Professional Engineers Registration (General, Exemption and Assessment Scheme Fees) Regulations 2021

The Regulations rest on several organising concepts that convert the Act’s framework into administrative practice. These concepts are defined or produced by specific regulations and schedules.

1. Prescribed application material. For registration applications, the Regulations require “a report from an assessment entity about an applicant’s qualifications and experience that is relevant to each area of engineering for which the applicant has applied for registration” (Reg. 5). For endorsement applications, the prescribed information is material enabling assessment of probity under the Building Act 1993 (Reg. 6). The Regulations thus link the Act’s registration and endorsement gates to third‑party assessment entities and to building-sector probity checks.

2. Exemptions and staged inclusion. Reg. 7 establishes a general exemption for persons who are eligible for registration, operative from 1 July 2021, but with explicit exceptions. Persons registered as building practitioners under the Building Act 1993 before 1 July 2021 and people intending to provide professional engineering services in an area of engineering while engaged in the building industry are excluded from the main exemption (Reg. 7(1)-(2)). Critically, the exemption is removed, with effective dates, for persons not engaged in the building industry for particular fields: fire safety engineering (from 1 Dec 2021), structural and civil engineering (from 1 Oct 2022), electrical engineering (from 1 June 2023) and mechanical engineering (from 1 Dec 2023) (Reg. 7(3)). The Regulations therefore phase who must be registered and when.

3. Civil aviation safety job gate. For registration in civil aviation safety engineering involving approval of modification and repair designs, the Regulations require an in-force CASA appointment under reg 201.001 of the Civil Aviation Safety Regulations 1998 and the qualifications and experience required under that Commonwealth regulation (Reg. 8). That ties state registration to an existing Commonwealth qualification gate for a subset of aviation work.

4. Continuation during renewal and review. Reg. 9 creates an administrative rule for continuity: where renewal is applied for on or before expiry, the registration or endorsement continues in force until the Authority either renews, issues a refusal notice, or the applicant withdraws. If renewal is refused and the engineer applies to VCAT for review within the statutory review period, the registration or endorsement continues until VCAT determines (Reg. 9(1)-(3)). This provides operational continuity for practitioners who apply on time.

5. Delegation of CPD content to assessment schemes. Continuing professional development requirements for renewal are prescribed as “the continuing professional development requirements specified in an assessment scheme approved under section 40 of the Act” (Reg. 10). The substantive CPD obligations therefore come from approved assessment schemes, not from the Regulations themselves, making assessment schemes the locus of CPD content.

6. Register and publication rules. The Register must be electronic (Reg. 11). The Regulations also prescribe that the Register record whether the engineer is practising or non-practising (Reg. 10A) and that the published online information must include the registration number and whether the engineer is practising or non-practising (Reg. 10B).

7. Fees, refunds and monetary units. Fees for approval and renewal of assessment schemes are specified in fee units (320 fee units for approval and renewal; 87 fee units for variation) (Regs 15-17). The Explanatory details specify how fee units and penalty units translate to dollars for the 2021-22 financial year (fee unit $15.03; penalty unit $181.74) and set rounding rules.

8. Enforcement adjuncts. The Regulations provide a required form for embargo notices (Reg. 12; Schedule 1) and create a list of infringement offences with prescribed penalty units for specified sections of the Act (Reg. 13; Schedule 2). They also authorise electronic service to an address the engineer has consented to (Reg. 14).

Together these concepts create a modular administrative architecture. Assessment entities and approved assessment schemes become essential operational levers (Reg. 5, Reg. 10). Monetary levers are implemented via fee and penalty units (Regs 15-18; Explanatory details). Transitional policy is operationalised through explicit exemption dates and carve-outs (Reg. 7). Publication and electronic registration are mandatory elements that shape access to market information (Regs 10A-11). Each of these items produces specific compliance tasks and allocates decision-making discretion (for example, the Registrar’s refund discretion under Reg. 18).

The Regulations affect a defined but diverse set of actors. The principal affected categories, and the specific ways in which they are affected, are:

• Prospective and current professional engineers: The Regulations determine what documentation applicants must provide on registration and endorsement (Reg. 5-6), set CPD requirements by reference to approved assessment schemes (Reg. 10), and prescribe rules governing continuation of registration during renewal applications and review processes (Reg. 9). Engineers must also be aware of publication requirements: the Register will show the registration number and whether they are practising or non‑practising (Regs 10A-10B), and they must maintain an electronic address if they consent to electronic service (Reg. 14).

