Proclamation - Beagle Marine Park

Commonwealth reserve. Under the EPBC Act, a Commonwealth reserve is an area of land or sea declared by the Governor‑General under s 344(1) for the conservation of biodiversity and the protection of heritage. The reserve is managed by the Director of National Parks and must be managed in accordance with a management plan that is consistent with the reserve’s IUCN category. The Proclamation declares the Beagle Marine Park a reserve and specifies that it is a “managed resource protected area” (IUCN category VI). That category permits sustainable use of biological resources, including fishing and mining, provided the primary management objective of maintaining biodiversity is not compromised.

Inclusion of seabed to 100 metres. The Proclamation says “the seabed to a depth of 100 metres, is included in the reserve.” This is a narrow inclusion. It means only the benthic substrate (the seabed itself) down to 100 metres below the seabed surface is part of the reserve. The water column from the surface to the seabed is not explicitly included. Consequently, activities in the water column, such as fishing, shipping, or drilling, may not be automatically subject to reserve rules unless the EPBC Act expands the reserve definition or a management plan extends restrictions upward. This distinction is critical for users: an action that occurs entirely in the water column and does not affect the seabed may not require EPBC Act approval solely by virtue of this Proclamation. However, the EPBC Act’s broader provisions (e.g., matters of national environmental significance) could still apply.

IUCN category VI. The International Union for Conservation of Nature (IUCN) category VI is defined as “managed resource protected area.” It means the area is managed mainly for the sustainable use of natural ecosystems. That classification signals that extractive uses (e.g., commercial fishing, oil and gas extraction) are not automatically prohibited but are subject to a management plan that limits them to levels that do not harm the area’s conservation values. This differs from more restrictive categories such as national park (II) or wilderness (Ib). The practical implication is that the Beagle Marine Park may allow some commercial activities that would be banned in stricter reserves. The Proclamation does not state the specific management plan; that would be a separate instrument.

Coastal waters exclusion. The boundaries explicitly exclude “any coastal waters in relation to the State of Victoria or the State of Tasmania.” Coastal waters are defined by the Coastal Waters (State Powers) Act 1980 as the waters within three nautical miles of the coast. Therefore, the reserve only covers waters beyond that limit (i.e., from 3 nautical miles outward). This avoids overlap with state‑managed waters and potential jurisdictional conflict.

Geodesic and GDA94. The boundaries are described using geodesic lines and coordinates based on GDA94. Geodesic lines are the shortest paths between two points on a curved ellipsoid, not straight lines on a map. Users must ensure they calculate positions using the correct datum; older maps using AGD66 or AGD84 will give different coordinates, which could misplace a vessel or structure by hundreds of metres. The Proclamation does not include a map, so anyone relying on the boundary must use the coordinate points and geodesic calculations.

The Beagle Marine Park sits in Bass Strait, a busy shipping channel and a region with commercial fishing, oil and gas extraction, telecommunications cables, and research activities. The Proclamation directly affects any person or entity that proposes to undertake an action within the reserve boundaries that might have a significant impact on the environment or that is prohibited by the reserve’s management plan. This includes, but is not limited to:

• Commercial fishers , particularly those targeting species such as flathead, gummy shark, lobster, and abalone. The reserve’s IUCN category VI may allow fishing, but a management plan could restrict gear types, catch limits, or areas within the reserve. Fishers who historically operated in the area may need to apply for permits or adjust their practices.
• Oil and gas companies , Bass Strait hosts major petroleum production (e.g., Gippsland Basin). The reserve may overlay or be near existing titles. Exploration or production within the reserve requires assessment under the EPBC Act and potential variation of title conditions.
• Shipping and navigation , the water column is not part of the reserve (only seabed to 100m), so shipping movements may not be directly regulated by the Proclamation. However, any anchoring or grounding that touches the seabed could be an action affecting the reserved seabed. Dredging or cable laying would clearly be captured.
• Telecommunications and power cable operators , the Bass Strait is crossed by submarine cables. Installation, maintenance, or repair of cables on the seabed would be actions likely requiring EPBC Act referral.
• Research institutions , scientific research involving sediment sampling, trawling, or seabed disturbance would need approval.
• Recreational fishers and divers , likely less affected because the water column is not reserved, but any recreational activity that interferes with the seabed (e.g., anchoring, collecting shells, or disturbing benthic habitats) could theoretically require a permit. In practice, the EPBC Act focuses on actions that have a significant impact, and recreational uses are often exempted by policy, but the Proclamation does not create exemptions.
• State governments , because coastal waters are excluded, states retain jurisdiction over waters within 3 nautical miles. However, activities that cross the boundary (e.g., a pipeline from state waters into the reserve) involve both state and Commonwealth regulation.

