Primary Industry Funding Schemes (Cattle Industry Fund) Regulations 2015

The regulations operate around a small number of interlocking legal and administrative concepts.

• Fund structure and sources. The Fund is a consolidated sink for specified receipts: legacy balances on repeal of an earlier statute, contributions attached to PID purchases, net proceeds from carcass sales under the compensation scheme, investment income and other receipts (r 5(3)). The Minister administers the Fund (r 5(2)) and decides its applications subject to the enumerated permitted uses in r 10(1).
• Contributions linked to PIDs. A statutory levy of $1.50 per PID is chargeable when purchasers buy PIDs from authorised manufacturers or authorised recyclers; those suppliers act as collecting agents and must forward money and quarterly statements to the Minister (r 7(1)-(2)). The regulation treats the collected moneys as held on trust and requires a separate ADI account for those funds (r 7(3)).
• Low-value vs other contribution refunds. The regulations distinguish between “low value cattle contributions” (a PID purchaser who later sells the animal for under $100: r 3(2)) and other contributions. Low value claims have a discrete deadline, anytime up to 31 July after the financial year (r 8(1)). Other refunds must be claimed within 12 months following the financial year and are subject to a prescribed calculation (r 9(1)-(3)). Both routes require evidence acceptable to the Minister and potentially a statutory declaration (rr 8(2), 9(2)).
• Compensation scheme for disease control. Owners whose animals are destroyed by notice or inspector action under Part 4 Division 4 of the Livestock Act 1997 may claim compensation (r 12). The scheme sets a monetary cap for brucellosis and tuberculosis claims at up to $2,000 or pre-destruction value, whichever is less (r 14(1)(a)). The Minister may authorise other compensable diseases by Gazette and determine compensation for them after consultation (r 3(1) definition; r 14(1)(b)).
• Assignment and carcass realisation. Inspectors may require owners to assign destroyed animals to the Minister, in which case the inspector must ensure destruction and may sell the carcass and pay net proceeds into the Fund (r 13). Proceeds affect compensation entitlements and timing: if the owner assigns and the net proceeds exceed compensation, the excess is paid to the owner; if no claim is made within the allowed period, proceeds may also be paid to the owner (r 13(c)(iii)-(v)).
• Administrative discretion and review. The Chief Inspector determines claims, with delegated power (r 15). The Chief Inspector may reduce or refuse compensation for specified conduct by an owner (failure to notify, failure to follow directions, failure to take reasonable steps to minimise risk or where the animal was likely infected on importation within three months) or where the owner is in default on contributions (r 15(4)). The Minister must consult a producers’ body before approving decisions under r 15(4) (r 15(5)). Claimants may seek review in SACAT under s 34 of the SACAT Act within one month of notice, though s 71 of the SACAT Act does not apply to such decisions (r 15(7)-(9)).
• Reporting and information exchange. The Minister may require financial statements, annual reports and business plans from bodies that receive Fund payments (r 11(1)), and may disclose to such a body identifying information about persons who have paid or been refunded contributions (r 11(2)). This creates a reporting and information sharing loop tying recipients of Fund moneys back into the Fund’s oversight.
• Compliance and offences. The regulations make it an offence for authorised manufacturers or recyclers to contravene collection and trust duties (r 7(5)) and make false or misleading statements an offence under r 16, each with a maximum penalty of $5,000.

These concepts present a coherent administrative package: levies at point of PID sale fund a compensation and industry-support vehicle, suppliers are made accountable for collection and accounting, owners have defined claim procedures and limitations, and the Minister retains management and information powers. The text embeds ministerial discretion in several places: defining compensable diseases by Gazette (r 3(1)); setting compensation for diseases other than brucellosis and tuberculosis (r 14(1)(b)); determining valuation methods after consultation (r 14(3)(c)); approving later payment times (r 7(1)(b)(ii)); and deciding recipient bodies and disclosure of contributor identities (r 10(1)(b), r 11). These are the legal levers that will drive administrative outcomes.

The regulations allocate costs, duties and decision-making across a defined set of actors. Identify parties and precise statutory connections.

