32 Granting exemptions

(1) After receiving, in accordance with section 29, an application for an exemption from a provision of Part 3 or 4 of the Act, the Secretary may: (a) if the Secretary is reasonably satisfied that the condition mentioned in subsection (2) of this section is satisfied—grant the exemption by notice in writing published on the Department’s website; or (b) otherwise—refuse the application, by notice in writing given to the applicant. (2) For the purposes of paragraph (1)(a), the condition is that the product or products to which the application relates will be used or otherwise dealt with as mentioned in the exemption category nominated in the application. (3) An exemption comes into force on the day specified by the Secretary in the exemption. (4) An exemption may be, but is not required to be, expressed to remain in force until a specified date or during a specified period.