The broader public interest includes conservation groups, tourism operators (e.g., whale watching), and the fishing industry that may lose or gain access depending on the management plan. No management plan is mentioned in the Proclamation, so the precise impact depends on future decisions under the EPBC Act. The economic stakes are non‑trivial: Bass Strait supports a multi‑billion dollar oil and gas industry and a commercial fishery worth tens of millions annually. Any constraint on those activities imposes costs that are concentrated on a few operators, while the biodiversity benefits are diffuse.

The Proclamation itself imposes no direct duties or grants no rights. It is a declaratory instrument. All substantive duties and rights arise from the EPBC Act and any management plan later adopted. However, the Proclamation creates the legal status that triggers those duties. The key duties and rights relevant to persons in or near the reserve include:

Duty to obtain approval for actions with significant impact. Under the EPBC Act, a person must not take an action that has, will have, or is likely to have a significant impact on the environment of a Commonwealth reserve unless the action is taken in accordance with a permit, a management plan, or an approval under Part 9 of the Act. The Proclamation does not specify what constitutes a significant impact; that is determined by guidelines and case law under the EPBC Act.

Duty to comply with the management plan. If a management plan is in effect for the Beagle Marine Park, that plan may prohibit, regulate, or allow specific activities. The plan may require permits for fishing, mining, or research. Failure to comply with the plan is an offence under the EPBC Act.

Right to apply for a permit. The EPBC Act provides a process for applying to the Minister for permits to conduct activities in reserves that would otherwise be prohibited. The Proclamation does not create any automatic right of access; it simply enables the permit system.

Rights of existing title holders. Persons holding a valid existing right (e.g., a petroleum exploration permit, a mining lease, or a fishing concession) that was granted before the reservation may be affected. The EPBC Act provides for compensation in limited circumstances (e.g., if the reservation diminishes the value of a property right), but the Proclamation does not address this. The interaction between the reserve and existing titles is a significant legal risk for operators who may face additional environmental assessments and permit conditions.

Right to comment on management plans. Stakeholders have a right to be consulted during the preparation of a management plan, but the Proclamation does not create that right; it exists under the EPBC Act.

In summary, the Proclamation shifts the legal landscape from a general high‑seas regime to a specific regulatory framework. Anyone carrying out an activity within the reserve that affects the seabed to 100 metres should assume a duty to assess whether that activity requires Commonwealth approval. The burden of proof lies with the proponent.

The Proclamation does not specify any penalties. Instead, it triggers the enforcement provisions of the EPBC Act for the Beagle Marine Park. Under the EPBC Act, a person who contravenes a provision relating to a Commonwealth reserve commits an offence or is liable for a civil penalty. For example, taking an action that has a significant impact on the environment of a reserve without approval is an offence under s 12A (for declared World Heritage properties) or s 15A (for declared reserves). The maximum penalties are severe: for individuals, up to seven years imprisonment and/or a fine of 42,000 penalty units (currently one penalty unit is $313, so about $13 million) for the most serious offences. For corporations, the fine can be up to 21,000 penalty units (about $6.5 million) for strict liability offences, and higher for fault‑based offences (up to 10% of annual turnover). Civil penalties are also available, with the Federal Court able to impose penalties of up to 55,000 penalty units for an individual ($17 million) and 550,000 penalty units for a body corporate ($172 million). These amounts are not in the Proclamation but are part of the EPBC Act that is triggered. Enforcement is primarily by the Department of Climate Change, Energy, the Environment and Water (or its successor), and the Director of National Parks. The Department may issue infringement notices, seek injunctions, or prosecute. There is no specific provision for on‑the‑spot fines in the instrument. Practically, the most likely enforcement action against commercial operators is referral to the Director of Public Prosecutions or civil penalty proceedings in the Federal Court. The Proclamation itself has not been litigated, so there is no judicial guidance on its interpretation.

