Proclamation - Nelson Marine Park

Commonwealth reserve is the central legal instrument. Under the EPBC Act, a Commonwealth reserve is an area of land or sea (or both) that the Commonwealth owns or over which it has jurisdiction, declared by the Governor-General for the conservation of biodiversity. The Proclamation here deals only with a marine area, not land. The reserve includes the seabed to a depth of 100 metres as a separate inclusion, so areas deeper than 100 metres are not part of the reserve. That depth limit may be significant for offshore activities such as mining or cable laying that occur on the seabed; only the shallower portion is reserved.

IUCN category VI - Managed Resource Protected Area - is one of the six International Union for Conservation of Nature categories. Category VI is intended for areas where conservation is integrated with sustainable use of natural resources. Unlike a strict nature reserve (category Ia) where human access is severely limited, category VI contemplates ongoing extractive uses such as fishing, tourism, and possibly oil and gas extraction, provided they are managed to maintain biodiversity. The Proclamation does not itself define what uses are allowed; that is determined by the EPBC Act and any management plan. The selection of category VI here suggests that the reserve is not intended to be a fully no-take zone, though the Act may still impose prohibitions on certain high-impact activities.

National Representative System of Marine Protected Areas is the policy framework under which the reserve was declared. It aims to establish a comprehensive, adequate and representative system of marine protected areas across Australia's Exclusive Economic Zone. The Proclamation explicitly states that purpose, so the reserve is part of a larger network. This matters for legal interpretation because courts may consider the systemic purpose when resolving disputes about management decisions.

Coordinates and geodesic boundaries are technical but critical. The area is defined by five vertices using latitude and longitude on GDA94. The boundary follows parallels of latitude and meridians of longitude except for the final leg, which follows a geodesic line (the shortest path on the ellipsoid). The reference to GDA94 is essential for precise mapping; GPS receivers using WGS84 will be very close, but official positions should be converted. The boundary also relies on the “adjacent area” boundary between South Australia and Victoria as defined under the Petroleum (Submerged Lands) Act 1967, frozen at the time of the Coastal Waters Acts. This creates a jurisdictional interface between Commonwealth waters and state coastal waters.

The Proclamation directly affects any person or entity that conducts activities within the defined boundary. The primary groups include:

Commercial fishers - the area is part of the Southern Ocean fishery grounds. The reserve’s IUCN category VI may allow some fishing, but the EPBC Act imposes restrictions. For example, fishing with gear that damages the seabed or takes protected species may be prohibited or require a permit. Fishers operating near the SA-Victoria border will need to check whether their access point falls within the reserve or in state waters.

Recreational fishers and boaters - while general navigation may be allowed, any fishing or collecting of marine organisms is subject to reserve rules. The Proclamation does not expressly prohibit recreational fishing, but the EPBC Act’s default provisions for Commonwealth reserves may restrict it unless a management plan allows otherwise. Persons traversing the area must be aware that they are entering a regulated zone.

Oil and gas exploration and production companies - the area may overlie potential hydrocarbon deposits. Under the EPBC Act, mining operations (including petroleum extraction) are prohibited in Commonwealth reserves unless specifically exempted by regulations. The Proclamation does not create an exemption; indeed, assignment to category VI does not override the automatic prohibition under s 354 of the EPBC Act. Companies holding petroleum titles in the adjacent area need to assess whether their existing rights have been affected. The adjacent area boundary description ties back to the Petroleum (Submerged Lands) Act, which may create grandfathering issues.

Shipping and maritime industries - the reserve designation does not automatically close the area to shipping. However, activities such as anchoring, seabed disturbance, or discharge of waste that damage the reserve’s values may be offences. The Australian Maritime Safety Authority and vessel operators must coordinate with the reserve management.

Scientific researchers - research within the reserve will require a permit under the EPBC Act, especially if it involves collecting specimens, deploying equipment, or disturbing the seabed. The IUCN category VI suggests that some research activity is contemplated, but consent from the Director of National Parks is likely needed.

