use prescribed forms, prescribe procedures for notification, and rely on deposit and retention requirements (for example the 2 year retention period for garbage record books in regulation 21(6)). The compounded effect is that owners, masters, shippers, surveyors, port managers and the State Marine Pollution Controller are the principal parties who must change administrative and operational behaviour to meet the Regulations.

Duties are largely prescriptive and documentation‑centric, with operational duties (stowage, washing, garbage disposal) tied to documentary evidence and reporting. Rights are procedural and flow from the Minister’s discretion and prescribed officer powers under the Act as implemented by these Regulations.

Record‑keeping duties. Oil tankers to which section 11 of the Act applies must carry both Part I and Part II oil record books in the forms set out in the Protocol (regulation 5(1)). Other ships to which section 11 applies must carry the Part I oil record book (regulation 5(2)). The Regulations prescribe which machinery space operations, cargo and ballast operations, and occurrences must be recorded in oil record books (regulation 6) and which cargo operations and occurrences must be recorded in cargo record books (regulation 8). The cargo record book form is prescribed (regulation 7).

Packaging, labelling and stowage duties. Packaged harmful substances carried as cargo must be packaged in accordance with the IMDG Code (regulation 13(1)). Packages must be marked or labelled to indicate marine pollutant status, technical name and trade name, and markings must be durable for at least three months of immersion (regulations 13(2)-(3)). Stowage and securing must comply with the IMDG Code (regulation 14). Quantity limits are those specified by the IMDG Code (regulation 15). Documents relating to such cargo must state marine pollutant status and technical name, include signed certificates from shippers, and ships loaded in the State must retain and deposit stowage plans with the port manager prior to departure (regulation 16).

Tank washing duty. Regulation 9(1) imports Regulation 8 of Annex II (other than paragraph 1) into State law for the washing of tanks from which noxious liquid substances have been unloaded, making failure to wash in accordance with the applicable provisions an offence for the master with a maximum penalty of $5,000 (regulation 9(3)). Surveyors accredited under the Marine Safety (Domestic Commercial Vessel) National Law are authorised to implement Regulation 8 (regulation 9(2)), and certain exemptions granted under Annex II are constrained by requirements related to State Parties and surveyor endorsement (regulation 9(6)).

Garbage duties. Ships of 400 GT or more, and ships certified to carry 15 or more persons, must carry and implement garbage management plans conforming to IMO guidelines and must keep garbage record books in the Annex V form (regulations 20 and 21). Specific logging obligations are set out for discharges and incinerations, including signature, time, position and description (regulation 21(3)). The owner must keep the garbage record book for 2 years after the final entry (regulation 21(6)). Placards about garbage disposal are required on ships 12m or longer (regulation 19).

Notification and reporting duties. A prescribed incident must be notified immediately to the State Marine Pollution Controller by specified communications routes through Port Adelaide Signal Station or the Australian Search and Rescue Centre (regulation 22(1)). A written report in the Schedule 1 form must be furnished within 24 hours of request (regulation 22(2)). For discharges other than from ships, reports must be furnished to the Minister within 24 hours of receipt of a request (regulations 23(1) and 24(1)), using Schedule 1 (regulations 23(2) and 24(2)).

Enforcement and ministerial powers. The Minister may make orders to give effect to parts of Annexes I, II, III and V and to fix fees for matters under those orders (regulation 25). Regulation 26 prescribes a $40 fee payable for deposit of an oil or cargo record book under sections 13(4) and 23(6) of the Act respectively. Regulation 4 prescribes the State Marine Pollution Controller and port managers as officers for functions under specified sections of the Act.

Liability allocation. The Regulations routinely make both owner and master liable for offences (for example carriage contraventions regulation 12, placard offences regulation 19(2), garbage plan offences regulation 20(2), garbage book offences regulation 21(2) and related penalties). Certain offences are attributed specifically to masters, such as failure to wash tanks in accordance with Annex II (regulation 9(3)).

Rights and procedural discretion. Procedural discretion primarily resides with the State Marine Pollution Controller and the Minister. The Controller may allow extended time for reports (regulation 22(2)(a)), and the Minister may allow further time for reports related to non‑ship discharges (regulations 23(1) and 24(1)). Surveyors performing functions under regulation 9 must comply with IMO control procedures (regulation 9(5)), which constrains surveyor discretion within internationally accepted control steps.

