Presbyterian Churches Act 1837

The Act operates on a limited set of recurring legal and governance concepts. First, trusteeship is statutoryised as a role confined to temporal affairs, not spiritual oversight. Section 8 expressly limits trustees’ duties to temporal matters: collecting pew rents, receiving subscriptions, devises and bequests for erection, maintenance and repair of the church, minister’s dwelling, burial ground or glebe, paying stipends or salaries of church officers, and meeting expenses for worship and ministerial functions. Section 8 also expressly declares trustees have no power to appoint or dismiss ministers, separating temporal management from spiritual appointment.

Second, eligibility and membership criteria are normative checkpoints. Section 3 requires trustees to be congregation members, either seat-holders or communicants, free and over 21. The preamble elaborates practical nomination rules: where a person builds a church at their cost they may nominate trustees; where subscribers contribute at least three hundred pounds they may elect trustees by plurality from a leet of ten names prepared under local regulation and signed by the meeting chairman before transmission to Presbytery for selection and onward to the Governor for approval (preamble; see s 5 for continued procedures on vacancies).

Third, oversight and layered approvals are core design features. The Presbytery performs both spiritual adjudication (it is to judge spiritual disqualification in s 4) and administrative consent in multiple operations (selection of trustees from the leet in the preamble; nomination where surviving trustees fail to call a meeting s 6; consent to leases and uses of glebe land under s 10). The Governor with Executive Council has the final approval role (preamble; s 13), and the Act declares previous trustee appointments under the earlier colonial Act void where inconsistent, converting earlier appointments to new procedures within six months of the Act’s passing (s 13).

Fourth, property and income rights are defined and restricted. Trustees hold real estate in trust for church purposes (preamble). Section 7 requires deeds and assurances to effectuate appointment. Section 9 gives the officiating minister rights of free access, admission and occupation of church premises, burial ground and minister’s dwelling, and to receive rents and profits, but the Act also expressly disclaims any conferral of proprietary title to the clergyman nor a defence to ejectment by trustees after removal by Presbytery (s 9). Section 10 creates a specific revenue-raising mechanism for glebe land: trustees, with Presbytery consent, may improve and lease glebe land for up to 28 years where such improvement produces more than £150 yearly profit, subject to security being given to the present and next minister for the £150 annual allowance and to an appropriation of up to one-fifth of the glebe for the personal use and occupation of the clergyman where residence is situated on the glebe.

Fifth, procedural safeguards and record-keeping are embedded. Trustees must furnish to the Presbytery, by 1 May each year, accounts of receipts and disbursements to the close of the preceding year (s 12). The Act also imposes a constraint on resignation: no trustee may resign until he has duly accounted to the satisfaction of co-trustees for all sums received in trust (s 5, proviso).

Finally, enforcement is a mix of ecclesiastical adjudication and civil remedies. Presbytery resolves spiritual disqualification and can nominate replacements where trustees fail to act (s 4, s 6). Trustees have the civil power to sue for recovery of pew rents and other sums due (s 11). The Act itself does not provide a detailed statutory enforcement regime beyond these mechanisms.

The Act creates obligations, rights and processes that affect a defined set of actors in church governance and property management. Immediate stakeholders are the trustees of Presbyterian churches and chapels connected with the Church of Scotland as constituted under the Act; the Act prescribes how they are nominated, the minimum and maximum numbers (three to five) and their duties (preamble; s 3; s 8). Congregation members who are subscribers and seat-holders are materially affected: they are the pool from which trustees must be nominated or elected (preamble; s 3), they participate in meetings to form a leet of ten candidates when raising funds or establishing a church, and they have the power to elect trustees by plurality in those circumstances (preamble).

Officiating ministers are directly affected. Section 2 entitles the minister, ex officio, to attend meetings concerning the affairs of his church and to vote; it also provides that the chair has a casting vote in case of equality. Section 9 gives the minister statutory rights to access church property, to occupy the minister’s dwelling and use glebe appurtenances while recognised by the Presbytery, and to receive the rents, profits and issues of glebe. At the same time, the Act clarifies those occupancies do not confer proprietary title and that trustees retain the right to pursue ejectment after the minister’s removal by Presbytery (s 9).

