Private Parking Areas Act 1986

The Act’s core concepts are defined in s 4 and are operational throughout the instrument. The primary constructs are private walkway, private access road and private parking area, each being a facility provided by an owner and marked by notice denoting it as such (s 4). The law treats markings and signs as central: an owner may impose conditions but they must be “clearly shown” on a notice at each entrance to the walkway or access road (s 5(3)), and time limits for private parking must be exhibited at or near each entrance (s 7(1)). For enforcement and evidentiary purposes, allegations that a specified area is a private walkway, private access road or private parking area and that it was duly marked are accepted as proved in the absence of contrary proof (s 10; s 14(2)).

Authorised officer is a defined enforcement actor, incorporating “an authorised person for the purposes of the Local Government Act 1934” and expressly including a member of the police force (s 4). This definition is material to the Part 4 enforcement agreement framework (s 9), which enables an owner and council to contract for council enforcement of Part 3; under such an agreement authorised officers exercise powers analogous to those under the Local Government Act 1934 (s 9(2)(b)). The Act also contemplates the Governor making regulations and establishes a mechanism for the Minister to set a code of notices, signs and markings (s 15), with regulations able to incorporate standards prepared by external bodies (s 16).

Owner is defined for both land and motor vehicle contexts (s 4). For land, owner means fee simple holder, registered proprietor of an estate conferring possession, proprietor of a registered easement or right of way or the Crown instrumentality that controls unalienated Crown land; for vehicles owner includes the registered owner, transferee notwithstanding pending registration, or a person in possession by hire or bailment (s 4). This matters because offences in Part 2 and Part 3 can make both driver and owner liable (s 6(2), s 8(9)), subject to rules limiting conviction to one person for the same circumstances (s 14(3)) and the statutory defence for owners who were not in control or who supply a statutory declaration identifying the driver (s 14(5)).

Private parking area sub-types are important operationally. Owners may allocate parts of a private parking area as disabled persons parking area, loading area, no standing area, restricted parking area or permit parking area (s 7(2)). Each sub-type imposes distinct prohibitions and conditions in s 8: for example, parking in a disabled persons parking area requires a disabled persons parking permit (s 8(2)); permit parking areas require an owner-issued permit to be exhibited (s 8(3)); loading areas are limited to commercial vehicles delivering to the owner’s premises (s 8(4)); restricted parking areas are limited to the stipulated class of vehicle (s 8(5)). The Act defines disabled persons parking permit to include permits issued under the Motor Vehicles Act 1959 and similar interstate permits (s 4).

Regulatory overlay and ministerial control are other core concepts. The Minister’s approval is required before an owner of a “regulated shopping centre parking area” may charge fees for parking, and such approval may carry conditions, be varied or revoked by written notice (s 13(1)-(3)). Regulations may fix expiation fees for alleged offences and prescribe penalties for regulatory contraventions not exceeding $1 250 (s 15(2)(b)-(c)). The Act authorises incorporation by reference of standards or codes by regulation, with an obligation on the Minister to keep a copy of any incorporated document available for public inspection (s 16(1)-(2)).

Evidentiary streamlining is built in: certain allegations in a complaint will be accepted as proved in the absence of contrary proof (s 10; s 14(2)). Offences under the Act are summary offences (s 14(1)), invoking summary criminal procedure and, in owner cases, a mandatory pre-proceedings notice requirement to the owner identifying particulars and inviting the owner to identify the driver where appropriate (s 14(4)).

Owners of land with private walkways, private access roads or private parking areas are the primary decision-makers and obligors under the Act. The Act’s definition of owner for land covers fee simple proprietors, registered proprietors of an estate or interest conferring possession, proprietors of registered easements or rights of way and Crown agencies in control of unalienated Crown land (s 4). Owners gain express powers (s 5, s 7) to impose conditions, allocate parts of parking areas to specialised uses and set time limits, but with obligations to sign and mark those conditions at entrances (s 5(3); s 7(1)).