In summary, the Regulations create a mix of documentary, operational and reporting duties imposed largely on owners and masters, set enforcement roles for State officers and surveyors, and confer ministerial powers to make orders and fix fees. Duties are anchored in internationally standardised technical instruments and are enforceable by criminal sanction and financial penalty.

The Regulations attach specified monetary penalties and, in one instance, an imprisonment term for contraventions. Enforcement architecture relies on the State Marine Pollution Controller, port managers, authorised surveyors and the Minister, with notifications routed by specified communication channels.

Penalty framework. The Regulations set explicit maximum penalties for named offences. Examples include:

• Failure to wash an unloaded tank in accordance with Regulation 8 of Annex II is an offence for the master, maximum penalty $5,000 (regulation 9(3)).
• Carriage of harmful substances in packaged form in contravention of the Regulations exposes the master and the owner to maximum penalties; for a natural person $8,000 or imprisonment for 1 year, for a corporate entity $20,000 (regulation 12).
• Failure to display garbage placards on ships 12 metres or more makes the master and owner guilty of an offence: natural person max $2,000, corporate max $5,000 (regulation 19(2)).
• Non‑compliance with garbage management plan and garbage record book obligations carries similar maximum penalties for natural persons and corporations (regulations 20(2) and 21(2)).
• Various record‑keeping and signing breaches under regulation 21 carry maximum penalties of $2,000 (for example regulation 21(3) recording obligations and regulation 21(5) signing and availability).

Criminal liability distribution. The Regulations commonly make both the master and the owner liable for offences. Certain breaches are attributed specifically to the master (tank washing offence in regulation 9(3)) or to the person responsible for an operation (the person overseeing a discharge or incineration must make entries, regulation 21(3)). The presence of alternative penalties for natural persons and bodies corporate indicates the legislative intent to hold individuals personally accountable in appropriate circumstances.

Enforcement agents and prescribed officers. Regulation 4 prescribes the State Marine Pollution Controller and each port manager as prescribed officers for purposes of sections 8(2) and 18(2) of the Act, and makes the State Marine Pollution Controller a prescribed officer for other specified sections (regulation 4(2)-(3)). Those designations tie enforcement actions, requests for reports and administrative interactions to identifiable State officers. Regulation 9(2) authorises surveyors accredited under the Marine Safety (Domestic Commercial Vessel) National Law to implement Regulation 8 of Annex II; regulation 9(5) requires such surveyors to comply with IMO control procedures when exercising their implementation powers, which may be used in enforcement and verification activities.

Reporting and investigation tools. The notification architecture in regulation 22 channels immediate verbal or telex/radio/fax notifications through the Port Adelaide Signal Station or the Australian Search and Rescue Centre. Written reports in a prescribed form (Schedule 1) must be furnished within 24 hours on request (regulation 22(2)). These reporting duties operate as both monitoring and enforcement triggers. Regulations 23 and 24 require reports for discharges occurring other than from ships pursuant to section 27(2) of the Act and prescribe the same Schedule 1 form.

Ministerial orders and administrative penalties. Regulation 25 confers on the Minister the power to make orders to give effect to Annexes I, II, III and V and Article 8 and Protocol I of the Convention, and to fix fees in respect of such orders (regulation 25(a)-(c)). The availability of ministerial orders creates an administrative route for additional enforcement tools, procedures or fees to be introduced without primary legislation amendment.

Administrative fees. Regulation 26 fixes a fee of $40 payable by the owner for deposit of an oil or cargo record book under the Act. While modest, the fee formalises an administrative cost of compliance.

Enforcement risks and operational constraints. The Regulations place practical reliance on accredited surveyors (regulation 9(2)) and on the ability of prescribed officers to receive and act on notifications and reports. Regulation 9(6) restricts some Annex II exemptions to ships operating between States that are party to the Convention and requires surveyor endorsement of endorsed exemptions. These procedural requirements can constrain enforcement discretion and shape enforcement outcomes.

Summarily, enforcement is a composite of criminal sanctions, administrative fees and reporting obligations backed by designated State officers and authorised surveyors. Owners and masters face parallel and overlapping exposure to penalties, and the Minister retains rule‑making authority that can alter or extend enforcement mechanisms.

