42Preliminary inquiries

#### 42 Preliminary inquiries (1) Where a complaint has been made to the Commissioner, the Commissioner may, for the purpose of determining: (a) whether the Commissioner has power to investigate the matter to which the complaint relates; or (b) whether the Commissioner may, in his or her discretion, decide not to investigate the matter; make inquiries of the respondent or any other person. (2) The Commissioner may make inquiries of any person for the purpose of determining whether to investigate an act or practice under subsection 40(2).
