sec.162 Application of offence provision requiring licences for day hospitals and other provision
This section applies if— immediately before the commencement day— a person operated a facility that, after the commencement day, is a day hospital; and the person did not have a licence to use under the repealed division for the day hospital; and the person is required to be a licensee to operate the day hospital under this Act; and the same health services are provided at the day hospital as were provided immediately before the commencement day. Section 39 does not apply to the operation by the person of the day hospital until 6 months after the commencement day. (sec.162-ssec.1) This section applies if— immediately before the commencement day— a person operated a facility that, after the commencement day, is a day hospital; and the person did not have a licence to use under the repealed division for the day hospital; and the person is required to be a licensee to operate the day hospital under this Act; and the same health services are provided at the day hospital as were provided immediately before the commencement day. (sec.162-ssec.2) Section 39 does not apply to the operation by the person of the day hospital until 6 months after the commencement day.
- (a) immediately before the commencement day— (i) a person operated a facility that, after the commencement day, is a day hospital; and (ii) the person did not have a licence to use under the repealed division for the day hospital; and
- (i) a person operated a facility that, after the commencement day, is a day hospital; and
- (ii) the person did not have a licence to use under the repealed division for the day hospital; and
- (b) the person is required to be a licensee to operate the day hospital under this Act; and
- (c) the same health services are provided at the day hospital as were provided immediately before the commencement day.
