Prevention of Cruelty to Animals (Domestic Fowl) Regulations 2016

Domestic fowl is defined narrowly in regulation 5 as “a member of the species Gallus gallus domesticus”. This covers chickens of all types - layers, broilers, breeders - but excludes other domestic fowl such as turkeys, ducks, geese, quail, guinea fowl, or ostriches. The regulations therefore do not apply to poultry farming of other species, though those species may be covered by general cruelty provisions under the parent Act or by other regulations. The term “person in charge of domestic fowl” is not defined in these regulations but derives from the Prevention of Cruelty to Animals Act 1986, and would ordinarily include the owner, occupier, manager, or any person who has custody or control of the birds.

Cage floor area is defined as “the floor area of the internal part of a cage”. This excludes any fixtures such as feeders, drinkers, or nest boxes that might protrude into the cage; the requirement is calculated on the bare floor space. Regulation 8 prescribes minimum floor areas per bird depending on number of birds per cage and their weight. For example, a cage housing three birds each weighing less than 2.4 kg must have at least 550 cm² per bird, i.e. 1,650 cm² total. For birds weighing 4.5 kg or more (which would be very heavy layer breeds, but more likely broiler breeders kept for hatching eggs), density is expressed as a weight-to-area ratio - e.g. for 3+ birds, total weight must not exceed 46 kg per square metre of cage floor area.

Non-cage housing system is not defined exhaustively in the regulations but is implicitly any indoor housing that is not a cage. This includes barn systems, aviaries, deep litter sheds, and multi-tier systems. Regulation 10 imposes general requirements: sufficient access for health assessment, protection from excreta falling from higher levels, and a minimum height of 45 cm for the housing system (not per bird, but the overall structure). The low height minimum (45 cm) is notable because a fully grown broiler may stand 40-50 cm tall, so a 45 cm height may restrict normal posture; this could be a trap for producers who build low-roofed sheds.

Useable floor area is used for non-cage density calculations (regulations 11-12). Unlike cage floor area, useable floor area may include slatted or metal mesh flooring, and areas taken up by feeding, watering equipment, and nest boxes. This is a permissive expansion that allows producers to count certain occupied spaces as floor area, thereby reducing the effective density burden. The density limits for non-cage egg production is 30 kg per square metre (roughly 6-7 standard layers per m²). For meat birds (broilers), the density varies by cooling system: 40 kg/m² with evaporative cooling or water-based cooling with stirring fans (during the cooler months); 36 kg/m² for water-based cooling in the warmer months (November to February); and 28 kg/m² for sheds without mechanical cooling. These densities are higher than in many European jurisdictions and reflect the hot Australian climate constraints.

Range is defined simply as “an outdoor area that is accessible to domestic fowl”. Regulation 13 imposes five obligations: provide shelter on the range for protection from adverse weather causing heat or cold stress; take reasonable steps to reduce predation risk; provide unrestricted access for at least 8 hours daily (except when the person in charge determines confinement is in the best interest of health and wellbeing); opening dimensions of at least 35 cm high and 40 cm wide; and combined opening width of at least 2 metres per 1000 fowl. The openings must allow free and safe movement and be designed to minimise adverse effects of weather on fowl and litter quality. The “best interest” exception gives the producer discretion to confine birds, which could be used for disease control, extreme weather, or management reasons, but creates a risk of abuse and enforcement difficulty.

The regulatory framework distinguishes three housing systems: cage (for layers only), non-cage indoor (barn), and non-cage with range (free range). The regulations do not define “free range” or require any minimum flock size or rotation, but the range requirements in regulation 13 effectively set the floor for any producer claiming free-range status. Producers marketing eggs as “free range” must also comply with the Australian Consumer Law and any trade mark or certification scheme requirements, but the regulation itself does not mandate any labelling or marketing compliance.

