Presbyterian Church of Australia Act 1970

Several core legal concepts structure the Act and the Schedule.

Basis of Union as a constitutional instrument. The Basis of Union in the Schedule is deployed as a constitutional text for church governance and doctrine. It identifies supreme and subordinate doctrinal standards (Part I, clauses 1-4), prescribes required subscription formulas for ministers and elders (clauses 5-6), establishes amendment procedures for changes to doctrine and the Basis itself (clause 7), and defines the institutional architecture of the Church , the general assembly as the supreme court, synods, presbyteries, sessions and their composition and powers (Part II, clauses 8-14).

Statutory conversion of property holdings. Section 2 converts property “held immediately before” the Gazette notice for Presbyterian purposes into property held “subject to the Basis of Union”. The statutory language reaches “all interests in property held … by or in trust or otherwise for some or all of the purposes of the Presbyterian Church in Western Australia or for the General Assembly thereof or for any presbytery, session, board of management, congregation, mission, institution, committee, council or board however constituted, or fund in connection with that Church” (s 2(1)). The Act therefore targets trusts, legal titles and other proprietary interests used to advance church purposes.

Trust preservation and subjectivity. Section 3 preserves how trusts are held and for what purposes immediately prior to the notice, while making those trusts subject to the new powers of the Synod under the Basis and the powers previously exercised by the General Assembly in Western Australia. The text therefore keeps the operative terms of existing trusts but subjects their administration and ultimate authority to the new constitutional regime.

Evidence and public notice. The Gazette notice is an evidentiary and triggering instrument. A notice under s 2(1)(c) or s 4(1)(c) is evidence “of the matters declared in the notice” (s 2(2)). The Act conditions the substantive legal conversion on public, formal acts: deeds by Moderators, enabling Acts in other States and the Gazette publication.

Advance implementation of Part III. Section 4 permits implementing Part III , which sets out procedures for union with other churches and minority safeguards , in advance of full adoption of the Basis. It contains specific adaptative readings so that references to Synods and the Basis are workable during partial implementation, and delegates jurisdictional arrangements (s 4(2)). Where a union under Part III produces continuing congregations, s 4(3) permits the General Assembly to place continuing congregations under its jurisdiction if a continuing State Presbyterian Church is unable to function.

Minority safeguards and commission powers. Part III of the Basis (clauses 15-18) grants the General Assembly power to negotiate union and to approve unions only after a Barrier Act procedure through synods and presbyteries. Clause 16 requires that communicants aged 16 and over be given the opportunity to answer two specific questions on whether they desire their congregation to join the church resulting from the proposed union and whether they desire to remain in any continuing Presbyterian Church. Clause 17 prescribes detailed roll purging, voting register certification, attestation by presbyteries and voting procedures. Clause 18 requires the General Assembly to set up a commission with two groups of equal numbers plus three independent persons to protect minority rights. The commission may allow continuing congregations to retain congregational property, order equitable provision of property or funds for minorities, determine specific items of general property to be retained by a continuing church, and require compensation or provide for key institutions for the functioning of a continuing church (clauses 18(a)-(e)).

Operational powers over proceeds. Section 6 permits the Commission referred to in the Basis to give effect to its powers from proceeds of property to which the Act applies, which provides a statutory funding mechanism for the commission’s operations.

Cross‑references to earlier Acts and codes. The Act expressly ties the new regime to existing legislation and state codes. Section 3 gives the Synod powers “as are contained in that Basis of Union and in the Presbyterian Church Act 1908, and the Acts with which that Act is to be read”. The Schedule (Part II, clause 14) preserves the operation of former state codes until a new code of the Presbyterian Church of Australia is enacted.

Procedural thresholds for doctrinal change. Clause 7 of the Basis prescribes that changes in the Basis of Union or restatements of doctrine require referral to synods and presbyteries and consent by a majority of synods, three‑fifths of presbyteries and three‑fifths of the members of the general assembly present at the final vote. That is a specified high threshold for constitutional amendment within the Church.

These concepts interact to move control over property and internal governance from a patchwork of state arrangements and trust instruments into a single federal ecclesiastical constitution with statutory backing, once the procedural triggers set out in the Act are satisfied.

The Act affects several distinct constituencies, with different legal positions and obligations under the text.

Congregations and local trustees. Every congregation in the State with property used for Presbyterian purposes is potentially affected because s 2(1) refers broadly to “all interests in property held … for some or all of the purposes of the Presbyterian Church in Western Australia” and specifically names congregations. On publication of the Gazette notice, trustees, trusteeship arrangements and the legal handling of local property will be governed by the Basis of Union insofar as the Basis confers powers on the Synod and other courts (s 2(1), s 3).

State Synod and State Presbyterian Church bodies. The Synod of Western Australia under the Basis is endowed with powers in relation to property equivalent to those in the Basis and in the Presbyterian Church Act 1908, together with the powers formerly exercised by the General Assembly of the Presbyterian Church in Western Australia (s 3(a)). The Act therefore alters who has legal ecclesiastical authority over property , a shift from the pre‑existing State General Assembly structures to the Synod provided for under the new Basis.

