What it does
The Primary Industry Funding Schemes (SA Grape Growers Industry Fund) Regulations 2021 (SA) continue and administer a compulsory levy scheme on wine grapes grown in South Australia. The instrument establishes a mechanism by which a levy per tonne of SA wine grapes is deducted from growers' payments by winemakers and remitted to a fund administered by the Minister. The levy rate is not fixed in the regulations themselves. Instead, the Minister fixes the amount per tonne by notice in the Gazette for each twelve-month prescribed period commencing on 1 June. The Minister may also vary that amount part way through a period, but only prospectively from the date the variation takes effect (regulation 5(4) and (5)). This means the levy can change without amendment to the regulations, giving the Minister significant discretion over the financial burden imposed on growers.
The fund, called the South Australian Grape Growers Industry Fund, is a continuation of the fund established under the revoked 2007 regulations. It is administered by the Minister and consists of contributions paid under both the old and new regulations, investment income, and other sums received by the Minister. The fund may be applied to payments to a body that the Minister considers represents SA grape growers. Those payments can cover the body's operating expenses, promotion of growers, research and development, information dissemination, affiliation fees, programs encouraging communication between winemakers and growers, and "other purposes of the body" (regulation 7(a)(vi)). That last category is broad and gives the Minister and the recipient body substantial flexibility. The Minister may also make payments for "other purposes for the benefit of SA grape growers" (regulation 7(b)). The fund can also cover administration expenses and repay advances made to the representative body.
