Presbyterian Church (Proposals for Union with other Churches) Act 1972

This Act prescribes how the trusts and trust-held property of congregations of the Presbyterian Church of Australia in the Australian Capital Territory are to be treated if the General Assembly proposes or resolves to enter into a union with one or more other churches. Mechanically, the Act creates a statutory rule‑set that links (a) the outcome of congregational voting on two specified questions (Schedule 1, cl 1), (b) the decision of the General Assembly to enter into union, and (c) the legal status of property held by the Trust on behalf of each congregation under the Presbyterian Church Trust Property Act 1971 (the Trust Property Act). The key mechanical pathways are:

• If congregational voting has occurred in accordance with Schedule 1 and, for a given congregation, less than one third of voting members vote “Yes” to the second question in Schedule 1, cl 1, then on the passing of the General Assembly resolution to enter into union all property then held by the Trust on behalf of that congregation ceases to be church trust property under the Trust Property Act and is to be held by the Trust for the purposes of the church formed by the union (s 3).

• If the same votings have occurred and one third or more of voting members vote “Yes” to the second question, then on the passing of the General Assembly resolution the property continues to be church trust property held by the Trust as if the Act had not been made (s 4).

• A procedural exception allows an application, signed by not less than one twentieth of the congregation members entitled to vote, to be made to the General Assembly after the counting of votes and before the General Assembly resolves to enter into union; that application requests that, if the General Assembly resolves to enter into union, the question of the trusts attaching to the congregational property be referred to a commission constituted by the General Assembly (s 5).

• If such an application is made and the General Assembly resolves to enter into union, the Trust’s property for that congregation continues to be held as if the Act had not been made pending the commission’s determination (s 6). The commission is to be constituted of two equal groups representing those who voted for and against union, plus three independent persons acceptable to both groups, with one of the independents appointed chair by the General Assembly (s 7). The commission must hear the application in accordance with any procedural regulations and determine the trusts on which the property is to be held applying principles specified in the regulations (s 8); its determination changes the legal status of the property from the date of the determination (s 9).

The Act confers a regulation‑making power on the Executive (s 10), and Schedule 1 prescribes specific steps to identify eligible voters and the mechanics of the ballot (Schedule 1, cl 2). Definitions in s 2 expressly import the Trust Property Act’s definitions of “church trust property”, “congregation”, “the Church”, “the Trust”, and related terms, so the legal effect on property must be read against that Act.

The republication front matter records the statutory purpose in the long title , "to make provision in relation to the trusts on which property of the Presbyterian Church of Australia is to be held" , and records legislative history and penalty unit values applying to offences against the republished law (see republication header and endnotes). The Act is confined to congregations in the ACT by its operative references to "members of each congregation in the ACT" in ss 3 and 4.

The Act introduces and interlocks several discrete legal and procedural concepts.

Property status tied to voting: The central legal concept is that the property held by the Trust on behalf of a congregation becomes, or remains, "church trust property" for different legal purposes depending on a two‑question congregational ballot and a threshold rule tied to the second question. The two questions are set out in Schedule 1, cl 1; the second question asks whether, if the required majority for union is obtained at higher levels (presbyteries, state general assemblies, General Assembly), the voter desires to remain in membership of any Presbyterian Church of Australia continuing on the present basis (Schedule 1, cl 1(b)). The threshold that governs property is defined by the proportion of voting members who answer “Yes” to that second question: less than one third leads to property being held for the prospective union church (s 3); one third or more means the property remains held for the continuing Presbyterian Church (s 4).

Temporal sequencing and interrupting application: A timing rule governs interventions. Section 5 allows a minority of members , not less than one twentieth of those entitled to vote , to apply, after counting and before the General Assembly resolves to enter into union, for the question of trusts to be referred to a commission. If such an application is made and the General Assembly resolves to enter into union, s 6 preserves the pre‑existing trust status pending the commission’s decision.

Commission model and composition: The Act creates a specialized decision‑maker, a commission to be appointed by the General Assembly and to include two groups representing the voting blocs for and against union in equal numbers, and three independent persons who must be acceptable to both groups (s 7). One independent is appointed chair by the General Assembly (s 7(2)). The commission’s function is adjudicative: it hears the application under procedures established by regulations and determines the trusts on which the property is to be held, applying principles specified in the regulations (s 8). The Act therefore delegates substantive determinations about the future character and purposes of trust property to a tripartite body whose procedure and guiding principles are to be set by subordinate legislation.

