Prisoners (Interstate Transfer) Regulations 2024

The Regulations operate as a short, descriptive instrument that pins down six primary concepts: authorisation, commencement, revocation, prescribed officer for consent, prescribed form of certification, and prescribed holders for revocation of transfer orders on escape. Each concept is narrowly tied to a provision of the Prisoners (Interstate Transfer) Act 1983, as indicated in the Regulations.

Authorisation. The Regulations are made under section 35 of the Prisoners (Interstate Transfer) Act 1983 (reg 2). That identifies the statutory power delegated to make subordinate rules addressing procedural or administrative matters under the Act. The text confines itself to that delegated authority.

Commencement. The Regulations commence on a specified date, 3 May 2024 (reg 3). The Endnotes clarify the making date and the Governor in Council as maker. The prescribed commencement fixes the timeline for when designated officers and prescribed certification requirements become operative.

Revocation. The 2014 Regulations are expressly revoked (reg 4). Revocation replaces any mechanisms previously contained in the 2014 instrument with the new prescriptions. The explanatory note in the Endnotes cross-references S.R. No. 26/2014 as the instrument being replaced.

Prescribed officer for necessary consents. For the purposes of a specific consent provision in the parent Act, section 13(2), the Secretary to the Department of Justice and Community Safety is defined as the prescribed officer (reg 5). The term "prescribed officer" is a legal trigger point within the Act which, once specified by regulation, directs where certain statutory consents must come from.

Certification of copy documents. The Regulations avoid creating a bespoke certification regime. Instead, they import the formal certification requirements of another statute. A copy of an order or other document is to be certified "in the prescribed manner" if it is certified according to the requirements of Part 5 of the Oaths and Affirmations Act 2018 (reg 6). This connects evidentiary and authentication standards under the transfer Act to the established oath and affirmation framework.

Revocation of an order of transfer on escape from custody. The Regulations list the holders of "prescribed office or position" for the purposes of section 34 of the Act: the Minister, the Secretary to the Department of Justice and Community Safety, the Attorney-General and the Director of Public Prosecutions (reg 7). The list identifies who may act to revoke an interstate transfer order when a transferred prisoner escapes custody, as contemplated by the Act.

The main concepts are therefore administrative and nominative. The Regulations do not introduce new substantive offences or sentencing rules. They create deterministic links: where the parent Act calls for "prescribed officers", "prescribed manner" or "holder of prescribed office", the Regulations answer who and how, by reference to named offices and to Part 5 of the Oaths and Affirmations Act 2018.

The Regulations allocate duties and processes to a small set of public offices and indirectly affect any person or body that interacts with interstate prisoner transfer processes under the parent Act. The primary affected parties are specified in the Regulations themselves.

Departmental and ministerial officers. The Secretary to the Department of Justice and Community Safety is named in two places: as the prescribed officer for the purposes of section 13(2) (reg 5), and as one of the holders of prescribed office or position empowered to revoke an order of transfer on escape from custody (reg 7). The Secretary and their office therefore bear administrative responsibilities under the transfer regime. The Minister and the Attorney-General are also listed in reg 7 as those who may revoke an order of transfer on escape from custody. The Director of Public Prosecutions is included alongside those offices.

Agencies producing or receiving certified documents. Any agency, court registry or official required to produce a certified copy of an order or other document for purposes under section 26(2) of the parent Act will be required to certify that copy according to Part 5 of the Oaths and Affirmations Act 2018 (reg 6). This affects front-line administrative staff, registrars, and legal officers who prepare transfer documentation.

Transferee prisoners and sending/receiving jurisdictions. While the Regulations do not set out the rights of prisoners or the operational rules for transfer, they affect the administrative pathway through which consents, certifications and revocation decisions are processed. Practically, prisoners whose transfers rely on consents or certified documentation must have those items issued by or through the prescribed officers and in the prescribed form. Interstate correctional authorities and interstate prosecutorial or legal offices engaged in transfer arrangements will need to observe that consents and revocation requests come from the offices named.

Legal practitioners, compliance officers and external counsel. Lawyers and compliance professionals acting for prisoners, family members, or state authorities will need to know which offices can legally give consents under section 13(2), which offices can revoke transfers on escape, and what form certification must take. The Regulations narrow the list of authorised signatories and define the certification pathway, which affects how practitioners draft, lodge, and authenticate documents for transfer-related processes.

The general public. Indirectly, the public and media have an interest insofar as the Regulations shape how interstate transfer actions are authorised and how revocation occurs after escape. The instrument centralises certain decisions in named offices, which has implications for accountability and the locus of administrative action.