The primary duty holders are any person who is “in charge of domestic fowl” as defined. This sweeps broadly to include: egg farmers who house hens in cages or barns; broiler farmers who raise meat chickens; hatcheries that keep breeding stock; small-scale producers selling eggs at farmers’ markets; and even hobbyists who keep chickens for domestic egg production if they could be argued to be “in charge” of the fowl. However, enforcement discretion likely targets commercial operations. The regulations explicitly apply to domestic fowl kept for “egg production” or “meat production”, but regulation 6 (general conditions) applies to all domestic fowl regardless of purpose. So the general duties - food, water, inspection, contingency plans - apply even to backyard chickens.

Regulation 7 (cage requirements) applies only to domestic fowl kept for egg production and housed in cages. This covers the conventional battery cage sector and any enriched colony cages. The cage floor area requirements of regulations 8 and 9 are similarly confined. Regulation 8 covers birds weighing less than 4.5 kg (most commercial laying hens), while regulation 9 covers heavier birds (e.g. some heritage breeds or broiler breeders). The thresholds act as a barrier to keeping very large birds in cages for egg production, because the weight-based density limit for a single 4.5 kg bird in a cage would be 26 kg/m², meaning the cage would need at least 0.173 m² (1,730 cm²) - larger than for a lighter bird.

Regulation 10 (general non-cage requirements) applies to both egg and meat production, while regulations 11 (egg) and 12 (meat) have separate density limits. The seasonal density variation for broilers (regulation 12(1)(b)) affects producers using water-based cooling with stirring fans: during the five hot months they must reduce stocking density from 40 kg/m² to 36 kg/m². This has a direct economic impact: fewer birds per shed during summer, or earlier slaughter before the season change, or investment in evaporative cooling to avoid the reduction. Producers with no mechanical cooling face the strictest limit (28 kg/m²) year-round, effectively forcing a choice between lower output or capital investment.

Regulation 13 (range requirements) affects any producer who provides outdoor access, irrespective of whether they market as free range. Even a producer who uses a barn system but occasionally lets birds out must comply with shelter, opening dimensions, and 8-hour access rules. The 2 metres per 1000 fowl opening width requirement is a significant design constraint. For a 20,000-bird free range flock, the total opening width must be at least 40 metres, distributed across popholes. This limits building designs and may require multiple openings along the shed wall, increasing construction and maintenance costs, as well as biosecurity risks from wild birds or vermin entry.

The regulations indirectly affect suppliers of poultry housing equipment (cage manufacturers, shed builders, cooling system vendors) because compliance determines market demand for different housing systems. They also affect consumers through egg and chicken prices, as compliance costs are passed through the supply chain. Veterinary consultants and animal welfare auditors are affected as compliance verification services become necessary. Local government enforcement officers and Department of Agriculture inspectors are the front-line enforcers, though the regulations do not create a specific inspection regime; enforcement occurs under the general powers of the parent Act.

Crucially, the regulations impose identical duties on producers of any scale, but the per-unit compliance cost is higher for small producers because fixed costs (e.g. drafting a contingency plan, purchasing an alarm system) do not scale linearly. A small farm may not have a mechanically ventilated shed, but if it does, the alarm testing requirement applies. The predation risk reduction duty is open-ended and could impose costs such as fencing, guardian animals, or netting, which may be disproportionately expensive for small operations. The exemption to confine birds “in the best interest of the health and wellbeing” could be used to reduce range access during high-risk periods, but doing so requires a genuine determination and could be challenged.

Duties regarding food and water. Regulation 6(1) and (2) require that domestic fowl have access to food and water with adequate nutrients to meet health and wellbeing requirements, at least once every 24 hours (and within 60 hours of hatching for newly-hatched fowl). The term “access” is not defined, but implies that feed and water must be within reach of all birds, not merely provided in the shed. For cage birds, feed troughs must be accessible; for non-cage, distribution of feeders must ensure all birds can reach them. The duty is strict: it is not enough to place feed in the shed; the person in charge must ensure that suffices to meet health and wellbeing. This could be interpreted to require appropriate number of feeders, adequate space at the trough, and protection from contamination. Failure to provide access for even a day is an offence.