• Building practitioners and building‑industry engineers: Reg. 7 creates a special relationship between the new engineer registration regime and the Building Act 1993 status. Persons registered as building practitioners under the Building Act before 1 July 2021 are specifically excepted from the broad exemption, and any person intending to provide professional engineering services in an area of engineering while engaged in the building industry is not covered by the main exemption (Reg. 7(2)). Additionally, persons taken to be an endorsed building engineer under s 107(1) of the Act are exempt from CPD requirements for three years from first registration under the Act (Reg. 7(4)). This imposes different transitional obligations and potentially different compliance paths for engineers depending on their involvement in the building industry.

• Persons who are not engaged in the building industry but provide professional engineering services: The Regulations phase in the requirement to comply with the Act for non-building-industry practitioners in specified fields via dates in Reg. 7(3). From those dates, the exemption no longer applies and those practitioners will be directly subject to registration and associated duties.

• Assessment entities and entities proposing assessment schemes: The Regulations require assessment entity reports to accompany registration applications (Reg. 5). Entities seeking approval of assessment schemes under s 40 of the Act are subject to fees (320 fee units for approval and renewal; 87 fee units for variation) (Regs 15-17) and to the Registrar’s discretionary refund regime (Reg. 18). Thus, entities that design, run or seek approval for assessment schemes face direct fee costs and administrative interaction with the Registrar.

• The Business Licensing Authority (BLA) and the Registrar: The Regulations define procedural duties for the Registrar (for example refund discretion, Reg. 18), and they set mechanics that shape the Authority’s processing of renewals (Reg. 9). They also prescribe the form of embargo notices used by inspectors (Reg. 12; Schedule 1), which affects inspectors employed under the Act and the Authority’s enforcement function.

• Employers and contracting parties: The staged removal of exemptions for non-building-industry practitioners (Reg. 7(3)) and the continuation of registration during renewal when applications are timely (Reg. 9) are relevant to hiring, contracting and risk allocation. Organisations that engage engineers in the specified fields must track the dates at which statutory registration obligations bind those workers and ensure contractual compliance.

• The public and market participants: The electronic Register (Reg. 11) and the requirement to publish registration numbers and practising status online (Reg. 10B) create public-facing information that market participants, clients and competitors can use to verify registration status. That will affect market signalling and customer decision-making.

• Entities subject to embargoes and inspectors: Schedule 1 prescribes the embargo notice form (Form 1) and cross-references section 87 of the Act, which creates a criminal offence for dealing with embargoed items without written consent (Schedule 1, para 2, referencing s 87(2) and the penalty of up to 60 penalty units).

The Regulations therefore affect both individual and corporate actors across the engineering and building sectors, specialist assessors and assessment-scheme operators, public authorities (the BLA and Registrar), inspectors and those handling embargoed property. The staged temporal structure creates different compliance obligations by discipline and industry engagement, meaning that employers and engineers must map the dates in Reg. 7 to their practical activities. Fees and penalty units create direct monetary impacts on assessment-scheme applicants, registered engineers and potentially bodies corporate (noting a higher corporate infringement penalty for one offence in Schedule 2, item 8).

The Regulations impose specific duties on applicants, engineers and entities and confer certain rights and administrative protections. Below are the principal duties and rights created or clarified by the Regulations, phrased with the relevant regulatory citations.

Duties and procedural prescriptions

• Application content duty: An applicant for registration must ensure their application is accompanied by “a report from an assessment entity about an applicant’s qualifications and experience that is relevant to each area of engineering for which the applicant has applied for registration” (Reg. 5). This creates a documentary precondition to registration applications tied to third-party assessment entities.

• Endorsement content duty: An applicant for endorsement must provide information that enables probity assessment under ss 171D and 171E of the Building Act 1993 (Reg. 6). This creates an evidentiary duty linked to building-sector probity standards.

• CPD compliance duty by reference: Continuing professional development requirements for renewal are those specified in an assessment scheme approved under s 40 of the Act (Reg. 10). Practising engineers therefore must comply with assessment-scheme CPD requirements applicable to their registration.

• Record‑keeping and publication duties: The Register must be kept in electronic form (Reg. 11). The Registrar must record and publish specific matters: the registration number and whether the engineer is practising or non‑practising (Regs 10A-10B).

• Service and consent duty: Engineers who consent to electronic service must provide a functional electronic address and maintain it; the Regulations explicitly permit service by electronic communication to the electronic address the engineer has consented to (Reg. 14). This creates a duty to keep an available address for service if the engineer elects that mode.