In short, the immediate effect is on public offices named in regs 5 and 7 and on all organisational actors who must produce, accept or rely on certified documents under reg 6 in the context of the parent Act.

The Regulations create limited but discrete duties by naming who may perform particular statutory acts and prescribing the form of documentary certification. They do not purport to create new substantive rights for prisoners, but they shape the procedural architecture that implements rights and duties in the parent Act.

Duties on named offices. The Secretary to the Department of Justice and Community Safety is prescribed for the purposes of section 13(2) of the parent Act (reg 5). While the Regulations do not reproduce section 13(2), the naming of the Secretary imposes an administrative duty: where section 13(2) requires consent from a "prescribed officer", that consent must come from the Secretary. The Secretary also appears in reg 7 as a person who may revoke an order of transfer on escape from custody, aligning the Secretary with decision-making responsibilities under section 34 of the Act.

Ministerial and prosecutorial duties. The Minister, the Attorney-General and the Director of Public Prosecutions are each listed in reg 7 as holders of a prescribed office or position for the purposes of revoking an order of transfer on escape. That list places statutory authority to cancel a transfer order with executive and prosecutorial offices. The Regulations therefore allocate revocation power among those offices; the precise exercise of that power remains governed by section 34 of the Act.

Documentary certification duty. Regulation 6 prescribes the manner in which copies of orders or other documents must be certified for the purposes of section 26(2). The duty is not to use a bespoke format but to adopt the certification requirements in Part 5 of the Oaths and Affirmations Act 2018. Any official who certifies a document for transfer purposes must comply with those Part 5 requirements.

Rights affected indirectly. The Regulations do not enumerate individual rights. However, they alter the administrative pathway for exercise of procedural rights in the parent Act by specifying who may give or revoke consents and how documents must be certified. For example, a prisoner whose transfer depends on a consent under section 13(2) will have that procedural right realised only if the consent comes from the Secretary designated in reg 5. Likewise, revocation of a transfer on escape will be available only through the offices listed in reg 7.

Discretion and delegations. The Regulations name offices rather than individuals. They do not specify whether the Secretary or other named offices may delegate the functions for which they are prescribed. The presence of titles imposes a formal locus of decision-making but leaves open, in the absence of express provision, whether and how delegation within those offices is permitted under other governance instruments or the parent Act.

No penalties created. The Regulations do not create offences, fines or criminal penalties within their text. They are procedural and nominative, establishing administrative duties about who acts and how papers are certified, rather than imposing sanctions for non-compliance in the Regulations themselves.

The Regulations do not contain express penalty or enforcement clauses. They operate by prescribing who is authorised to perform particular functions under the parent Act and what form certification must take. Enforcement and any sanctions for non-compliance are therefore not supplied within these Regulations, and instead will depend on the mechanisms and remedies available under the Prisoners (Interstate Transfer) Act 1983 and other applicable laws.

Absence of penalty provisions. A review of the Regulations shows no monetary penalties, criminal offences, compliance notices or infringement frameworks. The instrument’s provisions are administrative: they identify a prescribed officer (reg 5), prescribe certification under another Act (reg 6), and list holders of offices with revocation powers (reg 7). The text contains no enforcement mechanisms that the Regulations alone can invoke.

Reliance on the parent Act for enforcement. Because the Regulations are made under section 35 of the Prisoners (Interstate Transfer) Act 1983 (reg 2), any enforcement consequences for failure to adhere to the procedural prescriptions will depend on the parent Act’s provisions about validity, effect, or consequences of actions taken without required consents or certifications. The Regulations link directly to particular sections of the Act: section 13(2), section 26(2), and section 34. Remedies, invalidity rules, or offences, if any, will be located in those sections of the parent Act. The Regulations do not expand or narrow enforcement beyond naming the relevant offices and the method of certification.

Operational enforcement. Practically, compliance will be enforced through administrative practice: courts, registries and receiving authorities are likely to reject transfer applications, certified copies or revocation notices that do not bear the prescribed signatories or do not comply with the prescribed certification method. The instrument substitutes a legal test for authenticity and authorised signatory: if a consent or revocation is required to come from a "prescribed officer" or "holder of prescribed office", parties and agencies will look to the Regulations to determine validity. Similarly, recipients will expect certification to follow Part 5 of the Oaths and Affirmations Act 2018 as the prescribed manner.

