Prohibited Weapons Regulation 1997

Several recurring legal and administrative concepts organise the regulation’s mechanics.

Registrar and decision-making: The registrar, defined as the registrar of firearms (s 3), is the primary decision-maker. The registrar must be satisfied that permit applicants are fit and proper and may impose and approve conditions, storage guidelines, club approvals and training requirements (see s 5 and s 6). The Minister has a limited, specific declaratory power to approve suppliers and manufacturers for particular classes (s 7(1), s 8(1)), and those declarations are disallowable instruments (s 7(5), s 8(4)).

Fit and proper person test and exclusionary triggers: Section 5 creates a fitness test and a set of concrete exclusionary triggers. The registrar must not issue a permit unless satisfied the applicant is a fit and proper person to have possession without danger to public safety or to the peace (s 5(1)). The registrar must also refuse where there is reasonable cause to believe the applicant cannot exercise continuous and responsible control because of way of living or domestic circumstances (s 5(2)). The regulation sets out categorical prohibitions for persons who, within the relevant period of 10 years before application, have been convicted of a prescribed offence anywhere, or are subject to protection orders, interim protection orders, undertakings to keep the peace, or have had permits or licences cancelled (s 5(3)-(5)). The relevant period is defined as 10 years (s 5(6) definition).

Permits as conditional licences: Permits are conditional and the regulation lists many conditions. Section 6 makes compliance with registrar-approved storage and security guidelines a condition of any permit. Specific items attract bespoke conditions: crossbow permits contain resale restrictions and age and club membership requirements (s 7(2), s 7(4)); manufacturing or disposal of darts is restricted to approved manufacturers or persons with certain disabilities (s 8); baton and body armour permits require registers of use, identification inscriptions, limits on quantities and approved training for users (ss 10 and 12).

Targeted approvals and lists: The regulation operates with closed lists and administrative approvals. For crossbows the approved archery clubs are specifically named in the regulation (s 7(6)). Approved suppliers and manufacturers are appointed by Ministerial declaration (s 7(1), s 8(1)) and are disallowable instruments (s 7(5), s 8(4)). Martial arts clubs must be “approved” by the registrar to obtain permission for nunchaku (s 11).

Specialist-purpose authorisations: Suppressors are only authorised to specified persons and for particular purposes (s 12A). The authorised person must hold a licence or permit or be otherwise authorised under the Firearms Act 1996 to possess or use a prohibited firearm and must also fall within listed occupational or legal roles (conservation officers, veterinary practitioners, CSIRO employees, licensed firearms dealers, lessees of rural leases or persons authorised by them) (s 12A(1)-(3)). The authorised purposes list is specific and procedural rather than open-ended (s 12A(2)).

Event and production permits: The instrument recognises special regimes for militaria fairs and theatrical or re-enactment productions (ss 13-14). These require particular findings by the registrar on premises suitability, activities, types of prohibited items, safekeeping and security (s 13). Permits for productions require that the production be staged by a theatrical, dramatic or historical society and that the weapon be lent or hired by a person who holds a permit in relation to it or by an out-of-jurisdiction person legally entitled to possess it (s 14).

Record-keeping, marking and quantity limits: Several sections impose administrative controls that are intended to facilitate oversight: serial numbers on catapults (s 9(1)(b)), identification numbers inscribed permanently on batons and body armour (ss 10(3)(b)(i)(ii), 12(2)(b)), registers of each use for batons and body armour (ss 10(5)(a), 12(2)(a)), and permitting limits on how many items an organisation may possess (ss 10(5)(b), 11(5)(a), 12(2)(c)).

Disallowable and administrative instruments: Some approvals and declarations are disallowable instruments (s 7(5), s 8(4)), which means the Assembly may disallow them. Registrar-approved guidelines and approvals of clubs and training establish the detailed operational rules but are not reproduced in this regulation; they are administrative instruments that will materially affect compliance.

Together, these concepts show a framework that mixes statute-specified criteria with delegated administrative determinations. The structure channels access via permits and then controls use and transfer through conditions, marking and record-keeping.

The regulation distributes rights, duties and costs across multiple actor groups. Who pays and who decides are explicit or can be inferred from the regulatory design.

