Primary Produce (Food Safety Schemes) (Meat) Regulations 2017

The regulations organise the meat safety regime around a handful of core concepts: accreditation, “meat” (scope), approved food safety arrangements and compliance with standards, marking and branding, sale prohibitions, evidentiary presumptions, and a fees system.

• Accreditation and the Minister’s role. The Minister is the accreditation body (reg 6). A person must not carry on the business of producing meat without accreditation, subject to narrow exceptions (reg 7(1)-(2)). An applicant must satisfy the Minister that the applicant has the capacity or appropriate arrangements to meet the Act and these regulations applicable to the activities to be accredited (reg 9; s 15(1)(c) of the Act is referenced). Separate accreditations are required for operations on separate discrete premises (reg 8). The Minister may designate authorised persons or inspectors by condition of accreditation for enforcement functions (reg 11(3)(f)).

• Definition and scope of “meat”. Regulation 4 expands the definition of meat for the Act to include a range of processed products identified in the Food Standards Code (reg 4(1)(a)), such as cured, dried, manufactured and processed meats and ready‑to‑eat products. It expressly includes minced meat, salted meat and tripe (reg 4(1)(b)). It excludes certain prepared foodstuffs, for example meat pies, sausage rolls, canned meats, and pasta containing meat (reg 4(1)(c)). The regulation also defines “cooked” for core‑temperature standards (reg 4(2)). These definitions set the perimeter of regulatory coverage and therefore who must obtain accreditation and follow the codes.

• Approved food safety arrangement. Accredited meat producers must adopt an approved food safety arrangement (reg 10). The regulations preserve previously approved arrangements from the revoked 2006 regulations (Sch 3, cl 3). The adoption requirement carries a penalty if not complied with (reg 10).

• Compliance with codes. Regulation 11 requires accredited meat producers to carry on authorised activities in compliance with the codes in Schedule 1. Schedule 1 incorporates specific Australian Standards (for example AS 4696:2007, AS 4465:2005, and parts of the Food Standards Code) according to the type of activity (Sch 1). Regulation 11(3) contains a list of textual substitutions that adapt the standards to the state accreditation framework, for example substituting “Controlling Authority” with “Minister” and “licensee” with “accredited meat producer” (reg 11(3)(a)-(e)). The Minister can, on application, exempt a producer from specified provisions if alternative arrangements will allow compliance within a specified period (reg 11(2)).

• Marking, brands and container labelling. Before meat is removed from accredited premises for human consumption, it must be safe and suitable and marked as such (reg 14(1)). Containers must be marked with the accreditation number and date of packing before removal (reg 15(1)). The Minister may lease brands and impose conditions and fees for that lease (reg 16(1)). A lessee must take reasonable steps to prevent theft or misuse of the brand and must return it within seven days after specified events (reg 16(2)-(3)). There is an offence to manufacture or possess an unauthorised brand (reg 17).

• Sale prohibitions. The sale of meat for human consumption or for pet consumption is prohibited unless the meat has been “lawfully produced” (see reg 3(2)-(3) which ties lawfulness to compliance with the Act and these regulations or equivalent laws of other States or Territories, or lawful importation) and is safe and suitable (regs 18-19).

• Evidence rules and burden. Regulation 20 contains evidentiary presumptions used in prosecutions under the Act and these regulations. Allegations that a matter was meat, intended for human or pet consumption, or that a sale was for those purposes, are accepted as proved unless proof to the contrary is given (reg 20(1)). Presence of meat on premises used for selling meat is, in the absence of proof to the contrary, proof that it was being offered, exposed or stored for sale by that person (reg 20(2)). These are procedural mechanisms that shift evidentiary burdens in prosecutions.

• Fees, returns and calculations. Accredited producers must pay an annual fee and lodge an annual return by 30 June each year (reg 21(1)). The regulations refer to “fee notice” and the Legislation (Fees) Act 2019 for the means of prescribing fees (reg 21(5)). The Minister may decide the “relevant period” and determine nature and level of activity using mass of meat processed or number of positions held (reg 22(1)(a)-(c)). The Minister may require specified information to determine fee matters (reg 22(2)). Applicants must pay a pro rata fee before grant (reg 23).

Collectively, these concepts create a regulatory regime that moves a range of meat production and selling activities into a controlled accreditation and standards framework administered by the Minister, with compliance anchored to adopted food safety arrangements and specified Australian Standards and Food Standards Code provisions as modified by the regulations.

The regulations target natural persons and corporate entities engaged in producing and selling meat in commercial contexts within South Australia, but they also articulate specific exemptions and definitions that narrow or broaden coverage.

• Accredited meat producers. The primary group affected are “accredited meat producers,” a term defined to include accredited processors or handlers and accredited poultry growers (reg 3(1)). These persons must secure accreditation to carry on the business of producing meat (reg 7(1)) and are subject to obligations in relation to adopted approved food safety arrangements (reg 10), compliance with Schedule 1 codes (reg 11), marking and branding rules (regs 14-17), sale prohibitions (regs 18-19), and fee and return obligations (reg 21).