Accountability and review. The Regulations centralise particular functions in named offices, which concentrates administrative responsibility. Any review, internal audit or judicial challenge about whether a consent or revocation was properly made will hinge on whether the document was issued by the prescribed office or certified in the prescribed manner. The Regulations themselves do not establish review pathways or appeal rights. Those procedural mechanisms will need to be sought in the parent Act or general administrative law avenues.

Sunset and lifecycle enforcement. The Endnotes record that the Regulations will sunset 10 years after the day of making on 16 April 2034 under the Subordinate Legislation Act 1994 (Endnote 1). Any enforcement regime tied to these prescriptions will cease to be operative on sunsetting unless the instrument is remade or replaced.

The Regulations explicitly cross-reference two primary instruments: the Prisoners (Interstate Transfer) Act 1983 and the Oaths and Affirmations Act 2018. They also engage with the Subordinate Legislation Act 1994 by operation of the Endnotes. The interaction is naming, incorporation by reference, and lifecycle governance.

Delegation to the parent Act. The instrument is made under section 35 of the Prisoners (Interstate Transfer) Act 1983 (reg 2). The Regulations therefore function as subordinate provisions to implement particular procedural aspects of the Act. Several Regulations are expressly "for the purposes of" specific sections of the parent Act: reg 5 for section 13(2), reg 6 for section 26(2), and reg 7 for section 34. This means the Regulations do not stand alone, but supply answers to statutory prompts in the main Act where the Act refers to "prescribed officers", "prescribed manner", or "holders of prescribed office".

Incorporation by reference to the Oaths and Affirmations Act 2018. Regulation 6 prescribes that a copy of an order or other document is certified in the prescribed manner if it is certified according to the requirements of Part 5 of the Oaths and Affirmations Act 2018. That is an incorporation by reference of procedural requirements from another statute. Practically, the legal standard for certification under the transfer Act now depends on the content of Part 5 of the Oaths and Affirmations Act 2018. Any change to that Part will affect certification for transfer purposes unless the reference is amended.

Sunsetting framework under Subordinate Legislation Act 1994. The Endnotes record that the Regulations will sunset 10 years after the day of making, on 16 April 2034, pursuant to section 5 of the Subordinate Legislation Act 1994 (Endnote 1). This places the Regulations within the lifecycle and review framework of subordinate legislation, triggering potential automatic cessation and the need for renewal if continued operation is desired.

Revocation of earlier subordinate law. Regulation 4 expressly revokes the Prisoners (Interstate Transfer) Regulations 2014. The revocation severs reliance on the 2014 text and replaces it with the 2024 prescriptions. Any transitional issues, saving provisions or references to the 2014 Regulations elsewhere in subordinate instruments are not addressed in this instrument; those matters will require attention in practice to ensure no gaps have been created.

Interplay with administrative law and delegation regimes. The Regulations name offices rather than individuals and do not state delegation rules. How named officers allocate tasks within their administrative structures will depend on internal administrative law, public service rules and the parent Act. The Regulations therefore co-exist with internal governance instruments, which will determine delegation, signature authority and record-keeping practices.

No interaction with penal or evidentiary statutes within the Regulations. Apart from incorporating Part 5 of the Oaths and Affirmations Act 2018 for certification purposes, the instrument does not reference other laws governing evidence, offences, extradition, or corrections. Any cross-jurisdictional or evidentiary implications outside the named Acts will be managed through the parent Act and other applicable laws.

The Regulations are new as at the version provided and have a minimal recorded amendment history. The Endnotes state there are no amendments made to the Prisoners (Interstate Transfer) Regulations 2024 by statutory rules, subordinate instruments or Acts (Endnote 2). The salient chronology recorded in the instrument is as follows.

Making and commencement. The Regulations were made on 16 April 2024 by the Governor in Council under section 35 of the Prisoners (Interstate Transfer) Act 1983 and came into operation on 3 May 2024 (reg 3 and Endnote 1).

Revocation of predecessor instrument. The Regulations revoke the Prisoners (Interstate Transfer) Regulations 2014 (reg 4). The explanatory detail cites S.R. No. 26/2014 as the instrument revoked (Endnote 3). The revocation is an immediate substitution: the 2014 Regulations are removed and the 2024 Regulations take effect from their commencement date.

Sunset provision. The Endnotes record that these Regulations will sunset 10 years after the day of making on 16 April 2034 in accordance with the Subordinate Legislation Act 1994 (Endnote 1). That temporary lifecycle is a statutory governance feature that sets an expiry date unless the instrument is remade, renewed or preserved by the amendment or repeal of the Subordinate Legislation Act 1994 or by other legislative action.

