#### 57 Secretary may direct licensee to engage external expert 57 Secretary may direct licensee to engage external expert > > (1) The Secretary may give a direction in writing to the licensee of a private health facility requiring the licensee to engage an external person or body to provide expert advice to the licensee on specified matters that relate to the conduct of the facility. > > > (2) The Secretary may, in such a direction, specify that the licensee must engage a person or body having specified expertise or knowledge. > > > (3) A direction may only be given under this section if the Secretary has reason to believe that the licensee is not conducting the facility in accordance with this Act, the regulations or a licence condition. > > > (4) A person who is given a direction under this section is liable for any costs incurred in complying with the direction. > > > (5) A person who is given a direction under this section must not, without reasonable excuse, fail to comply with the direction. > > > > Maximum penalty—200 penalty units.