• Embargo compliance duty: Persons who know that an embargo notice relates to a thing must not sell, lease, transfer, move, dispose of or otherwise deal with that thing without the written consent of the inspector who issued the embargo notice; Schedule 1 reproduces the statutory warning and references the offence in s 87(2) of the Act (Schedule 1, para 2).

• Fee payment duties: Entities seeking approval, renewal or variation of assessment schemes must pay the prescribed fees measured in fee units (Regs 15-17). Payment is a precondition to processing of such applications under the Act.

Rights and administrative protections

• Continuation of registration where renewal applied for on time: If a registered professional engineer applies for renewal of registration or endorsement on or before the date the registration or endorsement ends, the registration/endorsement continues in force until the Authority renews it, notifies refusal, or the applicant withdraws (Reg. 9(1)-(2)). This right of continuance ensures no immediate lapse where an on-time application is lodged.

• Continuation during review: Where the Authority refuses a renewal and the engineer timely applies to VCAT for review, the registration or endorsement continues until the tribunal determines the application (Reg. 9(3)(b)). If the engineer does not apply to VCAT, continuance ceases the day after the VCAT application period expires (Reg. 9(3)(a)). This protects practitioners seeking merits review from immediate deregistration during the review.

• Registrar’s discretionary refund right: An entity that has paid an assessment-scheme fee may apply to the Registrar for a refund in whole or in part, and the Registrar may grant a refund having regard to the entity’s circumstances and the progress of the application (Reg. 18(1)-(2)). This provides an administrative remedy to recover fees where appropriate, but it is non‑compellable and rests on Registrar discretion.

• Electronic publication and transparency rights: Members of the public have the right to access specified items on the Internet about registered engineers , the registration number and whether they are practising or non‑practising , as the Regulations require those matters to be published (Reg. 10B). This is an information-right for market participants.

Statutory penalties and infringement rules

• The Regulations specify a schedule of infringement offences and prescribed penalty units for particular sections of the Act (Reg. 13 and Schedule 2). These create monetary consequences for contraventions identified in the Act (Schedule 2 sets penalty units for offences against ss 17(3), 24, 67(1), 68(1)-(4), 80(3), 92(2) and 94). One item (Schedule 2, item 8) distinguishes between natural persons (12 penalty units) and bodies corporate (60 penalty units), giving a higher penalty for corporate actors.

Operational effects

• Because CPD obligations, assessments and endorsement probity are specified by reference to third-party assessment entities and assessment schemes, applicants and registered engineers are required to interact with those external bodies. The Register’s electronic and published nature means engineers cannot avoid public visibility of registration numbers and practising status. The staged exemption dates create time-dependent obligations for non-building-industry practitioners in specified fields.

The Regulations therefore create a web of documentary, procedural and monetary duties that link engineers, assessment entities, the Registrar and the Business Licensing Authority. They also create rights of continuity during renewal and review, and a discretionary refund route for assessment-scheme fees. All duties and rights are enacted by reference to the Act and are operationalised through the Regulations’ specific prescriptions (Regs 5-18; Schedule 1; Schedule 2).

The Regulations augment the Act’s enforcement architecture by prescribing infringement offences (Reg. 13; Schedule 2), by specifying the embargo notice form and cross-referencing the Act’s criminal embargo offence (Reg. 12; Schedule 1), and by enabling electronic service (Reg. 14), which affects how enforcement communications can be effected. The principal enforcement elements are:

• Infringement offences and amounts (Reg. 13; Schedule 2). Schedule 2 lists ten items. Each item ties an offence under a specified section of the Act to a penalty measured in penalty units:

  • Item 1: offence against s 17(3) of the Act , 2 penalty units.
  • Item 2: offence against s 24 of the Act , 2 penalty units.
  • Item 3: offence against s 67(1) of the Act , 12 penalty units.
  • Items 4-7: offences against s 68(1)-(4) respectively , each 12 penalty units.
  • Item 8: offence against s 80(3) , 12 penalty units for a natural person; 60 penalty units for a body corporate.
  • Item 9: offence against s 92(2) , 12 penalty units.
  • Item 10: offence against s 94 , 12 penalty units.

  (Reg. 13(1)-(2); Schedule 2.)

The Regulations do not reproduce the substance of the referenced sections of the Act. To understand conduct captured by each infringement item a reader must cross‑reference the Act’s sections. The Regulations, however, set the monetary exposure for each such infringement.