State governments of South Australia and Victoria - the boundary line between the states and the Commonwealth is referenced in the schedule. The reserve sits in Commonwealth waters adjacent to the state boundary. State laws (fisheries, ports, coastal management) continue to apply in state waters, but the reserve may alter the practical extent of state jurisdiction. Coordination between Commonwealth and state agencies is essential, especially for management plans.

Aboriginal and Torres Strait Islander peoples - the Proclamation does not mention indigenous rights, but the area is within traditional sea country for some groups. Native title rights and interests, if they exist, may be affected. The EPBC Act includes provisions for indigenous co-management, but the Proclamation is silent on this.

Tourism operators - dive tours, whale watching, and charter operations must comply with reserve rules. Category VI may permit tourism, but operators should expect conditions on anchoring, noise, and proximity to sensitive habitats.

The Proclamation itself does not create specific duties or confer specific rights. Those arise from the EPBC Act and any management plan made under it. However, the act of declaration triggers several important legal effects.

Duties under the EPBC Act:

• A person must not carry out a mining operation in a Commonwealth reserve (s 354). This prohibition is absolute and applies to the Nelson Marine Park unless an exemption is granted by regulation. Mining includes exploration and extraction of minerals and petroleum.
• Activities that are likely to have a significant impact on the environment of the reserve may require approval under the EPBC Act if they are not already prohibited. This includes actions such as constructing artificial structures, dumping waste, or conducting large-scale research.
• The person must comply with any management plan in force for the reserve. Although the Proclamation does not refer to a specific plan, the EPBC Act requires the Director of National Parks to prepare a management plan for each Commonwealth reserve. Once a plan is made, it has the force of law and may impose additional prohibitions or permit requirements.
• A person must not kill, injure, take, trade, keep, or move a member of a listed threatened species or ecological community, or damage critical habitat, within the reserve. These are separate offences under Pt 13 of the Act, but the reserve declaration does not alter them.

Rights under the EPBC Act:

• The public generally has a right of access to a Commonwealth reserve, subject to the Act and any management plan. The Proclamation does not exclude any category of persons; it merely designates the area.
• A person may apply for a permit to conduct a prohibited activity if the management plan allows it. For example, a permit may be issued for scientific research, traditional use, or limited commercial harvesting.
• Existing lawful uses may be able to continue under transitional provisions. The EPBC Act includes provisions for existing rights, such as valid petroleum titles or fishing concessions, but the Proclamation does not address this. Any such rights would be determined under the Act itself.

Rights of the Commonwealth:

• The Commonwealth acquires the power to regulate activities in the reserve, including the ability to exclude persons, impose conditions on entry, and enforce penalties.
• The Director of National Parks has a duty to manage the reserve in accordance with its IUCN category and the objects of the EPBC Act. That duty includes preparing management plans, monitoring compliance, and responding to threats.

The Proclamation does not prescribe any penalties. Enforcement authority flows from the EPBC Act. The Act creates a range of criminal and civil penalties for offences involving Commonwealth reserves.

Criminal penalties: For a person who contravenes a provision of Pt 15 of the EPBC Act (e.g., mining without authorisation, damaging a listed heritage feature, or failing to comply with a management plan), the maximum penalty can be severe. For example, an offence of carrying out a mining operation in a Commonwealth reserve is punishable by up to 7 years imprisonment, or a fine up to 420 penalty units for an individual, or more for a body corporate. The Proclamation itself does not specify these amounts, but the Act as at the compilation date (2017) would have penalties in the range of hundreds of thousands of dollars plus imprisonment for serious violations.

Civil penalties: The EPBC Act also provides for civil penalty orders, where a court can impose a fine (up to 1,000 penalty units for an individual, five times that for corporations) for each contravention. Civil penalty proceedings do not require proof of criminal intent and are easier for the regulator to enforce.

Enforcement mechanisms: The Director of National Parks, the Department of the Environment and Energy (now DCCEEW), and the Australian Federal Police can investigate breaches. The Act grants inspectors powers to enter, board vessels, search, and seize evidence. For marine reserves, the Australian Maritime Border Command and the Australian Fisheries Management Authority also play roles. Enforcement can be proactive through patrols or reactive after complaints.