Duty to inspect daily. Regulation 6(3) requires inspection at least once in every 24 hour period to assess health and wellbeing. This does not specify time of day, but the inspection must be genuine. For large flocks, achieving a meaningful inspection of every bird is impossible in practice, so inspectors likely accept a walk-through of the shed with spot checks. However, the duty applies to all fowl, so a producer must have a system that allows them to reasonably assess the flock’s health - e.g. check for dead or sick birds, assess feed and water intake, observe behaviour. Failure to do so is an offence.

Duty to have contingency plans. Regulation 6(4) requires a person in charge to have a contingency plan for power failure and for interruption to food or water supply. The regulations do not prescribe the content of these plans, but they must be “in respect of” those events - presumably setting out actions to be taken, backup systems, contact numbers, etc. The plan must exist; it does not need to be in writing, but in practice it should be documented to demonstrate compliance. For a large farm, this could involve backup generators, automatic water valves, feed supply agreements. For a small producer, it may be as simple as having a neighbour who can bring feed.

Alarm testing in mechanically ventilated sheds. Regulation 6(5) mandates “a system in place for testing alarms installed at the shed”. This implies the producer must have a documented testing procedure (frequency, method, records) and execute it. Alarms typically monitor temperature and air quality; failure could lead to mass mortality.

Cage-specific duties. Regulation 7 requires: cages arranged so all birds are visible for inspection and protected from excreta from higher decks; floor constructed to support forward-pointing toes; cage height greater than the maximum height of any fowl standing normally; door height equal to full cage height, width at least 50 cm (or full width if less than 50 cm). These are structural requirements that affect cage design and must be maintained.

Cage floor area duties. Regulations 8 and 9 set per-bird floor area minima or density limits. For birds under 4.5 kg: singles 1000 cm², doubles 1350 cm² (675 per bird), three or more: 550 cm² each under 2.4 kg, 600 cm² each if any bird is 2.4 kg or more. For birds 4.5 kg+: weight-based density limits as described.

Non-cage duties. Regulation 10 requires: sufficient access to fowl for health assessment; protection from excreta from higher levels if multi-level; and height of at least 45 cm. Regulation 11 (egg production non-cage): 30 kg/m² density. Regulation 12 (meat production non-cage): densities vary by cooling system (40/36/28 kg/m²).

Range duties. Regulation 13: provide shelter on range; take reasonable steps to reduce predation risk; provide unrestricted access for min 8 hours daily except when confinement is in best interest; opening dimensions 35 cm high x 40 cm wide; combined opening width 2 m per 1000 fowl; openings must enable free and safe movement and minimise adverse weather effects on fowl and litter.

Rights. The regulations do not grant rights to birds or persons; they are penal provisions. The person in charge has a limited right to confine birds when it is in their best interest (regulation 13(4) exception). There is no right to appeal a decision short of prosecution, and no right to compensation if compliance requires capital expenditure.

Each duty under regulations 6 through 13 is an offence carrying a maximum penalty of 5 penalty units. At the time of making, the penalty unit value was $155.46, so each offence costs up to $777.30 (rounded to the nearest dollar per section 7 of the Monetary Units Act 2004). That value is adjusted annually by the Treasurer, so the fine increases with inflation. The penalty is the same regardless of the severity of the breach - a single bird in a cage that is 1 cm short of the height requirement faces the same maximum fine as a farm that starves 10,000 birds for a day, though in practice a court could impose a lower fine for minor breaches.

Enforcement is under the Prevention of Cruelty to Animals Act 1986, which provides for inspectors (usually from the Department of Agriculture or local councils) to enter premises, inspect animals, vehicles, records, and seize evidence. Inspectors may issue improvement notices or infringement notices for minor breaches, though the regulations do not establish a specific infringement penalty regime. The parent Act also allows for prosecution. Multiple offences can be charged simultaneously; for example, a producer could be charged with failing to provide food (reg 6(1)), failing to inspect (reg 6(3)), and failing to have a contingency plan (reg 6(4)) in the same incident, each carrying separate penalties.