Primary affected parties

• Applicants for and holders of permits: Individuals and organisations seeking to possess or use prohibited weapons or articles must apply for permits and meet thresholds set by the registrar (s 5). Permit-holders bear the compliance burdens in the form of storage and security obligations (s 6), inscription and register requirements (ss 10, 12), limits on numbers (ss 10(5)(b), 11(5)(a), 12(2)(c)), and conditions on sale or disposal (ss 7(4), 8(3)).
• Security organisations: Defined in s 3, a security organisation (corporation or partnership providing protection or transport/protection of others’ money or property, but not a bank) is a defined permit-holder for batons and body armour. Security organisations must ensure ownership or lease arrangements, inscription of identification numbers, registers of each use, and that employees complete registrar-approved training (ss 10, 12).
• Martial arts clubs and qualified instructors: Only approved martial arts clubs with full-time or part-time qualified instructors may obtain permits for nunchaku (s 11(3)). Qualified instructors are defined as persons holding a black belt or equivalent accredited under the Australian Coaching Council National Coaching Accreditation Scheme and evidenced in writing (s 11 definition). Clubs must comply with limits on numbers and restrict removal from premises (s 11(5)).
• Archery clubs and approved suppliers: The regulation specifies named approved archery clubs that are permitted to hold crossbows, and creates a Ministerial power to declare approved suppliers (s 7(2), s 7(6), s 7(1)). Approved suppliers and members of approved clubs may obtain permits subject to conditions, ownership and use limitations (s 7(2)-(4)).
• Research bodies and students: Catapult possession is limited to research bodies (Australian National University or the University of Canberra) for plant or animal research and requires registrar-assigned serial numbers (s 9). Employees and students connected to the research body are authorised for work purposes and student research with approval (s 9(2)-(3)).
• Firearms dealers, conservation officers, veterinary practitioners, CSIRO employees, and lessees of rural leases: These groups are specifically affected by the suppressor regime (s 12A). Suppressors are authorised only to authorised persons performing listed purposes; an authorised person must also be licensed or permitted under the Firearms Act 1996 (s 12A(1)-(3)).

Secondary affected parties and public interest concerns

• The general public: Access is limited by fit and propriety, and the registrar may refuse if to do so would be contrary to the public interest (s 5(5)). The public bears diffuse risks and potential benefits associated with permitting particular uses (public safety versus specialist uses such as research and conservation).
• Businesses dealing in weapons: Firearms dealers have explicit authorised activities with suppressors (manufacture, repair, test, etc.) which the regulation expressly contemplates (s 12A(2)(d)). Manufacturers and suppliers for darts and crossbows require Ministerial declarations to be “approved”, affecting market entrants and suppliers (s 7(1), s 8(1)).
• Event organisers and societies: Societies staging theatrical productions, historical re-enactments or militaria fairs are affected by the requirements for permits and premises suitability (ss 13-14). Militaria fair permit-holders must secure premises to the registrar’s satisfaction and specify authorised people and permitted items (s 13).

Who decides

• Registrar: Holds the principal decision-making role for issuing and conditioning permits, approving storage guidelines, approving martial arts clubs and training courses, authorising militaria fairs, and refusing on fit and proper grounds (ss 5, 6, 11(3), 10(4)(b)).
• Minister: May declare approved suppliers/manufacturers for crossbows and darts; those declarations are disallowable (s 7(1), s 8(1), s 7(5), s 8(4)).
• Permit-holders: Must ensure their organisations and employees meet conditions and training requirements and maintain registers and inscriptions.

Who pays

• Permit applicants and permit-holders: Administrative and compliance costs fall on applicants and holders: application costs, secure storage upgrades to meet registrar guidelines (s 6), marking/serial number costs (ss 9, 10, 12), training costs for baton users (s 10(4)(b)), and record-keeping costs for registers (ss 10(5)(a), 12(2)(a)). There may be additional transactional friction for sale/disposal restrictions (ss 7(4), 8(3)) and premises suitability obligations for militaria fairs (s 13).
• Government: Administrative costs and policy choices fall on the registrar and Minister for approvals, record maintenance, and potential compliance inspections.

In short, the regime channels possession and use through permit processes targeted at particular user groups and contexts. The regulation concentrates decision power with the registrar and the Minister for declarations, and distributes compliance costs primarily to permit applicants and holders.

The regulation establishes both negative rights (what is not permitted without authorisation) and positive duties (obligations on permit-holders and approvers). Below are the principal duties and rights, with section references.