The Regulations are not stand‑alone; they are framed to operate in conjunction with the Protection of Marine Waters (Prevention of Pollution from Ships) Act 1987, international instruments (the 1978 Protocol and various Annexes to the Convention), the IMDG Code, and national maritime legislation such as the Marine Safety (Domestic Commercial Vessel) National Law insofar as surveyor accreditation is concerned. Several provisions explicitly cross‑reference or import meaning and form from those instruments.

Dependence on the Act. Many of the Regulations’ operative duties are expressed as giving force to or prescribing matters “for the purposes of” specific sections of the Act. For instance, oil record book requirements are imposed where section 11 of the Act applies (regulation 5), cargo record book requirements are prescribed for the purposes of section 21 of the Act (regulation 7), and regulation 9 is made pursuant to section 24 of the Act. The practical effect is that the scope of these Regulations flows from the Act’s definitions and coverage. Compliance therefore requires concurrent consultation of the Act to determine whether a ship falls within sections 11, 21 or other sections referenced.

Integration of international law. The Regulations import and enforce specific Annex provisions of the Convention and the 1978 Protocol by reference. Regulation 11 states the purpose of Part 3 is to give effect to regulations 1 to 6 of Annex III to the Convention. Regulation 9 gives the provisions of Regulation 8 of Annex II (other than paragraph 1) the force of law within the State. Regulation 10(1) and regulation 18 require expressions used in a Part and in the corresponding Annex to have the same meaning as in that Annex. The IMDG Code is made compulsory for packaging, marking and stowage of packaged harmful substances (regulations 13, 14 and 15). This chain means that amendments to the referenced international instruments, or the national implementation of those instruments at other levels, can directly change the required domestic practice by altering the external instruments on which the Regulations rely.

Interaction with Marine Safety National Law. Regulation 9(2) specifically identifies surveyors accredited or otherwise recognised under the Marine Safety (Domestic Commercial Vessel) National Law as authorised surveyors for implementing Regulation 8 of Annex II. That cross‑reference indicates a deliberate point of integration with national surveyor accreditation regimes and binds the implementation role to those accreditation processes.

Overlap and duplication within the Regulations. Regulations 23 and 24 both prescribe the same reporting requirements and refer to the same section 27(2) of the Act, using the same Schedule 1 form and 24‑hour timeframe. This duplication appears in the text of the Regulations and should be read together with the Act’s reporting structure to determine which operative provision applies in a given situation.

Exemptions and State immunity. Regulation 27 preserves the Act’s exemption of Defence vessels and foreign State non‑commercial ships, and therefore interacts with broader public international law and defence legislation by excluding those classes from the Act and Regulations. The definition of “State” in regulation 27(2) mirrors the Convention’s use.

Administrative law and ministerial orders. Regulation 25 confers powers on the Minister to make orders to give effect to Annex provisions not already given effect by the Act or these Regulations, and to fix fees. Those ministerial orders will themselves operate as subordinate legislation subject to the Act’s administrative framework and any applicable procedural requirements under the Statutes and subordinate instruments regimes.

Criminal and procedural law. The Regulations create offences and penalties that operate under the criminal procedural framework applicable in South Australia. The attendant enforcement actions, prosecutions and appeals will be subject to the Act and to relevant criminal procedure legislation.

Operational interplay with port and search and rescue agencies. Regulation 22(1) directs immediate notifications to be conveyed through the Port Adelaide Signal Station of the Port of Adelaide operator or to the Australian Search and Rescue Centre using POLREP code letters. This bridges the Regulations with port operating practices and Commonwealth maritime search and rescue infrastructure.

In practice, compliance and enforcement require actors to navigate a bundle of legislative instruments: the Act defines scope and enforcement powers, these Regulations prescribe detail and forms, international Annexes and the IMDG Code set technical standards, and national accreditation and port procedures define who may certify or receive documents. Consultation and cross‑checking of all these sources is necessary to determine exact duties and limits of enforcement in any concrete incident.

The text attached includes a brief legislative history entry showing the Regulations as principal regulations made in 2013. The key chronological entry is:

• Principal regulations: Protection of Marine Waters (Prevention of Pollution from Ships) Regulations 2013, No. 223. Gazette 29.8.2013 p 3733. Commenced 1 September 2013 (regulation 2 references commencement date).