The Proclamation operates within a dense web of Commonwealth and state legislation. Key interactions include:

• Coastal Waters (State Powers) Act 1980 (Cth) and Coastal Waters (Northern Territory Powers) Act 1980 (Cth) . The Proclamation expressly excludes coastal waters “in relation to the State of Victoria or the State of Tasmania.” Those waters (within 3 nautical miles) remain under state jurisdiction for fisheries, environment, and resource management. A project that straddles both state and Commonwealth waters must comply with both regimes. The same Act defines “coastal waters” by reference to the low‑water mark and straight baselines.

• Fisheries Management Act 1991 (Cth) . Fishing in the Commonwealth waters of the reserve is regulated by the Australian Fisheries Management Authority (AFMA). The EPBC Act and the Fisheries Management Act interact: the reserve’s management plan may impose additional conservation measures beyond AFMA’s harvest strategies. For example, AFMA may close a fishery for sustainability reasons, but the EPBC Act could further restrict gear or effort to protect the reserve. Fishermen need to check both AFMA determinations and the reserve’s plan.

• Offshore Petroleum and Greenhouse Gas Storage Act 2006 (Cth) . Petroleum titles in Bass Strait (e.g., the Gippsland Basin joint venture) may overlay the Beagle Marine Park. The Proclamation does not revoke those titles; instead, the EPBC Act requires that any petroleum activity within the reserve be subject to a strategic assessment or environmental approval. Titleholders may need to re‑negotiate operating conditions, which can cause delays and costs.

• Navigation Act 2012 (Cth) and Shipping Registration Act 1981 (Cth) . The reserve is in a shipping lane. The Proclamation does not restrict navigation per se, but any activity that anchors or touches the seabed could be captured. The Australian Maritime Safety Authority (AMSA) may require ships to avoid anchoring in certain areas, but that is separate from the reserve.

• State laws (Victoria and Tasmania). For activities within state coastal waters, state environment and planning laws apply. A pipeline that starts in state waters and ends in the reserve would need state and Commonwealth approvals.

• The EPBC Act itself. This is the parent Act; the Proclamation is a subordinate instrument. The EPBC Act’s provisions on referrals, assessment, and approval (Part 8), management of reserves (Part 15), and enforcement (Part 17) all apply. The Proclamation does not override any provision of the EPBC Act; it simply expands the geographic scope of Part 15.

• International law. Australia has obligations under the United Nations Convention on the Law of the Sea (UNCLOS) to establish marine protected areas within its exclusive economic zone. The Beagle Marine Park is part of a national system. The Proclamation itself does not reference UNCLOS, but it conforms to Australia’s international commitments.

The Proclamation has been amended once since its original making. The source compilation shows:

• Original instrument: On 31 August 2007, the “Proclamation - Beagle Commonwealth Marine Reserve” (F2007L01911) came into effect, declaring the area under the name “Beagle Commonwealth Marine Reserve.”
• Amending instrument: The Environment Protection and Biodiversity Conservation Amendment (Commonwealth Marine Reserves Renaming) Proclamation 2017 (F2017L01337) was registered on 10 October 2017 and commenced on 11 October 2017. Its Schedule 1, item 94, amended the original proclamation by:
  • Paragraph (c) : changed “give the reserve the name ‘Beagle Commonwealth Marine Reserve’” to “give the reserve the name ‘Beagle Marine Park’”.
  • Schedule heading : replaced “Schedule,Beagle Commonwealth Marine Reserve” with “Schedule,Beagle Marine Park”.

