36Not taking regulatory action

36 Not taking regulatory action (a) has given a licensee a show cause notice in accordance with section 34; and

Immediate suspension or cancellation of licence Division 4.3 section 34 (2) (c); and (c) is satisfied regulatory action against the licensee— (i) may not be taken; or (ii) may be taken, but in all the circumstances, it is not appropriate to take the action. (2) The registrar must give the licensee a written notice that tells the licensee that regulatory action will not be taken against the licensee in relation to the matters stated in the show cause notice.