Interplay with Trust Property Act definitions: Section 2 explicitly incorporates several terms by reference to the Trust Property Act. The Act does not itself define "church trust property", "congregation", "the Church", or "the Trust": those meanings and the legal consequences attached to trust property are imported from the Trust Property Act. Reading the two Acts together is therefore necessary to understand the precise legal incidents of property affected by this Act.

Primary legal subjects: The immediate legal subjects are the members of each congregation of the Presbyterian Church of Australia within the Australian Capital Territory, the Trust (as defined in the Trust Property Act), and the General Assembly (s 2). The Act’s effects operate through corporate ecclesiastical structures: sessions of congregations, presbyteries of the bounds, and the General Assembly are explicitly engaged by the Schedule and operative sections. The Act therefore affects office‑holders (moderators, clerks of session, presbytery clerks, and the clerks of the assemblies) who have formal roles in establishing voting registers, certifying and attesting those registers, making voting papers available, counting votes and transmitting results (Schedule 1, cl 2).

Beneficiaries and interest‑holders in property: The Trust holds property for the purposes of church activities under the Trust Property Act; this Act alters which church purpose the Trust will hold the property for depending on the voting outcome and any commission determination (ss 3-4, 9). Thus beneficiaries or stakeholders with interest in congregational property , including local congregational committees, parish councils, and potentially lessees or third‑party beneficiaries under specific trust instruments , are affected because the legal description of the trust corpus and its permitted uses can change under s 3, s 4 or s 9.

Minority applicants and representation: Section 5 creates a route for not less than one twentieth of those entitled to vote in a congregation to trigger referral to a commission, so small minorities within a congregation can lawfully require the General Assembly to refer trust issues to a commission prior to the General Assembly resolution. Those applicants therefore have the right to seek a commission determination and to interrupt the automatic operation of ss 3-4 (s 5 and s 6).

Commission participants and independents: The commission includes two equal groups representing persons who voted for union and persons who voted to remain in membership of the continuing Presbyterian Church, plus three independent persons acceptable to both groups (s 7(1)(c)-(d)). The General Assembly appoints the independents and chooses a chair from them (s 7(2)). The people selected as commission members , typically drawn from within the church community but distinct from simple congregational members , therefore take on decision‑making responsibilities with legal consequences for property.

Executive and regulators: The Executive can make regulations under s 10 to prescribe the procedure and principles for the commission’s hearing and determination (s 8 and s 10). The Executive and any subordinate law making process are thereby actors who can shape how commissions will actually operate.

Duties imposed on church bodies and office‑holders: The Act imposes procedural duties rather than freestanding operational obligations. Sessions are required to purge their communion rolls as at a date specified by a commission of the General Assembly and to submit duplicate voting registers certified by moderator and clerk to the presbytery of the bounds (Schedule 1, cl 2(1)-(3)). Sessions must make voting papers containing the two prescribed questions available at least 14 days before the close of voting, ensure voters sign and return voting papers before the close, count the votes, and transmit tallies to the presbytery clerk for transmission to the clerk of the assembly (Schedule 1, cl 2(5)-(7)). The presbytery must attest copies of the voting register and retain one copy (Schedule 1, cl 2(3)). These are procedural duties carrying evidentiary and administrative obligations.

Rights of members to vote and to apply: Only persons on an attested voting register may vote (Schedule 1, cl 2(4)). Voters have the right to record a "Yes" or "No" to each of the two questions (Schedule 1, cl 1 and cl 2(5)). After the counting of votes but before the General Assembly resolves to enter into union, not less than one twentieth of those entitled to vote may apply to the General Assembly requesting that the trusts be referred to a commission (s 5). That application suspends, while the commission process is pending and if the General Assembly resolves to enter into union, the automatic application of ss 3-4 to the property in question; property shall continue to be held by the Trust as if the Act had not been made until the commission determines otherwise (s 6).

Duties of the General Assembly: If an application is made under s 5 and the General Assembly resolves to enter into union, the General Assembly is required to refer the application to a commission constituted in accordance with s 7 (s 7(1)(a)-(b)). The General Assembly must appoint the commission members, including the three independent persons and the chair from among them (s 7(1)(c)-(d), (2)). The General Assembly therefore has a duty to implement the commission process where the statutory prerequisites are met.