• Monetary translation to dollars and rounding rules (Explanatory details). The Regulations use fee units and penalty units. The Explanatory details set the value of a fee unit for the financial year commencing 1 July 2021 at $15.03 and the penalty unit at $181.74. The calculated fee may be rounded to the nearest 10 cents and penalties to the nearest dollar (Explanatory details). Using those figures, the monetary equivalents for the prescribed penalties in the 2021-22 financial year are approximately:

  • 2 penalty units: 2 × $181.74 = $363.48 → rounded to $363 (nearest dollar).
  • 12 penalty units: 12 × $181.74 = $2,180.88 → rounded to $2,181.
  • 60 penalty units: 60 × $181.74 = $10,904.40 → rounded to $10,904.

The Regulations require these conversions to be performed in accordance with the Monetary Units Act 2004 (Explanatory details).

• Embargo offence and procedure. Schedule 1 sets the form of the embargo notice (Form 1) under Reg. 12, and paragraph 2 of that form reproduces the Act’s offence in s 87(2): a person who knows an embargo notice relates to a thing and who, without the written consent of the inspector, sells, leases, transfers, moves, disposes of or otherwise deals with the thing is guilty of an offence and liable to a penalty not exceeding 60 penalty units (Schedule 1, para 2, cross-referencing s 87). The Regulations therefore prescribe the format and content of embargo notices to be used by inspectors.

• Service mechanics and enforcement communication. Reg. 14 prescribes that service of documents for the purposes of s 100(d) of the Act may be by electronic communication to an electronic address the engineer has consented to. The Regulation lists examples of electronic addresses (email, secure internet site, facsimile number or mobile phone number). This allows enforcement notices and other administrative decisions to be served electronically where an engineer has consented, which can affect notice periods and the speed of enforcement actions.

• Registrar discretion on refunds and its enforcement implications. Reg. 18 gives the Registrar discretion to refund fees paid for assessment-scheme applications. Since payment of fees is a precondition for processing under the Act, the Registrar’s discretion shapes the practical enforcement of fee requirements (Reg. 18(1)-(2)).

Operational and compliance consequences

• The set of infringement penalties is concentrated around particular sections of the Act. Because the Regulations do not define the substantive content of the referenced sections, compliance teams must map the schedule to the Act to assess exposure. The greater corporate penalty under Schedule 2 item 8 indicates that corporate actors face materially higher monetary risk for one particular statutory contravention.

• The embargo provisions create a separate criminal exposure (up to 60 penalty units) for dealing with embargoed property without inspector consent. The required embargo notice form in Schedule 1 ensures uniform recording of embargoes, which supports enforceability.

• Electronic service as prescribed may speed up enforcement and reduce transactional costs for authorities, but it requires practitioners to manage and maintain reliable electronic addresses and to be aware of the legal consequences of consenting to electronic service.

• The conversion of units to dollars is subject to the Treasurer’s annual setting of fee and penalty unit values; monetary exposure thus varies by financial year (Explanatory details). Compliance and risk functions should therefore monitor published fee/penalty-unit values for each year.

In short, the Regulations set specific monetary sanctions for defined Act offences, prescribe notice and process forms relevant to enforcement, and enable electronic service to facilitate administrative enforcement. The precise operational exposure of regulated persons depends on the substance of the referenced Act provisions and on the annual values of penalty units as fixed by the Treasurer.

The Regulations are expressly designed to fit within and interact with a number of other statutes and instruments. The principal interactions set out in the text are as follows.

• Interaction with the Professional Engineers Registration Act 2019 (the Act). The Regulations are made under s 103 of the Act (Reg. 2) and repeatedly operate “for the purposes of” specified sections of the Act (see Regs 5-6, 8-11, 12-14, 15-18). They prescribe information required under sections 10 and 11 (application content), define exemptions for s 12, specify qualification criteria for s 12(2)(a) (civil aviation safety), prescribe renewal continuation under s 20, set CPD requirements for s 20(4), specify Register content under s 28 and s 29, prescribe the form of embargo notices under s 87(1), designate infringement offences under s 96, and set a manner for service for s 100(d). Consequently, the Regulations operationalise many delegations in the Act and are functionally inseparable from its administration.