The Regulations’ preamble and notes do not list any subsequent amendments or replacements. The legislative history section at the end instructs readers to consult the Index of South Australian Statutes or the State legislation website for further information relating to the Act and subordinate legislation. That indicates this instrument is the 2013 consolidation of the subordinate regulations under the Act, and no further amending instruments are printed in the provided text.

Because the Regulations rely extensively on international instruments (the 1978 Protocol, Annexes I, II, III and V of the Convention, the IMDG Code and IMO guidelines and control procedures), amendments to those instruments at international level may have practical effect on the obligations created here if the Regulations or ministerial orders subsequently adopt the revised standards. Regulation 10(1) and regulation 18 incorporate meanings from the Annexes, and regulation 25 grants the Minister power to make orders giving effect to further Annex provisions and to fix fees; those are administrative levers for updating operational detail without amending the principal Regulations in Parliament.

The Regulations themselves provide ministerial power to make subordinate orders (regulation 25), which is an internal mechanism for change that does not require a primary amendment to the Regulations. The presence of that delegation means some technical changes to give effect to Annex provisions or to fix fees can be made by instrument in writing rather than by legislative amendment, subject to statutory limits and any required procedural steps for subordinate instruments.

Users of the Regulations should therefore check the consolidated version made available via official State legislation repositories for any post‑2013 amendments, ministerial orders made under regulation 25, and updated versions of the international instruments (IMDG Code, Annexes to the Convention) referenced by the Regulations. The legislative history section explicitly points to the Index of South Australian Statutes and the State legislation website for that purpose.

The text of the Regulations as provided does not include any case law, judicial decisions, or recorded litigation history. The instrument references statutory sections of the Protection of Marine Waters (Prevention of Pollution from Ships) Act 1987 and international instruments, but does not identify any reported cases, judicial interpretations or enforcement outcomes.

Because the Regulations are largely prescriptive and technical, litigation that might arise from them would typically involve questions such as: whether a particular vessel fell within the Act’s scope (for example whether section 11 applied), the adequacy of entries or the form of an oil or cargo record book as set out in the Protocol Appendices, whether marking and labelling of packaged harmful substances complied with IMDG Code requirements adopted by the Regulations, or challenges to administrative decisions by the State Marine Pollution Controller or port manager. Any such litigation would be recorded in State court or tribunal reports and not in the Regulations themselves.

The Regulations provide offences and penalties that are enforceable in the State’s courts, and the presence of specific monetary penalties and imprisonment exposure in regulation 12 means that prosecutions under the Act and Regulations could be brought against individuals or corporations. However, no judgments, prosecutorial guidelines or enforcement histories are included in the instrument text supplied.

For a complete litigation history, practitioners and researchers should consult State court records, the Public Prosecutions Office, administrative decisions published by the Department responsible for the Act, and consolidated legislative materials that may include notes of related cases, Ministerial orders or determinations. The Regulations’ reliance on international instruments such as the IMDG Code and Annexes suggests potential reference to technical expert evidence in any litigation, but the text supplied contains no instances of judicial treatment.

The Regulations are technical, detail‑heavy and reference multiple external instruments. The following practical pitfalls and technical traps arise directly from the Regulations as drafted.

1. External instrument dependency. Many operative duties import the IMDG Code, Annexes and Protocol Appendices by reference (regulations 5, 7, 9, 10, 13, 14, 15, 20(3)(c)). The Regulations do not reproduce the IMDG Code or the Annex texts. Compliance therefore requires ensuring the ship carries the correct editions and understands any amendments to those instruments. Failure to follow a later edition adopted in practice, or misunderstanding edition applicability, can create non‑compliance even where a crew believes it has followed “the Code”.

2. Scope determined by the Act. Several obligations apply only if particular sections of the Act apply (for example regulation 5 refers to ships “to which section 11 of the Act applies”). The Regulations do not themselves define those thresholds; users must cross-check the Act to determine whether a vessel is captured.

3. Dual liability of owner and master. Many offences make both owner and master liable (regulations 12, 19, 20, 21). In practice this means that compliance programmes must address both corporate systems and on‑board operational practice. Costs and penalties can be levied against either party.