Users, the public who walk on private walkways or use private access roads or park in private parking areas, are regulated by the Act. Pedestrians who contravene conditions imposed on private walkways and access roads commit an offence (s 6(1)). Drivers and vehicle owners may be guilty of offences if vehicles are driven or parked contrary to conditions, parked on pedestrian walkways, left in no standing areas, parked in disabled persons parking areas without an exhibited permit, parked in permit parking areas without an owner-issued permit, parked in loading areas without being a commercial delivery vehicle, parked in restricted parking areas when not the stipulated class, or exceed posted time limits (s 6(2); s 8(1)-(6)). For time-limited parking, there is a concession for vehicles displaying a disabled persons parking permit: contravention for excess time does not arise until 90 minutes beyond the limit (s 8(7)).

Local councils are affected where owners and councils agree to enforcement arrangements. Under s 9(1) an owner and the local council may agree that the council will enforce Part 3 in a private parking area. Once an agreement is in force, authorised officers may exercise relevant enforcement powers and any fines, penalties or expiation fees recovered are payable to the council (s 9(2)(b)-(c)). Agreements are revocable on three months notice by either party (s 9(5)).

Authorised officers, defined to include authorised persons under the Local Government Act 1934 and police officers (s 4),are authorised to enforce the Act’s parking provisions in accordance with any Part 3 enforcement agreement (s 9(2)(b)). The Act also contains a procedural constraint on prosecution where an agreement is in force: alleged offences may not be prosecuted except by authorised officers without prior approval of the Commissioner of Police or the chief executive officer of the council (s 9(2)(a)).

Disabled persons who hold an authorised permit are specifically protected insofar as the permit authorises parking in disabled persons parking areas (s 8(2)), and s 8A allows enforcement of disabled persons parking provisions in a private parking area even where no agreement with a council exists. Emergency and official services are exempted from offences: exempt vehicle is defined to include vehicles used by authorised officers, fire services vehicles in firefighting contexts, ambulances, police vehicles, State Emergency Service vehicles and vehicles used for road safety, maintenance or repair purposes; s 11 confirms that driving or parking by exempt vehicles does not give rise to an offence.

Finally, the Minister and regulatory bodies are affected where the Act contemplates ministerial approvals for charging in regulated shopping centre parking areas (s 13) and requires the Minister to keep copies of adopted standards available for public inspection where the regulations incorporate such standards (s 16(2)).

Owner duties and rights

• Rights: Owners may impose conditions on private walkways and private access roads (s 5(1)-(2)); owners of private parking areas may impose time limits and allocate areas as disabled persons parking areas, loading areas, no standing areas, restricted parking areas or permit parking areas (s 7(1)-(2)). Those rights are exercisable by owners acting jointly where there are multiple owners, unless one owner is empowered by agreement to act for all (s 4(2)).
• Duties: Conditions and time limits must be clearly exhibited at each entrance (s 5(3); s 7(1)). Owners who seek council enforcement must enter an agreement (s 9(1)) and, where an agreement exists, prosecutions for alleged offences in that private parking area cannot proceed without prior approval of the Commissioner of Police or council chief executive officer (s 9(2)(a)). The Act requires the owner’s permits (for permit parking areas) to be exhibited in vehicles when produced to satisfy s 8(3) and sets display requirements for permits (s 8(8)).

Enforcement authority duties and powers

• Councils and authorised officers: Where an enforcement agreement is in force, authorised officers may exercise powers analogous to their Local Government Act 1934 powers in relation to the private parking area (s 9(2)(b)). The agreement binds the parties until revoked on three months notice (s 9(5)). Any fines or expiation fees recovered under such an agreement are payable to the council (s 9(2)(c)).
• Prosecutorial constraints: For offences alleged in an area subject to a council agreement, only authorised officers may commence prosecutions without prior approval as specified (s 9(2)(a)).

