Complying with the Regulations requires attention to prescribed forms, attestation steps, service methods, and recordkeeping rules. Below are practical compliance steps derived from the Regulations and Schedule 1.
Use the prescribed forms and copies. Start by selecting the correct form from Schedule 1 for the action required: application for a prostitution restraining order (form 1) under s 38, the pro forma record of proceedings for s 37 orders (form 2), the restraining order templates with copies (form 3), application for leave and affidavit to apply to vary or cancel (forms 4 and 5), and the substantive application to vary or cancel (form 6). Ensure the correct roster of copies are produced: court copy, applicant’s copy (Commissioner), police copy, respondent’s copy, proof-of-service copy, and other party’s copy as specified for each form in Schedule 1.
Observe the substantial compliance provision but not as an excuse for missing critical items. Reg 3(2) allows a form substantially in compliance to be sufficient. That provides flexibility for formatting. However, do not omit jurisdiction-critical fields: names, dates, signature blocks, affidavit attestation, proof-of-service entries and the court hearing slots. Those items often determine whether the court will accept the document.
Affidavit attestation. For any application for leave to apply to vary or cancel a restraining order, ensure the supporting affidavit is sworn before a justice, as required by reg 4. The affidavit must set out all relevant circumstances, favourable and unfavourable, and should include additional numbered paragraphs as needed (Schedule 1, affidavit form). Keep an original sworn affidavit for filing and provide copies as required.
Service mechanics and proof of service. For applications under s 38, cause a copy to be served on the person sought to be restrained (reg 6(1)). For applications under s 42 to vary or cancel, serve according to reg 6(2): if the applicant is a police officer, serve the restrained person; if the applicant is the restrained person, serve the person on whose application the restraining order was made (which is treated as the Commissioner of Police for s 42 under reg 5(2)). Use the proof of service templates in Schedule 1 to document method, place, date, time, server identity and signature. If relying on oral service, have the serving police officer complete the required certification that the restrained person appeared to understand what was said.
Follow the Restraining Orders Act 1997 Part 6 Division 2 mechanics. The Regulations deliberately import that Part for service and notification (reg 6(3), reg 7, reg 8). Practitioners must study and follow the detailed steps in that Act for substituted service, methods of personal service, and official notifications because the Regulations do not reproduce those mechanics. Obtain any court orders necessary for substituted service before attempting to serve via substituted methods.
Court record when making a s 37 order. If a court is making an order under s 37, ensure the court prepares and places the prescribed written record on its file as required by reg 5(1). If you are a police applicant, supply the court with the completed record template and any supporting notes that the court should include in its record of proceedings.
Two-stage process for restrained persons seeking variation or cancellation. If acting for a restrained person, file an application for leave to apply to vary or cancel (form 4) with the sworn affidavit (form 5) and await the court’s leave. Do not file the substantive application to vary or cancel until the court grants leave. The affidavit must demonstrate a “substantial change” in circumstances, and the application for leave must be served only when the court orders service, where the form indicates that some forms must not be served until service is ordered.
Record and distribute police copies. For police applicants and police-implemented enforcement steps, ensure police copies are completed and retained at the police station/division identified on the forms. Police copies and corresponding certificates are the documents that usually support enforcement action by police and prosecution later.
Pay attention to duration and expiry. The respondent’s copy indicates a default expiry of one year after service if no duration is specified. When seeking variation or cancellation, take account of that timeframe in planning applications and timing.
Check the 2007 amending instrument and current consolidated text. The compilation notes an amendment in 2007 and flags an unresolved change in r 4(3) of the amending instrument. Before relying on the compiled text for contested procedural matters, inspect the Gazette of 31 July 2007 p. 3799 and any subsequent notices to confirm what amendments took effect and whether any clarifications have since been made.
Practical checklist for a police applicant seeking a restraining order under s 38:
- Complete Schedule 1 form 1 fully, including Applicant block showing name on behalf of the Commissioner, regimental number and station/division.
- Provide all known particulars for the person to be restrained and state grounds, including the alleged offence and the public place.
- Obtain any directions given under s 26 of the Act to note in the application if applicable per the form.
- Cause personal service or other compliant service in accordance with Part 6 Division 2 of the Restraining Orders Act 1997 and complete proof of service forms.
- Attend the court hearing and provide evidence; the court will complete the Record of Proceedings in form 2 if it makes the s 37 order.
Practical checklist for a restrained person seeking variation or cancellation under s 42:
- Prepare an affidavit sworn before a justice detailing all relevant circumstances, including adverse facts, and why those circumstances constitute a substantial change since the order was made (reg 4; Schedule 1, form 5).
- File an application for leave to apply to vary or cancel using form 4 and lodge the affidavit. Do not serve it until the court orders service where applicable.
- If leave is granted, serve the substantive application to vary or cancel on the person who applied for the restraint (normally the Commissioner of Police due to reg 5(2)), using Part 6 Division 2 mechanics and proof of service forms.
- If the court denies leave, consider appeal or alternative remedies as appropriate under the Act and court rules.
Finally, maintain documentary chains. The Regulations make documentary proof of service and court records central to enforceability. Keep originals of sworn affidavits, signed certificates of service, and copies of the court’s prescribed record to support any later prosecution or defence regarding breach or validity.
Following these steps will align practice with the procedural architecture the Regulations establish and reduce risk of technical non-compliance.