Duties imposed on the registrar and Minister

• Registrar’s gatekeeping duties: The registrar must not issue a permit unless satisfied the applicant is a fit and proper person to possess a prohibited weapon without danger to public safety or to the peace (s 5(1)). The registrar must refuse where the applicant may not personally exercise continuous and responsible control (s 5(2)). The registrar must also refuse in certain categorical circumstances (s 5(3)), and may refuse if issuance would be contrary to the public interest (s 5(5)).
• Registrar’s approval duties: The registrar must approve guidelines for storage and security applicable to permit-holders and impose them as permit conditions (s 6). The registrar is responsible for approving martial arts clubs for nunchaku, registrar-approved baton training courses, arbitration of permits for militaria fairs and theatrical productions, and allocation of serial numbers for catapults (ss 9, 10, 11, 13, 14).
• Ministerial declaratory power: The Minister may declare approved suppliers of crossbows and approved manufacturers of darts by written declaration; such declarations are disallowable instruments (s 7(1), s 8(1), s 7(5), s 8(4)).

Duties imposed on permit-holders and specified persons

• Storage and security: All permit-holders must comply with registrar-approved storage and security guidelines. This is a condition of any permit (s 6).
• Registers and recording: Permit-holders for batons (security organisations) and body armour must record each use in a register (ss 10(5)(a), 12(2)(a)). Militaria permit holders must specify authorised people and periods for fairs in their permit (s 13(3)). These records facilitate oversight and enforcement.
• Marking and serialisation: Catapults must bear a registrar-allocated serial number (s 9(1)(b)). Batons and body armour must be inscribed in a permanent way with an identification number (ss 10(3)(b)(i)(ii), 12(2)(b)).
• Limits on numbers and movement: Permits specify maximum numbers of items an organisation may possess (ss 10(5)(b), 11(5)(a), 12(2)(c)). Nunchaku must generally remain on club premises and may only be transported to and from competitions or demonstrations (s 11(5)(b)). Crossbow and dart permits impose conditions on sale or disposal, crossbows may not be sold without reasonable excuse to persons outside approved archery clubs who do not have a permit to acquire (s 7(4)); darts have a similar restriction on sale or disposal (s 8(3)).
• Training and employment criteria: Security organisation employees may only possess and use batons if employed by the organisation with the baton in their possession for employment purposes and after completing registrar-approved training (s 10(4)). Nunchaku use is limited to members of an approved club taking part in instruction by or supervised by a qualified instructor, or qualified instructors themselves within the defined uses (s 11(4)).
• Use limitations and authorised purposes: Suppressors may only be possessed or used by authorised persons for authorised purposes as expressly listed (s 12A(1)-(2)). The theatrical permit regime authorises only blank ammunition for use in a weapon under a production permit (s 14(2)).

Rights or permissions created

• Right to possess/use under permit: Where the registrar issues a permit and the permit-holder complies with any conditions, a permit authorises possession and in some instances use of specified prohibited weapons or articles for specified purposes (see s 13(3) and s 14(1)-(2)).
• Event and production authorisations: Permits may authorise multiple named persons to possess and, if specified, use prohibited weapons at a militaria fair during a stated period (s 13(3)). Theatrical permits allow performers or members of the staging society to possess specified weapons for the production, subject to lending/hire conditions and the blank ammunition restriction (s 14(1)-(2)).
• Authorisation by employment: Employees of permit-holding organisations may be authorised to possess and use prohibited items in the course of their employment where the permit conditions are satisfied (s 10(2), s 12(1)).

Interface between duties and rights

• Conditions create obligations for the continuation of rights: Holding a permit is conditional. Continued lawful possession depends on compliance with storage guidelines (s 6), marks and records (ss 9-12), training (s 10(4)(b)), and any limits specified in the permit (s 10(5)(b), s 11(5)(a), s 12(2)(c)). Failure to comply can jeopardise the permit-holder’s entitlement under the Act, and may open avenues to enforcement.
• Disallowable instruments and administrative detail: Key operational permissions depend on administrative approvals and disallowable instruments (s 7(5), s 8(4)), meaning a permit-holder’s rights can be affected by political or parliamentary action.

In practical terms, the regulation creates precise compliance duties that must be satisfied to enjoy a narrow right to possess or use listed prohibited items. The registrar’s satisfaction and approval powers determine access and ongoing compliance obligations.

The regulation itself does not set out the full schedule of criminal penalties for unlicensed possession of prohibited weapons; those primary offences are located in the parent Prohibited Weapons Act 1996 and related firearms legislation. However, this regulation specifies administrative conditions and obligations that feed into enforcement under the Act and provides a context for administrative refusal, permit conditions, and potential contraventions.