The Presbytery of the Colony holds dual roles as an ecclesiastical regulator and an administrative gatekeeper. Presbytery must approve initial nominations from builders or the leet, make selections from the leet for the Governor’s approval, judge spiritual disqualification (s 4), give consent to leasing and application of glebe profits (s 10), and may nominate a trustee where surviving trustees fail to call a meeting in time (s 6). The Governor, with the Executive Council, has the final administrative approval for trustees and the Act expressly vests the Governor with power to nominate pew-holders as trustees for churches already maintained at public expense under the earlier Act; the Act also declares prior appointments under the earlier Act null and void and requires reconstitution within six months (preamble; s 13).

Subscribers and seat-holders who contributed at least £300 towards building a church or minister’s dwelling are affected as the Act gives them the creation and electoral rights for trustees in those circumstances (preamble). Those who hold pews or sit in the church may also be liable to pew rents and therefore subject to collection and legal action by trustees if they fail to pay (s 11).

Wider civil authorities are indirectly affected to the extent they provide approvals or receive conveyances. The Act contemplates the conveyance of real estate to trustees and the heirs of the survivor of such trustees upon trust for church purposes (preamble; s 13). Conveyancers, registrars and courts may be engaged in giving legal effect to deeds and in resolving disputes (s 7, s 9, s 11), although the Act itself does not set out detailed court procedures.

Finally, where glebe lands are improved and leased to produce revenue above £150 per annum, tenants, developers and future ministers are affected by the financial priorities the Act prescribes: trustees must secure payment of £150 per annum to the present and next inducted minister and may reserve up to one-fifth of the glebe for personal occupation by the clergyman where the residence lies upon that glebe (s 10).

The Act draws a line between temporal management duties assigned to trustees and spiritual functions reserved for ministers and the Presbytery. Trustees’ primary duties are confined to temporal affairs, as expressly set out in s 8: to collect pew rents; receive subscriptions, donations and devises; manage property given for church purposes; apply funds for erection, maintenance and repair of church buildings and minister’s dwellings; manage burial grounds and glebe lands; pay stipends or salaries of church officers; meet expenses attendant on the dispensation of divine ordinances; and ensure faithful performance of ministerial, clerical and parochial duties connected with those temporal matters. The Act expressly disallows trustees from appointing or dismissing the minister (s 8).

Trustees have concrete rights to enforce financial obligations: s 11 authorises them to collect sums due for pews or sittings and to sue for recovery from persons who fail to pay. The Act also prescribes that trustees, out of monies received, shall apply funds for the purposes previously mentioned, "as far as the same will extend" (s 11).

Trustees have procedural duties around selection and replacement of trustees. When an original trustee dies, resigns with co-trustee consent, or is removed, the survivors must call a meeting of subscribers and seat-holders for nominating a new trustee and must follow the original selection procedures (s 5). Trustees must give public notice of meetings for filling vacancies within two months; failure to do so permits the Presbytery to nominate a qualified person and seek the Governor’s approval (s 6).

Trustees are required to furnish annual accounts to the Presbytery if requested, by 1 May in each year, of all receipts and disbursements to the close of the preceding year (s 12). A trustee cannot resign until he has satisfactorily accounted to co-trustees for all sums received in trust (s 5, proviso). Section 7 requires that deeds and assurances be made and executed as necessary to effectuate the appointment of new trustees, which places a duty on trustees to ensure conveyancing and trust documentation is in order.