• Purchasers of PIDs (primary payers). Any person who purchases permanent identification devices for cattle from an authorised manufacturer or authorised recycler is liable to pay the $1.50 contribution per PID (r 7(1)(a)). The purchaser is the statutory payer at the point of purchase; the regulations also define an economic fallback for low-value animals (r 3(2)).
• Authorised manufacturers and authorised recyclers (collecting agents and regulated suppliers). These entities collect contributions as agents for the Minister, must provide quarterly financial statements and forward funds within 14 days after each quarter (r 7(2)), hold collected moneys on trust in a separate ADI account (r 7(3)), make records available for inspection by persons authorised by the Minister (r 7(4)) and face an offence for breach of these duties (r 7(5)). They can apply surplus interest for their own benefit after account charges (r 7(3)(b)).
• The Minister (administrator and decision-maker). The Minister administers the Fund (r 5(2)), receives contributions and statements (r 7(2)), determines permitted applications of the Fund (r 10(1)), may declare compensable diseases by Gazette (r 3(1)) and determines compensation for non-brucellosis/tuberculosis diseases by Gazette after consultation (r 14(1)(b)). The Minister also has information powers including requiring reports from recipient bodies (r 11(1)) and disclosing contributor identities to recipient bodies (r 11(2)).
• Chief Inspector and inspectors (operational decision-makers). The Chief Inspector, appointed under the Livestock Act 1997, receives claims for compensation and determines them (r 15(1), (3)-(6)); may reduce or refuse compensation under specified factual grounds (r 15(4)); and must give written notice of determinations (r 15(6)). Inspectors (appointed under the Livestock Act 1997) may issue notices requiring assignment of animals to the Minister, cause destruction, sell carcasses and pay net proceeds into the Fund (r 13).
• Owners of cattle (beneficiaries and claimants). Owners (defined as persons who own or are entitled to possession, whether alone or jointly: r 3(1)) whose animals are destroyed under powers in the Livestock Act may claim compensation (r 12(1)). Owners must comply with assignment notices to be eligible (r 13(b)); file a claim within the prescribed period (r 15(1)); provide required information (r 15(3)); and are subject to reduction or denial of compensation where specified defaults occur (r 15(4)).
• Bodies that represent cattle producers and receive Fund payments. The Minister may, on the advice of a body that the Minister considers represents cattle producers, make payments to such a body for enumerated purposes (r 10(1)(b)(i)-(vii)). Recipients must provide financial statements, annual reports and business plans at the Minister’s request (r 11(1)). The Minister may share identifying contribution data with these bodies (r 11(2)).
• Financial institutions and ADI account custodians. Collecting agents must deposit contributions into a separate ADI account (r 7(3)). That imposes obligations on collecting agents to administer bank accounts complying with the trust holding and non-withdrawal except to forward contributions or use surplus interest for supplier benefit (r 7(3)(a)-(b)).
• Tribunal (SACAT) and administrative reviewers. Claimants may seek review of Chief Inspector determinations under s 34 of the SACAT Act within one month (r 15(7)), subject to the explicit exclusion that s 71 of the SACAT Act does not apply to such Tribunal decisions (r 15(9)).

The regulations also create cross-cutting effects. For example, a person who has been refunded (other than under the low-value route) or has unpaid contributions within the immediately preceding five financial years is treated as “in default” and is disqualified from receiving direct Fund benefits (r 4; r 10(2); r 15(4)(e)). That rule connects contribution compliance to eligibility for compensation and Fund-funded services. The Minister’s discretion to identify which body “represents cattle producers” (r 10(1)(b), r 11(1), r 15(5)) concentrates selection and consultative power in the Minister’s office and affects which bodies receive direct flows of Fund money and information.

This section enumerates specific statutory duties, notice obligations, claim rights and decision rights embedded in the regulations, with references to the relevant provisions.

Duties imposed on purchasers, suppliers and custodians

• Purchaser duty to pay contributions. A purchaser of PIDs must pay $1.50 per PID to the authorised manufacturer or authorised recycler who supplies the PID (r 7(1)(a)). Payment is due not later than one month after supply or payment for the PID, or at such later time approved by the Minister (r 7(1)(b)(i)-(ii)).
• Collecting agent duties. Authorised manufacturers and recyclers must: furnish quarterly financial statements within 14 days after each quarter to the Minister containing the prescribed information (r 7(2)(a)); forward collected contributions with those statements (r 7(2)(b)); hold contributions on trust in a separate ADI account with narrowly prescribed withdrawal rules (r 7(3)); and make the ADI account records available for inspection by persons authorised by the Minister (r 7(4)). Contravention is an offence punishable by up to $5,000 (r 7(5)).
• Record and evidence duties for claimants and refund applicants. Persons seeking refunds (r 8(1), r 9(1)) and claimants for compensation (r 15(3)) must supply evidence acceptable to the Minister or Chief Inspector, and if required, verification by statutory declaration (r 8(2), r 9(2)). Compensation claims must be in the form required by the Chief Inspector and include information about carcass sale proceeds where applicable (r 15(3)).