Penalty unit values stated at republication: The republished law notes the value of a penalty unit at the republication date as $160 for an individual and $810 for a corporation (front matter). These values are relevant to offences against this law where the Act sets a penalty in penalty units. The regulation does not itself list penalties in penalty units for particular contraventions; enforcement relies on the Act’s offence provisions and the regulator’s administrative powers.

Enforcement levers in the regulation and practical consequences

• Permit refusal and conditionality: The registrar may refuse to issue permits if statutory fitness and propriety criteria are not met (s 5). The registrar’s power to refuse is an immediate administrative control. Grounds for refusal include convictions within the 10 year relevant period for prescribed offences, being subject to protection orders or similar, or other public interest considerations (s 5(3)-(5)). Refusal prevents legal possession and use and thereby reduces the risk of unlawful activity under the Act.
• Permit conditions enabling monitoring: Several permit conditions are expressly designed to enable detection and prosecution of breaches. For example, registers of each use for batons and body armour (ss 10(5)(a), 12(2)(a)) and permanent identification numbers inscribed on batons and body armour (ss 10(3)(b)(i)(ii), 12(2)(b)) assist audit trails and link particular items to organisations and incidents. Catapults must bear registrar-allocated serial numbers (s 9(1)(b)).
• Administrative sanctions under the Act: Conditions attached to permits and legislative provisions under the parent Act create potential grounds for administrative sanctions, including cancellation of permits. Section 5(3)(e) expressly lists cancelled permits under the Act or cancelled licences under the Firearms Act 1996 as exclusionary material for future permits.
• Disallowance and parliamentary oversight: Ministerial declarations of approved suppliers and manufacturers are disallowable instruments (s 7(5), s 8(4)). Parliament may disallow such declarations, which affects what suppliers or manufacturers may lawfully supply permitted classes of items.
• Criminal enforcement: If a person possesses or uses a prohibited weapon without a permit or contravenes statutory prohibition in the parent legislation, criminal sanctions in the Act apply. The regulation amplifies the set of conditions that will be relevant to proving non-compliance during criminal proceedings, especially where evidence such as register entries, marking, or training records are central.

Practical enforcement risks and evidentiary mechanics

• Evidence trail: The requirement for registers and permanent markings creates a traceable paper and physical trail that enforcement agencies can rely on. Conversely, absence of marking or register entries may be used as evidence of unlawful possession or failure to comply with permit conditions.
• Discretion and review avenues: The registrar’s discretion to refuse or impose conditions and the public interest refusal power (s 5(5)) create administrative enforcement choices rather than strictly rule-driven outcomes. Administrative refusal or cancellation decisions under the Act will be subject to the procedural and merits review regimes in the Territory, including any judicial review pathways available under administrative law.
• Cross-jurisdictional complexity: For theatrical productions, s 14 permits transfer or hire from persons ordinarily resident in a State or Territory who are legally in possession under that jurisdiction’s law (s 14(1)(d)(ii)). This requires enforcement to consider interstate legality and may create evidentiary or jurisdictional complications if the out-of-jurisdiction legal possession is disputed.

In sum, enforcement under the regulation is primarily administrative, using permit refusal, conditions, marking and record-keeping to create enforceable obligations. Criminal penalties remain anchored to the parent Act, with penalty unit values noted in the republished law’s front matter relevant for those offences.

The regulation explicitly references and interacts with several other statutory regimes and instruments. Those interactions affect eligibility, authorisation, and the conditions under which certain conduct is lawful.

Relationship with the Prohibited Weapons Act 1996 and Firearms Act 1996

• Parent Act: The regulation is made under the Prohibited Weapons Act 1996 and operates as subordinate legislation. The principal offence provisions and broader frameworks for prohibited weapons are in the parent Act; the regulation fills in operational detail by setting conditions and eligibility rules. Permit refusals and conditions under the regulation operate within the Act’s enforcement architecture.
• Firearms Act nexus: Several provisions require or reference licences, permits or authorisations under the Firearms Act 1996. For example, in s 5(3)(e) a cancelled licence or permit under the Firearms Act 1996 is a bar to new permit issuance. Section 12A(3)(a) requires authorised persons to hold a licence or permit under the Firearms Act 1996 to possess or use a prohibited firearm before they may be an “authorised person” for suppressor permission.