4. Detailed recording obligations. Regulations 6 and 8 list operations and occurrences that must be recorded in the oil and cargo record books. Incomplete or late entries breach the Regulations. The requirement to deposit copies of stowage plans with the port manager before departure (regulation 16(d)(ii)) creates an administrative dependency on port procedures and timings.

5. Specific marking durability test. Regulation 13(3) requires marking or labelling to be legible after immersion for three months. That standard is stricter than plain labelling and may require specialised plating or labelling material; shippers and packers must ensure labels meet the immersion durability standard or rely on express IMDG exemptions (regulation 13(4)).

6. Reporting channels and timing. Immediate notification requires specified modes and routing (regulation 22(1)). A follow‑up written report must be furnished within 24 hours of a request and in the precise Schedule 1 form (regulation 22(2)). The two‑step requirement (immediate notification then 24-hour written report) can be misunderstood as interchangeable or optional. The Schedule 1 form requires detailed technical and geographic information; failures to provide substantive details may lead to enforcement or further information requests.

7. Surveyor authorisation and international exemption constraints. Regulation 9(2) authorises surveyors accredited under the Marine Safety National Law as authorised surveyors. Their availability and accreditation status affects the ability to obtain surveyor endorsement for exemptions under Annex II (regulation 9(6)). Regulation 9(6) also limits certain exemptions to ships engaged in voyages to ports in States party to the Convention and requires endorsement by an authorised surveyor, adding procedural steps to any exemption process.

8. Duplication and potential ambiguity in reporting regs. Regulations 23 and 24 are both titled “Discharge reports occurring other than from ships” and contain identical text prescribing Schedule 1 for reports under section 27(2) of the Act. The duplication in the instrument may create confusion about applicability or drafting intent; practitioners should treat both provisions as substantively identical and follow the prescribed form and timeframe.

9. Small administrative fee but potential cumulative costs. Regulation 26 prescribes a $40 fee for deposit of an oil or cargo record book. Although one‑off and modest, the fee is only one element of compliance costs that include training, acquiring prescribed forms, labelling materials that meet immersion standards, and potential port delays when deposits are required prior to departure (regulation 16(d)(ii)).

10. Exemptions for state vessels. Regulation 27 exempts Defence and certain foreign State government ships. Those exemptions are narrowly defined and may not extend to contractors or hybrid government commercial operations. Entities should not assume blanket immunity for any vessel with a government link.

11. Master‑specific offences. Some offences are expressly attributed to the master (for example tank washing failures under regulation 9(3)). That creates a situation where a master can be personally liable despite company systems, practical compliance must therefore include training and operational checks.

12. Record retention and accessibility. Garbage record books must be kept on board and available for inspection, with the owner required to retain completed books for two years after final entry (regulation 21(5)-(6)). Lost or improperly stored record books create exposure to penalties.

Overall, the “gotchas” arise from the combination of precise operational prescriptions, reliance on external technical instruments, tight reporting timeframes, dual liability, and procedural steps tied to port and surveyor systems. Practitioners should map these obligations to onboard checklists, shipping documents and port procedures to avoid inadvertent non‑compliance.

Compliance requires a bundled administrative and operational programme that aligns shipboard practice with the Regulations’ documentary, labelling, stowage, reporting and record retention obligations. Below is a practical, regulation‑by‑regulation checklist to operationalise the duties in the instrument.

1. Determine scope under the Act. Confirm whether your vessel falls within the sections of the Act referenced in the Regulations (for example whether section 11 and section 21 of the Act apply). Many Regulations refer back to the Act for coverage; the starting point is to confirm legal capture under the Act.

2. Obtain the prescribed record books and forms. Ensure the vessel carries:

   • Oil record book(s) in the forms set out in Part I and/or Part II of Appendix III to Annex I of the 1978 Protocol as applicable (regulation 5).
   • Cargo record book in the form set out in Appendix IV to Annex II (regulation 7).
   • Garbage record book in the form specified in the Appendix to Annex V (regulation 21(2)). Ensure crew know where these books are kept and how to make the prescribed entries for the operations and occurrences listed in regulations 6 and 8.

3. Train masters and responsible officers on recording obligations. Provide clear operational checklists that map the machinery space operations, cargo and ballast operations, and occurrences listed in regulations 6 and 8 to everyday procedures, so entries are accurate and contemporaneous. Ensure the master signs each completed page of the garbage record book and that the book is available for inspection (regulation 21(5)).

