41 Revocation of temporary public interest determination S. 41(1) amended by No. 20/2017 s. 106(2). (1) The Information Commissioner must revoke a temporary public interest determination if satisfied that— (a) the public interest in the organisation doing the act or engaging in the practice no longer substantially outweighs the public interest in complying with the Information Privacy Principle or approved code of practice specified in the determination; or (b) the reasons set out in the application for the determination no longer apply. S. 41(2) amended by No. 20/2017 s. 106(2). (2) Before revoking a temporary public interest determination, the Information Commissioner must give the organisation a written notice stating— S. 41(2)(a) amended by No. 20/2017 s. 106(2). (a) that the Information Commissioner intends to revoke the determination; and (b) the reasons for the intended revocation; and (c) that the organisation may make a submission as to why the determination should not be revoked. S. 41(3) amended by No. 20/2017 s. 106(2). (3) The Information Commissioner must consider any submission received under subsection (2)(c) within the period stated in the notice, before revoking the temporary public interest determination.
