58 Providing professional engineering service without registration (1) A person commits an offence if the person— (a) carries out a professional engineering service other than under the direction and oversight of a professional engineer who is responsible for the service; and (b) is not registered to carry out the professional engineering service; and (c) is reckless about whether the person is registered to carry out the professional engineering service. Maximum penalty: 100 penalty units. (2) A person commits an offence if the person— (a) carries out a professional engineering service other than under the direction and oversight of a professional engineer who is responsible for the service; and (b) is not registered to carry out the professional engineering service. Maximum penalty: 50 penalty units. (3) An offence against subsection (2) is a strict liability offence.