Officiating ministers have rights to attend trustee meetings and vote on affairs of the church of which they are officiating minister (s 2). They also have rights of access, admission and occupation of the church, burial ground and minister’s dwelling and to receive rents, profits and issues thereof, while they remain recognised by the Presbytery (s 9). These rights are protective of the minister’s ability to exercise spiritual functions without hindrance from trustees or others. However, s 9 also limits the minister’s rights by denying any conferral of proprietary title through occupation and by preserving trustees’ capacity to bring ejectment proceedings after ministerial removal by Presbytery.

The Presbytery has explicit rights and duties: to approve nominations from leets (preamble), to judge spiritual disqualification (s 4), to consent to trustees’ action in letting glebe land and to approve portions for ministerial occupation (s 10), and to nominate trustees where trustees have failed to give public notice for nomination meetings (s 6).

Finally, the Governor and Executive Council retain a final administrative approval role for trustees nominated or selected under the Act (preamble; s 13). Section 13 also transfers legal title to lands and dwellings, to trustees and the heirs of the survivor, upon trust for maintenance and repair, and in some cases empowers the Governor to nominate pew-holders to be trustees within six months of the earlier recited Act. The Act therefore divides duties and rights among congregational actors, trustees, ministers, Presbytery, and colonial executive authorities.

The Act does not establish a comprehensive punitive enforcement regime in the statutory text provided. Instead, enforcement primarily relies on ecclesiastical oversight and civil remedies. There are three recurring enforcement mechanisms embedded in the Act.

First, ecclesiastical enforcement by the Presbytery. The Presbytery is given the role of adjudicating spiritual disqualification of trustees (s 4). That means where allegations of disqualification arise "so far as regards spiritual matters," the Presbytery is to be the judge at the suit of other trustees or the kirk session (s 4). The Presbytery may also step in administratively where trustees fail to act: if surviving trustees do not give public notice for filling a vacancy within two months, the Presbytery may nominate a qualified person and forward the name to the Governor and Executive Council for approval (s 6). Further, Presbytery consent is required for leasing glebe land and for approvals of reserved portions of glebe for ministerial occupation (s 10). These provisions vest significant enforcement and corrective authority in an ecclesiastical body, not in statutory criminal sanctions.

Second, civil enforcement by trustees. Trustees may "collect and gather all and every sum or sums of money" due for pews or sittings and may "sue for the recovery of the same" from persons who fail or refuse to pay (s 11). This explicitly preserves civil remedies for enforcement of contractual or quasi-contractual pew-rent obligations. The Act does not prescribe particular procedural shortcuts, statutory summons powers, or penalties; it relies on ordinary civil process for recovery.

Third, conveyancing and ejectment. Section 9 preserves the trustees’ capacity to bring ejectment actions against a minister occupying the minister’s dwelling after removal by Presbytery; the Act states occupation does not become a property right nor a bar to any ejectment brought by or on behalf of trustees. That implies civil court remedies for possession and property rights remain available to trustees. Section 7 requires deeds and assurances be executed to complete trustees’ appointments, and the proper legal effect of those instruments would be enforced through ordinary property law.

Notably absent are explicit criminal offences or statutory fines for failure to comply with the Act’s provisions (for example, no explicit penalty for failing to furnish accounts to the Presbytery, or for failing to secure Governor approval). The Act does not prescribe a statutory procedure for removal of trustees other than the processes in ss 4-6, nor does it provide a schedule of fines or imprisonment for misconduct. Enforcement therefore is a combination of church governance tools (Presbytery oversight and decision-making) and ordinary civil court actions (suits for rent, ejectment, conveyancing disputes). Where the Act requires consent, nomination or approval by named actors (Presbytery, Governor), the practical sanction for non-compliance is likely legal invalidity of actions taken without those consents, rather than a separate statutory penalty.

This mix leaves implementation risk concentrated on institutional capacity and procedural compliance: trustees who act without required consents risk their deeds and leases being voidable, and ministers and congregants can enforce rights through civil action or through Presbytery challenge. The Act does not elaborate administrative enforcement steps, so securing approvals, maintaining proper deeds, and using civil courts where necessary are the principal enforcement pathways.