• Interaction with the Building Act 1993. The Regulations tie endorsement probity checks to ss 171D and 171E of the Building Act 1993 (Reg. 6). They also carve out building practitioners registered under the Building Act from the general exemption and provide a transitional CPD exemption for persons taken to be endorsed building engineers under s 107(1) of the Act (Reg. 7(2), Reg. 7(4)). These provisions create cross‑referencing between the engineer registration regime and the building practitioner regime, aligning probity and transitional treatment for those operating in the building industry.

• Interaction with Commonwealth aviation regulation. For the civil aviation safety engineering area that involves design approval, the Regulations require an appointment by CASA under regulation 201.001 of the Civil Aviation Safety Regulations 1998 of the Commonwealth and the qualifications required under that regulation (Reg. 8). That cross-reference links state registration to an existing Commonwealth appointment and qualifications framework, effectively requiring state-registered civil aviation safety engineers in the specified sub‑area to satisfy the Commonwealth gate.

• Interaction with the Monetary Units Act 2004 and Sentencing Act 1991. The Regulations specify fees and penalties in fee units and penalty units (Regs 15-17; Schedule 2). The Explanatory details explain that fee and penalty amounts are calculated in accordance with s 7 of the Monetary Units Act 2004 and that penalty units are within the meaning of s 110 of the Sentencing Act 1991. The Treasurer sets fee and penalty unit values annually (Explanatory details). This ensures the Regulations adopt Victoria’s monetary unit framework and that monetary amounts can be updated without amendment of these Regulations.

• Interaction with the Business Licensing Authority Act 1998 and tribunal review processes. The Regulations refer to the Registrar of the Authority employed under s 15 of the Business Licensing Authority Act 1998 (Reg. 4 definition of Registrar) and provide for continuation of registration during renewal and review by the Business Licensing Authority and VCAT under s 27(2) of the Act (Reg. 9). Thus, the Regulations insert administrative mechanics into the Authority’s licensing and review ecosystem and specify how those processes preserve registration status during administrative and merits review.

• Interaction with the Subordinate Legislation Act 1994. The Endnotes state that the Regulations will sunset 10 years after making under s 5 of the Subordinate Legislation Act 1994, creating a statutory expiry date (Endnotes).

Practical implications of these interactions

• The Regulations generate cross‑system dependencies. For example, endorsement processes now require evidence satisfying building-sector probity checks under the Building Act; civil aviation safety engineering registration depends on a CASA appointment under Commonwealth regulations. Practitioners and regulators must therefore coordinate across regimes when assessing qualifications or probity.

• Financial exposure and administrative costs are linked to state-wide monetary unit settings (Monetary Units Act 2004), meaning those costs can change annually without statutory amendment of the Regulations themselves.

• The continuation-of-registration rules interact with tribunal review rights under the Act and VCAT timeframes, producing practical protections for applicants who timely seek renewals or reviews.

In summary, the Regulations do not operate in isolation. They deliberately cross‑reference and integrate with Commonwealth aviation regulation, the Building Act, the Monetary Units Act and the Business Licensing Authority Act, embedding the engineer registration regime within a broader legal fabric. Users must cross‑check these other instruments to understand full compliance obligations.

This version of the Regulations incorporates amendments up to 31 August 2021 (Version No. 003). The Regulations were originally made on 9 February 2021; most provisions (Regs 1-4 and 15-18) commenced on that date, while Part 2 (Regs 5-14) commenced on 1 July 2021 (Reg. 3; Endnotes). The Endnotes record statutory rule amendments and the table of amendments identifies the Professional Engineers Registration (General, Exemption and Assessment Scheme Fees) Amendment Regulations 2021, S.R. No. 106/2021, as an amendment instrument with date of making 31 August 2021 and date of commencement 31 August 2021 (Endnotes, Table of Amendments).

The amendment S.R. No. 106/2021 inserted and adjusted multiple items in the Regulations, as shown by the notes in Reg. 1(a) and the insertion of Regs 10A and 10B. Specifically:

• Reg. 1(a)(via) and Reg. 1(a)(vib) were inserted by S.R. No. 106/2021 reg. 3 to add the recording of information in the Register and the publishing of information on the Internet for registered professional engineers (Reg. 1 notes).

• Reg. 10A was inserted by S.R. No. 106/2021 reg. 4 to prescribe registration type matters for s 28(3)(k) of the Act (Reg. 10A).

• Reg. 10B was inserted by S.R. No. 106/2021 reg. 4 to prescribe the information to be published online for each registered professional engineer, specifically the registration number and whether the engineer is practising or non‑practising (Reg. 10B).