User duties and rights

• Pedestrians: Must not breach conditions imposed on private walkways or private access roads (s 6(1)).
• Drivers and vehicle owners: Must comply with the particular prohibitions in s 8: no parking in no standing areas (s 8(1)); display a disabled persons parking permit when parked in a disabled persons parking area (s 8(2)); display an owner-issued permit when parked in a permit parking area (s 8(3)); only commercial vehicles making deliveries may park in loading areas (s 8(4)); only vehicles of the stipulated class may park in restricted parking areas (s 8(5)); observe time limits subject to the 90-minute concession for disabled permit holders (s 8(6)-(7)). Owners and drivers can both be guilty under s 8(9) and s 6(2) but the court will not convict both for the same circumstances (s 14(3)).
• Procedural rights: Before proceedings against an owner are commenced, a notice with particulars must be sent and the owner invited to identify the driver by statutory declaration within 21 days (s 14(4)); an owner may defend on the basis that the vehicle was not in their possession or control as a consequence of some unlawful act or that they supplied the statutory declaration naming the driver (s 14(5)).

Regulatory duties

• Minister and Governor: The Governor may make regulations for notices, signage and devices and may prescribe penalties and expiation fees (s 15). The Minister must keep copies of any adopted or incorporated codes and standards available for inspection (s 16(2)). The owner of a regulated shopping centre parking area must not charge for parking without Ministerial approval, and any approval can carry conditions and be varied or revoked by the Minister (s 13(1)-(3)).

Evidentiary and procedural effects

• Proof by complaint: Allegations that land is a private walkway, access road or parking area and was duly marked are accepted as proved unless contradicted (s 10; s 14(2)). Offences are summary offences (s 14(1)), affecting the procedures that apply in prosecutions and the availability and form of expiation fees under regulations (s 15(2)(c)).

Statutory penalties

• Part 2 offences: A pedestrian who breaches conditions imposed on a private walkway or private access road faces a maximum penalty of $200 (s 6(1)). Where a vehicle is parked or driven in breach of a condition or is parked on a private pedestrian walkway, the vehicle owner and the driver (if different) are each guilty of an offence carrying a maximum penalty of $1 250 (s 6(2)).
• Part 3 offences: The maximum penalty for offences under s 8 (parking contraventions) is $1 250 (s 8(9)). The Act lists specific prohibitions (s 8(1)-(6)); for example, parking in a disabled persons parking area without an appropriate permit (s 8(2)), or parking in a loading area other than a commercial vehicle making deliveries (s 8(4)).
• Regulated shopping centre parking area penalty: An owner of a regulated shopping centre parking area who charges a fee without Ministerial approval is subject to a maximum penalty of $5 000 (s 13(1)).

Enforcement pathways

• Owner prosecutions: Owners may commence prosecutions for offences under the Act where no council agreement exists. Section 10 and s 14(2) simplify evidentiary burdens by treating certain allegations as proved in the absence of contrary proof.
• Council enforcement via agreement: Owners may contract with the local council for the council to enforce Part 3 in the private parking area (s 9(1)). Once such an agreement exists, authorised officers are empowered to exercise enforcement powers in relation to the private parking area as if operating under the Local Government Act 1934 (s 9(2)(b)). Any fine, penalty or expiation fee recovered in respect of offences relating to the private parking area shall be paid to the council (s 9(2)(c)). Agreements can be revoked by either party on three months notice (s 9(5)).
• Prosecution controls: Where an agreement is in force, prosecutions in relation to that private parking area cannot be commenced by persons who are not authorised officers without prior approval of the Commissioner of Police or the council’s chief executive officer (s 9(2)(a)). This creates a gatekeeping role for police and council executives in such enforcement contexts.

Expiation and regulations

• The Governor may, by regulation, fix expiation fees for alleged offences against the Act and may prescribe penalties, not exceeding $1 250, for contravention of regulations (s 15(2)(b)-(c)). The Act itself does not fix expiation levels; it leaves that detail to subordinate regulation.
• Regulations and a Ministerial code may standardise signage and markings (s 15(2)(a)), which affects enforceability where the Act requires conditions and time limits to be “clearly shown” (s 5(3); s 7(1)).