4. Conform to the IMDG Code for packaged harmful substances. Implement the IMDG Code requirements for packaging, marking, labelling, stowage and quantity limitations (regulations 13-15). Keep current copies of the IMDG Code onboard or in operational documentation and ensure cargo packing agents and shippers provide the signed certification required by regulation 16(b).

5. Marking and labelling durability. For marine pollutants carried in packages, ensure markings indicate marine pollutant status, correct technical name, and trade name (regulation 13(2)). Use labelling materials and techniques that maintain legibility after immersion for three months or confirm applicability of any IMDG Code exemptions (regulation 13(3)-(4)).

6. Stowage plans and shore deposits. Maintain a detailed list or stowage plan showing locations of harmful substances on the ship and, when loaded in this State, retain a copy ashore and deposit a copy with the port manager before departure (regulation 16(c)-(d)). Factor port deposit time into voyage planning to avoid delays.

7. Garbage management planning. For ships of 400 GT or more or certified for 15+ persons, carry and implement a garbage management plan that provides written procedures, designates a responsible person, and conforms to IMO guidelines (regulation 20(1)-(3)). Ensure crew training on collection, storage, processing and disposal and that garbage disposal equipment is operable.

8. Placards and signage. For ships 12 metres or longer, display placards informing crew and passengers of garbage disposal requirements (regulation 19(1)). Verify placard legibility and placement.

9. Reporting protocols and contact points. Establish a reporting protocol for immediate notification of prescribed incidents per regulation 22(1), including contact details and templates for messages routed through the Port Adelaide Signal Station and the Australian Search and Rescue Centre. Maintain an internal incident folder with the Schedule 1 form and pre‑populated data fields to allow rapid submission of the 24‑hour report required on request (regulation 22(2) and Schedule 1).

10. Surveyor access and tank washing. If your operations involve unloading noxious liquid substances and tank washing, ensure surveyor availability and accreditation under the Marine Safety National Law for any required certifications or endorsements (regulation 9(2)). Keep records demonstrating tank washing was carried out in accordance with the relevant provisions of Regulation 8 of Annex II, and obtain surveyor endorsements for any exemptions that rely on voyage endpoints to other party States (regulation 9(6)).

11. Record retention. Keep garbage record books on board and available for inspection, and ensure owners retain completed garbage record books for two years after the final entry (regulation 21(5)-(6)). Keep copies of deposited stowage plans and deposited oil and cargo record books, and be prepared to pay the $40 deposit fee for deposit of oil or cargo record books when required (regulation 26).

12. Compliance documentation for shippers. Require shippers to supply shipping documents that state marine pollutant status, correct technical names and signed certificates that cargo is packaged and marked in accordance with the Regulations (regulation 16(a)-(b)). Include contractual indemnities and warranties from shippers about IMDG Code compliance where appropriate.

13. Internal audits and training. Implement routine compliance audits that check record book entries, cargo documentation, placards, garbage plan implementation and report readiness. Train masters and designated responsible persons for garbage plans and ensure knowledge of the precise marking durability and labelling requirements.

14. Administrative law preparedness. Keep track of any Ministerial orders made under regulation 25 that may further define obligations or fix additional fees. Subscribe to official consolidated legislation updates from the State legislation website and monitor IMO and IMDG Code updates that could affect obligations imported by these Regulations.

15. Insurance and liability management. Given dual liability of masters and owners on many offences, confirm that insurance and indemnity arrangements address fines, defence costs and potential criminal exposures. Where possible, ensure contractual clauses require shippers and cargo packers to assume responsibility for improper packaging or labelling.

16. Port engagement. Engage proactively with port managers where stowage plans must be deposited and where port procedures may affect departure timing. Establish a standard operating procedure for communicating with the Port Adelaide Signal Station and Australian Search and Rescue Centre for immediate notifications.

Following these steps aligns operational practice with the Regulations by addressing the documentary, technical and reporting elements in the instrument. The key to compliance is integrated shipboard procedures supported by shore‑side documentation controls, surveyor engagement and training that reflect the specific prescribed forms, IMDG Code technical standards and the 24‑hour reporting and deposit obligations set out in the Regulations.