• Applicants for accreditation and premises operators. A person applying for accreditation must meet capacity requirements (reg 9) and if operating across multiple discrete premises must apply separately for each (reg 8). The obligation to obtain accreditation attaches to the business of producing meat rather than a single individual; body corporates must notify changes to the registered corporate office within the 14‑day notice window (reg 13(b)).

• Poultry growers and distinct classes. The regulations expressly create the category “accredited poultry grower” and make particular allowances and exceptions for poultry in the marking rules (reg 14(2)(b)) and container marking (reg 15(2)). Schedule 1 lists distinctive Standards for poultry activities (Sch 1, items 2 and 3, referencing AS 4465:2005 and Standard 4.2.2 of the Food Standards Code).

• Retail meat processors and handlers. The regulations define “retail meat processor and handler” by a threshold test: at least 50% of meat sold by mass is sold by retail and not more than 4 tonnes is sold by wholesale during the relevant period (reg 3). That definition affects fee classification and potentially which Schedule 1 code applies.

• Sellers of pet meat. The regulations have a specific regime for meat produced for pet consumption. Different standards apply (Sch 1, item 8 references AS 4841:2006) and the sale prohibition in reg 19 requires the meat to have been lawfully produced for pet consumption and to be suitable.

• Persons handling imported meat or meat produced elsewhere in Australia. “Lawfully produced for human consumption” and “lawfully produced for consumption by pets” include meat lawfully imported into Australia or, to the extent produced in Australia, produced in accordance with the Act and these regulations, or in accordance with laws of other States or Territories (reg 3(2)-(3)). That ties importers and interstate producers into compliance expectations where their products are sold in South Australia.

• Small operators and household exceptions. The accreditation obligation does not apply to: the growing of poultry, killing of an animal, or further processing on premises by an owner where none of the meat is sold, used as paid food or taken away (reg 7(2)(a)); killing of wild game where none of the meat is sold or used for business purposes (reg 7(2)(b)); or certain minor further processing in the course of retail sale, or non‑business household processing (reg 7(2)(c)). These carveouts exempt non‑commercial, on‑premises consumption and certain retail slicing/packaging activities from accreditation.

• Lessees of brands and related third parties. The Minister may lease brands for marking meat (reg 16(1)). Lessees and their employees or agents are bound by duties to prevent misuse (reg 16(2)) and to return brands (reg 16(3)). Persons who manufacture or possess unauthorised brands without Ministerial approval commit an offence (reg 17), though possession by lessee's employees at the authorised premises is carved out (reg 17(2)).

• Inspectors and authorised persons. The standards’ substantive operation will be enforced by “authorised persons” or persons designated by the Minister as inspectors under conditions of accreditation (reg 11(3)(f)). Those designated persons will consequently exercise inspection and enforcement functions consistent with the Act and the accreditation framework.

Taken together, the regulations reach a spectrum of commercial actors in the meat supply chain in South Australia , from growers and slaughterers to processors, distributors and retailers , while setting specific standards and carveouts for small, non‑commercial activity, poultry, pet meat and imported product. The Minister’s central role in accreditation, designation, leasing and fee determination means affected parties principally interact with a single state authority under these regulations.

This section summarises the express duties imposed on regulated persons and the rights or discretions conferred on the Minister. Every duty or right below is grounded in the reg numbers cited.

Duties imposed on prospective and accredited producers

• Accreditation requirement: No person may carry on the business of producing meat without accreditation (reg 7(1)). There are specified exceptions for non‑commercial activities, some household processing, wild game killed for non‑business purposes, and certain retail‑context processing (reg 7(2)(a)-(c)).

• Separate accreditation per premises: An applicant who proposes to carry on business at more than one discrete premises must apply for a separate accreditation for each premises (reg 8).

• Capacity demonstration: An accreditation applicant must satisfy the Minister that he or she has the capacity, or has made/proposes to make appropriate arrangements, to satisfy the Act and these regulations for the activities (reg 9; referencing s 15(1)(c) of the Act).

• Adoption of an approved food safety arrangement: Accredited producers must adopt an approved food safety arrangement (reg 10). Failure attracts a maximum penalty and expiation fee (see Penalties).

• Compliance with codes: Accredited producers must ensure activities under accreditation comply with the codes listed in Schedule 1, as modified (reg 11(1)-(3)). The Minister may, on application, exempt a producer from specified code provisions if alternative arrangements are in place to achieve compliance within a specified period (reg 11(2)).

• Approval for new activity: An accredited producer must not carry on activities beyond the classes specified under the accreditation without the Minister’s prior written approval (reg 12).

• Notification obligations: Accredited producers must notify the Minister within 14 days of specified changes: change in business name, change in business address (including registered corporate office), or commencement of building works at premises used under the accreditation (reg 13). This is a low‑level compliance obligation with a statutory maximum penalty.

Marking, branding and container duties

• Meat marking: Producers authorised to slaughter animals must ensure meat intended for human consumption is safe and suitable and is marked as safe and suitable before removal from the accredited premises (reg 14(1)). Specific exemptions apply for meat processed in establishments registered under the Commonwealth Export Control Act 1982 and for poultry (reg 14(2)(a)-(b)).