Interconnection with family and personal protection orders regime

• Protection orders: Section 5 incorporates protection orders and interim protection orders under the Family Violence Act 2016 and the Personal Violence Act 2016 as exclusionary grounds for permits (s 5(3)(b)-(c)); corresponding orders from other jurisdictions are also captured (s 5(6) definitions). Protection orders that have been revoked are excluded from the disqualification (s 5(4)). The regulation therefore links firearms/prohibited weapon access rules to family and personal violence protective mechanisms.

Planning, biosecurity, stock and nature conservation Acts

• Planning Act 2023: The regulation references the Planning Act 2023 for the definition of “rural lease” in s 12A and for the list of reserved public land categories (s 12A(2)(a) reference to Planning Act 2023 s 385). Amendments in the legislation history reflect updates to cross-reference Planning Act changes.
• Nature Conservation Act 2014: The suppressor regime references the Nature Conservation Act by defining conservation officer and the conservator’s powers to authorise persons to take action under controlled native species management plans (s 12A note and definitions).
• Biosecurity Act 2023 and Stock Act 2005: The definition of “pest” cross-refers to the Biosecurity Act 2023 (s 12A) and “stock” is defined by the Stock Act 2005 (s 12A). These cross-references govern what constitutes fauna, pest status and livestock, which in turn shapes authorised uses for suppressors and other measures.

Commonwealth and research legislation

• CSIRO: Section 12A(2)(c) and definition references the Commonwealth Scientific and Industrial Research Organisation established by the Science and Industry Research Act 1949 (Cwlth). The regulation therefore defers to a Commonwealth agency’s employment relationships for authorisation purposes.
• Inter-jurisdictional recognition: For theatrical productions, s 14 permits items to be lent or let on hire by a person ordinarily resident in a State or Territory who is legally in possession under the law of that State or Territory. This creates an interoperability between ACT permits and lawful possession in other jurisdictions.

Regulatory instruments and disallowable instruments

• Ministerial declarations are disallowable instruments for approved suppliers and manufacturers (s 7(5), s 8(4)). Registrar-approved guidelines (s 6) and approvals of clubs and training (ss 11(3), 10(4)(b)) are administrative instruments that operationalise the regulation’s requirements. These instruments will determine day-to-day compliance detail and are subject to differing levels of parliamentary scrutiny depending on whether they are disallowable.

Implications of cross-references

• Eligibility and disqualification flows across statutes: A person’s status under family violence, firearms or other statutes can directly affect eligibility to hold a prohibited weapons permit in the ACT (s 5 cross-references). For instance, a protection order under Family Violence Act or a cancelled firearm licence under the Firearms Act 1996 are material disqualifiers.
• Operational overlap: Officers enforcing the regulation will need to engage with multiple statutes and datasets: registries for firearms licences, family violence order registries, planning and land tenure records for rural leases, biosecurity designations, and potentially interstate legal possession confirmations for theatrical hires.

The regulation therefore must be read as part of an interlocking legal ecosystem. Its administrative provisions rely on, and may be constrained by, other Territory, Commonwealth and inter-jurisdictional laws.

The instrument includes a detailed legislation and amendment history in the endnotes. The regulation has been modified multiple times since its initial making in 1997. The key mechanical amendment milestones recorded in the republished law are:

• Original and renaming: Originally enacted as the Prohibited Weapons Regulations, renamed by the Protection Orders (Consequential Amendments) Act 2001 (A2001-90). The regulation commenced on 22 May 1997 and has been subject to subsequent amendments and republications (Legislation history).
• Early 2000s amendments: Legislative amendments in 2001 (Legislation (Consequential Amendments) Act 2001 A2001-44 and Protection Orders Act consequential amendments) restructured definitions and added protections linked to protection order regimes. These amendments are recorded in the legislation history (endnotes 3).
• Domestic violence and protection order amendments: Amendments arising from the Domestic Violence and Protection Orders Amendment Act 2005 (A2005-13) and later the Domestic Violence and Protection Orders Act 2008 (A2008-46) introduced and updated cross-references to protection orders, reflecting changes in the Territory’s family violence law architecture (Legislation history, A2005-13, A2008-46).
• Firearms-related amendments: The Firearms Amendment Act 2008 (A2008-25) and the Firearms and Prohibited Weapons Legislation Amendment Act 2018 (A2018-1) introduced substantive changes. Notably, s 12A (suppressors) was inserted by A2018-1 s 38 (as reflected in the amendment history). Other changes addressed relationships with the Firearms Act 1996 and aligned regulatory arrangements.
• Research, veterinary and planning updates: The Veterinary Practice Act 2018 (A2018-32) and Planning (Consequential Amendments) Act 2023 (A2023-36) updated cross-references and definitions, particularly relevant to animal research and rural lease references in the suppressor provisions (s 12A) and catapult provisions (s 9).
• Biosecurity and stock law alignment: The Biosecurity Legislation Amendment Act 2024 (A2024-11) updated the regulation to align terms such as “pest” to the Biosecurity Act 2023, and amendments took effect in 2025 for certain parts (endnotes 3).
• Recent statutory amendments: The Statute Law Amendment Act 2025 (A2025-29) included amendments to multiple sections (as noted in the amendment history entries for s 7, s 8, s 10, s 12 and others). The republication date is 26 December 2025 reflecting those changes.