Duties and constraints on the commission: The commission is obliged to hear the application “as soon as practicable” after referral and to conduct the hearing in accordance with procedures prescribed by regulations (s 8). It must make a determination specifying the trusts on which the property is to be held applying the principles specified in the regulations (s 8). The commission’s determination has immediate legal effect: property determined to be held for the purposes of the union church ceases to be church trust property under the Trust Property Act from the date of determination and is held by the Trust for the purposes of the union church until other provision is made by law (s 9).

Absence of specific offence provisions: The Act’s operative provisions establish procedures and legal effects for property and do not specify criminal offences or bespoke enforcement mechanisms within the text of the Act. Sections 3 to 9 set out statutory consequences for property status, duties of church bodies and the composition and duties of a commission, but they do not create named offences with sanctions in the body of the Act.

Penalty unit values recorded in the republication header: The republished law’s front matter expressly records the penalty unit values that applied at the republication date, noting that the value of a penalty unit for an offence against the republished law was, at that time, $100 for an individual and $500 for a corporation. That statement indicates how monetary penalties against offences under the republished law would be calculated, but it does not identify particular offences in the Act itself.

Enforcement through civil effect on property: The primary enforcement mechanism in the Act is the statutory change in legal status of property held by the Trust upon specified triggers. Where the criteria in s 3 are met and no valid s 5 application intervenes, the Act automatically causes property to cease to be church trust property and to be held for the union church’s purposes from the date of the General Assembly resolution. Where the criteria in s 4 are met (one third or more 'Yes' votes to the second question) property continues to be held as previously. Where a s 5 application is made and the General Assembly refers the matter, the property is held as if the Act had not been made until the commission determination (s 6). Section 9 gives legal effect to commission determinations. Those property status rules operate as the Act’s main compliance and enforcement mechanism; they alter legal title or trust purposes rather than triggering audits, fines, or criminal enforcement under the Act itself.

Regulatory enforcement and procedural safeguards: The Act contemplates regulations to govern commission procedure and the principles to be applied (s 8). Those regulations, when made, will determine procedural safeguards for the hearing and thus shape what counts as fair notice, evidentiary standards, rights of representation, and so on. Until such regulations exist, the statutory mandate to hear “as soon as practicable” and to follow the procedures in the regulations may create uncertainty about enforcement timing. The Executive’s regulation‑making and the Legislation Act 2001 presentation requirements (s 10 note) are the subordinate‑law route by which procedural enforcement detail will be established.

Dependence on the Trust Property Act 1971: The Act repeatedly imports and relies on the Trust Property Act for core definitions and the legal concept of "church trust property". Section 2 defines "church trust property", "congregation", "the Church" and "the Trust" by reference to the Trust Property Act. The statutory consequences in ss 3, 4 and 9 operate by changing whether property is or ceases to be "church trust property within the meaning of the Trust Property Act". Therefore, the substantive legal effects of transfers, uses, or restraints on property will be governed by the Trust Property Act’s articulation of trust duties, powers and remediation mechanisms; one must read both Acts together to determine the precise rights and liabilities that flow from a change in trust purpose.

Interplay with church governance instruments and internal law: The Act engages the internal governance structures of the Presbyterian Church of Australia , sessions, presbyteries, state general assemblies and the General Assembly , and prescribes procedures to be implemented by these bodies (Schedule 1, cl 2 and ss 3-9). The Act therefore overlays statutory rules on top of ecclesiastical procedures. Where church constitutions, standing orders, or internal canons conflict with the Act’s requirements, the Act operates as the statute governing property status; practitioners will need to reconcile church law with the statutory obligations, or identify whether church law provides complementary or inconsistent procedures.

Regulatory interaction and subordinate law: Section 8 expressly requires that the commission act "in accordance with the procedure prescribed by the regulations" and "in accordance with the principles specified in the regulations" as the principles to be applied by it. Section 10 authorises the Executive to make regulations for the Act, and the note to s 10 indicates that regulations must be notified and presented under the Legislation Act 2001. Thus the Act anticipates a body of subordinate law that will determine how commissions operate. The Legislation Act 2001 procedures for notification and presentation will apply to those regulations.

Presentation against general administrative law principles: The Act establishes a statutory decision‑maker (the commission) making determinations affecting property and rights. The Act does not specify internal review or appeals from commission determinations; general administrative law remedies (judicial review) and statutory review mechanisms in other applicable statutes will therefore be the likely legal routes for parties challenging procedurally defective or unlawful commission action. The Act’s silence on appeals should be read in light of ordinary administrative law rights.