Remediation orders: A court may order a person to take specified action to remedy the harm caused by an offence, for example, restoring the seabed or removing debris. Failure to comply can lead to further penalties.

Strict liability: Some provisions in the EPBC Act apply strict liability for certain elements of an offence, such as entering a prohibited zone. This means the person does not need to intend to break the law; merely being present in a restricted area without an exemption can be an offence. The Proclamation does not create any specific strict liability zones (no zoning is mentioned), but the default provisions of the Act may still apply.

Practical consequences: The penalties are high enough to deter non-compliance, but enforcement in a remote marine area is costly. The likelihood of detection may be low, so the deterrent effect depends on visibility and reporting. The Proclamation alone does not change enforcement resources; it is just one of many reserves in the marine park network.

EPBC Act: This is the primary interaction. The Proclamation is made under s 344(1) and triggers the operation of Pt 15 of the Act. That Part prevails over inconsistent Commonwealth laws, and over state laws to the extent of any inconsistency if the Commonwealth has jurisdiction. The Act also provides for cooperative management with states, but no specific cooperative arrangement is mentioned.

Petroleum (Submerged Lands) Act 1967: The Proclamation explicitly references the adjacent area boundaries as defined in Schedule 2 to that Act, as it stood before the 1980 Coastal Waters Acts. This means that the boundary of the reserve aligns with the historical boundary between Commonwealth and state offshore petroleum jurisdictions. The interaction is purely definitional: the reserve boundary uses that line as a reference. However, the Petroleum (Submerged Lands) Act itself regulates oil and gas activities in Commonwealth waters. Those activities are now also subject to the Offshore Petroleum and Greenhouse Gas Storage Act 2006, which post-dates the 1980 reference. The reference to the 1967 Act is likely a drafting convention to fix the boundary at a particular date.

Coastal Waters (State Powers) Act 1980 and Coastal Waters (Northern Territory Powers) Act 1980: These Acts ceded certain coastal jurisdiction to the states and Northern Territory. The Proclamation’s definition of “adjacent area” is frozen before those Acts commenced, so the reserve boundary does not extend into state coastal waters. This avoids overlap with state marine parks or fisheries laws.

Fisheries legislation: The reserve may affect fishing operations under the Fisheries Management Act 1991 (Commonwealth) and the South Australian and Victorian Fisheries Acts. For example, a fishing concession granted under Commonwealth law may be exercised in the reserve unless the EPBC Act or a management plan restricts it. The interaction is often managed through memoranda of understanding or by integrating management plans with fisheries harvest strategies.

Native Title Act 1993: If native title exists over the area (e.g., in the form of exclusive access rights), the declaration of a reserve may affect those rights. The EPBC Act provides that native title rights continue to exist but may be regulated. The Proclamation does not address native title; it would be considered separately under the Native Title Act.

Environment Protection and Biodiversity Conservation Regulations 2000: These regulations set out procedural matters, permit fees, and specific offences for Commonwealth reserves. They fill in the gaps left by the Act. The Proclamation triggers the application of these regulations to the Nelson Marine Park.

International law: The reserve is part of Australia’s implementation of the Convention on Biological Diversity and the UN Sustainable Development Goal 14. The IUCN category assignment reflects international standards. The Proclamation does not directly implement any treaty, but it is consistent with Australia’s international commitments.

The compilation records two legislative steps:

1. Original proclamation: The Proclamation - Nelson Commonwealth Marine Reserve was registered on 2 July 2007 (F2007L01919) and commenced on 31 August 2007. This original instrument declared the area as a Commonwealth reserve under the name “Nelson Commonwealth Marine Reserve”.

2. Renaming amendment: The Environment Protection and Biodiversity Conservation Amendment (Commonwealth Marine Reserves Renaming) Proclamation 2017 was registered on 10 October 2017 (F2017L01337) and commenced on 11 October 2017. Schedule 1, item 94, amended paragraph (c) of the original Proclamation to change the reserve’s name from “Nelson Commonwealth Marine Reserve” to “Nelson Marine Park”. The same amendment substituted the schedule heading accordingly. The commencement paragraph (which previously stated the date of commencement) was repealed by the Legislation Act 2003, s 48D, which automatically removes such provisions upon compilation. The compilation notes also record that the schedule heading was substituted (rs) by the 2017 amendment.

