36 Suspending exemptions

Suspending exemptions (1) The Secretary may, by notice in writing published on the Department’s website, suspend an exemption, in whole or in part, if the Secretary reasonably suspects that: (a) the product or products to which the exemption relates will not be used or otherwise dealt with as mentioned in the exemption category nominated in the application for the exemption; or (b) a condition to which the exemption is subject has not been complied with. (2) The suspension takes effect on the day specified in the notice. (3) To avoid doubt, an exemption is not in force to the extent it is suspended. Ending suspensions (4) The Secretary may, by notice in writing published on the Department’s website, end a suspension of the exemption, in whole or in part. (5) The ending of the suspension takes effect on the day specified in the notice.