The Endnotes also record that this version does not contain amendments that are not yet in operation (Endnotes, section 3). The Regulations are subject to the Subordinate Legislation Act 1994 sunset provision and will expire automatically ten years after making, on 9 February 2031, absent further legislative action (Endnotes).

Practical reading of amendment history

• The 31 August 2021 amendment primarily added provisions concerning the Register and online publication (Regs 10A-10B). These are administrative but materially change the public disclosure obligations for registered engineers.

• The staged commencement dates reflect implementation sequencing: the initial Regulations established fees and other procedural matters early (9 February 2021), with the substantive transitional provisions and application requirements deferred to 1 July 2021 to allow a transitional window (Reg. 3).

• Because fee and penalty amounts are linked to fee/penalty unit values set annually by the Treasurer under the Monetary Units Act 2004, future monetary effects can change without further amendments to these Regulations; however, the structural allocations of duties, exemptions and publication rules are fixed until amended or sunset.

No other amendment instruments are recorded in the text provided. Practitioners relying on these Regulations should monitor the Victorian Government Gazette for any subsequent statutory rule changes and the Treasurer’s annual announcements of fee and penalty unit values.

The text of the Regulations does not record any litigation or judicial decisions concerning these Regulations. The Endnotes and Table of Amendments note instrument provenance and amendments but do not cite any VCAT or court decisions interpreting the Regulations. As made subordinate legislation, many of the Regulations’ effects , for example, the scope of the exemptions in Reg. 7 or the Registrar’s exercise of refund discretion in Reg. 18 , are likely to generate administrative decisions that could be the subject of merits review under the Act and judicial review in the courts, but the Regulations record none. The continuation-of-registration rules themselves reference VCAT review in the Act (Reg. 9(3)(b) refers to s 27(2) of the Act and VCAT review), indicating that tribunals are the natural forum for disputes about renewal refusals and continuance, but no cases are cited.

Practical implications from the absence of litigation history

• Because the Regulations are relatively new and the Part 2 provisions only commenced on 1 July 2021, there may be limited time for litigation to have matured to reportable decisions at the time of these incorporated amendments (the version is current as at 31 August 2021). Stakeholders should expect that novel disputes , for example, about the sufficiency of an assessment entity’s report under Reg. 5 or the Registrar’s reasons for refusing a refund under Reg. 18 , would initially be resolved through administrative channels or by VCAT on merits review before appellate courts.

• The Regulations themselves reference administrative review mechanisms under the Act (Reg. 9 and the Act’s s 27(2) and VCAT processes), which suggests a predictable administrative law pathway for challenges. Practitioners should therefore structure evidence and applications with this review path in mind.

• The lack of litigation to date means that interpretation issues (for example, the scope of “engaged in the building industry” in Reg. 7(2) or the application of CPD rules arising from assessment schemes under Reg. 10) remain matters of statutory construction and practical administration. Regulatory risk remains but is, as yet, untested in reported decisions.

Given the absence of a litigation record in the source, interested parties should monitor VCAT and court lists for any developing jurisprudence on how the Act and these Regulations are applied, particularly in relation to the Registrar’s discretionary powers, the interplay with the Building Act and the enforcement provisions in Schedule 2.

The Regulations contain specific traps and non-obvious effects that practitioners and compliance officers should note. The following are concrete “gotchas” grounded in the regulatory text:

1. Exemption is not universal and is time-limited by discipline. Reg. 7 creates a general exemption from the operation of the Act for persons who are eligible for registration from 1 July 2021. However, Reg. 7(3) stages the removal of the exemption for non-building-industry practitioners in specified fields with precise effective dates (fire safety 1 Dec 2021; structural and civil 1 Oct 2022; electrical 1 June 2023; mechanical 1 Dec 2023). A practitioner who assumes the exemption is permanent risks non-compliance when their discipline’s date arrives. Employers must map these dates against their workforce and contracting chains.

2. Building practitioners and building‑industry engagement are treated differently. Reg. 7(2) excludes persons registered as building practitioners under the Building Act 1993 before 1 July 2021, and also excludes those intending to provide professional engineering services while engaged in the building industry. The phrase “intends to provide professional engineering services in an area of engineering while engaged in the building industry” is fact-sensitive; contractual arrangements that blur “engaged in the building industry” versus not may change regulatory obligations. No gloss on “engaged” is provided in the Regulations , cross-refer to the Building Act and the Act for clarifying definitions.