Procedural protections and defences

• Pre-proceedings notice: Before proceedings against an owner of a vehicle are commenced, the prosecutor must send the owner a notice setting out particulars and inviting the owner to provide, within 21 days, a statutory declaration naming the driver if the owner was not the driver (s 14(4)).
• Owner defences: In proceedings against the owner of a motor vehicle, it is a defence to prove that the motor vehicle was not in the owner’s possession or control due to some unlawful act, or that the owner provided the prosecutor with a statutory declaration naming the driver in accordance with s 14(4)(b) (s 14(5)).
• Single conviction rule: The owner and driver are not both liable to be convicted of an offence arising from the same circumstances; conviction of one exonerates the other (s 14(3)).

Evidence and proof rules

• Proof of status and markings: A complaint’s allegation that land constitutes a private walkway, private access road, private parking area or marked part of a private parking area will be accepted as proved in the absence of proof to the contrary (s 10; s 14(2)). Additionally, documents purporting to be copies of standards incorporated by regulation are, absent contrary proof, to be accepted as such (s 16(3)), streamlining evidentiary production for standardised codes.

Exemptions and special enforcement

• Emergency vehicles and certain official uses are exempt from offences at s 11 and by definition of exempt vehicle in s 4. Disabled parking areas retain special enforceability via s 8A, which makes s 8(2) enforceable in accordance with s 9 even where no agreement is in force.

Local Government Act 1934 and authorised officer powers

• The Act explicitly links authorised officers under this Act to the authorised person concept in the Local Government Act 1934 by definition (s 4) and by conferring enforcement powers in relation to a private parking area to authorised officers “empowered to exercise in relation to the private parking area any of the powers of the authorised officer in relation to the enforcement of the Local Government Act 1934” when an agreement is in force (s 9(2)(b)). Enforcement therefore operates within the framework of existing local government enforcement powers and practices, and powers under the Local Government Act 1934 will be the practical template for council enforcement.

Motor Vehicles Act 1959 and disabled persons permits

• The Act recognises and depends on the Motor Vehicles Act 1959 for the form and requirements of disabled persons parking permits by defining a disabled persons parking permit to include permits issued under s 98R of the Motor Vehicles Act 1959 (s 4). Display requirements for disabled persons permits are tied to any requirements in the Motor Vehicles Act 1959 (s 8(8)(a)). The Act also accepts similar interstate permits by definition.

Regulatory incorporation and external standards

• Section 16 permits regulations or codes under this Act to adopt, with or without modification, codes, standards or other documents prepared by bodies referred to in the regulation. This creates an incorporation-by-reference relationship between standards prepared externally (for example by technical or standards bodies) and the enforceable requirements under the Act. The Minister must keep copies of any adopted or incorporated documents available for public inspection (s 16(2)), and certified copies are prima facie evidence in legal proceedings (s 16(3)).

Criminal procedure and summary offences framework

• The Act makes its offences summary offences (s 14(1)), which places them within the broader criminal procedure regime for summary offences in South Australia. The pre-proceedings notice requirement to owners (s 14(4)) and the owner-defence provisions (s 14(5)) interact with general procedural rules for summary offences and with any expiation scheme implemented by regulation (s 15(2)(c)). The Statutes Amendment and Repeal (Common Expiation Scheme) Act 1996 is referenced in the legislative history with transitional provisions (see Legislative history), showing prior alignment with an expiation framework.

Crown land and public rights

• The Act’s definition of owner includes Ministerial or Crown instrumentalities where the land is not alienated from the Crown (s 4). Section 12 explicitly states that public use of a private access road, private parking area or private walkway does not create rights by prescription or adverse possession nor does it convert the land into a highway, street or road (s 12). This preserves other property law concepts and avoids unintended dedication by user.

Regulated shopping centre overlay

• Section 13 creates an intersection between the Act and ministerial authorisation powers: owners of regulated shopping centre parking areas (definition in s 4) must obtain Ministerial approval to charge parking fees, and the Minister may attach, vary or revoke conditions (s 13(1)-(3)). This introduces an administrative control point with potential interface to retail, commercial lease and planning regimes, especially given that the Act’s definition of retail shop and retail shopping centre adopts the Retail and Commercial Leases Act 1995 definitions (s 4).