A significant enforcement gap is that the regulations do not prescribe a minimum frequency for testing alarms (only that there is a system for testing), nor do they specify what is “sufficient access” for health assessment, “reasonable steps” for predation reduction, or “adequate nutrients”. This gives inspectors and courts considerable discretion, which can lead to inconsistency. The burden of proof in a prosecution lies with the enforcement body to show beyond reasonable doubt that a breach occurred. However, because many duties are strict liability (no mental element), the producer cannot argue that they were unaware or that compliance was inconvenient.

The contingency plan requirement is also not self-enforcing; it only becomes an offence if an inspector requests the plan and it is absent or inadequate. In practice, enforcement is likely complaint-driven or triggered by an animal welfare incident. Producers should maintain documentary proof of compliance: floor area calculations, testing logs, inspection records, contingency plans, shelter on range, etc. Absent such records, a prosecutor may still prove breach through observation (e.g. measuring cages).

The regulations do not include any civil penalty or remediation order; the only remedy is the criminal fine. Corporate officers may be liable if they are “in charge” of the fowl, or under the parent Act’s provisions on officer liability. There is no right to a formal warning or rectification period; an inspector could lay charges immediately upon discovering a breach.

These regulations sit under the Prevention of Cruelty to Animals Act 1986 (Vic) (POCTA) and are made under section 42. They supplement the general cruelty offences in that Act (e.g. section 9: cruelty to animals, section 10: aggravated cruelty) by setting specific minimum housing standards. A breach of a regulation is also an offence under the parent Act, but the regulations provide a defence against a cruelty charge if the person was complying with the regulations? Not directly; compliance with the regulations does not necessarily mean a person is not guilty of cruelty if the housing conditions still cause unnecessary pain or suffering. The regulations set a floor, not a ceiling.

Other relevant Victorian laws include the Domestic Animals Act 1994 (if fowl are kept in residential areas and cause nuisance), the Planning and Environment Act 1987 (for land use and building permits for poultry farms), and the Subordinate Legislation Act 1994 (which imposes the 10-year sunset). The regulations are subordinate legislation and can be amended or revoked by a later statutory rule.

Nationally, the regulations interact with the Competition and Consumer Act 2010 (Australian Consumer Law) for claims about free-range eggs or chicken - e.g. “free range” labelling must comply with the Australian Consumer Law and the specific information standards for eggs. The Victorian regulations do not define “free range” but impose minimum standards that would be relevant in determining whether a free range claim is misleading. Producers using range must comply with the state biosecurity laws (e.g. Livestock Disease Control Act 1994, Biosecurity Act 2015) regarding disease prevention, predator control, and bird health monitoring.

There is no direct interaction with the Model Code of Practice for the Welfare of Animals - Domestic Poultry (which is a non-binding national standard), but the Victorian regulations may be seen as giving legal force to some of its recommendations. However, the regulations are not identical to the Code; for example, the Code recommends cage floor areas larger than 550 cm² for layers, so compliance with the regulation does not guarantee compliance with the Code, and non-compliance with the Code could be used as evidence of cruelty in a POCTA prosecution.

There is no specific reference to the Australian Animal Welfare Standards and Guidelines for Poultry (currently under development), but once finalised, they may influence future amendments or the remake of these regulations at sunset.