Ministerial and administrative duties and limits

• Fund application duties. The Minister may apply Fund moneys only for the stated list of purposes in r 10(1): compensation and Part 3 amounts (r 10(1)(a)); payments to an industry body on its advice for specific operating, promotional and research purposes (r 10(1)(b)); other purposes for cattle producers’ benefit (r 10(1)(c)); repayment of contributions (r 10(1)(d)); and administrative expenses including inspectors’ expenses where they exceed carcass sale proceeds (r 10(1)(e)).
• Reporting duties of recipient bodies. The Minister may require recipient bodies to provide copies of financial statements, annual reports and business plans, and any other information reasonably required (r 11(1)). The Minister may disclose to recipient bodies the identity of persons who have paid or been refunded contributions (r 11(2)).

Rights of owners and contributors

• Refund rights. Persons who qualify may claim refunds: low value cattle contributors have a claim window until 31 July following the relevant financial year (r 8(1)); other contributors may claim within 12 months after the financial year (r 9(1)). Both categories require evidence acceptable to the Minister and may require statutory declarations (rr 8(2), 9(2)). The Fund must refund entitled claimants (r 8(3); r 9(3) provides a formula in the text supplied for non-low-value refunds, with variables defined).
• Compensation claim rights and review. Owners whose animals are destroyed under the powers of the Livestock Act in relation to compensable diseases may claim compensation (r 12(1)). A claim must be made to the Chief Inspector within one month of the notice or destruction (r 15(1)), although the Chief Inspector may extend time if just and reasonable (r 15(2)). The claimant is entitled to written notice of determination (r 15(6)) and may apply to SACAT for review under s 34 of the SACAT Act within one month after notice (r 15(7)).
• Rights relating to carcass proceeds. If an owner assigns an animal to the Minister and the inspector sells the carcass, the net proceeds are paid into the Fund (r 13(c)(iii)). If net proceeds exceed compensation, the excess is payable from the Fund to the owner (r 13(c)(iv)). If no claim is made within the prescribed period, the net proceeds must be paid to the owner (r 13(c)(v)).

Discretionary reductions and disqualification

• The Chief Inspector may reduce or refuse compensation where the owner failed to notify an inspector of visible disease, failed to follow written inspector directions, failed to take reasonable steps to minimise disease risk, the animal was likely infected upon importation within three months, or the owner is in default on contributions (r 15(4)(a)-(e)). Before approving reductions under r 15(4), the Minister must consult an industry body (r 15(5)). Persons in default on contributions over the preceding five financial years are excluded from direct benefits from the Fund (r 4; r 10(2)).

Offences and penalties

• Contraventions by authorised manufacturers/recyclers of their duties attract a maximum penalty of $5,000 (r 7(5)).
• Making a false or misleading statement in material provided under these regulations attracts a maximum penalty of $5,000 (r 16).

These duties and rights create a network of administrative obligations focused on collection fidelity, evidence and time-limited claims, Ministerial discretion and reserve powers for inspectors and the Chief Inspector. The structure ties payment compliance to eligibility for benefits and creates reporting obligations for both collectors and recipients of Fund payments.

The regulations set a small set of direct criminal or quasi-criminal sanctions and several non-penal enforcement levers tied to administrative eligibility.

Criminal / monetary penalties

• Authorised manufacturers or authorised recyclers who contravene r 7 (duties to furnish statements, forward amounts, hold funds on trust in separate ADI account, permit inspection of records, etc) are guilty of an offence with a maximum penalty: $5,000 (r 7(5)). The text does not specify intermediate enforcement mechanisms such as infringement notices; the instrument states the maximum penalty only.
• A person who makes a statement that is false or misleading in a material particular in information provided, or a record kept for the purposes of these regulations, is guilty of an offence with a maximum penalty of $5,000 (r 16). The provision targets record-keeping and representations made to the Minister, Chief Inspector, or other authorised persons.