No other amendments are recorded. The Proclamation has had only two versions: the original 2007 version and the 2017 renamed version. The amendment was minor and cosmetic, changing only the name and schedule heading. The area and IUCN category remain unchanged.

The endnotes indicate that the original proclamation was registered as a legislative instrument under the Legislative Instruments Act 2003 (now Legislation Act 2003). The compilation includes editorial changes (e.g., the commencement paragraph repeal) that do not affect the substantive law.

This sparse amendment history suggests that the reserve has been stable in its geographic definition for over a decade. However, management plans may have been updated separately (not captured in this compilation). The renaming in 2017 was part of a larger exercise to bring naming conventions into line with the National Representative System of Marine Protected Areas, affecting dozens of reserves across Australia.

The source compilation does not mention any litigation or court decisions directly involving the Nelson Marine Park. There are no references to cases, challenges to the proclamation, or disputes about its application in the text or endnotes. Given the long standing of the proclamation (since 2007), it is possible that the reserve has been litigated indirectly in broader EPBC Act cases, but no such information appears in this source.

The absence of specific litigation does not mean there have been no disputes. Legal challenges to Commonwealth marine reserves have occurred, for example, concerning the adequacy of management plans, the validity of zoning, or the compatibility with constitutional boundaries. However, without source material, we cannot assert any such history for this particular reserve.

A thorough analyst would check the Federal Court’s decisions database and the Administrative Appeals Tribunal for matters involving the Nelson Marine Park. The Proclamation’s coordinates and boundary definitions could be disputed if they conflict with other laws, such as the boundary between Commonwealth and state waters. But the source is silent.

For the purpose of this deep dive, we record that there is no litigation history evident from the compilation provided.

Coordinate datum confusion: The boundary is defined using GDA94, but many modern GPS systems default to WGS84, which is almost identical (differences of less than a metre in this region). However, for precise boundary work, especially when determining whether a vessel or structure is inside or outside the reserve, using the correct datum matters. A small offset could be legally significant near the boundary edges.

The 100-metre depth limit: The Proclamation includes the seabed to a depth of 100 metres. This is unusual; typical marine reserves include the seabed without depth limitation. The 100-metre cut-off means that deeper seabed and subsoil are not part of the reserve. Consequently, any mining or drilling that penetrates deeper than 100 metres below the seabed (e.g., petroleum wells) might not be covered by the reserve’s protections. The EPBC Act’s prohibition on mining in Commonwealth reserves applies to the reserve area; if the subsoil beyond 100 metres is not part of the reserve, the prohibition may not apply there. This could be a significant oversight (or deliberate limitation) depending on the geology of the area. Activities such as seabed mining for nodules or deep-sea mineral extraction could potentially avoid the reserve restrictions by operating below 100 metres.

Adjacent area definition frozen in time: The boundary uses the “adjacent area” as defined in Schedule 2 to the Petroleum (Submerged Lands) Act 1967 immediately before the commencement of the Coastal Waters Acts. That definition has been superseded by later offshore legislation. The Proclamation effectively locks in a historical boundary line, which may not align perfectly with modern jurisdictional boundaries for fisheries or other laws. Anyone relying on the boundary must consult the 1967 Act as it then stood, not its current version. This creates a research burden.

Geodesic line ambiguity: The final leg of the boundary is described as “north‑easterly along the geodesic”. A geodesic is the shortest path on the ellipsoid, which differs from a rhumb line (constant bearing). For the short distances involved, the difference is tiny, but surveyors and GIS analysts must use geodesic calculations, not simple straight lines in a projected coordinate system. Misinterpretation could shift the boundary by several metres.

IUCN category VI does not guarantee extractive uses: The assignment to category VI may lead some to believe that fishing, mining, or other commercial activities are automatically allowed. They are not. The EPBC Act imposes its own prohibitions that override the IUCN label. Only if the management plan or regulations specifically permit an activity can it proceed. The Proclamation does not list any permitted activities; it only assigns the category. Practitioners should not assume that a category VI reserve is “soft” compared to higher categories.