• Container marking: Containers or other things containing meat intended for human consumption must be marked with the person’s accreditation number and date of packing before removal from the premises, subject to an exclusion for poultry (reg 15(1)-(2)). These markings are in addition to labelling requirements under the Food Act 2001 or other legislation (reg 15 note).

• Brand care and return: If the Minister leases a brand to a producer, the producer must take reasonable steps to prevent theft, defacement or misuse of the brand (reg 16(2)) and return the brand within seven days after cancellation, suspension or surrender of accreditation, or after written request (reg 16(3)).

• Prohibition on unauthorised brands: A person must not manufacture or possess a brand that appears to be a Minister‑leased brand without Ministerial approval (reg 17(1)), but possession by the lessee’s employee at the authorised premises is allowed (reg 17(2)).

Sale duties and evidentiary provisions

• Sale requirements: A person must not sell meat for human consumption unless it has been lawfully produced for human consumption and is safe and suitable (reg 18). For pet meat, a person must not sell it unless it has been lawfully produced for pet consumption and is suitable (reg 19).

• Evidentiary presumptions in proceedings: In prosecutions under the Act or these regulations, specified matters are accepted as proved in the absence of proof to the contrary, for example that specified matter was meat, intended for human or pet consumption, or that the sale was for those purposes (reg 20(1)). Presence of meat on premises used for selling meat is accepted as proof it was intended for sale absent contrary proof (reg 20(2)).

Fee, return and information duties

• Annual fees and returns: Accredited producers must, not later than 30 June each year, pay the annual fee prescribed by fee notice and lodge an annual return (reg 21(1)). The Minister may prescribe penalties for default by fee notice (reg 21(2)). The Minister may waive, defer or reduce payment in appropriate circumstances (reg 21(3)), and may recover fees as a debt (reg 21(4)).

• Fee calculation information obligations: The Minister may determine the relevant period and determine nature and level of activity by reference to mass of meat processed or number of positions during the relevant period (reg 22(1)). An accredited producer must provide specified information if the Minister requires it by written notice to enable fee determination; failure carries a maximum penalty (reg 22(2)).

• Pre‑grant fee payment: Applicants must, before grant, pay a pro rata fee calculated by multiplying the projected annual fee by the proportion of whole months remaining to the next 30 June (reg 23(1)-(2)).

Discretions and rights vested in the Minister

• Accreditation granting and conditions: The Minister is the accreditation body and decides whether to grant accreditation based on an applicant’s demonstration of capacity and arrangements (reg 6; reg 9).

• Exemptions and approvals: The Minister may exempt accredited producers from specified code provisions for a specified period if alternative arrangements are demonstrated (reg 11(2)). The Minister must give prior written approval for activities not specified under an accreditation (reg 12).

• Brand leasing and fees: The Minister may lease brands and impose conditions and a fee for the lease (reg 16(1)).

• Fee and administrative discretions: The Minister may determine the relevant period and activity measures for fee calculation (reg 22), may waive, defer or reduce fees (reg 21(3)), and may determine fees by fee notice under the Legislation (Fees) Act framework (reg 21(5)).

Rights and procedural protections are not extensively detailed in the text; instead the instrument confers discrete administrative discretions and prescribes duties and penalties. Where the regulations permit ministerial exemptions (reg 11(2)) or fee waivers (reg 21(3)), those mechanisms function as compliance relief points but are exercised at ministerial discretion and are not described as rights enforceable by private parties in the text itself.

The regulations specify criminal penalties, expiation fees and administrative enforcement levers tied to specific breaches. The Minister and authorised persons are positioned to administer the regime, and evidentiary provisions shift burdens in prosecutions.

Penalties by provision

• Failure to adopt an approved food safety arrangement (reg 10): Maximum penalty $5 000; expiation fee $315.

• Failure to comply with codes (reg 11(1)): Maximum penalty $5 000; expiation fee $315. The Minister may exempt particular provisions on application (reg 11(2)).

• Failure to notify change in circumstances (reg 13): Maximum penalty $250; expiation fee $80.

• Failure to ensure meat is safe, suitable and marked before removal (reg 14(1)): Maximum penalty $5 000; expiation fee $315.

• Failure to mark containers before removal (reg 15(1)): Maximum penalty $5 000; expiation fee $315.

• Failure to take reasonable steps to prevent brand theft, defacement or misuse (reg 16(2)): Maximum penalty $5 000; expiation fee $315.

• Failure to return brand when required (reg 16(3)): Maximum penalty $2 500; expiation fee $210.

• Manufacturing or possessing an unauthorised brand without approval (reg 17(1)): Maximum penalty $5 000; expiation fee $315.

• Sale of meat for human consumption that is not lawfully produced or not safe and suitable (reg 18): Maximum penalty $5 000; expiation fee $315.

• Sale of pet meat not lawfully produced for pets or not suitable (reg 19): Maximum penalty $5 000; expiation fee $315.

• Failure to provide information to determine matters under reg 22 when required by written notice: Maximum penalty $5 000; expiation fee $315 (reg 22(2)).