According to the table of amendments in the endnotes of the original instrument (version 001), there are no amendments made to the Prevention of Cruelty to Animals (Domestic Fowl) Regulations 2016 by statutory rules, subordinate instruments, or Acts. The version as at 18 October 2016 is the sole version. However, note that the penalty unit values change annually, but that is an automatic statutory adjustment under the Monetary Units Act 2004, not an amendment to the regulations themselves. The regulations were made on 4 October 2016 and commenced on 18 October 2016. They replace the 2006 regulations (S.R. No. 143/2006) which were revoked in their entirety by regulation 4. The 2006 regulations had similar structure but different numerical standards; for example, the 2006 regulations had minimum cage floor areas of 600 cm² per bird for multi-bird cages under 2.4 kg, whereas the 2016 regulations reduced it to 550 cm² for birds under 2.4 kg (but 600 cm² if any bird is 2.4 kg or more). This is a notable reduction in space for lighter layers, which may have been driven by industry pressure or economic considerations, but the explanatory material does not explain the change. The 2016 regulations also introduced the 45 cm non-cage height minimum (which was not present in 2006), and added the specific opening dimensions and width requirements for range. The 2006 regulations did not have a separate range regulation. The 2016 regulations also added the contingency plan requirement and alarm testing requirement, which were absent in 2006.

As of the publication date (October 2016), no amendments are in operation or schedule for the future. However, regulatory impact statements or consultation documents may exist but are not part of the statutory instrument. Users should check the current version on the Victorian Legislation website for any amendments made after 2016.

The text of the regulations does not mention any litigation history, and no cases are cited. There are no known reported court cases specifically interpreting these regulations as of their commencement. However, the parent Act (Prevention of Cruelty to Animals Act 1986) has been litigated in various animal cruelty prosecutions, but none specifically on these regulations. The lack of litigation may reflect the fact that the regulations are relatively new and enforcement may have been limited, or that disputes are resolved without contested court hearings. Potential future areas of litigation include: interpretation of “access to food … adequate nutrients” - what constitutes adequate nutrients for health and wellbeing; the meaning of “reasonable steps to reduce the risk of predation” - whether a particular fencing or netting system meets the test; and the “best interest” exception for confining birds - whether a producer’s determination was made in good faith and based on sound evidence. Because these are penal regulations with strict liability, a successful defence might require the defendant to show that they had no control over the situation (e.g., an act of God) or that they relied on the advice of a qualified expert. The absence of litigation history does not mean the regulations are immune from challenge; it merely indicates that no significant disputes have arisen yet.

Several traps await the unwary. First, the definition of “cage floor area” is the internal part of the cage. If the cage has sloping floors (common in conventional cages), the floor area is measured as the actual internal area, not the horizontal projection. This can reduce available space. Producers using inclined floors may need to adjust bird numbers to account for the reduced effective area per bird.

Second, the cage height requirement (reg 7(4)): “height of each cage is greater than the maximum height of any domestic fowl standing normally in that cage.” A standard laying hen standing normally is about 40-45 cm. The cage height must exceed that. If a cage has a flat roof and is 45 cm high, a hen that stands 44 cm high just fits, but a larger bird may touch the roof. Producers should measure their tallest bird and ensure all cages have at least a few centimetres clearance. This is easy to miss because cage height is often uniform across a shed, and if a batch of birds is larger than expected, non-compliance occurs.

Third, the door dimensions (reg 7(5)): door height must equal the full height of the cage, and width at least 50 cm (or full width of cage if less than 50 cm). This means that conventional cage doors that do not open the full height (e.g., half-height doors) are non-compliant. Many older cage systems had doors that only partially opened; these must be retrofitted or replaced.

Fourth, the non-cage height of 45 cm (reg 10(4)) is startlingly low. For broilers weighing 4 kg, a standing height of 40-45 cm is not uncommon. If the roof of the non-cage housing system is only 45 cm high, the birds may not be able to stand fully erect. This may violate the basic cruelty provisions of the parent Act even if the regulation is technically met. Producers should interpret the 45 cm as an absolute minimum and likely need higher ceilings for good welfare.

Fifth, the useable floor area for non-cage systems includes slatted, metal mesh, and areas taken up by feeders, drinkers, and nest boxes (reg 12(2) for meat birds; for egg birds, regulation 11 does not include such a permissive definition, but presumably the same interpretation applies by analogy or by reference to standard industry practice). However, the regulation does not clarify whether the area under feeders is counted only if it is litter floor or can be slatted. This can create ambiguity.

