• Until payment timetables and methods are specified in the Rules or regulations (s 8; s 9), set aside provisioning procedures to meet potential levy charges based on prior census counts. Establish internal approval processes for remittances once the rate and payment date are announced.

6. Design internal controls for reporting and audit readiness

• Expect the Rules to require returns, records and possibly an audit trail of policy counts and payments. Put in place retention policies and document handling for census-day reports, cross-checks, and reconciliation. Because no enforcement provisions appear in the Act, any procedural recourse or document requirements are likely to be specified in subordinate instruments.

7. Stakeholder communication and pricing considerations

• Assess whether to absorb, allocate, or pass through the cost of any levy to policyholders. The Act does not prescribe how the levy interacts with premium-setting or product design. Ensure compliance teams coordinate with actuarial, pricing and customer-communications functions so that any changes in premiums or product terms are handled in accordance with the insurer’s legal and regulator obligations.

8. Governance for dispute management

• Even though the Act does not provide dispute-resolution mechanisms, subordinate instruments may. Establish an internal escalation path for disputes about counts, classifications, or payments. Monitor Rules for objection, review, or refund processes.

9. Coordinate with third-party administrators and IT providers

• If policies are administered externally, ensure contracts require third-party administrators to provide census-day snapshots and certification of counts. Make sure system interfaces can produce reliable data extracts for the exact date-time required by the Rules.

10. Legal and regulatory watch

• Keep counsel and compliance officers on alert to check:
  • whether the Minister determines supplementary complaints levy days (s 5(1)(b); s 5(3));
  • whether the rate for any levy day is zero (s 6(2)(c));
  • whether the Rules or regulations introduce exemptions, deferrals, or special calculation methodologies (s 8; s 9). Promptly adjust operational processes in response to new or changed instruments.