The Act expressly interacts with one earlier statutory instrument and implicitly with general property and civil law. The preamble recites an earlier colonial Act, "An Act to promote the Building of Churches and Chapels, and to provide for the maintenance of Ministers of Religion in New South Wales," passed in the seventh year of King William the Fourth. That earlier Act contemplated that trustees not less than three nor more than five would be nominated by contributors for the Governor’s approval and that real estate would be conveyed to trustees and the heirs of the survivor upon trust for church purposes (preamble). The 1837 Act builds on and modifies that framework for Presbyterian churches in the Colony by prescribing nomination procedures, replacements, and by declaring earlier trustee appointments under the recited Act null and void; s 13 requires trustees for churches already built to be appointed under the 1837 Act within six months of its passing.

On conveyancing and trust law, the Act assumes ordinary mechanisms of deeds, assurances and conveyance remain necessary to effectuate trustees’ legal title and trust obligations. Section 7 requires necessary deeds and assurances be made and executed to complete appointment of new trustees, and the preamble and s 13 contemplate conveyance of church real estate to trustees and the heirs of the survivor upon trust for maintenance and worship. Those provisions operate within the normal property law framework (conveyancing, title, registration) applicable in the Colony at the time, and any disputes over title, breach of trust or conveyancing defects would be resolved under general property and trust law rather than by this Act’s internal procedures.

The Act also allocates certain powers to the Governor and Executive Council that interact with executive authority under colonial law. The Governor’s approval is required for trustee appointments (preamble; s 13), and the Governor is empowered to nominate pew-holders to be trustees for churches maintained at public expense under the earlier recited Act (s 13). That creates an administrative overlay where executive approval intersects with ecclesiastical selection and subscribers’ nominations.

Ecclesiastical law is also implicated. The Presbytery is given authority to judge spiritual disqualification (s 4), to approve nominations and leases of glebe land (preamble; s 10), and to nominate trustees where trustees fail to call meetings (s 6). Those powers sit within the internal governance of the Presbyterian Church and would interact with church discipline and synodical processes. The Act reinforces the role of ecclesiastical decision-making alongside civil conveyancing and contract enforcement.

Finally, civil remedies remain primary for financial enforcement and property possession. Trustees may sue for pew-rent arrears (s 11) and may bring ejectment actions against a minister who remains in possession after removal by the Presbytery (s 9). Those remedies bring in ordinary civil procedure, contract and property law. The Act does not specify procedural alterations to courts; it therefore should be read as complementary and not supplanting existing civil jurisdiction.

In sum, the Act overlays a statutory nomination-and-approval structure on top of existing property, trust and ecclesiastical law, importing the ordinary processes of deeds and civil enforcement while delegating spiritual assessments and certain consents to the Presbytery and final administrative approval to the Governor and Executive Council.

The textual materials provided state that there are no amendments to the Presbyterian Churches Act 1837 by later Acts or subordinate instruments. The Endnotes (Table of Amendments) explicitly record "There are no amendments made to the Presbyterian Churches Act 1837 by Acts and subordinate instruments." The Act as supplied is therefore presented in its original form as assented to on 9 September 1837 (Endnotes 1). The preamble records its assent and operation date as 9 September 1837.

Because the Act declares prior trustee appointments under the earlier recited Act void and prescribes reconstitution within six months, it effected a near-immediate reconfiguration of trustees for affected churches upon its passage (s 13). That internal change is part of the Act’s initial operation rather than a later amendment.

For practitioners, the absence of recorded amendments in the supplied materials means that the Act’s text, as presented, remains the primary source of obligations and processes it creates. However, it is necessary in modern practice to verify whether later statutes, repeals, or consolidations have affected the Act since the version provided. The supplied version is annotated as "Version as at 3 March 2003" and the Endnotes show no amendments listed. The explanatory note indicates the short title is "8 Wm. IV No. 7. An Act to regulate the Temporal Affairs of Presbyterian Churches and Chapels connected with the Church of Scotland, in the Colony of New South Wales." The legal effect of any subsequent jurisdictional changes, superseding trust legislation, or general church property statutes enacted after the version date would not be reflected in the provided text.

