37APower to serve a notice

37A Power to serve a notice (1) An authorised officer may serve an infringement notice on any person that he or she has reason to believe has committed— (a) an offence against section 15A(2); or (b) a prescribed offence against the regulations. (2) In this Part a reference to an "authorised officer" is a reference to— S. 37A(2)(a) amended by Nos 60/2012 s. 72(8), 71/2014 s. 8(1). (a) in the case of an offence relating to a scientific procedure (within the meaning of Part 3) an authorised officer, within the meaning of section 25; and S. 37A(2)(b) substituted by No. 71/2014 s. 8(2). (b) in any other case, a POCTA inspector. S. 37A(3) substituted by No. 32/2006 s. 94(Sch. item 39(1)). (3) An offence referred to in subsection (1) for which an infringement notice may be served is an infringement offence within the meaning of the **Infringements Act 2006** and the penalty for that offence is the prescribed infringement penalty in respect of that offence.