No recorded amendments since making. The instrument’s Endnote 2 lists that there are no amendments attributable to statutory rules, subordinate instruments or Acts. That indicates a clean version history to date, with only the initial making and the replacement of the 2014 Regulations recorded.

Practical implication for counsel and administrators. Because the Regulations are recent and have no amendment history, practitioners should monitor whether any future subordinate instruments or amendments alter the list of prescribed officers, the certification reference, or commencement and sunset arrangements. The regulations’ reliance on external Acts for certification and its revocation of the 2014 instrument mean that any future change to the Oaths and Affirmations Act 2018 or to the parent Act could affect operation without amendment to these Regulations themselves.

The Regulations contain no litigation history in their text or Endnotes. The instrument’s Endnotes do not list any judicial decisions, challenges, or litigation arising from the Regulations. The record in the Endnotes is limited to administrative facts: the making date, the Governor in Council as maker, commencement, revocation of the 2014 Regulations and the sunset date (Endnote 1).

No reported cases cited. The Regulations themselves do not reference any judicial interpretation or precedent. They are regulatory and nominative in nature; no cases are named within the instrument.

Implication of absence of litigation. The lack of litigation history in the instrument does not indicate that disputes could not arise. Potential areas for legal challenge would typically be whether a particular consent, certification or revocation complied with the parent Act and the Regulations. Any judicial review or statutory interpretation proceedings would look to the parent Act’s provisions, section 13(2), section 26(2) and section 34,together with these Regulations to determine whether an administrative act met the prescribed requirements. However, there are no recorded or cited instances of such proceedings in the text provided.

Monitoring recommended. Given the Regulations’ centralisation of particular functions in named offices, cases could arise in future concerning the validity of consents or revocations if those acts are performed by persons not named, or if certification departs from Part 5 of the Oaths and Affirmations Act 2018. Practitioners and compliance officers should track any administrative decisions or judicial determinations that interpret the interplay between the parent Act and these Regulations, even though none are recorded here.

Several practical pitfalls arise from the Regulations’ design choices. These are not judgments about policy, but identification of places where administrative friction, uncertainty, or unintended outcomes are likely unless addressed in practice.

Concentration of prescribed authority. The Regulations prescribe a narrow set of offices for key functions. For instance, reg 5 makes the Secretary to the Department of Justice and Community Safety the prescribed officer for the purposes of section 13(2). Reg 7 lists only four offices for revocation of an order of transfer on escape: the Minister, the Secretary, the Attorney-General and the Director of Public Prosecutions. If the parent Act requires consent or revocation from a "prescribed officer", and the Regulations narrow that class to these named offices, any document signed by a delegate or by another official may be treated as invalid for the statutory purpose unless delegation is expressly permitted under other laws or internal instruments. A pitfall arises where operational practice assumes broader signatory authority than the Regulations allow.

Reliance by reference on another Act’s Part 5. Regulation 6 requires certification to follow the requirements of Part 5 of the Oaths and Affirmations Act 2018. That provides a clear procedural specification but imports an external standard whose content is not reproduced in these Regulations. Changes to Part 5 or differing interpretations of Part 5 will affect transfer documentation without the need to amend these Regulations. Practically, parties must consult Part 5 to ensure compliance, and any inconsistency between local practice and Part 5 standards can invalidate certified documents for the purposes of the transfer Act.

No express delegation or substitution rules. The Regulations name offices but do not state whether functions may be delegated within those offices, and if so, to whom. If operational staff are required to act in time-sensitive circumstances, such as dealing with escape or urgent revocation, a lack of explicit delegation can create procedural paralysis or cause reliance on unauthorised signatories. That is a practical risk for correctional services and prosecutorial teams.

Revocation without transitional savings. The instrument revokes the 2014 Regulations (reg 4) but contains no transitional provisions in the text provided. If the 2014 Regulations included different or broader prescriptions for officers, there may be a period of adjustment to the new regime. Records, templates and operational processes must be updated to align with the 2024 prescriptions to avoid reliance on the old regime.

No penalty provisions in the Regulations. Because the Regulations do not themselves establish penalties, there is potential uncertainty about consequences of procedural non-compliance. That increases the importance of verifying whether a consent, certification or revocation is strictly compliant before acting on it. Organisations cannot rely on the Regulations to provide an enforcement framework; instead they must look to the parent Act and administrative practice.

Sunset creates time-limited certainty. The Endnotes state the Regulations will sunset on 16 April 2034 unless remade (Endnote 1). That creates a legal expiry date. Entities that invest in systems and templates should plan for renewal or replacement before the sunset date to avoid operational gaps.