Administrative enforcement and eligibility controls

• Ineligibility to receive Fund benefits. The regulations create a civil enforcement lever by denying direct Fund benefits and services to persons who are “in default” on contributions over the immediately preceding five financial years (r 4; r 10(2)). A person is defined as in default if they have unpaid contributions in the prior five years or have been refunded a contribution (other than low value cattle contributions) in that period (r 4). This rule operates as an administrative sanction: defaulting payers lose access to Fund-funded programmes and compensation.
• Reduction or refusal of compensation. The Chief Inspector has delegated authority to reduce or refuse compensation where specified conduct of owners is established: visible disease not notified, failure to carry out written inspector directions, failure to take reasonable steps to minimise disease risk, recent importation likely infected, or default on contributions (r 15(4)). The Minister must be consulted before approval (r 15(5)). This gatekeeping function is an enforcement lever tied to conduct and compliance.
• Trust and inspection powers over collecting agents. The requirement that collecting agents hold contributions in a separate ADI account and make records available for inspection (r 7(3)-(4)) enables the Minister to audit and, by implication, enforce proper collection and forwarding. Breach of these duties is criminalised (r 7(5)).

Adjudicative and review pathways

• Determinations by the Chief Inspector must be notified to the claimant, the Minister and an industry body (r 15(6)). A claimant dissatisfied with a Chief Inspector determination may apply to the South Australian Civil and Administrative Tribunal under s 34 of the SACAT Act within one month after receiving notice (r 15(7)). The regulations explicitly state that s 71 of the SACAT Act does not apply to Tribunal decisions under this regulation (r 15(9)). The effect is a judicial or quasi-judicial review path constrained by the SACAT Act’s particular exclusion but otherwise available.

Information exchange as a compliance and enforcement tool

• The Minister may require recipient bodies to supply financial statements, annual reports and business plans and any other information reasonably required (r 11(1)). The Minister may disclose identifying information about persons who have paid or been refunded contributions to such recipient bodies (r 11(2)). This creates an information feedback loop which can support monitoring of collection and the allocation of Fund resources; it may also operate as a compliance incentive or pressure point for contributors.

The enforcement architecture is mixed: modest criminal penalties accompany a broader set of administrative controls (eligibility denial, discretion to reduce compensation, inspection and reporting powers). Monetary penalties are not large in scale relative to many commercial regulatory regimes; the more immediate enforcement levers appear to be administrative ineligibility and the Chief Inspector’s remedial discretions.

The regulations are explicitly interwoven with the Primary Industry Funding Schemes Act 1998 (the parent Act) and with a number of other statutory instruments and institutions. The text references external Acts and instruments for jurisdictional and operational purposes.

Links to the Livestock Act 1997 and Livestock Regulations 2013

• The compensation scheme in Part 3 depends on powers in the Livestock Act 1997: compensation is payable where animals are destroyed in accordance with a notice or order issued under Part 4 Division 4 of the Livestock Act 1997, or by inspector action under that Division (r 12(1)). Inspectors and the Chief Inspector are those appointed under the Livestock Act (r 3(1) definitions).
• Authorised manufacturers and authorised recyclers are defined with reference to the Livestock Regulations 2013 (r 3(1): “authorised manufacturer … has the same meaning as in the Livestock Regulations 2013; authorised recycler … has the same meaning as in the Livestock Regulations 2013; PID has same meaning as in the Livestock Regulations 2013”). The effect is that operational definitions and licensing regimes in those instruments govern who may act as a collecting agent and what constitutes a PID.

Interaction with the Primary Industry Funding Schemes Act 1998

• These regulations are made under the Primary Industry Funding Schemes Act 1998, and they implement a funding scheme model established by that Act. The regulations operationalise the Fund, the contribution mechanism, and the permitted uses, within the enabling Act’s framework (r 5 references continuity of the Fund established under revoked regulations).
• The regulations also refer to the Act for purposes of citation and mechanics; the legislative history indicates these regulations revoke and replace earlier subordinate instruments made under the Act (Legislative history: Principal regulations and variations).

Tribunal and administrative law cross-references

• The right of review is expressly linked to the South Australian Civil and Administrative Tribunal Act 2013: claimants may apply to SACAT under s 34 (r 15(7)); r 15(9) expressly excludes the application of s 71 of the SACAT Act to decisions of the Tribunal under r 15. This creates a defined administrative-law route, bounded by the SACAT Act’s provisions and the express exclusion of s 71 (the content of which is not reproduced here).

