What it does
The Primary Industry Funding Schemes (McLaren Vale Wine Industry Fund) Regulations 2017 (SA) establish a compulsory industry levy scheme for the McLaren Vale wine region. The regulations continue the McLaren Vale Wine Industry Fund (originally created under the 2003 regulations) and prescribe mandatory contributions payable by both grape growers and winemakers for every tonne of McLaren Vale grapes delivered for wine production. The fund is administered by the South Australian Minister. Its stated purposes include promoting the McLaren Vale wine industry, funding research and development, disseminating information, and supporting communication between growers and winemakers. The Minister may pay money from the fund to a representative body that the Minister considers represents both groups, or for other purposes considered to benefit the industry. The scheme also contains a refund mechanism: a grower or winemaker who has paid contributions may claim a refund within a specified period (six or twelve months depending on the year) and receives interest at the Reserve Bank cash rate from the date of payment to the date of lodgment. A person who is in default of contributions (meaning unpaid contributions remain from the previous two prescribed periods, or they have been refunded contributions) is excluded from receiving direct benefits or services funded by the fund. The scheme replaces the 2003 regulations with transitional provisions preserving liability for amounts payable from June 2017. Contributions are not voluntary: a winemaker must deduct the grower’s share from the purchase price and remit both portions to the Minister. From 2023 onward, the contribution amounts are no longer fixed in the regulations; the Minister may set them by Gazette notice, subject to a maximum cap also set by the Minister. The scheme therefore imposes a mandatory tax on a geographically defined agricultural industry, with the money directed to a body chosen by the state government, and with an opt-out refund mechanism that carries a penalty (default status for two periods if exercised).
