### 30 Swearing of affidavits
> > (1) Subject to [subrule (2)](#GS30@Gs2@EN) , an affidavit will be sufficient under the Act and these Rules of Court if it is sworn before –
> >
> > > > (a) a person specified in [rule 511](/view/html/inforce/2026-04-12/sr-2000-008#GS511@EN) or [512 of the](/view/html/inforce/2026-04-12/sr-2000-008#GS512@EN) [Supreme Court Rules 2000](/view/html/inforce/2026-04-12/sr-2000-008) ; or
> > >
> > > > (b) an Australian legal practitioner acting for the person on whose behalf the affidavit is to be used; or
> > >
> > > > (c) an employee or an agent, who is also a person specified in [paragraph (a)](#GS30@Gs1@Hpa@EN) , of the law practice of a person specified in [paragraph (b)](#GS30@Gs1@Hpb@EN) .

> > (2) An affidavit is not sufficient under the Act and these Rules of Court if it is sworn before a person who is an executor of the estate to which the affidavit relates.
