What this instrument does (mechanically)

This document is a commencement proclamation. It brings the Public Health Amendment (Prohibited Tobacco and Other Products) Act 2026 into operation from 22 July 2026 (that is, it sets the date on which the amendment law starts to have legal effect).
The proclamation itself does not set new offences, penalties or regulatory rules; it simply turns on the amendment Act (and any parts of it specified) so those substantive provisions now apply in Tasmania. To see the actual rules you must read the Amendment Act and any regulations made under it.

Who is affected

Businesses in the tobacco supply chain: manufacturers, importers, wholesalers and retailers who sell tobacco or related products. These actors will face any new prohibitions, packaging or sale rules the amendment introduces.
Consumers of tobacco and products captured by the amendment: availability, purchase options and legal risks may change once the amendment is in force.
Government agencies and officers: health regulators, police, customs and enforcement agencies that must apply, monitor and enforce the new law.
Small businesses and community outlets that sell tobacco: they will need to adjust practices, stock and compliance systems to the new legal requirements.

Why it matters

The official purpose of the amendment (as stated in its title and explanatory material) is to prohibit certain tobacco and other products to protect public health. By commencing the amendment, the proclamation activates those prohibitions and the compliance regime that goes with them.