Gazette and ministerial instrument interactions

• The regulations delegate certain definitional and valuation functions to the Minister by Gazette. The definition of “compensable disease” includes diseases declared by the Minister by notice in the Gazette (r 3(1)(c)(iii)). Regulation 14(1)(b) allows the Minister to set compensation for diseases other than brucellosis or tuberculosis by Gazette after consultation. Regulation 14(3)(c) permits the Minister to determine valuation methodology after consultation with a producers’ body. These are regulatory-delegation interactions where the main text sets the framework and leaves specifics to ministerial instruments.

Privacy and information law interfaces

• The Minister may provide identifying information about persons who have paid or been refunded contributions to bodies that receive Fund payments (r 11(2)). That exchange potentially engages privacy, data-handling and confidentiality norms under other laws (not cited in the text), and the regulations themselves do not specify rules on use, retention, or redaction. How those disclosures interface with privacy legislation would be determined by the other legal regimes in force.

Banking, trust and commercial law

• The separate ADI account trust holding obligation on collecting agents (r 7(3)) engages banking contractual arrangements, trust law principles and obligations regarding fiduciary conduct. The collecting agent may apply surplus interest to its benefit after account charges and government charges are deducted (r 7(3)(b)), but may not withdraw principal other than to forward contributions.

Overall, the regulations are implemented through a network of references to other legislation and instruments: the Livestock Act 1997 for operational disease-control and inspector powers; the Livestock Regulations 2013 for definitions of authorised suppliers and PIDs; the Primary Industry Funding Schemes Act 1998 as the enabling statute; the South Australian Civil and Administrative Tribunal Act 2013 for review procedures; and ministerial Gazette notices for declaring compensable diseases and setting compensation and valuation methodology. Each cross-reference imposes dependencies: administrative actors must operate within the interfaces of those instruments and any changes in the referenced instruments (for example to inspection powers, definitions, or tribunal procedure) will affect how these regulations function in practice.

The legislative history within the instrument records the regulations’ commencement and several subsequent variations. The document explicitly lists the principal regulations, variations and dates. Important entries are:

• Principal regulations: Primary Industry Funding Schemes (Cattle Industry Fund) Regulations 2015, Gazette 14.5.2015 p 1765; commencement listed as 14.5.2015 (r 2).
• Subsequent variations and commencements:
  • 2016, No 192 (Gazette 11.8.2016 p 3192) with commencement of varied provisions on 10.9.2016 (r 2). The table notes r 7(1) was varied by 192/2016 r 4, effective 10.9.2016.
  • 2018, No 14 (Gazette 30.1.2018 p 582) with commencement 22.2.2018 (r 2). The legislative history records r 15(7)-(9) substituted by 14/2018 r 4 on 22.2.2018, and r 15(10) deleted by the same instrument.
  • 2019, No 236 (Gazette 7.11.2019 p 3802) with commencement 7.11.2019 (r 2). Multiple provisions were varied by 236/2019: r 3(1) (compensable disease substituted) (r 4), r 6 deleted (r 5), r 10(1) substituted (r 6), r 11(1) inserted and r 11 varied and redesignated (r 7), r 14(1) and (3) varied (r 8), and r 15(5) and (6) substituted (r 9). The legislative history notes deletion of a consultative committee reference and other redesignations.
• Deletions and other revisions: r 2 was omitted under the Legislation Revision and Publication Act 2002 on 10.9.2016. Sch 1 omitted under the same Act on 10.9.2016. The document notes earlier versions are available and that references in the legislation may not be automatically updated by the revision program.

What the amendment notes mean in practice

• The 2016 variation (192/2016) altered r 7(1), the core contribution rule. The instrument records the variation but does not show the previous text here; the present consolidated r 7(1) sets the $1.50 per PID charge and payment timing requirements.
• The 2018 instrument focused on procedural review changes in r 15: substitution of rr 15(7)-(9) and deletion of r 15(10). The consolidated r 15 establishes SACAT review rights under s 34 and expressly excludes s 71 of the SACAT Act from application (r 15(9)).
• The 2019 instrument made several substantive adjustments including substituting the definition of compensable disease in r 3(1), substituting r 10(1) (governing permitted applications of the Fund), and inserting and varying r 11 on exchange of information and reporting obligations. It also varied compensation-related provisions (r 14) and the Chief Inspector approval notification provisions (r 15(5)-(6)).

