What it does
This instrument establishes the spatial limits of a marine protected area labelled the Freycinet Marine Park and divides it into three named management zones, each identified by an IUCN category. Mechanically it does four things in the text supplied:
- Creates the Freycinet Marine Park footprint (Part 1) by fixing a polygon defined by sequential geographic coordinates and links to the outer limit of Australia’s exclusive economic zone (EEZ) at two intersection points. Part 1 expressly excludes "any coastal waters in relation to the State of Tasmania" for the areas to which that exclusion phrase applies.
- Creates a Sanctuary Area Zone (Part 2) labelled IUCN Category Ia , Strict Nature Reserve , by fixing a second polygon of coordinates, which begins at a point that also appears in Part 1 and runs to the EEZ outer limit and back. Part 2’s text does not include the express exclusion of coastal waters that appears in Parts 1, 3 and 4.
- Creates a Recreational Use Area Zone (Part 3) labelled IUCN Category II , National Park , by fixing a polygon where the Part 3 starting point corresponds to an interior point of Part 1. Part 3 expressly excludes any coastal waters in relation to the State of Tasmania.
- Creates a Multiple Use Area Zone (Part 4) labelled IUCN Category VI , Managed Resource Protected Area , by fixing a polygon that uses many of the same nodes and again expressly excludes coastal waters in relation to the State of Tasmania.
The text anchors all geographic coordinates to the Geocentric Datum of Australia 1994 (GDA94) as published in Commonwealth Gazette GN35 of 6 September 1995. It also ties the EEZ references to the declaration made under the Seas and Submerged Lands Act 1973 (proclamation dated 26 July 1994; Commonwealth Gazette S290 of 29 July 1994). Coastal waters are not defined in the instrument itself; the text explicitly points users to the Coastal Waters (State Powers) Act 1980 and the Coastal Waters (Northern Territory Powers) Act 1980 for that definition.