Where a lawyer or compliance officer must advise a contemporary client, the absence of amendments in the supplied material flags two necessary first actions: confirm the current statutory status in the relevant jurisdictional statute book and check whether later general trust, property, charity or ecclesiastical law regimes have modified or overridden the Act’s practical operation. The supplied materials do not include any schedule of repeals or cross-references to contemporary statutes, so those inquiries must be undertaken outside the text supplied here.

The materials provided contain no cases, reported judicial decisions, or references to litigation under the Presbyterian Churches Act 1837. The Endnotes and the body of the Act do not cite any judicial interpretations, nor does the explanatory detail include litigation summaries. The Act itself anticipates legal disputes,by preserving trustees’ rights to sue for pew rents (s 11) and trustees’ rights to bring ejectment actions (s 9),but no litigation history is recited in the materials supplied.

For a practitioner seeking precedent on the Act’s provisions,on, for example, the meaning of "spiritual disqualification" adjudicated by the Presbytery, the legal force of ministerial occupation short of property title, or the enforceability of leases executed by trustees for glebe improvement under the £150 threshold in s 10,there is no litigation summary here to rely on. That means careful drafting of instruments (conveyances, leases, security for the £150 payment) and anticipatory dispute-resolution clauses will be important, because statutory text alone governs the rights absent judicial gloss.

A modern researcher or advocate should seek case law in the relevant jurisdiction’s databases to determine whether courts have interpreted the Act’s provisions over time. The Act’s age and colonial provenance mean historic litigation may exist in early colonial reports or in ecclesiastical court records, but none are provided here. The absence of litigation history in the supplied material should be treated as a gap to be filled by independent research into archival and reported decisions.

There are a number of technical traps and practical frictions the Act creates if followed literally. Because the Act is specific in form and procedure, failure to observe those formalities can void authority or cause dispute.

1. Governor and Presbytery approvals are required. Nominations and selections of trustees must be transmitted to and approved by the Presbytery and then the Governor and Executive Council (preamble; s 13). Appointing trustees without those approvals risks invalidity. Conversely, the Act gives the Governor a backstop power for churches previously maintained at public expense; s 13 declares prior trustee appointments under the earlier Act null and void, requiring reconstitution within six months. Failure to comply within those timeframes (noting the six-month timeframe applies at passing) could leave property administration in legal uncertainty.

2. Trustee eligibility is narrow. A trustee must be a congregation member, seat-holder or communicant, free and over 21 (s 3). Appointing someone who does not meet those criteria gives grounds for challenge and might invalidate the appointment.

3. Resignation carries an accounting precondition. A trustee may not resign until he has accounted "to the satisfaction" of his co-trustees for all sums received in trust (s 5 proviso). The Act does not define the standard for satisfaction, leaving room for dispute and deadlock where co-trustees withhold acceptance. Practically, that may impede turnover of trustees or require formal accounting and perhaps judicial determination of adequacy.

4. Presbytery’s role in spiritual disqualification is broad but undefined. Section 4 makes the Presbytery the judge "so far as regards spiritual matters" of disqualification. The Act does not define the contours of spiritual disqualification or the procedural protections for a trustee accused of disqualification. This raises procedural risk of ecclesiastical decisions that have significant property consequences without clear statutory due process.

5. Ministerial occupation does not create property rights but may obstruct trustees’ plans. Section 9 grants ministers occupation and receipt of rents while recognised by Presbytery, but expressly denies the occupation confers property title or a defence to ejectment after ministerial removal. That creates a potential flashpoint where a minister in occupation asserts strong de facto possession, and trustees must pursue ejectment to regain possession after a removal by Presbytery. That measured approach requires courts for resolution and risks damaging congregational relationships.