Sixth, the “best interest” exception in regulation 13(4) allows the person in charge to confine birds. But the determination must be based on health and wellbeing. If an inspector disagrees, the producer could face a charge for failing to provide 8 hours access. The burden of proof would be on the prosecutor to show the confinement was not in the best interest. However, the producer should document the reasons for confinement (heatwave, disease outbreak, predator threat) to mount a defence.

Seventh, the combined opening width of 2 metres per 1000 fowl (reg 13(5)(b)) is a linear requirement that does not account for flock size. For a 50-bird flock, combined opening must be at least 0.1 m (10 cm) - easily met. For a 100,000 bird flock, combined opening must be at least 200 metres, which may require many openings and could compromise building integrity or biosecurity.

Eighth, the predation risk reduction duty (reg 13(3)) is open-ended. “Reasonable steps” could include fencing, guardian dogs, traps, netting, or deterrents. The cost could be substantial. A producer who installs a 1.5 metre fence may be found to have taken reasonable steps, but an inspector may argue that higher fences or overhead netting are needed. There is no safe harbour.

Ninth, the regulations do not exempt producers from the requirement to house domestic fowl in a structure that complies; there is no transition period for existing facilities. If a producer was compliant under the 2006 regulations but not under the 2016 regulations (e.g., cage door dimensions), they could face immediate liability upon commencement.

Tenth, the penalty appears small (5 penalty units), but each bird or each day could be a separate offence depending on the charging decision. A 1000-bird cage facility that violates floor area per bird could be charged with 1000 offences, leading to a theoretical fine of over $777,000. In practice, prosecutors may charge a single representative offence, but the potential is there.

Eleventh, “range” is defined only as “an outdoor area that is accessible”. It does not have to be grass, it can be concrete or dirt. But if the range does not provide shelter (regulation 13(2)), the producer must install shade structures. Also, the range must be accessible; if the popholes are blocked or the birds refuse to go out, the producer is still liable to provide openings that enable free and safe movement.

Twelfth, the contingency plan (reg 6(4)) must be in respect of power failure and interruption to food or water. This implies the plan must address each event specifically. A generic “call the supplier” plan may be insufficient; it should identify backup food sources, emergency water supply, generator capacity and maintenance schedule, and contact numbers for utility providers. Not having a plan is an offence.

Compliance requires a systematic approach covering documentation, physical measurements, and management practices. Here is a practical checklist based on the regulations.

General duties (regulation 6):

1. Ensure food and water are available at least once every 24 hours (for newly hatched, within 60 hours). Document feed delivery schedules and check water lines daily. Keep records of feed and water refills.
2. Conduct daily inspection of all fowl. Maintain a logbook noting time of inspection, any sick or dead birds found, and actions taken. For large sheds, ensure the inspection route covers all areas and all levels.
3. Prepare a written contingency plan for power failure. Include details of backup generator (if any), automatic transfer switch, fuel supply, and a protocol for when to activate. Also a plan for food interruption (emergency feed supplier, alternative feed sources) and water interruption (backup pump, water storage tanks, access to tanker water). Keep the plan on site and review annually.
4. If the shed is mechanically ventilated, establish an alarm testing system. Decide frequency (e.g., weekly or monthly), document tests, and keep a log. Test all alarms (temperature, airflow, power). Maintain records.