Limitations of the legislative history in the provided text

• The legislative history records when provisions were varied and the instrument numbers; it does not reproduce prior text for every variation. Readers wanting a longitudinal comparison should consult the historical versions listed (historical versions noted at the end of the legislative history: 10.9.2016 and 22.2.2018) or the Government Gazette entries referenced.
• The provided copy shows that some changes removed earlier consultative structures and moved certain determinations into ministerial power (for example, the substitution and deletions noted in 2019), which indicates a shift in administrative design; the precise pre-2019 mechanics would require consulting the revoked or varied instruments for the full picture.

In short, the regulations entered into force in 2015 and have been materially varied in 2016, 2018 and 2019. The 2019 package in particular adjusted definitions, fund application rules and information exchange duties. Users should consult the referenced Gazette notices and historical versions for detailed text-level comparisons.

The regulatory text supplied does not include any case law, judicial decisions or recorded litigation related to these regulations. The instrument itself contains no references to judicial decisions, nor does the legislative history list appeals or litigation outcomes.

The only adjudicative pathway the text provides is administrative review through the South Australian Civil and Administrative Tribunal (SACAT) for claimants dissatisfied with Chief Inspector determinations (r 15(7)). The regulations permit a claimant to apply to SACAT under s 34 of the SACAT Act within one month after receiving notice of the Chief Inspector’s determination, and explicitly exclude the application of s 71 of the SACAT Act to such Tribunal decisions (r 15(9)). The text does not furnish further detail about the consequences of that exclusion, nor does it reproduce any Tribunal decisions.

Given the absence of any cases named in the text, one should not infer any settled interpretive authority from this instrument alone. Practitioners needing case law on interpretation, enforcement, the ambit of ministerial discretion under the regulations, or operational conflicts (for example, disputes over whether a person is “in default” for eligibility) will need to consult SACAT decisions and any relevant South Australian court judgments outside the instrument.

Where a claimant intends to litigate or seek review, the procedural route available is the one provided: application to SACAT within the one‑month window created by r 15(7). The regulators’ explicit exclusion of s 71 of the SACAT Act from these Tribunal decisions (r 15(9)) limits certain statutory processes that might otherwise apply; practitioners should consult the SACAT Act for the substantive consequences of that exclusion before preparing review applications.

These regulations contain precise procedural and drafting features that can produce traps in practice. Key practical pitfalls and friction points follow, with direct references to the provisions that create them.

Missing arithmetic for r 9(3) in the supplied text

• The supplied extract defines variables used in the refund calculation (R, Ct, C1-C4, I) in r 9(3), but the arithmetic/formula line itself is absent from the excerpt. The regulation therefore appears to provide a formula to calculate refunds for non-low-value contributions but that formula is not visible in this copy. Practitioners must consult the official consolidated legislation or the Gazette text for the exact formula before advising clients on likely refund amounts (r 9(3)).

Tight time limits and strict proof requirements

• Compensation claims must be made to the Chief Inspector within 1 month after the issuing of the destruction notice or the destruction by an inspector (r 15(1)). The Chief Inspector has a discretion to extend time but only where satisfied it is just and reasonable (r 15(2)). Evidence requirements are set by the Chief Inspector and may include information about carcass sale proceeds where the animal was not assigned to the Minister (r 15(3)). Refund claims for low value contributions are due by 31 July after the financial year (r 8(1)); other refunds within 12 months following the financial year (r 9(1)). Missing these windows can forfeit entitlements.

Assignment notices can extinguish claim rights

• If an inspector gives written notice requiring the owner to assign the animal to the Minister, the owner cannot make a compensation claim unless the owner complies with the notice (r 13(a)-(b)). Assignment triggers procedural consequences: assigned animals must be destroyed and carcasses may be sold, with net proceeds paid into the Fund (r 13(c)). Owners who fail to comply with assignment notices will be barred from claiming compensation under these regulations.

Compensation caps and valuation method

• For brucellosis and tuberculosis the statutory cap is the lesser of $2,000 or the animal’s value immediately prior to destruction (r 14(1)(a)). The regulations require valuation “as if it were unaffected by the compensable disease” and having regard to comparable markets whether interstate or intrastate, and using a valuation method determined by the Minister after consultation (r 14(3)(a)-(c)). This means actual compensation can be significantly lower than market expectations if valuation is conservative, and the valuation method is a ministerial instrument not fixed in the regulation text.

