What it does
These Rules, titled the Private Health Insurance (Data Provision) Rules 2018, specify what data private health insurers must provide to the Secretary of the Department for particular categories of insured treatment. The Rules do not set out enforcement or penalty provisions themselves; they operate for the purpose of section 172‑10(1) of the Private Health Insurance Act 2007 (the Act), and therefore link the data‑provision requirement to the Act’s mechanisms (see s 5(1)). The Rules achieve their effect by incorporating, by reference, named data protocols that the Department has approved. Those protocols are given precise names and approval details in the Rules’ definitions (see s 4). Under s 5(1) a private health insurer must give to the Secretary the information specified in each of the listed protocols: GT‑Dental Data from Insurers to the Department; HCP1 Data from Insurers to the Department; HCP1 Data from Insurers to the Department 2024‑25; and HCP2 Data from Insurers to the Department. Each incorporated protocol is defined in the Rules as a document (or set of documents) approved by an Assistant Secretary of a named branch of the Department on a stated date and internally described as containing “Data Specifications” and “Explanatory Notes” (see s 4 definitions for GT‑Dental, HCP1, HCP1 2024‑25 and HCP2). Mechanically, the Rules convert those externally maintained protocols into binding data obligations on private health insurers by reference. The Rules also state the scope of the reporting obligation: the information is to be provided “in relation to the treatment of insured persons under complying health insurance products that are referable to health benefits funds” (s 5(1)). The Rules themselves are short; they do not reproduce the data fields or transmission mechanics. Instead they rely on the Department‑approved protocols to define the detail of what must be given.
