51A Requirements for use of virtual fencing devices—the Act, s 35(1)

(1) Before using a virtual fencing device, a person must complete training in the use of the device under the instruction of the manufacturer or supplier of the device.

(2) A person must not activate a virtual fencing device unless the person—

(a) is on the same property as the animal wearing the device, and

(b) is satisfied that the device will be monitored by a person who can have the device deactivated or removed if—

(i) the device malfunctions, or

(ii) the device causes the animal distress.

(3) In this section—

virtual fencing device has the same meaning as in Schedule 3.