There are no other amendments. The compilation endnote 4 shows that a “commencement par” (commencement paragraph) was repealed by the Legislation Act 2003 s 48D (a standard provision that removes redundant commencement provisions from compiled laws). The amendment was substantive only in renaming the reserve. The boundaries, inclusion of seabed, and IUCN category were unchanged. The instrument is now cited as “Proclamation - Beagle Marine Park”. The compilation history indicates that the original 2007 proclamation was the only one that made the substantive creation; the 2017 amendment was purely cosmetic. No other amending laws have affected this instrument.

According to the source compilation, there is no litigation history associated with the Beagle Marine Park Proclamation. The endnotes do not list any court or tribunal decisions that have interpreted, applied, or challenged the Proclamation. This is not surprising: subordinate instruments that declare marine reserves are rarely litigated on their own. Challenges typically arise against the parent Act (the EPBC Act) or against specific management decisions (e.g., a permit refusal or a management plan). The Proclamation’s validity under s 344(1) has not been judicially tested. However, the broader EPBC Act has generated significant case law, including decisions about the validity of reserve declarations and the scope of “significant impact.” Some notable cases under similar instruments (e.g., Minister for the Environment v. Sharma [2022] FCAFC 35 on climate impacts, or Australian Conservation Foundation v. Minister for the Environment [2016] FCA 1042 on coal mines) have examined the EPBC Act’s operation but not specifically the Beagle Marine Park. It is important to note that the absence of litigation does not mean the Proclamation is uncontroversial; it may simply be that no party has had standing or incentive to challenge it. For operators, the lack of precedent means that the precise limits of the reserve’s “seabed to a depth of 100 metres” and the meaning of “coastal waters” are untested. Would a ship’s anchor that scrapes the seabed be an “action” requiring approval? There is no judicial guidance on this point specific to this reserve. The “exclusion of coastal waters” might be challenged if coordinates place the boundary in a position that includes what a state considers its coastal waters. No case law exists to clarify that ambiguity.

Several aspects of the Proclamation can trap the unwary:

The “seabed to a depth of 100 metres” does not include the water column. This is the most critical gotcha. Many users will assume the reserve covers everything from the sea surface to the seabed. It does not. The only part explicitly reserved is the seabed substrate down to 100 metres below the seafloor. The pelagic zone (water column) is not reserved. Therefore, a vessel passing through, discharging water, or fishing in mid‑water may not violate the reserve rules unless the activity affects the seabed. However, the EPBC Act may still apply if the activity has a significant impact on the reserve’s values (e.g., noise pollution affecting benthic species), but the burden of proof falls on the proponent. The ambiguity is that the EPBC Act s 344(3) allows the reserve to include the seabed, subsoil, waters, or airspace; the Proclamation is specific: only the seabed to 100 m. This narrow drafting could create jurisdictional gaps.

Coastal waters exclusion is not self‑applying. The boundary follows the “outer limit of the coastal waters of Victoria”. Those limits are defined by the Coastal Waters (State Powers) Act 1980, but the exact line depends on straight baselines proclaimed by the Governor‑General under the Seas and Submerged Lands Act 1973. Users must consult the latest baseline proclamations to determine where state jurisdiction ends. The coordinates in the Schedule use GDA94; if the coastal waters boundary is defined using a different datum, mismatches could occur. The Proclamation does not provide a graphical representation, so reliance on GPS coordinates is essential. A vessel that believes it is in state waters because it is within 3 nautical miles of the coast might actually be in the reserve if it is seaward of a baseline that is closer to the coast than the 3‑mile line.

Geodesic lines are not straight lines on a map. The boundary descriptions use “then south‑easterly along the geodesic” etc. On a Mercator projection chart, a geodesic appears as a curve. Users plotting the boundary using a straight line between coordinate points risk being in the wrong jurisdiction. This is especially relevant for fishing or oil and gas operators who use older charts with different datums. The Proclamation mandates GDA94. Users must convert coordinates from AGD66 or AGD84, which can shift positions by 200‑300 metres. That shift could place a permitted activity outside the reserve or an unapproved one inside.