These maxima sit alongside the ability for the Minister to prescribe penalties for late payment/lodgement by fee notice under reg 21(2). The regulations also provide for recovery of fees as a debt (reg 21(4)).

Enforcement agents and mechanisms

• Authorised persons and inspectors. Regulation 11(3)(f) replaces references in adopted standards to inspectors or meat safety inspectors with a reference to authorised persons or a person designated (individually or by class) by the Minister by condition of accreditation as an inspector in relation to an accredited meat producer. The text therefore contemplates a body of authorised persons empowered under the Act to inspect premises and enforce compliance, although the Act’s enforcement powers and procedural steps are not reproduced in this instrument.

• Evidence presumptions. Regulation 20(1) and (2) explicitly set out evidentiary presumptions in prosecutions: certain allegations about meat and sales are accepted as proved in the absence of proof to the contrary, and meat found on premises used for selling meat will, absent contrary proof, be treated as being offered for sale. These provisions lower the prosecution’s initial burden on statutory elements like “was being offered for sale” and shift to the defendant the need to provide contrary proof.

• Administrative recovery of fees. The Minister may recover unpaid fees or parts of fees as a debt from the person liable (reg 21(4)). The Minister also may waive, defer or reduce fees where considered appropriate (reg 21(3)), creating an administrative relief power.

• Expiation scheme. Many offences carry expiation fees: a nominee sum is provided with each maximum penalty. Expiation permits out‑of‑court settlement of less serious breaches where the scheme is applied; the regulation provides fixed expiation figures (for example $315 for many $5 000 maximum offences). The practical effect is to create lower‑cost resolution pathways for enforcement action in specified cases.

• Brand recovery and prohibition. The Minister may impose conditions on brand leases, and there is a specific offence for manufacturing or possessing an unauthorised brand (reg 17), which is a direct enforcement mechanism protecting the integrity of marking and supply‑chain traceability.

Limits and practical enforcement risks

• Ministerial discretion is central. The Minister decides accreditation, exemptions to code compliance, approvals for new activities, fee waivers and lease conditions for brands (regs 6, 11(2), 12, 16(1), 21(3)). Enforcement therefore depends in part on exercise of administrative discretion and the Minister’s capacity to delegate to authorised persons.

• Compliance monitoring depends on authorised persons. The standards are adapted to the Minister as authority and to authorised persons or ministerially designated inspectors for on‑the‑ground enforcement (reg 11(3)(f)). The regulations do not set out inspection powers in detail; those are matters for the Act or other instruments.

• Evidentiary presumptions accelerate prosecution thresholds. Regulation 20’s presumptions facilitate enforcement by allowing certain facts to be accepted unless the defendant proves otherwise. That eases the evidential burden for the prosecutor but requires regulators to be prepared to justify those presumptions in the context of particular prosecutions.

• Fee non‑payment recovery is administrative and civil. The Minister may recover fees as a debt (reg 21(4)) rather than by criminal sanction alone; reg 21(2) also contemplates penalties for defaults as prescribed by fee notice.

Collectively, the enforcement architecture combines criminal penalties with administrative debt recovery and a presumptive evidentiary regime, all administered through ministerial discretion and delegated authorised persons. Those mechanics determine how non‑compliance is likely to be policed and resolved in practice.

The regulations cross‑reference and incorporate multiple national and state instruments, aligning state regulation with national food safety standards, Commonwealth export controls, and the fee prescription frameworks. The interaction points are explicit in the text.

• Food Standards Code and Australian Standards. The definitions in regulation 4 refer to the Food Standards Code (reg 4(1)(a)), and Schedule 1 incorporates specific Australian Standards (for example AS 4696:2007, AS 4465:2005, AS 4464:2007, AS 4466:1997, AS 5010:2001, AS 5011:2001, AS 4841:2006) and parts of the Food Standards Code (Sch 1, items 1-8). Regulation 11(1) requires compliance with those codes as modified. By adopting these standards, the state regime aligns substantive hygiene and production standards with nationally recognised benchmarks, while modifying textual references to fit the state accreditation model (reg 11(3)).

• Food Act 2001. The term “Food Standards Code” is given the same meaning as in the Food Act 2001 (reg 3(1)), and regulation 15 notes that container marking requirements are in addition to labelling requirements under the Food Act 2001 or other legislation. This means operators need to comply with both the state meat safety scheme and labelling/regulatory obligations under the Food Act.

• Export Control Act 1982 (Commonwealth). Regulation 14(2)(a) exempts from the state marking requirement meat processed or handled in an establishment registered under the Commonwealth Export Control Act 1982 and marked in accordance with that Act. That provides a practical overlap rule for establishments subject to Commonwealth export inspection and marking schemes, reducing duplication where federal export controls apply.

• Legislation (Fees) Act 2019. Regulation 21(5) defines “fee notice” to have the same meaning as in the Legislation (Fees) Act 2019, and fees are prescribed by fee notice (reg 21(1)). This ties the administrative fee prescription and variation process to the state fees legislation and the mechanisms it provides for setting, varying and publishing fees.