Mechanically, the amendment history (endnote 4) lists specific subsection substitutions and insertions, including the insertion of s 12A in 2018 and subsequent refinements. The regulation’s amendment record demonstrates an iterative approach: the instrument has been updated to track changes in family violence law, firearms law, research and veterinary regimes, planning and biosecurity law.

Practical consequence of amendment pattern

• Cross-reference maintenance: Many amendments are consequential to changes in other statutes. Practitioners must monitor related Acts (Family Violence Act 2016, Firearms Act 1996, Planning Act 2023, Biosecurity Act 2023) because the regulation’s content depends on their definitions and authorisation frameworks.
• Administrative detail evolving by secondary instruments: Several operational features (approved clubs, training courses, storage guidelines, Ministerial declarations of approved suppliers/manufacturers) will evolve through administrative instruments that follow from statutory amendments.
• Recent introduction of suppressor rules: The inclusion and later amendment of s 12A demonstrates the Legislature’s interest in tightly controlling suppressor possession and linking it to specified public interest activities like conservation and scientific specimen collection.

The endnotes in this republication provide the official legislative chronology and record of amendments at the republication date; practitioners should consult the up-to-date register for any instruments or amendments after 26 December 2025.

The republished regulation and its endnotes do not record any case law or judicial determinations applying or construing the regulation itself. The endnotes list legislative and amendment history but no litigation history entries or named cases appear in the republished text.

Practical implications of an absence of recorded litigation

• Limited authoritative interpretation: Where a regulation has not been subject to reported litigation, administrative interpretation and practice by the registrar and relevant agencies (police, licensing bodies, courts in unreported decisions) will shape how provisions are applied. That increases the importance of registrar-approved guidelines and administrative instruments in clarifying detail such as storage standard expectations, training approvals, and club approvals.
• Reliance on statutory text and administrative guidance: Lawyers and compliance professionals must rely heavily on the text of the regulation, the parent Act, cross-referenced statutes, and any administrative guidance, forms and decision notices issued by the registrar. Any ambiguity in how provisions like s 5(2) (continuous and responsible control) or s 5(5) (public interest refusal) are applied will be resolved through administrative practice or future litigation.
• Risk allocation in permits: In the absence of judicially developed standards of review for particular permit refusals or conditions, permit-holders face administrative discretion. That makes careful documentation of compliance (registers, inscriptions, training certificates and storage evidence) a practical risk mitigation strategy.

If litigation arises in future, reported cases would be the principal source for settled interpretive approaches, especially regarding the registrar’s discretion and the interaction between protection orders and permit eligibility as set out in s 5. For now, no cases are cited in the republication.

This section collects practical traps, uncertainties and operational friction points evident from the regulation as published. Each “gotcha” identifies the concrete mechanism that creates risk or compliance friction.

1. Registrar discretion is broad and fact-driven

• The registrar must be satisfied that an applicant is a fit and proper person (s 5(1)) and may refuse if issuance would be contrary to the public interest (s 5(5)). The regulation provides substantive criteria (convictions in the last 10 years, protection orders, cancelled permits) but also leaves open public interest and way-of-living assessments (s 5(2), s 5(5)). Expect case-by-case administrative decisions and some unpredictability unless registrar guidance is explicit.