Local regulatory instruments and signage codes

• The Governor may make regulations establishing a code of notices, signs, road markings and other devices to denote parking and access restrictions across private walkways, private access roads and private parking areas (s 15(2)(a)). That regulatory exercise will interact with standards incorporated under s 16 and with local council enforcement practices under Local Government Act 1934-derived authorities.

Transitional and amendment interfaces

• The legislative history shows multiple amendments and inserts affecting definitions, penalties and procedural clauses. These amendments interact with existing local government enforcement and expiation regimes (notably the 1996 Statutes Amendment and Repeal (Common Expiation Scheme) Act transitional provision, recorded in the legislative history), and the current text reflects the combined effect of amendments up to the 2022 Shopping Centre Parking Areas amendment (see Legislative history).

The Act has been amended multiple times; the legislative history in the text provides the amendment instruments, dates of assent and commencements and notes how particular provisions were varied. The principal Act (Private Parking Areas Act 1986 No 118) received assent on 18 December 1986 and commenced on 11 January 1988. Key subsequent amendments and their mechanical effects, as recorded in the legislative history included in the source, are:

• 1991, No 24: Private Parking Areas (Disabled Persons Parking) Amendment Act 1991 (assent 18.4.1991). This amendment inserted s 8A (enforcement in disabled persons parking areas) and s 16 (Incorporation of standards) as noted (s 8A inserted by 24/1991 s 2; s 16 inserted by 24/1991 s 4), both commencing 18.4.1991. Section 15(2) was also amended by this Act (24/1991 s 3).

• 1996, No 34: Statutes Amendment and Repeal (Common Expiation Scheme) Act 1996 (assent 2.5.1996). This Act made changes effective 3.2.1997, notably amending s 9(2) and deleting some sub-paragraphs (Sch cl 28). The legislative history also records a transitional provision (Statutes Amendment and Repeal (Common Expiation Scheme) Act 1996 s 5) preserving application of repealed or amended Acts to expiation notices issued before repeal or amendment.

• 2005, No 40: Fire and Emergency Services Act 2005 (assent 14.7.2005). This Act amended the definition of exempt vehicle (40/2005 Sch 6 cl 11), with the amendment commencing 1.10.2005. The amended definition is reflected in the current s 4.

• 2007, No 55: Private Parking Areas (Penalties) Amendment Act 2007 (assent 29.11.2007), which amended s 6(2) and s 8(9) (55/2007 s 4 and s 5) with commencement 13.12.2007. These amendments adjusted penalties and related provisions.

• 2009, No 84: Statutes Amendment (Public Sector Consequential Amendments) Act 2009 (assent 10.12.2009). This Act deleted s 13 with effect 1.2.2010 (Pt 120 (s 276)). The legislative history shows s 13 was later reinserted.

• 2010, No 22: Statutes Amendment (Budget 2010) Act 2010 (assent 18.11.2010). This Act substituted the content of s 8(8) (22/2010 s 59), commencing 1.7.2011.

• 2022, No 18: Private Parking Areas (Shopping Centre Parking Areas) Amendment Act 2022 (assent 10.11.2022; commenced 8.2.2023). This amendment made several definitional insertions and changes: it inserted Adelaide CBD into s 4(1) (18/2022 s 3(1)); inserted lease and major retail shopping centre definitions (18/2022 s 3(2)-(3)); amended owner and private parking area definitions (18/2022 s 3(4)-(5)); inserted regulated shopping centre parking area and retail shop/retail shopping centre definitions (18/2022 s 3(6)-(7)); and reinserted s 13 (Regulated shopping centre parking areas) as s 13 was deleted in 2009 and subsequently reinserted by the 2022 amendment (s 13 inserted by 18/2022 s 4). The 2022 amendments commenced on 8 February 2023.