Origination and conversion: The statute began life as the Presbyterian Church (Proposals for Union with other Churches) Ordinance 1972 (Ord1972‑17 (Cwlth)), notified 16 June 1972 and commenced the same day (endnotes, legislation history). When self‑government was conferred on the ACT, most former Commonwealth ordinances in force were converted into ACT enactments under the Australian Capital Territory (Self‑Government) Act 1988 (Cwlth), s 34(4); this Act was converted into an ACT enactment on 11 May 1989, which is recorded in the endnotes.

Amendments recorded in endnotes: The endnotes identify specific amending instruments. The Ordinances Revision (Administrative Arrangements) Ordinance 1977 (Ord1977‑18), part 6, amended the Act and was notified 21 June 1977. The Self‑Government (Consequential Amendments) Ordinance 1989 (Ord1989‑38) made consequential changes on conversion; this instrument was notified 10 May 1989 (Cwlth Gaz 1989 No S160) with particular provisions commencing on 10 and 11 May 1989 as noted in the endnotes.

Later amendment in 2001: The Legislation (Consequential Amendments) Act 2001 A2001‑44 (pt 294) is recorded as amending the Act; it was notified 26 July 2001 and part 294 commenced on 12 September 2001 (endnotes, amendment history). The endnotes also record that s 10 (regulation‑making power) was amended by Ord1977‑18 s 12 and Ord1989‑38 sch 1, and later substituted by A2001‑44 amdt 1.3273 (endnotes 4).

Republications and editorial changes: The Parliamentary Counsel’s Office republished the Act as at 24 July 2002; the republication includes editorial changes authorised by the Legislation Act 2001, part 11.3, and the republication notes set out the range of editorial changes and the approach to editorial amendments. The republished law includes amendments, repeals and expiries affecting the republished law up to 12 September 2001 (republishing notes and endnotes). Earlier republications are listed in the endnotes (endnote 5), including an unnumbered republication in 1993 following Ord1989‑38.

Scope of amendments: The amendments recorded in the endnotes appear focused on adapting the ordinance into Territory legislation and on consequential adjustments to numbering and the regulation‑making head of power. The core operative provisions (ss 3-9 and Schedule 1) remain structured as originally enacted in 1972, subject to the conversion and the subsequent legislative housekeeping amendments recorded in the endnotes.

Implication for interpretation: When interpreting present provisions, practitioners should note the Act’s origin as an ordinance and the conversion to Territory enactment. Editorial amendments pursuant to the Legislation Act 2001 do not change legal effect but can alter drafting form; the republication notes advise they have effect as if made by an Act commencing on the republication date (Legislation Act 2001, ss 115 and 117, per the republication front matter).

No cases cited in the statute: The text of the Act and its republication endnotes do not cite any judicial decisions or list any litigation arising under the Act. The endnotes provide legislative history and amendment records but contain no references to litigation or court determinations interpreting the Act.

No recorded decisions in the republication: The republication prepared by the Parliamentary Counsel’s Office does not include a litigation history section and does not annotate the statute with case law. The absence of such material in the endnotes and the body of the Act indicates that, at least as of the republication date and the amendment incorporation date (12 September 2001), no reported cases are recorded in the republication materials.

Practical consequence for practitioners: Because the Act’s provisions create a specialised statutory process for changing the legal status of church trust property and for referring particular matters to a commission, the lack of reported judicial decisions in the republished materials means there are no statutoryly recorded judicial interpretations or precedents setting out how courts have construed the commission’s role, the meaning of the Schedule 1 questions, or the interplay with the Trust Property Act. Practitioners seeking guidance on contentious points , for example, the interpretation of the second question in Schedule 1, the evidentiary sufficiency of voting registers, the boundaries of the commission’s powers, or third‑party protection against change in trust purpose , will need to search case law databases beyond the text of the Act to see whether courts have addressed these issues since the republished date.

Potential for judicial review: The Act does not specify internal appeal routes from commission determinations. Ordinary avenues of judicial review (procedural fairness, jurisdictional error, unreasonableness) would be available in principle under administrative law frameworks if a party challenged a commission determination or a General Assembly act required by the Act, subject to any statutory ouster or limiting provision elsewhere. The republished Act contains no express privative clause or limited statutory review provision.