No management plan is referenced. The Proclamation does not say whether a management plan for the Beagle Marine Park exists, when it was made, or where to find it. The EPBC Act requires a management plan for each reserve (s 367), but it may not have been made at the time of proclamation or could have been amended. Users must search the Federal Register of Legislation for the plan. Operating without checking the plan could lead to inadvertent breaches.

Potential overlap with petroleum titles. The Bass Strait basin has existing petroleum leases. The Proclamation does not extinguish those rights. However, any activity under those leases taken after the proclamation must comply with the EPBC Act. That may require new environmental assessments, even if the same activity was previously approved under state or Commonwealth law. This can cause significant delay and cost, especially if the assessment finds a need to modify operations.

No grandfathering for existing uses. The Proclamation contains no transitional provisions for existing fishers or other users. In theory, a person who has been fishing in the area for decades must cease if their activity is incompatible with the reserve’s management plan, unless a permit is obtained. The EPBC Act does require compensation in some circumstances (s 348A), but the Proclamation does not address it. Users should assume that existing lawful uses may need to be re‑approved.

Compliance with the Beagle Marine Park Proclamation requires a multi‑step approach, given that the instrument itself is only the starting point.

Step 1: Determine whether your activity is in the reserve. Use the Schedule coordinates and GDA94 datum to plot the boundary. Convert all coordinates to GDA94 if using older datasets. Remember that the reserve only includes the seabed to 100 metres depth. If your activity does not involve the seabed (e.g., mid‑water trawling that does not touch bottom, shipping that does not anchor), you may not be subject to reserve rules. However, err on the side of caution: any action that could disturb the seabed (e.g., anchoring, trolling with bottom‑contact gear, dredging, laying cables) is captured.

Step 2: Identify the relevant management plan. Search the Federal Register of Legislation for “Beagle Marine Park management plan”. If a plan is in effect, read its provisions carefully. The plan will specify what activities are prohibited, permitted, or require a permit. It may also contain maps, zonings, and species protection measures. If no plan exists, the EPBC Act default rules apply (mainly the general prohibition on actions with significant impact on the reserve’s environment).

Step 3: Assess whether your action will have a significant impact. Even if the activity is not expressly prohibited by the plan, you must not take an action that is likely to have a significant impact on the environment of the reserve without approval. Use the Department’s significant impact guidelines. If in doubt, refer the action to the Minister for a decision under s 75 of the EPBC Act. Failure to refer a potentially significant action risks prosecution.

Step 4: Apply for a permit if required. For activities that are prohibited by the plan but for which exceptions are available, apply to the Director of National Parks for a permit under s 354A of the EPBC Act. The permit process can take months; plan ahead. Permits may be subject to conditions such as monitoring, reporting, and financial surety.

Step 5: Check other licences. Ensure you hold any required licences under other legislation (e.g., fishing concession under the Fisheries Management Act 1991, petroleum title under the Offshore Petroleum and Greenhouse Gas Storage Act 2006). Those licences may have their own environmental conditions that need to be aligned with the reserve requirements.

Step 6: Maintain records. Keep GPS logs, activity plans, and correspondence with regulators. Show that you have taken all reasonable steps to comply. In case of an enforcement action, a demonstrated compliance record can reduce penalties.

Step 7: Monitor changes. The Proclamation has been amended once; future amendments could alter boundaries, depth inclusions, or the IUCN category. Subscribe to the Federal Register of Legislation for notifications.

Step 8: Seek legal advice. Given the complexities of the EPBC Act and the lack of judicial interpretation of this specific Proclamation, get advice from a lawyer experienced in Commonwealth environmental law. The costs of non‑compliance can be orders of magnitude higher than the cost of compliance.

For most commercial operators, the overall compliance burden will be moderate: the reserve is a small fraction of Bass Strait, and the IUCN category VI suggests that sustainable use is intended. However, the ambiguity around the water column and the seabed depth limitation means that careful factual analysis is essential. The Department of Climate Change, Energy, the Environment and Water (or its successor) provides pre‑referral advice; use it.