• Road Traffic Act 1961. The definition of “prime mover” and “semi‑trailer” for transport definitions is referenced by the Road Traffic Act 1961 (reg 3). This cross‑reference assists in interpreting transport‑related terms used in the standards (Sch 1) or the accreditation framework.

• Interstate law equivalence. Regulation 3(2)-(3) treats meat as “lawfully produced for human consumption” if it has been lawfully imported into Australia, and if produced in Australia it must have been produced in accordance with this Act and these regulations, or in accordance with the law in force in another State or Territory relating to processing and handling of meat. That clause creates a non‑exclusive interstate recognition mechanism: if a product meets another State or Territory’s law on processing and handling, that may satisfy the “lawfully produced” test, subject to proof.

• Commonwealth import law. The definition in reg 3(2)(a) includes lawfully imported meat, tying the state conception of “lawful production” to compliance with Commonwealth importation rules. The regulations do not displace federal import controls; rather they rely on lawful importation as a ground for acceptance.

• The Primary Produce (Food Safety Schemes) Act 2004. These regulations are subordinate to and operate under the Act. Several regulations explicitly reference the Act’s provisions: reg 7 refers to section 12 of the Act (obligation to be accredited), reg 9 references s 15(1)(c) for grant of accreditation, reg 21 references s 17(1) and (2) for fee payment and default. The Act will, therefore, provide additional procedural and enforcement powers and definitions not reproduced in the regulations.

• Export and interstate regulatory overlap. The exemptions and cross‑references (reg 14(2)(a), reg 3(2)) indicate an attempt to avoid duplication where Commonwealth export controls or other State laws apply. Nevertheless, operators should note that compliance with Commonwealth export registration does not render them exempt from all state obligations, only specific marking requirements are carved out (reg 14(2)(a)).

• Interaction with criminal and civil procedure. Regulation 20’s evidentiary presumptions will interact with rules of criminal procedure in prosecution. The presumption that certain facts are “accepted as proved in the absence of proof to the contrary” is procedural and will shape the presentation and rebuttal of evidence in court. The regulations do not alter the nature of the criminal burden of proof, but they provide statutory rules of evidence within prosecutions under the Act and these regulations.

In short, the regulations work with the existing national food safety architecture, the Commonwealth export framework, state fee regulation, and the Parent Act, using cross‑references to import and align standards and to set out where the state defers to federal or interstate regimes. Operators must therefore manage compliance on multiple fronts: state accreditation and marking rules, national standards incorporated by reference, federal export registration where applicable and labelling under the Food Act 2001.

The instrument’s legislative history records the revocation of earlier 2006 regulations and subsequent variations to the 2017 principal regulations. The following points are taken from the legislative history entries included in the source.

• Revocation and commencement. The Primary Produce (Food Safety Schemes) (Meat) Regulations 2017 (No 278) were gazetted 19 September 2017 and the commencement is recorded by r 2 noted as 19 January 2018 (Gazette 19.9.2017 p4115; reg 2 indicates commencement on 19.1.2018). The principal 2017 regulations revoked the Primary Produce (Food Safety Schemes) (Meat Industry) Regulations 2006 (Legislative history: “Legislation revoked by principal regulations”).

• Subsequent variations and amendments. The legislative history lists several variations and commencement dates:

  • 2018 variation: No 98, Gazette 21.6.2018 p2246, commenced 1 July 2018 (r 2).
  • 2019 variation: No 123, Gazette 13.6.2019 p2000, commenced 1 July 2019 (r 2).
  • 2020 variation: No 184, Gazette 4.6.2020 p3049, commenced 1 July 2020 (r 2).

• Specific provisions varied or deleted in these amendments. The recorded changes in the “Provisions varied” table show:

  • r 2 was omitted under the Legislation Revision and Publication Act 2002, effective 1 July 2018.
  • Regulation 21(1) was varied by 184/2020 r 4(1), effective 1 July 2020.
  • Regulation 21(2) was varied by 184/2020 r 4(2), effective 1 July 2020.
  • Regulations 21(3)-(5) were inserted by 184/2020 r 4(3), effective 1 July 2020.
  • Regulation 24 was deleted by 184/2020 r 5, effective 1 July 2020.
  • Schedule 2 (Sch 2) was substituted by 98/2018 r 4 on 1 July 2018 and substituted again by 123/2019 r 4 on 1 July 2019, and later deleted by 184/2020 r 6 on 1 July 2020.
  • Schedule 3 Part 1 was omitted under the Legislation Revision and Publication Act 2002 on 1 July 2018.

• Transitional provisions preserved prior approvals. Schedule 3 contains transitional provisions (Part 2) which preserve existing approved food safety arrangements, exemptions, approvals to carry on new activities, brands and approvals relating to unauthorised brands that were in force immediately before commencement. Clauses 3-7 of Schedule 3 take forward arrangements, exemptions and brands from the revoked 2006 regulations into the 2017 regime on and from the commencement date (Sch 3, cll 3-7).