Recommendation to check later materials: Given the absence of litigation footnotes in the republished text, users who require current interpretive law should consult updated legal databases, tribunal/court records and ACT law reports to identify any cases that may have been decided since the republication date and which are not reflected in the republished instrument.

Timing and sequencing traps: The Act sets tight, interlocking time windows that can produce unintended consequences if procedural deadlines are missed. The key window for minority applicants is after counting of votes and before the General Assembly has resolved to enter into union (s 5). If the required one twentieth of entitled voters do not lodge a properly signed application within that interval, the statutory automatic consequences in ss 3-4 will operate on the General Assembly resolution with no commission referral. Practitioners should note that "after the counting of votes" means post‑count but pre‑resolution; the Act does not provide an express stay of the General Assembly’s power to resolve and practitioners must watch closely to preserve the right to apply.

Interpretation of the second question and threshold measurement: The property outcome turns on whether "1/3 or more" or "less than 1/3" of members who voted answered “Yes” to Schedule 1, cl 1(b). This is a relatively low threshold for minority influence. Parties must be precise in measuring the denominator: the Act defines eligible voters by reference to attested voting registers (Schedule 1, cl 2), so the counting base is "members of a congregation who voted on the questions" rather than the whole roll. That means strategic voting and turnout dynamics can materially change outcomes: a well‑timed petition by a small fraction (≥1/20) can lead to referral, while a low turnout among opponents could lead to property passing to the union church under s 3 if fewer than one third say "Yes" to the second question. The Act does not spell out tie‑breaking rules or rounding conventions for fractional votes.

Ambiguity about scope of "property held by the Trust": The Act operates on "all property held by the Trust on behalf of that congregation" (ss 3 and 4) but imports the meaning of "church trust property" from the Trust Property Act (s 2). Third parties and practitioners should take care to identify precisely which assets are trust property under the Trust Property Act; assets held in corporate titles, by charities, or under separate legal vehicles may or may not be within the statutory scope, and the Act provides no express mechanism for ring‑fencing or tracing assets if titles are ambiguous.

Regulation dependence creates implementation risk: Section 8 requires the commission to act in accordance with procedures and principles prescribed by the regulations, and s 10 authorises those regulations. However, until the Executive makes detailed regulations, crucial aspects of the commission’s operation (evidence, representation, locus standi for interveners, standard of proof, remedies) are unspecified. Parties are therefore exposed to implementation uncertainty: the Act binds the property consequences but leaves procedural detail to regulation. If regulations are delayed, the undefined standard of "as soon as practicable" may be interpreted flexibly, producing timing disputes.

For congregational officers (sessions and moderators/clerks)

• Purge and prepare: Follow Schedule 1, cl 2(1) and purge the communion roll as at the date specified by the commission of the General Assembly appointed for that purpose. Ensure timely submission of duplicate voting registers to the presbytery with certification by the moderator and clerk (Schedule 1, cl 2(1)-(3)).

• Voting papers and notice: Provide voting papers containing the two statutory questions at least 14 days before the close of voting (Schedule 1, cl 2(5)). Ensure the voting paper requires the voter’s signature and that all returned papers are received before the close of voting (Schedule 1, cl 2(6)).

• Counting and transmission: Count votes at session level as required by Schedule 1, cl 2(7). Transmit the number of “Yes” and “No” votes on each question to the clerk of the presbytery for onward transmission to the clerk of the assembly through the clerk of the state general assembly, keeping accurate records and copies of attested registers.

For congregation members

• Check attested register status: Only persons on an attested voting register may vote (Schedule 1, cl 2(4)). Confirm registration status with the session well ahead of voting, and observe any roll‑purge date set by the relevant commission.

• Participate timely and sign votes: If you intend to vote, ensure your voting paper is signed and returned before the close of voting (Schedule 1, cl 2(6)). If you oppose an outcome and intend to seek commission review, organise the required petition: an application to the General Assembly must be signed by not less than one twentieth of those entitled to vote, and it must be made after counting but before the General Assembly has resolved to enter into union (s 5).

For minority applicant groups

• Prepare valid application: Ensure the application under s 5 is properly signed by the requisite minimum number (not less than one twentieth) of members entitled to vote, and lodge it after counting but before the General Assembly resolution. The application should explicitly request a referral to a commission for determination of the trusts on which the property is to be held.

• Preserve evidence and timing: Keep copies of certified registers, vote counts and proof of application lodgement to substantiate the timing and validity of the petition. Failure to meet these timing or signature requirements will forfeit the right to commission referral.