Cage housing for egg production (regulations 7-9):

1. Measure cage dimensions: internal floor area (length x width, excluding any feeders or drinkers that reduce usable space). For sloping floors, measure the actual floor surface area.
2. Calculate per-bird floor area based on number of birds per cage and their individual weights (or estimated weights). Ensure compliance with regulation 8 or 9. For multiple birds, the table must be applied correctly: for 3+ birds under 2.4 kg each, 550 cm² per bird; if any bird is 2.4 kg or more, 600 cm² per bird. For large breeds over 4.5 kg, use weight-to-area ratios.
3. Check cage door dimensions: height must equal full cage height; width at least 50 cm (or full width if less than 50 cm). Retrofit doors if necessary.
4. Ensure cage floor is constructed to support forward-pointing toes. The floor should be sloped to allow egg roll but with a surface that prevents claw damage. This may require replacing worn or damaged mesh.
5. Arrange cages so that all birds are visible for inspection. If stacked decks are used, ensure lighting and access allow sight of birds on all levels. Also ensure upper decks have excreta boards or belts to prevent droppings falling onto lower birds.
6. Measure cage height from floor to ceiling. Must exceed the maximum height of any bird standing normally. If a bird stands 42 cm, cage height must be at least 43 cm. Measure birds after a batch and adjust if necessary.

Non-cage housing (regulations 10-12):

1. Ensure the height of the housing system (from floor to ceiling or top of structure) is at least 45 cm. For multi-level systems, the height of each level must be at least 45 cm? The wording is “the height of the non‑cage housing system” - likely the overall building height, but interpret as each tier’s vertical space.
2. Provide sufficient access to assess health and wellbeing. This may require walkways, lighting, and ability to see birds on all levels. Install ramps or ladders for inspection.
3. If using multi-level perches or housing levels, ensure birds on lower levels are protected from excreta from above. This could be solid floors, dropping boards, or belts.
4. For egg production (regulation 11): ensure stocking density does not exceed 30 kg/m² useable floor area. Calculate total weight of flock (average weight x number) divided by useable floor area (including slatted areas, feeders, drinkers, nest boxes). If density exceeds limit, remove birds or increase floor area.
5. For meat production (regulation 12): density limits depend on cooling system. If you have evaporative cooling, limit is 40 kg/m² year-round. If water-based cooling with stirring fans, 40 kg/m² from 1 March to 31 October, 36 kg/m² from 1 November to 28/29 February. If no mechanical cooling, limit is 28 kg/m² year-round. Calculate as total weight / useable floor area. Adjust bird numbers per batch or slaughter schedule to stay within limits.

Range (regulation 13):

1. Provide shelter on the range: shade cloth, trees, structures that protect from sun, rain, wind. Ensure it covers enough area for all birds that go out.
2. Take reasonable steps to reduce predation: install fencing (at least 1.5m high, buried mesh), use guardian animals (e.g., dogs, donkeys), remove attractants, or use netting. Document the steps taken.
3. Provide unrestricted access for at least 8 hours daily. Open popholes at dawn and close at dusk, but ensure total open time meets 8 hours. Record opening and closing times. If confining birds due to health/welfare reasons, document the determination (e.g., heatwave forecast, predator sighting, disease outbreak).
4. Each opening must be at least 35 cm high and 40 cm wide. Measure all popholes.
5. Combined width of all openings must be at least 2 metres per 1000 fowl. For example, 5,000 birds need 10 metres total width. If each pophole is 40 cm wide, you need 25 popholes (10m / 0.4m). Install sufficient openings.
6. Ensure openings allow free and safe movement: no sharp edges, clear of obstructions, and designed to minimise adverse weather effects on fowl and litter (e.g., flaps, overhangs, windbreaks).

General compliance management:

• Keep records of all measurements, calculations, inspections, test logs, contingency plans, and confinement decisions. Ideally date and sign.
• Regularly audit your facilities against the regulations, at least annually.
• Train staff on duties and inspection procedures.
• If making changes to housing, check that new cages or sheds meet these regulations before installation.
• When purchasing birds, obtain expected weight ranges to calculate density.
• For multi-shed operations, treat each shed separately for compliance.

The regulations sunset on 4 October 2026. The responsible Minister may initiate a review before then. Producers should engage with industry bodies and government during that process to influence the standards. In the interim, full compliance is mandatory.