No management plan referenced: The Proclamation does not mention any existing management plan. Under the EPBC Act, a plan must be prepared, but until it is in force, the default provisions of the Act apply. Those defaults are restrictive. For example, without a plan, a permit may be needed for any activity that could damage the reserve. This creates uncertainty for businesses that might otherwise rely on the management plan to authorise uses.

Potential for conflict with state waters: The boundary follows the SA-Victoria adjacent area line, which is the same line used for offshore petroleum jurisdiction. However, that line may not coincide with the seabed boundary for fisheries or other purposes. A fishing vessel operating near the boundary could inadvertently enter the reserve if its GPS is set to a different datum.

The word “protected area” in the name is not determinative: The reserve is called a “marine park”, but the EPBC Act uses the term “Commonwealth reserve”. The public may assume that “marine park” implies recreational access and limited restrictions. In reality, the legal regime is stricter.

The Proclamation itself imposes no direct compliance steps. However, anyone intending to carry out an activity within the boundaries of the Nelson Marine Park must ensure that the activity is lawful under the EPBC Act, any applicable regulations, and any management plan that is in force. Because the compilation does not reproduce the management plan or the relevant EPBC provisions, a general compliance approach is outlined below.

Step 1: Determine whether you are inside the reserve. Obtain the coordinates in GDA94 and plot them using a reliable GIS tool. Compare with your planned area of operation. If you are outside the boundary, the reserve restrictions do not apply (though other EPBC Act provisions may still apply). Pay attention to the 100-metre seabed depth limit: if your activity involves the seabed deeper than 100 metres, it may fall outside the reserve.

Step 2: Identify the relevant management plan. Check the Federal Register of Legislation for any management plan made for the Nelson Marine Park under the EPBC Act. The plan will specify what activities are permitted, what are prohibited, and what require a permit. As of the compilation date (2017), no plan was referenced, but one may have been made since. Contact the Director of National Parks (Parks Australia) for the current status.

Step 3: Assess whether your activity is prohibited by the EPBC Act without a management plan. Even without a plan, the Act prohibits mining operations outright (s 354). Fishing may be allowed if not otherwise prohibited by the fisheries law or if the reserve has a specific regulation. However, the default position under the EPBC Act is that you must not take an offence under Pt 15. The safest approach is to assume that any activity that could damage the environment or biodiversity (including fishing, anchoring, dredging, or construction) is prohibited unless you have a permit or the activity is specifically exempted.

Step 4: Obtain necessary approvals. If your activity requires a permit under the EPBC Act or under the management plan, apply to the Director of National Parks well in advance. Permits may be subject to conditions, monitoring requirements, and fees. For commercial fishers, check with the Australian Fisheries Management Authority whether your concession allows operations in the reserve and whether any additional conditions apply.

Step 5: Comply with ongoing obligations. If you are permitted to operate within the reserve, you must comply with any conditions, report any incidental impacts, and avoid listed threatened species or ecological communities. Keep records of your position, activities, and any interactions with wildlife. Failure to comply can lead to enforcement action.

Step 6: Monitor for changes. The Proclamation itself is static, but the regulatory framework evolves. New management plans, regulations, or emergency closures can impose additional restrictions. Subscribe to notifications from the Department of Climate Change, Energy, the Environment and Water (DCCEEW) and check the legislation register periodically.

Step 7: Seek legal advice if uncertain. The interaction between the Proclamation, the EPBC Act, state laws, and existing titles can be complex. A fisheries lawyer or environmental lawyer with experience in Commonwealth reserves can provide concrete advice tailored to the specific activity. Do not rely solely on the presumption that IUCN category VI allows your activity.

Practical tip: Use vessel monitoring systems (VMS) or GPS trackers that record positions in GDA94 to prove compliance if audited. Communicate with other users of the area to understand local practices. The reserve is relatively remote, so self-policing is essential.

In summary, compliance begins with precise geographic determination, then a careful reading of the EPBC Act and any management plan, and finally obtaining and adhering to any required permits. The Proclamation is the starting point, not the end.