Other amendments and statutory revisions are recorded in the provision-specific table in the legislative history, showing which sections were deleted, substituted or varied and the instruments effecting those changes. The legislative history also records a sequence of reprints (e.g. Reprint Nos 1 and 2, and reprints reflecting the statute as at 1.10.2005, 13.12.2007, 1.2.2010 and 1.7.2011) and notes that references to other legislation are not automatically updated and may be obsolete.

Mechanically, the amendments tightened enforcement in disabled parking areas (s 8A, 1991), adjusted penalties and evidentiary material (2007; 2010), aligned definitions with broader retail leasing law and added a new regulatory regime for regulated shopping centre parking areas (2022). The 1996 Common Expiation Scheme amendment established continuity provisions for expiation notices under repealed or amended Acts. The legislative history establishes that the Act’s structure and enforcement profile have evolved through a mix of penal amendments, definitional clarifications and regulatory standardisation over several decades.

The source text contains no reported cases or judicial decisions. The Act itself does not list any litigation or case annotations in the legislative history supplied. Consequently, there are no cases named in the Act’s text that can be summarised here.

Despite the absence of named cases in the source, the Act contains features that shape litigation risk and likely lines of litigation if disputes arise. Those features include statutory evidentiary presumptions and procedural requirements that affect the structure of prosecutions and defences:

• Presumptions in complaints: s 10 and s 14(2) provide that an allegation that land constitutes a private walkway, private access road, private parking area or that parts are marked (for example, as a disabled persons parking area) will be accepted as proved in the absence of proof to the contrary. In practice, this shifts an early evidentiary burden onto defendants to provide contrary proof of either non-marking or non-qualification of the land.
• Owner-driver procedural protections and defences: s 14(4) requires prosecutors to send an owner notice with particulars and an invitation to name the driver before proceedings are commenced. Section 14(5) preserves a defence where the vehicle was not in the owner’s control due to some unlawful act or where the owner supplies a statutory declaration naming the driver. Litigation touching on these provisions would turn on adequacy of notice, timeliness and the sufficiency of statutory declarations.
• Agreement-based enforcement controls: s 9(2)(a) requires prior approval by the Commissioner of Police or the council chief executive officer for prosecutions in private parking areas subject to a council agreement. Disputes about whether prosecutions were properly authorised could give rise to procedural challenges and judicial review of administrative decisions relating to approval or to the scope of powers exercised by authorised officers.
• Regulatory incorporation and evidentiary proof of standards: s 16(3) provides that certified copies of incorporated codes or standards are to be accepted in the absence of proof to the contrary. Litigation might focus on whether the regulation validly incorporated a particular standard and whether the standard was correctly applied in a specific enforcement action.

Because the Act establishes maximum penalties, summary offence procedures and an expiation regime by regulation, actual enforcement practice (and therefore litigation risk) will also be shaped by the expiation levels and local council enforcement policies adopted under the regulatory powers in s 15 and by the codes of notices and signs made under the Act. Any litigation that has occurred and developed precedents is not reflected in the statutory text provided. Practitioners should therefore consult case law databases and local council enforcement records for reported decisions and administrative rulings that interpret the Act’s provisions in practice.

Signage and exhibition requirements are dispositive

• The owner’s powers to impose conditions and time limits are conditional on proper exhibition of notices. Section 5(3) requires conditions for private walkways and access roads to be “clearly shown” on a notice at each entrance; s 7(1) requires time limits to be exhibited at or near each entrance to a private parking area. The Act’s evidentiary rules (s 10; s 14(2)) accept as proved that premises were private and duly marked unless contrary proof is provided. Failure to comply with signage or marking requirements can therefore defeat enforcement because the prosecutor must establish either proper marking or be met with contrary proof from the defendant.

Owner-driver liability is joint but not cumulative

• Both owner and driver can be guilty for the same offence under s 6(2) and s 8(9), but s 14(3) prevents both being convicted for the same circumstances. Practically, a prosecutor must choose which party to pursue, and convictions will exonerate the other. Owners, however, face a pre-proceedings notice requirement (s 14(4)), and if they supply a statutory declaration naming the driver they may invoke the defence in s 14(5). Owners who fail to provide such a declaration face potential liability.

