40 Neglect to prosecute If a person who filed a charge-sheet charging an offence under this Act or the regulations does not appear at the hearing or in any other way fails to proceed with the prosecution, the court hearing the alleged offence may authorise another person to take or continue the proceedings for that offence, whether upon that charge-sheet or not.