2. Storage guidelines are delegated but not published in this instrument

• Compliance with registrar-approved storage and security guidelines is a condition of any permit (s 6). The content of those guidelines will be decisive for compliance costs and whether premises can satisfy a militaria fair suitability test (s 13). Absence of the guidelines within the regulation creates implementation uncertainty for applicants until guidelines are made available.

3. Closed lists and named clubs for crossbows

• The “approved archery club” list for crossbows is set out in s 7(6) by naming specific clubs. If a user belongs to a club not on the list, additional administrative steps will be necessary, such as seeking the registrar’s approval or the club seeking recognition. This narrow route may create access bottlenecks for archery participants.

4. Ministerial declarations and potential political uncertainty

• Approved suppliers and manufacturers are declared by the Minister and are disallowable instruments (s 7(1), s 8(1), s 7(5), s 8(4)). A supplier or manufacturer approved today could have that approval disallowed by the Assembly, affecting market access and supply chains for crossbows and darts.

5. Cross-jurisdictional hire for theatrical productions has evidentiary demands

• Section 14 allows hire from a person ordinarily resident in another State or Territory legally in possession under that jurisdiction’s law (s 14(1)(d)(ii)). Practitioners should anticipate documentary proof will be required to demonstrate lawful interstate possession and chain-of-custody for hire arrangements.

6. Specific disqualification timing for crossbows

• Section 7(3) bars permits to possess and use crossbows if the applicant has been convicted of an indictable offence within the period of 10 years before either commencement of the regulation or acquisition of the crossbow, whichever is later. This creates a somewhat unusual retrospective cutoff linked to commencement or acquisition dates; careful attention is needed when applicants have historical convictions.

7. Training approvals and definitions may be narrow

• For batons the employee must have completed a registrar-approved training course (s 10(4)(b)). For nunchaku qualified instructors must hold a black belt or equivalent accredited under the National Coaching Accreditation Scheme (s 11 definitions). These technical definitions may exclude experienced practitioners whose accreditation or training pathway does not precisely match the statutory formula.

8. Registers and inspection risk

• Requiring that each use of a baton or body armour be recorded in a register (ss 10(5)(a), 12(2)(a)) imposes operational burdens and creates potential evidence against the permit-holder in disciplinary or criminal proceedings if records are incomplete, inconsistent or falsified.

9. Quantity limits and potential operational constraints

• Permits may limit how many items an organisation may possess (ss 10(5)(b), 11(5)(a), 12(2)(c)). Organisations with changing operational needs must manage permit amendment processes or risk non-compliance.

10. Suppressor authorisation tightly circumscribed

• Suppressors are only for “authorised persons” and “authorised purposes” (s 12A(1)-(2)). An authorised person must be licensed or permitted under the Firearms Act 1996 and fall into narrow occupational categories listed in s 12A(3). Practical uses like pest control on rural leases are included, but the framework is specific and documentation of the authorised purpose and licensing will be critical.

11. Definitions and cross-references can shift eligibility

• The regulation relies on definitions imported from other Acts (e.g. rural lease Planning Act 2023 s 256, pest Biosecurity Act 2023 s 11, conservation officer Nature Conservation Act 2014 s 28). If those definitions are amended in their home statutes, eligibility and scope under this regulation can shift without a direct amendment to this instrument.

12. No express private right to appeal is included in this regulation

• The text prescribes administrative decision-making but does not set out appeal procedures. Permit applicants must rely on the parent Act and general administrative law mechanisms for review or judicial review. Procedural routes and timelines should be checked in the parent Act and administrative law.

These “gotchas” are concrete, statute-rooted friction points. Practitioners should map these to operational processes, ensure documentary evidence is prepared in advance of applications, and monitor registrar instruments and Ministerial declarations closely.

A practical compliance checklist and recommended documentation and operational steps follow. Compliance hinges on satisfying the registrar, maintaining required records, and ensuring that employees and contractors meet statutory preconditions.

Pre-application audit and documentation

1. Criminal and protection-order check

• Ensure applicants have no disqualifying convictions within the 10 year “relevant period” for prescribed offences, and are not subject to protection orders, interim protection orders, or undertakings to keep the peace (s 5(3), s 5(6) definitions). Obtain criminal history checks covering the ACT and interstate jurisdictions. For protection orders seek registry confirmation or advice on whether any corresponding order exists in another jurisdiction.

2. Review domestic circumstances and continuous control

• Prepare evidence that the applicant personally will exercise continuous and responsible control over the weapon, and that their way of living or domestic circumstances do not undermine that continuity (s 5(2)). This may include storage arrangements, household membership, employment status and supervised access arrangements.