Disabled persons parking specifics and the 90-minute concession

• A motor vehicle displaying a disabled persons parking permit is given a specific time-limit concession: contravention for exceeding a posted time limit does not arise until 90 minutes in excess of the limit (s 8(7)). This is a precise statutory carve-out and must be accounted for in enforcement or towing decisions. Also, s 8A makes enforcement of the disabled persons parking prohibition (s 8(2)) available even where no council agreement is in force, so private owners can expect enforceability around disabled bays even without council involvement.

Regulated shopping centre charging trap

• Owners of regulated shopping centre parking areas (major retail shopping centres as defined at s 4) must not charge for parking without Ministerial approval (s 13(1)). That prohibition has a higher maximum penalty ($5 000). The definition of major retail shopping centre and regulated shopping centre parking area was inserted in the 2022 amendment, and owners that fall within the new definitions must ensure Ministerial approval before imposing parking fees or risk penalty exposure.

Agreement-based gatekeeping

• Where an owner and council have an agreement under s 9, prosecutions are effectively controlled: a non-authorised person cannot commence a prosecution without prior approval of the Commissioner of Police or the council chief executive (s 9(2)(a)). That gatekeeping can delay or prevent private prosecutions and concentrates decision-making with police or council executives. Owners relying on council enforcement should be aware fines and expiation revenue go to the council, not the owner (s 9(2)(c)).

Exempt vehicle breadth

• The definition of exempt vehicle (s 4) is broad and includes vehicles used by authorised officers, fire services vehicles in firefighting contexts, ambulances, police vehicles, SES vehicles and vehicles used for road safety or road maintenance. Section 11 further exempts such vehicles from offences even where the vehicle is otherwise in breach of posted conditions. Enforcement and towing operators must therefore confirm whether a vehicle qualifies as exempt before acting.

Regulation-dependent enforcement details

• The Act leaves expiation schedules, the precise form of signage and the maximum penalties for regulatory contraventions to regulation (s 15). In practice this means the operational enforcement landscape can change when regulations change. Section 16 allows incorporation of external documents by reference; those external documents, once incorporated, carry evidentiary weight (s 16(3)). Users and owners should check the current regulations and any applicable codes.

Evidential presumptions cut both ways

• The Act’s presumptions (s 10; s 14(2)) ease the prosecutor’s task by treating land and marking allegations as proved unless contradicted. Defendants can therefore shift the contest to factual proof about marking and status. Prosecutors relying on signage and markings should preserve contemporaneous evidence of signage placement and content in case of rebuttal.

Procedural notice technicalities

• For proceedings versus an owner, the prosecutor must deliver a s 14(4) notice with particulars and an invitation to identify the driver. Failure to comply with this procedural step may be a technical ground to challenge proceedings. The owner must respond within 21 days if they were not the driver and wish to name the driver in a statutory declaration; failure to respond or to make the statutory declaration removes the owner’s statutory defence.

Incorporation of standards requires public availability

• When regulations incorporate standards by reference, s 16(2) requires the Minister to keep a copy available for public inspection. A failure to make such copies available could be raised in litigation as undermining the fairness of enforcement tied to a standard that was not publicly accessible.

Owners (private walkways, access roads and private parking areas)