Disqualification for being “in default”

• Persons are treated as “in default” in relation to contributions if in the immediately preceding five financial years they have unpaid contributions or have been refunded contributions (other than low value cattle refunds) (r 4). Regulation 10(2) states that a person in default is not entitled to receive direct benefits or services funded by the Fund. The definition ties together unpaid or refunded contributions with loss of access to Fund outputs , a potentially counterintuitive consequence for persons who may have been refunded in prior years.

Ministerial discretion over compensable diseases and payments

• The Minister can declare compensable diseases by Gazette (r 3(1)(c)(iii)) and prescribe compensation for diseases other than brucellosis and tuberculosis by Gazette after consultation (r 14(1)(b)). The Minister also chooses which industry body, “in the opinion of the Minister, represents cattle producers” for the purposes of advice and payments (r 10(1)(b); r 11(1); r 15(5)). These open-ended delegations create uncertainty for stakeholders about which diseases will be covered and which bodies will receive payments or influence valuation and compensation settings.

Information disclosure to recipient bodies

• The Minister may provide a body that receives payments from the Fund with information identifying persons who have paid or been refunded contributions (r 11(2)). That provision can raise practical concerns about confidentiality and commercial sensitivities: contributors may have their identities exposed to recipient organisations. The regulation does not set out constraints on how recipient organisations must treat that information.

Small criminal penalties relative to compliance costs

• The maximum criminal penalties in r 7(5) and r 16 are $5,000. For large authorised manufacturers, this may be relatively small compared to the cost of implementing segregated ADI accounts, quarterly reporting and inspection systems. The design therefore leans on administrative visibility (inspection and transparency) and exclusion from benefits (r 10(2)) as stronger behavioural levers than large financial penalties.

Trust-account complexity for collecting agents

• Collecting agents must hold contributions on trust in a separate ADI account into which no other money is paid and from which withdrawals are limited to forwarding contributions or applying surplus interest for the supplier’s benefit after deduction of account charges and government charges (r 7(3)). Implementing a legally compliant trust account that segregates funds and permits inspections may require changes to financial systems and banking arrangements.

Net proceeds interactions with compensation

• If an animal is assigned to the Minister and the carcass sold, net proceeds are paid into the Fund; if the owner then claims compensation and the net proceeds exceed the amount of compensation, the excess must be paid from the Fund to the owner (r 13(c)(iii)-(iv)). Conversely, if no claim is made the net proceeds must be paid to the owner (r 13(c)(v)). That sequencing and reconciliation requires timely sale and accurate accounting; delays or disputes in carcass realisation could affect compensation entitlements.

Potential information asymmetries and selection of recipient bodies

• Payments to a body “on the advice of a body that, in the opinion of the Minister, represents cattle producers” (r 10(1)(b)) can concentrate benefits in selected organisations. Because the Minister both selects the body and may thereafter share contributor identities with that body (r 11(2)), the governance of selection and disclosure has practical significance and risk for perceived fairness and capture; the regulation does not prescribe objective criteria for selection.

Practitioners should address these gotchas proactively: confirm the r 9(3) formula from the official source; ensure timely filings for refunds and compensation claims; verify whether an inspector’s assignment notice has been issued; maintain robust evidence trails and statutory-declaration-ready documentation; and advise collecting-agent clients on trust-account structure and inspection readiness.

This section gives a practical compliance checklist for the main affected actors, grounded in the regulations’ language and timeframes. It is written for practitioners advising clients on operational and governance tasks.

For purchasers of PIDs (primary payers)

• Pay $1.50 per PID at the time of purchase, or within one month of supply/payment for the PID, unless a later payment date has been approved by the Minister (r 7(1)(a)-(b)). Retain invoices and receipts showing PID purchase, dates and amounts, because refund and eligibility claims require evidence acceptable to the Minister (r 8(2), r 9(2)).