• Observations about fee regime amendments. The legislative history shows that provisions concerning fees (reg 21 and Schedule 2) were the subject of iterative amendment across 2018, 2019 and 2020, including substitution and later deletion of Schedule 2 and the insertion of reg 21(3)-(5) in 2020. The text of the principal regulations refers to “fee notice” and the Legislation (Fees) Act 2019 (reg 21(5)), suggesting that the fee prescription mechanism was adjusted, but the specific monetary values in Schedule 2 are not reproduced in the instrument text provided here, and Schedule 2 was deleted in the 2020 variation per the legislative history table.

• Practical consequence of the transitional clauses. Transitional clauses maintain continuity for existing accredited producers who had approved food safety arrangements, exemptions or leased brands under the revoked 2006 regulations, carrying those across to the 2017 regulations on the same terms and conditions (Sch 3 cl 3-7). That mechanism reduces immediate compliance cost for previously regulated parties by preserving existing approvals and arrangements.

These legislative history entries record the instrument’s evolution between 2017 and 2020, with particular focus on the fee and schedule changes. The amendments demonstrate that the financial and administrative mechanics (fees, Schedule 2) have been actively adjusted since commencement. Users relying on fee figures should consult the current fee notices and the consolidated text of these regulations as in force, because Schedule 2 content is not present in the reproduced regulation text and the legislative history shows it has been altered and subsequently deleted.

The regulatory text supplied contains no references to judicial decisions or litigation. There are no cases, court judgments or decisions named in the instrument itself, and the legislative history records only the revocation of earlier regulations and subsequent amendments. Because the regulations contain evidentiary presumptions (reg 20) and criminal penalties for specified breaches, it is possible that prosecutions or civil recoveries will arise under the Act and these regulations, but the instrument does not provide or cite any reported litigation.

Practically, the only relevant legal matters referenced by the regulations are other statutes and standards (for example the Food Act 2001, the Export Control Act 1982, and the various Australian Standards in Schedule 1). Those cross‑references suggest points of legal interplay that could generate disputes (for example, whether a product is “lawfully produced” under reg 3(2) if produced under another State’s law, or whether certain standards have been complied with under the modifications in reg 11(3)), but no adjudicated authority or precedent is included in the text.

If litigation were to arise on the interpretation or application of the regulations, central issues likely to be litigated would include the scope of “lawfully produced” meat (reg 3), the evidential effect of reg 20’s presumptions, the ambit of the Minister’s discretion to grant exemptions under reg 11(2) and approvals under reg 12, the proper interpretation of modified standards in Schedule 1, and the correctness of fee calculations under reg 22 and reg 23. However, the instrument itself contains no case law, so any discussion of judicial treatment of these provisions would require reference to external case law not present in the supplied text.

Users seeking case law on the practical enforcement of these regulations should therefore consult court databases and the enforcement records of the administering agency. The regulations, as supplied, do not include a litigation roll or citations to decisions.

The regulations contain several particulars and drafting features that can produce compliance surprises or practical traps for operators. These are concrete points anchored in the text.

1. “Meat” scope is broader and narrower in different ways. Regulation 4 includes many processed products (cured, dried, manufactured, processed, sausages and ready‑to‑eat meat) but explicitly excludes meat pies, sausage rolls, canned meat products and many cooked meat products that are not otherwise processed on meat processing premises (reg 4(1)(a)-(c)). Operators of mixed food businesses (for example bakeries or pasta makers) need to map product lines against reg 4 to determine whether their products fall in the accreditation and marking regime. The inclusion of ready‑to‑eat meat under the standards also brings in specific requirements (reg 4(1)(a)(iii)).

2. Poultry exceptions for marking and containers. Poultry is treated differently in marking rules: reg 14(2)(b) and reg 15(2) carve out poultry from the requirement to mark carcasses or containers in the same way as other meat. Yet Schedule 1 contains separate standards for poultry (Sch 1 items 2-3). Businesses dealing with mixed species must apply different rules per species, which complicates logistics and record keeping.

3. Export‑registered establishments are exempt from state carcass marking but may still face other obligations. Reg 14(2)(a) excuses marking where the establishment is registered under the Commonwealth Export Control Act 1982 and is marked in accordance with that Act. However, this does not relieve such establishments from adopting approved food safety arrangements, or from complying with other state rules not explicitly carved out. Check the precise scope of Commonwealth marking and what obligations remain at state level.

4. Brand leasing is a state monopoly with tight duties. Brands identifying meat as “safe and suitable” are leased by the Minister (reg 14(3); reg 16(1)). Lessees must prevent theft or misuse (reg 16(2)), and return brands within seven days of accreditation cancellation, suspension or surrender (reg 16(3)). There is an offence to manufacture or possess an unauthorised brand without approval (reg 17). Practical issues include storage, chain‑of‑custody and staff controls to avoid an offence, and timely return when accreditation ends.

5. Evidentiary presumptions shift burdens. Under reg 20, certain matters are “accepted as proved in the absence of proof to the contrary.” This shifts evidentiary burden to the defendant in prosecutions. For example, meat on premises used for selling meat is presumed to have been offered for sale. Operators should maintain contemporaneous records to rebut such presumptions when necessary.