6. Glebe improvement requires security but the form is unspecified. Section 10 permits trustees, with Presbytery consent, to let glebe land to increase yearly profit beyond £150, but only "security being given" to the present and next inducted minister for payment of £150 annually. The Act does not specify the form or enforceability of that security, which risks disputes over what suffices as adequate security and who must provide it. Practitioners will need to structure robust security interests or trust provisions and consider registration where possible.

7. Reservation of up to one-fifth of the glebe for clergyman’s personal occupation requires Presbytery approval and approval of the portion. This reduces the free residue of the glebe available for revenue-raising and must be measured in conveyancing and leasing plans (s 10). The Act uses "not exceeding one fifth" and requires approval by the Presbytery, so the calculation and approval process could generate disagreement.

8. Leases capped at 28 years. Where trustees let glebe land under s 10, leases cannot exceed 28 years. For potential developers or investors, this term limit affects valuation and investment appetite; trustees seeking modern capital structures will need to consider whether the 28-year cap constrains financing or requires staged renewals.

9. Annual accounting deadline is tight and reactive. Section 12 requires trustees, "if required to do so," to furnish to the Presbytery, before 1 May each year, a true and correct account to the close of the preceding year. Because the statutory duty is conditional ("if required to do so"), the Presbytery can demand accounts. Failure to supply accounts could provoke Presbytery action but the Act specifies no statutory penalty, so remedy will likely be ecclesiastical process or civil action for breach of trust in extreme cases.

10. The Act voids earlier trustee appointments. Section 13 declares former trustee appointments under the recited Act null and void and requires that trustees be appointed under the new procedures within six months. Trustees relying on prior appointments that have not been reconstituted risk being divested of legal title if reappointment procedures are not completed.

11. No express dispute-resolution framework. The Act anticipates litigation (s 11, s 9) but does not prescribe internal dispute resolution or arbitration. Parties will need to rely on church courts (Presbytery) for spiritual matters and civil courts for property and contractual matters, which increases transaction costs.

12. Local custom-and-leet processes are underspecified. The preamble contemplates a leet of ten persons prepared "agreeably to such local regulations as the said subscribers may appoint." Because local regulations vary and the Act does not provide default rules, procedural challenges can arise where no clear local regulation exists.

These "gotchas" are concrete legal and operational frictions embedded in the Act’s structure and language. Parties dealing with trustee appointments, glebe development, accounting, or ministerial occupation should build compliance steps into governance documents and conveyancing instruments to mitigate these risks.

Compliance under the Act requires a mix of procedural, documentation and institutionally coordinated steps. Below are practical steps drawn directly from the Act’s text and the processes it prescribes.

1. Establish eligibility before nomination. Ensure any person nominated or appointed as a trustee is a member of the congregation (seat-holder or communicant), free and over 21 years old (s 3). Confirmation of seat-holder status and communicant status should be recorded in meeting minutes. Where nominations come from builders or subscribers, confirm eligibility before forming the leet.

2. Follow the leet and election formalities where subscribers contribute £300 or more. When subscribers contribute the statutory minimum to erect or provide a church or minister’s dwelling, convene a special meeting of subscribers and seat-holders to prepare a leet of ten qualified candidates under local regulations, have the chairman sign the leet, and transmit it to the Presbytery for selection of not less than three nor more than five trustees, and subsequently obtain the Governor and Executive Council’s approval (preamble). Keep minutes evidencing the meeting, the leet, the chairman’s signature and its transmission.

3. Secure Presbytery and Governor approvals. Obtain written approvals from the Presbytery (selection/consent) and final approval from the Governor and Executive Council before completing trustee appointments (preamble; s 13). Where the Presbytery’s consent is required for leases or glebe improvements, secure that consent in writing.

4. Prepare deeds and conveyances when appointing or replacing trustees. Execute such deeds and assurances as are necessary to effectuate and complete appointments in accordance with s 7. Register conveyances and trust deeds as required by local property registration systems to ensure legal title clarity.