3. Licensing status under Firearms Act 1996

• For categories that require a firearms licence or permit (notably suppressors in s 12A), ensure the applicant holds the relevant Firearms Act authorisation. Collate licence certificates and any dealer authorisations.

Operational compliance steps once a permit is obtained

4. Implement registrar-approved storage and security guidelines

• Comply with all storage and security guidelines approved by the registrar as a permit condition (s 6). Request a copy of the current guidelines early in the process and budget for any premises upgrades (secure safes, alarms, restricted access, cameras) necessary to comply.

5. Marking and serial numbers

• Ensure items that must be marked or serialised are physically inscribed per the regulation: catapults must bear a serial number allocated by the registrar (s 9(1)(b)); batons and body armour must be inscribed with an identification number in a permanent way (ss 10(3)(b)(i)(ii), 12(2)(b)). Liaise with the registrar to obtain serial numbers and confirm marking standards.

6. Maintain registers and records of use

• For batons and body armour keep a contemporaneous register recording each use (ss 10(5)(a), 12(2)(a)). Maintain training certificates for employees (s 10(4)(b)), ownership or lease documents for items owned by the organisation (ss 10(3)(a), 12(1)(a)), and evidence of transport movements when permitted (s 11(4)(a)(i)-(ii)). Securely store records for the period necessary to respond to audit or enforcement.

7. Training and instructor accreditation

• Ensure security organisation employees complete registrar-approved training for baton use before authorising possession or use (s 10(4)(b)). For nunchaku, confirm that the club employs a full-time or part-time qualified instructor and retain written evidence of their qualifications and accreditation (s 11(3), ss 11 definition of qualified instructor).

8. Quantity limits and permit conditions

• Check permit terms for limits on how many items the organisation is allowed to possess and do not exceed them (ss 10(5)(b), 11(5)(a), 12(2)(c)). If operational needs change, seek a permit variation prior to acquiring additional items.

9. Sale, disposal and transfer controls

• For crossbows and darts, observe the permit condition that restricts sale or disposal to persons who are members of approved archery clubs or are otherwise permitted to acquire (s 7(4), s 8(3)). Record sale or transfer attempts and confirmations of buyer permits.

10. Event and production compliance

• For militaria fairs, ensure premises are suitable and documented to satisfy the registrar’s consideration points: activity nature, types of prohibited items, safekeeping arrangements, and premises security (s 13(2)). For theatrical productions, confirm the staging society status, that the person issued is a performer or society member, and that any hired weapon is lent by a permitted person or an interstate resident lawfully possessing the item under that jurisdiction’s law (s 14(1)). Use only blank ammunition where the permit is granted (s 14(2)).

11. Suppressor-specific compliance

• For suppressors (s 12A) document the authorised purpose for each use and ensure the person is an authorised person (licensed under the Firearms Act 1996 and within the listed occupational categories). For conservation, veterinary or rural lease uses record the direction or authority that permits killing of fauna in specified contexts and retain evidence of the fauna classification (native, pest, stock) as these are defined terms (s 12A).

12. Monitor administrative instruments

• Track registrar guidelines, club approvals, training course approvals, and Ministerial declarations of approved suppliers and manufacturers, as these instruments materially affect permissible conduct (s 7(5), s 8(4), s 6, s 11). Disallowance or changes can alter market access and compliance requirements.

13. Plan for inspections and audits

• Maintain a compliance file to produce to inspectors or in the event of an enforcement inquiry: permits, licences, registers, training records, marking images, serial numbers, lease or ownership documents and written policies for secure storage.

14. Legal review and administrative review routes

• Understand the procedural rights under the parent Act and general administrative law for challenging a permit refusal or condition. Although this regulation does not set an appeal route, refusals and cancellations will be subject to administrative review mechanisms in the Act or judicial review via the courts.

15. Inter-jurisdictional coordination

• For hires or transfers from interstate jurisdictions, collect contemporaneous legal possession evidence from the out-of-jurisdiction supplier to satisfy s 14(1)(d)(ii). Be prepared to provide certified copies of interstate licences or permits.

By following these steps and retaining documentary and operational evidence, permit-holders and applicants can reduce compliance risk under the regulation. The crucial themes are early engagement with registrar guidelines, robust record-keeping, formalised training and marking processes, and active monitoring of administrative instruments that govern approvals and product supply.