6. Fee calculation uses both throughput and staffing and allows ministerial assumptions. Reg 22 permits the Minister to determine the “relevant period,” the nature of activity using mass of meat processed, and the level of activity using number of positions held (reg 22(1)(a)-(c)). If the producer did not carry on business during the relevant period, the Minister may use reasonable assumptions to determine nature and level of activity (reg 22(1)(d)). This makes fee forecasts uncertain for new entrants; the pre‑grant pro rata payment in reg 23 compounds the need to estimate likely annual fees.

7. Ministerial discretion is central and largely unfettered in the instrument. The Minister’s roles, accreditation body, approver of exemptions, lessor of brands and determinant of fees and relevant periods, are recurring. The regulations give operational discretion (regs 6, 11(2), 12, 16(1), 21(3), 22). Operators must therefore engage administratively with the Minister and be prepared to seek and document approvals and exemptions where necessary.

8. Small retails may nonetheless be captured by definition thresholds. The “retail meat processor and handler” is defined by both a 50% retail‑by‑mass threshold and a 4‑tonnes wholesale cap (reg 3). Businesses near those thresholds need to monitor sales mix and volumes carefully, because breaching the definitions could change applicable fees, obligations and which Schedule 1 standards apply.

9. Transitional continuity may mask expired approvals. Schedule 3 carries across prior approved arrangements and approvals from the revoked 2006 regulations (Sch 3, cll 3-7). Operators should verify that their prior approvals remain in force on the same terms; however, some fee mechanics (Schedule 2) have been varied and deleted in subsequent amendments (Legislative history), so presumption of full continuity without checking the current consolidated regulations and fee notices is risky.

10. The regulations reference fee notices but do not list current monetary values in the supplied text. Regulation 21(5) ties fee prescription to fee notices under the Legislation (Fees) Act 2019; the legislative history indicates Schedule 2 was substituted and eventually deleted. Operators must consult current fee notices and the administering authority for the up‑to‑date fee amounts rather than rely on the 2017 text.

11. Certain low‑level offences carry modest expiation fees but significant maximum penalties. For example, failure to notify change in circumstances carries a maximum penalty of $250 and expiation $80 (reg 13), whereas many compliance breaches have a $5 000 maximum penalty with $315 expiation (regs 10, 11, 14-15, 16(2), 17, 18-19). Expiation availability may vary with enforcement policy, so assuming expiation will always be offered is hazardous.

12. Definitions rely on external standards that may be amended. Schedule 1 applies standards “as amended or substituted from time to time” (Sch 1). The Minister modifies textual references in those standards (reg 11(3)), but material technical changes in the Australian Standards or the Food Standards Code may change compliance requirements without a change in the regulations themselves. Operators must track relevant standards updates.

13. The regulations do not elaborate inspection powers in detail. Enforcement is delegated to authorised persons or inspectors referenced in reg 11(3)(f), but the instrument does not set out inspection warrants, seizure powers or procedural safeguards; those powers are likely in the Parent Act or other instruments. Relying only on the wording here will not reveal the full enforcement toolkit.

These “gotchas” are concrete compliance and administrative pitfalls embedded in the instrument’s drafting and cross‑references. They point to areas where operators should verify current standards, fees and administrative procedures with the administering agency and where record keeping and internal controls will matter in practice.

The following is a practical, step‑by‑step checklist grounded in the regulations and intended to help practitioners ensure legal compliance. Citations to specific regulations are provided for each action.

1. Determine whether your activities fall within the scheme (reg 5; reg 4).

   • Identify if you are “carrying on the business of producing meat” or “selling meat” by wholesale or retail (reg 5).
   • Map products against reg 4 to establish whether the product is “meat” under the regulations (for example, check exclusions such as meat pies and canned meat products in reg 4(1)(c)).

2. Check for exemptions from accreditation (reg 7(2)).

   • If your activity is non‑commercial household slaughter or processing (meat not sold, not used for paid guests, not taken away from premises) or handling of wild game not for business purposes, you may be exempt (reg 7(2)(a)-(b)).
   • Small retail further processing that consists only of cutting, slicing and packaging ready‑to‑eat meat in a supermarket/delicatessen is exempt (reg 7(2)(c)(i)).

3. If required, apply for accreditation (regs 6, 8-9).

   • Apply to the Minister as the accreditation body (reg 6).
   • If you operate at more than one discrete premises, apply separately for each (reg 8).
   • Prepare documentation to show you have the capacity or will make appropriate arrangements to satisfy the Act and these regulations for the activities proposed (reg 9).

4. Pay the pre‑grant fee and understand fee obligations (reg 23; reg 21).

   • Calculate the projected annual fee for your operations and pay a pro rata fee before the accreditation is granted as required by reg 23(1)-(2).
   • Prepare to pay annual fees and lodge annual returns by 30 June each year (reg 21(1)). Check for the current fee notice (reg 21(5)).

5. Adopt an approved food safety arrangement (reg 10).

   • Implement and document an approved food safety arrangement as required by reg 10. If you had an arrangement under the previous 2006 regulations in force immediately before commencement, it continues under Sch 3 cl 3.