Naming rather than specificity. The Regulations identify titled offices without specifying the mechanics or forms for consents and revocations. Practitioners must therefore prepare administrative protocols to capture the statutory requirements in practice, including signature blocks, attestation language conforming to Part 5 of the Oaths and Affirmations Act 2018, and records of authority in the Secretary’s office.

Compliance is narrowly procedural but important for the validity of interstate transfer processes. The Regulations identify three compliance checkpoints: consents under section 13(2), certification of copies under section 26(2), and revocation of orders under section 34. Below are concrete steps and administrative controls that implement the prescriptions in regs 5-7, together with lifecycle considerations from commencement and sunset.

1. Update delegations and authorisation registers

• Record the Secretary to the Department of Justice and Community Safety as the prescribed officer for section 13(2) consents (reg 5). Ensure the Secretary’s instrument of appointment and any internal delegation schedules are current and readily available.
• Record the Minister, the Secretary, the Attorney-General and the Director of Public Prosecutions as the offices authorised to revoke transfer orders on escape (reg 7). Maintain an internal list of who within those offices can sign and whether any delegation is permitted under public service rules or the parent Act.

2. Implement a signature and certification protocol

• For documents required under section 26(2) of the parent Act, adopt the certification format demanded by Part 5 of the Oaths and Affirmations Act 2018 (reg 6). Obtain a copy of Part 5 and create templates that match its requirements, including any prescribed wording, attestation statements and authorised certifiers.
• Ensure registrars, correctional registries and legal support units are trained to use the templates and to verify that the certifier is authorised under Part 5.

3. Revise operational forms and filing systems

• Replace any forms or templates that relied on the 2014 Regulations with updated forms reflecting the 2024 prescribed offices and the Part 5 certification process. Remove references to repealed provisions and obsolete signature lines.
• Keep a version control log showing when forms were updated to the 3 May 2024 commencement.

4. Train staff in chain-of-authority and time-critical processes

• Train correctional staff, prosecutorial units and legal officers on whom to approach for consents under section 13(2) and for revocation under section 34. Establish contact protocols with the Secretary’s office, the Minister’s office, the Attorney-General’s office and the DPP so that time-sensitive communications about escape and revocation are handled correctly.
• Clarify internal delegation rules where allowed. If delegation is not permitted under the parent Act, create a rapid escalation process to the named office holders.

5. Audit and verification checkpoints

• Institute a checklist for incoming consents and certified copies to verify: (a) whether the signatory is from a prescribed office; (b) whether the certification complies with Part 5 of the Oaths and Affirmations Act 2018; and (c) whether the certificate is dated and supported by appropriate identity checks.
• Require legal sign-off before actions that depend on consents or revocations are executed, to minimise the risk of acting on defective instruments.

6. Recordkeeping and provenance

• Maintain electronic and hard-copy records of all consents, certified copies, and revocation notices, annotated with the statutory basis (section 13(2), section 26(2), section 34) and the corresponding regulation (reg 5, reg 6, reg 7).
• For certified copies, retain the underlying Part 5 attestation and any identity verification documents relied on by the certifier.

7. Lifecycle management and legislative monitoring

• Note the sunset date in planning documents. The Regulations will sunset on 16 April 2034 unless remade (Endnote 1). Plan for review and potential amendment well in advance to avoid a regulatory gap.
• Monitor Part 5 of the Oaths and Affirmations Act 2018 for changes that could affect certification requirements. Amend templates and training in response to any statutory modifications.

8. Liaise with external jurisdictions

• Where interstate documentation originates from or will be sent to other jurisdictions, confirm that those bodies will accept certification in the form required by Part 5. Where necessary, obtain confirmatory legal opinion or execute any additional authentication steps that the receiving jurisdiction requires, while preserving the prescribed domestic form.

9. Contingency planning for escapes

• Given reg 7 lists the offices that may revoke a transfer order on escape, develop incident-response checklists that specify which office to contact, who within that office can sign, and the timeline for obtaining revocation. Include escalation paths if primary contacts are unavailable.

10. Legal vetting

• Have legal counsel review all templates and procedural manuals to confirm that the practices align with regs 5-7 and the referenced sections of the parent Act. Where there is uncertainty about delegation or the scope of "prescribed officer" under the parent Act, seek formal advice.

By adopting these steps, agencies and practitioners will align operational practice with the narrow prescriptions in the Regulations: consent sourcing from the Secretary (reg 5), certification in accordance with Part 5 of the Oaths and Affirmations Act 2018 (reg 6), and revocation authority residing in the offices listed in reg 7.