For authorised manufacturers and authorised recyclers (collecting agents)

• Set up a separate ADI account dedicated to contributions held on trust as required by r 7(3)(a). Ensure no other funds are deposited into that account and limit withdrawals to forwarding contributions to the Minister or applying surplus interest for the supplier after account charges (r 7(3)(b)).
• Build a quarterly accounting and reporting process to prepare the financial statement required by r 7(2)(a) covering PIDs sold during each quarter. Deliver the statement and forward the collected funds to the Minister within 14 days after the end of each quarter (r 7(2)(a)-(b)).
• If you have the necessary equipment, be prepared to provide these statements in an electronic form acceptable to the Minister (r 7(2)(a)(ii)). Make ADI account records available for inspection by persons authorised by the Minister at reasonable times (r 7(4)).
• Institute compliance checks to avoid contravention (r 7(5)). Maintain clear audit trails reconciling PID sales, contributions collected and transfers to the Minister’s account.

For owners of cattle (claimants)

• If an animal is destroyed in the exercise of powers under the Livestock Act 1997, file a claim for compensation to the Chief Inspector within one month after the notice or destruction (r 15(1)). Prepare to provide the information and evidence required by the Chief Inspector, including details of carcass sale proceeds if the animal was not assigned to the Minister (r 15(3)).
• If required, provide statutory declarations to verify evidence (r 8(2), r 9(2)). If you receive a written notice from an inspector requiring assignment of the animal to the Minister, comply if you wish to preserve the right to claim compensation under these regulations, because a claim is not permitted unless the owner complies with such a notice (r 13(a)-(b)).
• Be aware of conduct-based reduction or refusal grounds: notify an inspector of visible disease; comply with written directions for control and eradication; keep records of steps taken to minimise disease introduction into the herd; and avoid introducing animals likely to be infected within three months of importation (r 15(4)(a)-(d)). Maintain documentary proof of biosecurity steps and communications with inspectors to support claims.

For bodies seeking Fund payments or already receiving payments

• Expect the Minister to request copies of financial statements, annual reports and business plans and any other information reasonably required (r 11(1)). Put in place governance and reporting systems so these materials can be produced on a timely basis.
• Be aware the Minister may provide your body with identifying information about persons who have paid or been refunded contributions (r 11(2)). Establish privacy and data-handling procedures and consider confidentiality obligations in contracts and member communications.

For the Minister and departmental administrators

• Ensure clear administrative processes for collecting and reconciling quarterly returns and remittances from authorised manufacturers and recyclers (r 7(2)). Maintain a registry of who is treated as “in default” under r 4 and apply the ineligibility rule (r 10(2)) consistently.
• When declaring compensable diseases or setting compensation or valuation methodologies by Gazette (r 3(1), r 14(1)(b), r 14(3)(c)), document consultative steps taken with the body that, in the Minister’s opinion, represents cattle producers, since the regulations require consultation before certain actions (r 14(1)(b), r 15(5)).
• Use the Fund only for the purposes stated in r 10(1); maintain records for audit and oversight purposes and ensure payments to industry bodies are tied to the listed objectives.
• Establish secure protocols before providing identifying contributor information to recipient bodies under r 11(2) and ensure recipient bodies’ use of that data is consistent with relevant privacy and confidentiality obligations.

For inspectors and the Chief Inspector

• If issuing assignment notices under r 13(a), ensure owners understand the consequence that a compensation claim cannot be made unless the owner complies with the notice (r 13(b)). Keep contemporaneous records of assignment notices, destruction actions and carcass sales to support later reconciliation.
• When assessing compensation claims, apply r 15(4) grounds with written reasons and consult the nominated producers’ body as required before seeking Ministerial approval for a reduction or refusal (r 15(5)). Provide written notices of determinations to the claimant, the Minister and the producers’ body (r 15(6)).

Cross-cutting compliance tasks

• Ensure data retention and record-keeping systems capture PID sale receipts, contribution collections, statutory declarations, carcass sale proceeds and correspondence with inspectors, given the evidentiary demands of refund and compensation processes (rr 7(2), 8(2), 9(2), 15(3)).
• For authorised manufacturers and recyclers, design systems so that the ADI account is reconcilable, interest is tracked separately and any surplus interest used in accordance with r 7(3)(b).
• For anyone making submissions, statements or records under these regulations, implement verification processes and fact-checking to avoid r 16 offences for false or misleading statements (r 16).

Finally, practitioners should verify the r 9(3) refund formula using the official consolidated legislation source before advising clients on refund quantum, and confirm any Ministerial Gazette notices that define compensable diseases or valuation methodologies (r 3(1); r 14(1)(b); r 14(3)(c)).