6. Ensure compliance with Schedule 1 codes and understand modifications (reg 11; Sch 1).

   • Identify the Schedule 1 item applicable to your activity (for example, AS 4696:2007 for red meat processing, AS 4465:2005 and Standard 4.2.2 for poultry).
   • Note the textual modifications in reg 11(3) that substitute “Minister” for “Controlling Authority” and “accreditation” for “licence” and ensure your compliance documentation reflects those substitutions.
   • If you propose alternative arrangements to comply, apply to the Minister for an exemption from specified code provisions under reg 11(2) and supply the evidence to show alternative measures will achieve compliance within the specified period.

7. Obtain written approval before commencing any activity not specified in your accreditation (reg 12).

   • Before adding new classes of activities (for example new processing lines or species), apply for written approval under reg 12.

8. Implement marking, branding and labelling controls (regs 14-16).

   • Ensure meat intended for human consumption is safe and suitable and marked as safe and suitable before removal from accredited premises (reg 14(1)). If you are covered by the Commonwealth Export Control Act registration, check the exemption in reg 14(2)(a).
   • Mark containers with your accreditation number and date of packing before removal from the premises (reg 15(1)). Poultry is excluded from reg 15(2).
   • If you require a brand leased by the Minister, apply for a lease (reg 16(1)), pay any lease fee, impose internal controls to prevent theft or misuse (reg 16(2)), and plan to return the brand promptly when accreditation ends or on request (reg 16(3)).
   • Do not manufacture or possess an unauthorised brand without Ministerial approval (reg 17). Ensure any brand in the custody of employees is used only at authorised premises (reg 17(2)).

9. Confirm lawfulness and suitability prior to sale (regs 18-19; reg 3).

   • Verify that meat sold for human consumption has been lawfully produced for human consumption and is safe and suitable (reg 18).
   • For pet meat, ensure it has been lawfully produced for pet consumption and is suitable (reg 19).
   • If the meat was produced outside South Australia, ensure it was lawfully imported (reg 3(2)(a)-(3)(a)) and that production complied with the relevant laws of the producing State or Territory or the Act and these regulations (reg 3(2)(b)(ii), 3(3)(b)(ii)).

10. Maintain records and be prepared to rebut evidentiary presumptions (reg 20).

    • Keep contemporaneous records showing compliance with approved food safety arrangements, marking, labelling, sales records, and the provenance and lawful production status of meat.
    • Records will be critical to rebut the presumptions in reg 20 that meat on premises was being offered for sale or that specified meat was intended for human or pet consumption.

11. Prepare for fee calculation and information requests (reg 22).

    • Track the mass (by kg) of meat processed, handled and sold in the relevant period and the number of positions held by persons engaged in the business during that period (reg 22(1)(b)-(c)).
    • If the Minister issues a written notice under reg 22(2) requesting specified information, comply within the timeframe. Failure to provide information attracts a maximum penalty.

12. Implement internal controls to comply with branding and return obligations (regs 16-17).

    • Maintain a secure chain of custody for any leased brand and plan administrative procedures to effect brand return within seven days after cancellation, suspension or written request (reg 16(3)).

13. Update the Minister within 14 days of certain changes (reg 13).

    • Notify the Minister in writing within 14 days of changes to business name, business address or commencement of construction/demolition at premises used under the accreditation (reg 13). This is a low‑threshold duty with a modest penalty but important for administrative compliance.

14. Monitor standards and statutory amendments.

    • Schedule 1 adopts standards “as amended or substituted from time to time” (Sch 1). Monitor Australian Standards and the Food Standards Code for amendments and incorporate those changes into your food safety arrangements.
    • Check current fee notices under the Legislation (Fees) Act 2019 rather than relying on historic Schedule 2 figures, since Schedule 2 was subject to substitution and later deletion per the legislative history.

15. Use transitional provisions if migrating from prior approvals (Sch 3).

    • If you held a pre‑existing approved food safety arrangement, exemption or brand under the revoked 2006 regulations immediately before commencement, it will continue under the 2017 regulations on the same terms per Sch 3 cll 3-7. Confirm the terms and ensure records can demonstrate continuity.

16. Engage early with the Minister on discretion points.

    • Where you anticipate needing an exemption under reg 11(2), approval for a new activity (reg 12) or a fee waiver (reg 21(3)), engage the Minister early and provide robust alternative arrangements and supporting evidence.

17. Plan staff training and operational SOPs to meet the standards.

    • Because compliance is anchored to documented approved food safety arrangements and technical standards (Sch 1), ensure Standard Operating Procedures, staff training records and monitoring documentation are in place and aligned to the applicable Australian Standards and the modified textual references in reg 11(3).

This compliance checklist converts regulatory obligations into operational tasks. It highlights the need for record keeping, pre‑grant financial provisioning, interaction with the Minister for approvals and exemptions, and active monitoring of standards and fee instruments. Legal advice should be taken where the scope of activities or the intended interstate or export arrangements raise questions about “lawful production” or applicable standards.