3. CPD obligations are not spelled out in the Regulations. Reg. 10 prescribes CPD requirements by reference to approved assessment schemes. That means the substantive CPD hours, topics, record-keeping and audit mechanisms will be in externally approved assessment schemes, not in these Regulations. Lawyers and HR professionals must review applicable assessment schemes to determine actual CPD workloads; the Regulations only show where to find the substantive requirements.

4. Application for registration requires an assessment-entity report. Reg. 5 makes an assessment entity’s report a required annex to registration applications. Applicants who cannot secure such a report, or whose assessment entities operate slowly or charge substantial fees, may face practical barriers to registration. The Regulations do not set the cost of such reports; the market will determine it.

5. Fees for assessment scheme approval are significant and denominated in fee units. Regs 15-17 fix fees at 320 fee units (approval and renewal) and 87 fee units (variation). Using the fee-unit value for 2021-22 noted in the Explanatory details ($15.03), a 320 fee-unit amount equates to about $4,810. The Regulations note rounding rules. Entities seeking to operate assessment schemes should budget for these fees and for the Registrar’s discretionary handling of refunds (Reg. 18).

6. Refunds are discretionary and conditioned on “circumstances” and “progress”. Reg. 18 allows the Registrar to refund fees in whole or in part if the Registrar “considers that it is appropriate, having regard to the circumstances of the entity and the progress of the entity’s application”. The absence of a precise test gives the Registrar wide latitude; applicants may face financial uncertainty where approval is denied or delayed.

7. Continuation of registration on renewal applications can persist even after a refusal until VCAT determination. Reg. 9(3)(b) provides that registrations or endorsements continue in force if the engineer applies to VCAT within the period specified in s 27(2) of the Act, until VCAT determines. This benefits practitioners seeking merits review, but employers need to know that a refusal is not immediately effective if review is lodged on time.

8. Electronic service requires consent and maintenance of an address. Reg. 14 prescribes electronic service to an electronic address the engineer has consented to. If engineers fail to keep that address active, they may miss critical notices. The Regulation lists examples of acceptable electronic addresses; practitioners must manage those contact points.

9. Publication of registration number and practising status is mandatory. Reg. 10B requires that the registration number and whether the engineer is practising or non‑practising be published on the Internet. Practitioners with privacy concerns should be aware that this is a regulatory requirement and not discretionary.

10. Higher corporate penalty for one offence. Schedule 2 item 8 sets a penalty for an offence against s 80(3) of 12 penalty units for a natural person but 60 penalty units for a body corporate. Corporates face higher exposure for that specific statutory contravention.

11. Embargo penalties and inspector formality. The embargo notice in Schedule 1 reproduces the statutory offence cross-referent to s 87(2) of the Act and warns that dealing with embargoed items without written inspector consent may attract a penalty not exceeding 60 penalty units. Organisations handling property subject to embargo must ensure chain-of-custody and inspector approvals are strictly followed.

12. Fee and penalty amounts change annually. The Regulations rely on the Treasurer’s annual determination of fee and penalty unit values under the Monetary Units Act 2004 and Sentencing Act 1991 (Explanatory details). Monetary exposures can therefore change each financial year without statutory amendment. Compliance teams should monitor the Government Gazette for the annual fee/penalty unit publications.

Each of the foregoing is concrete, evidenced in the Regulations and their Explanatory details. They represent common operational pitfalls: transitional timing mismatches, delegation of substantive content to external instruments, discretionary refund risks, and electronic-service and publication consequences that change information flows and privacy exposure.

This section sets out practical, source‑grounded steps to achieve compliance with the Regulations. The steps are organised by actor and by task, with references to the relevant regulation numbers and the Explanatory details where monetary computation is required.

For prospective and current registered engineers

1. Prepare application materials with an assessment-entity report. If you are applying for registration, ensure your application includes a report from an assessment entity about your qualifications and experience relevant to each area of engineering you seek (Reg. 5). Identify approved or market‑available assessment entities early, understand their evidentiary requirements, timelines and fees, and factor these into application planning.

2. For endorsement applicants, assemble probity information. If applying for an endorsement, provide information enabling assessment under ss 171D and 171E of the Building Act 1993 (Reg. 6). Consult the Building Act and any relevant guidance from the assessment body or Authority to compile required probity documents.

3. Track exemption and phase-in dates. Map the discipline you practise to the dates in Reg. 7(3). If you are not engaged in the building industry and practise one of the listed fields (fire safety, structural/civil, electrical, mechanical), prepare for the removal of the exemption on the relevant date. If you are a building practitioner, confirm your status under the Building Act 1993 to determine whether Reg. 7(2) applies.