• Signage and exhibition: Ensure all conditions imposed on private walkways and private access roads are clearly shown on notices at each entrance (s 5(3)). For private parking areas impose time limits and exhibit them at or near each entrance (s 7(1)). Use signage consistent with any code or standards prescribed by regulation under s 15 and s 16 to reduce the risk of challenge.
• Permits and marking: Where parts of the parking area are designated as disabled persons parking areas, permit parking areas, loading areas, no standing areas or restricted areas, physically mark and sign those parts in accordance with any regulatory code (s 7(2); s 15(2)(a)). For permit parking areas, issue permits and specify display requirements consistent with s 8(8)(b).
• Disabled parking: Ensure disabled persons bays are appropriately marked and comply with display requirements under the Motor Vehicles Act 1959 where relevant (s 4; s 8(8)(a)). Note the 90-minute concession in s 8(7) when setting enforcement policies.
• Agreements with councils: If intending to rely on council enforcement, negotiate a written agreement with the local council under s 9. The agreement should clarify operational responsibilities, signage standardisation, revenue handling (fines and expiation fees go to the council, s 9(2)(c)), and revocation terms (s 9(5)). Where an agreement exists, be aware prosecutions may be subject to prior approval of senior police or council officers (s 9(2)(a)).
• Charging in regulated shopping centres: If operating a regulated shopping centre parking area (as defined in s 4 following the 2022 amendments), obtain Ministerial approval before charging for parking, and ensure any conditions attached by the Minister are complied with (s 13(1)-(3)).
• Record-keeping and evidence: Keep records and photographic evidence of signage placement and condition, time-limit displays, issued permits and any communications with users. Such evidence supports enforcement actions and defends against claims that premises were not properly marked (cf. s 10 and s 14(2)).

Councils and authorised officers

• Understand delegated powers: When enforcing under an agreement, authorised officers exercise powers analogous to enforcement under the Local Government Act 1934 (s 9(2)(b)). Ensure officers are authorised appropriately under local legislation and trained in the Act’s requirements, including the display and marking standards expected under s 15 and s 16.
• Administrative approvals: Ensure internal procedures for approving prosecutions under s 9(2)(a) are clear, and that approvals are documented where an agreement requires prior sign-off by the Commissioner of Police or the council chief executive.
• Expiation regime and revenue: If expiation fees are to be used, confirm regulatory settings (s 15(2)(c)). Where fines are recovered under a council agreement, account for those funds in accordance with the agreement and applicable local government financial rules (s 9(2)(c)).

Drivers and vehicle owners

• Observe signage and permits: Abide by posted conditions, respect designated disabled bays, loading and restricted areas, and observe time limits. When parking in permit or disabled parking areas, display the relevant permit in accordance with s 8(8).
• Responding to pre-proceedings notices: If an owner receives a s 14(4) notice and was not the driver, respond with a statutory declaration within 21 days naming the driver to preserve the defence in s 14(5). If a vehicle was unlawfully taken or used, gather evidence to support an owner defence under s 14(5)(a).
• Keep permits valid: Disabled persons parking permit holders should ensure their permits are current and displayed in the manner required by Motor Vehicles Act 1959 standards (s 8(8)(a)).

Operators (towing, private enforcement firms)

• Confirm authority before acting: Verify owner authority and that proper signage is in place before towing or immobilising vehicles, given the evidentiary presumptions and potential defences. Confirm whether the area is subject to a council agreement and whether the council or authorised officer has instructed enforcement.
• Check exemptions: Verify whether a vehicle qualifies as an exempt vehicle under s 4 and s 11 before imposing sanctions.

Regulatory compliance and standards

• Check current regulations and codes: Because expiation fees, the code of notices and the incorporation of standards are regulatory matters (s 15-16), regularly review the contemporary regulations and any incorporated codes to ensure signage, marking, permits and enforcement practices comply.
• Public accessibility of standards: If regulations incorporate external standards, check that the Minister has made a copy available for public inspection as required by s 16(2). Non-availability might be raised as a defence to enforcement.

Dispute avoidance and documentation

• Maintain contemporaneous documentation of signage installation, permit issuance, consultations with council and any Ministerial approvals for charging (s 13). Documentation will be material in defending enforcement actions, addressing rebuttals to the presumption in s 10 and s 14(2), and in responding to owner notices under s 14(4).
• Where councils are involved, agree roles and communication protocols in writing and keep records of approvals for prosecutions and enforcement directions in case of procedural challenges under s 9(2)(a).

In sum, compliance focuses on correct signage and marking, proper issuance and exhibition of permits, procedural compliance with notice and statutory declaration regimes, clarity about enforcement arrangements with councils, and observance of ministerial approval requirements in regulated shopping centre contexts.