5. Observe resignation accounting rules. Ensure any trustee intending to resign provides a full accounting to co-trustees and secures their satisfaction before resignation is accepted, and record the acceptance formally (s 5 proviso). Consider establishing a prescribed process in trustees’ rules for an independent audit or accounting review to prevent deadlock over satisfaction.

6. Handle absences and disqualification per the Act. If a trustee is absent for more than six months, is a confirmed lunatic, or becomes disqualified by reason of improper conduct, notify the Presbytery and follow the s 4 process for obtaining Presbytery sanction and the subsequent procedure for subscribers to nominate a panel of not less than three qualified persons for selection by the Presbytery (s 4). Keep contemporaneous documentation of notices to Presbytery and meeting notices for selecting replacements.

7. Give public notice and convene vacancies meetings promptly. When a vacancy arises the surviving trustees must call a meeting of subscribers and seat-holders to nominate a new trustee forthwith; if they fail to give public notice within two months, Presbytery may nominate a qualified person (s 5-6). Maintain proof of public notices and meeting advertisements.

8. Maintain accounts and annual reporting. If required by the Presbytery, furnish a true and correct account of all receipts and disbursements to the close of the preceding year before 1 May annually (s 12). Establish bookkeeping procedures, segregated bank accounts for trust funds, and an annual accounting cycle timed to meet the 1 May reporting date. Consider independent review or audit of accounts to satisfy Presbytery and co-trustees.

9. Enforce pew rents and handle arrears through civil process. Trustees authorised to collect pew rents should document tenancy terms for pews and seat-holders, maintain ledgers of rents and arrears, and be prepared to commence civil proceedings to recover sums due if voluntary payment fails (s 11). Establish internal debt-recovery policies that are compliant with general contract and consumer laws.

10. For glebe improvements and leasing, secure Presbytery consent and provide security for ministerial allowance. If the trustees propose building upon glebe land to increase annual profit beyond £150, obtain Presbytery consent, ensure security is provided for payment of £150 annually to the present and the next inducted minister, and ensure leases do not exceed 28 years (s 10). Document the form of security (e.g. charge, covenant, sinking fund), obtain legal advice on enforceability and, if necessary, register security instruments.

11. Reserve up to one-fifth of glebe for ministerial occupation as required. Where the minister’s residence lies on the glebe, reserve up to one-fifth of the glebe for the minister’s personal use if the Presbytery approves the portion. Document the portion, rationale and Presbytery approval and record the reservation in any conveyance or lease instruments (s 10).

12. Preserve ministerial access rights while guarding trustees’ property rights. Recognise the minister’s statutory rights to access and occupation while preserving trustees’ capacity to bring ejectment after removal by Presbytery (s 2; s 9). Include clear occupancy agreements and surrender provisions tied to continuance of ministerial recognition by Presbytery.

13. Reconstitute trustees for churches previously appointed under the earlier Act. If a church’s trustees were appointed under the recited Act and not yet reconstituted, follow the Act’s directions to make appointments within the timeframes set at enactment or seek confirmation from the Governor as required by s 13.

14. Keep governance documents up to date. Since many procedural steps rely on local regulation (preparing a leet) and Presbytery determinations, trustees should adopt standing rules of governance and maintain records of local regulations approved by subscribers. Draft trust instruments to reflect the Act’s constraints and to provide clarity where the Act leaves matters unspecified (for example, the form of the "security" for £150).

15. Seek early legal and ecclesiastical advice where disputes arise. Given the interplay between ecclesiastical determinations and civil property rights, obtain counsel for contested resignations, disputes over "spiritual disqualification," contested accountings, claims for pew rents, and proposed glebe developments. Use church processes to resolve spiritual issues and civil courts for property and contractual issues.

Adhering to these steps, documented in minutes, signed consents, deeds and clear financial records, implements the Act’s procedural requirements and reduces the risk that trustees’ acts are vulnerable to challenge. Where the Act is silent, trustees should build conservatively compliant instruments consistent with the statutory constraints.
