46 Appeals against financial assurance conditions

46 Appeals against financial assurance conditions

(1) If a financial assurance condition is imposed on an approved action plan, the brand owner or product stewardship organisation subject to the plan may appeal to the Court against the condition.

(2) The brand owner or product stewardship organisation must lodge an appeal within 21 days, or another period prescribed by the regulations, after being notified of the condition.

(3) The lodging of an appeal does not, except to the extent the Court otherwise directs in relation to the appeal, operate to stay the condition appealed against.

(4) In this section—

financial assurance condition means a condition imposed on an approved action plan under section 29.