4. Maintain continuity when renewing. Apply for renewal on or before the last day of your registration/endorsement period to benefit from automatic continuation until the Authority decides, until you withdraw, or until VCAT determines a review if one is lodged (Reg. 9(1)-(3)). If renewal is refused and you intend to seek review, lodge an application to VCAT within the period specified in s 27(2) of the Act to preserve continuation during the review (Reg. 9(3)(b)).

5. Meet CPD requirements as set out in the applicable assessment scheme. Identify which approved assessment scheme applies to your registration and comply with the CPD requirements specified there (Reg. 10). Keep records in the format required by the assessment scheme to support future audits.

6. Consent to electronic service only with safeguards. If you consent to electronic service, provide a reliable electronic address and keep it current (Reg. 14). Consider whether a secure email address or a dedicated administrative contact is appropriate and maintain evidence of consent and receipt.

7. Expect public publication of registration number and status. Be aware the Register will be electronic and will publish your registration number and whether you are practising or non‑practising (Regs 10A-11 and 10B). If accuracy in published details is important, monitor the Register and request corrections promptly through the Authority.

For assessment-scheme applicants and assessment entities

1. Budget for fees and understand fee-unit mechanics. The prescribed fee for application for approval or renewal of an assessment scheme is 320 fee units (Reg. 15), and the fee for variation is 87 fee units (Reg. 17). Using the fee unit value for 2021-22 ($15.03) gives an approximate dollar amount (Reg. 15-17 and Explanatory details). Confirm the current fee unit value each financial year before applying.

2. Apply early and document progress to preserve refundability. If you seek a refund under Reg. 18, the Registrar will consider “the circumstances of the entity” and “the progress of the entity’s application” in exercising discretion. Keep comprehensive records demonstrating the stage of your application and the reasons a refund would be appropriate. Understand that refunds are discretionary, not automatic.

3. Prepare CPD design and audit processes. Since CPD requirements are contained in approved assessment schemes (Reg. 10), ensure your scheme clearly sets CPD standards, monitoring, record‑keeping and audit mechanisms that are practicable for engineers and defensible to the Registrar when seeking approval.

For employers and contracting bodies

1. Audit workforce against phased dates and registration status. Identify which employees or contractors are subject to the staged removal of the exemption (Reg. 7(3)) and ensure they are registered where required. For building projects or contracts, check whether your engineers are caught by the building-industry carve-out (Reg. 7(2)).

2. Incorporate registration and renewal clauses in contracts. Given that registrations continue during timely renewal and during VCAT review (Reg. 9), include clauses that require practitioners to maintain registration and to notify parties promptly of renewal applications or adverse decisions, and specify steps to take if registration lapses.

3. Monitor published Register entries. Use the public Register information (Reg. 10B) to verify registration numbers and practising status of engineers you engage. Ensure contractual indemnities and professional indemnity insurance reflect registration risks.

For inspectors and enforcement officers

1. Use the embargo notice form exactly as prescribed. Reg. 12 requires the embargo notice to be in Form 1 in Schedule 1. Ensure embargo notices contain the particulars listed, are served or affixed as the form allows, and document inspector consent for any movement of embargoed items to avoid exposure to the s 87(2) offence referenced in Schedule 1.

2. Understand penalty structures and corporate exposure. Schedule 2 sets specific penalty units for identified Act offences. Note the higher corporate penalty for s 80(3) contraventions (Schedule 2, item 8) and ensure enforcement decisions consider corporate status where relevant.

General administrative steps

1. Monitor fee and penalty unit values annually. The Explanatory details explain that fee and penalty unit values for each financial year are set by the Treasurer and published in the Government Gazette (Explanatory details). Compliance programmes must refresh monetary calculations each year.

2. Keep records of consent, service and publication. Maintain contemporaneous records of any consent to electronic service, any electronic communications served to an engineer, and communications about published Register content. These records will be important in disputes about receipt or listing accuracy.

3. Cross‑reference the Act and other relevant statutes. Because many provisions in the Regulations operate “for the purposes of” sections of the Act and reference the Building Act and Commonwealth aviation regulations (Regs 5-8), compliance requires reading the Regulations together with those statutes and with any approved assessment schemes.

The practical steps above flow directly from the text of the Regulations and their Explanatory details. They aim to translate the Regulations’ prescriptions into operational checklists for applicants, registered engineers, assessment entities, employers and enforcement officers.