The General Assembly of the Presbyterian Church of Australia. The text expands or confirms the role of the federal General Assembly. The Schedule treats the General Assembly as the “supreme court” of the Church with legislative, administrative and judicial functions (Part II, clause 8), and s 4(2)(a) explicitly authorises the General Assembly constituted under the 1901 Scheme to exercise Part III powers in advance of full adoption.

Ministers, probationers and elders. The Basis requires ministers and probationers to sign a subscription formula upon ordination, induction or appointment (clauses 5) and requires elders at their ordination/induction to sign a formula (clause 6). This places a contractual or canonical condition on those taking office in the Church. Those who refuse or are unable to sign the formula could be precluded from office under the Basis.

Donors, testators and trustees dealing with gifts and wills. Section 5 brings certain post‑notice gifts and dispositions within the scope of s 2 and s 3. If a gift, devise or declaration of trust comes into operation after the notice and is formulated in the way described, it will be treated as an interest to which s 2 or s 3 applies. Practically, testators, executors and trustees must be alert to the timing and wording of dispositions because later‑operating instruments can be folded into the post‑notice property regime.

Persons and groups voting on union. Clause 16 and clause 17 of the Basis affect communicants aged 16 and over whose names are on congregation rolls. Those communicants must be given the prescribed questions and the sessions and presbyteries must comply with the roll purging, certification and reporting procedures. This set of rules affects individual communicants’ participation in constitutional change.

The Commission and its members. The Commission established under the Basis (clause 18) will be created to protect minority rights and to determine allocation of property and compensation where congregations do not join a union. The Commission’s composition , two groups representing proponents and opponents plus three independent persons , means particular individuals selected to the commission will exercise significant discretionary powers over property allocation for continuing churches (clause 18(a), (d), (e)).

State Parliaments and moderators. The Act requires enabling Acts in each other State and deeds by Moderators to trigger the statutory conversion of property. In practice, State Parliaments must pass legislation substantially enabling the Basis and the Moderators of the General Assembly and of each State General Assembly must execute the deed setting out agreement to substitute the Basis for the old Scheme (s 2(1)(a)-(b)). The Western Australian Moderator must publish a Gazette notice to make the statutory conversion effective (s 2(1)(c) and s 2(2)).

Legal advisers, conveyancers and court officers. Because the Act affects the legal ownership and administration of property and declares that trusts are to be held subject to the Basis once the notice is published, lawyers and trustees dealing with church property, wills and conveyancing will be consequentially affected. Section 2(2) treats the Gazette notice as evidence, which is material for courts and registries.

Unincorporated bodies and councils. The Act’s reach to “board of management, mission, institution, committee, council or board however constituted” (s 2(1)) signals that a wide array of church bodies, whether incorporated or not, have their property interests captured by the statutory shift.

Who does not automatically lose rights. The Act preserves existing trusts and provides statutory safeguards for minorities under Part III of the Basis, so individuals and subunits do not automatically have their property rights extinguished without the processes in the Basis being observed (s 3, clause 18).

The compilation notes indicate that at the date of compilation no Gazette notice under s 2(1)(c) had been published. That means, as a factual point recorded in the legislation materials, the statutory conversion described in s 2(1) had not been triggered as at that compilation date. Practitioners should confirm current Gazette and parliamentary activity to determine whether the triggering events have since occurred.

The Act and the Basis allocate particular duties, rights and procedural obligations across church bodies, office holders and lay communicants. Below are the principal duties and rights created by the instrument, with the controlling sections identified.

Duty to execute enabling deeds and obtain State Acts (prerequisite duties). Parties seeking to bring property under the Basis have preliminary duties: the Moderator of the General Assembly of the Presbyterian Church of Australia and the Moderators of each State General Assembly must execute a deed declaring agreement to substitute the Basis for the old Scheme and to unite on that Basis (s 2(1)(a)). Each other State Parliament must pass enabling legislation enabling effect to be given to the Basis (s 2(1)(b)). These are institutional duties on state and federal church leadership and legislative bodies.

Duty to publish a Gazette notice. The Moderator of the General Assembly in Western Australia must publish a notice in the Gazette declaring that union has taken place and that the other State Acts are in operation (s 2(1)(c); s 4(1)(c)). The Gazette notice is the operative trigger. Section 2(2) makes the notice evidence of the matters it declares. This creates a duty to make a formal public act to effect the legal conversion.

Right to have trusts preserved. Owners and beneficiaries of existing trusts have a statutory right to have the trusts “held in the same manner and for the same purposes” as immediately prior to the notice (s 3). The Act explicitly states that, except as provided in the Act, the trusts are not affected or varied (s 3).

Duty of sessions to prepare and certify voting registers and to manage ballots. When a proposed union is to be voted on, sessions must purge their communion rolls and submit a voting register in duplicate by the date prescribed by the General Assembly (clause 17(1)). The moderator and clerk of the session must certify both copies (clause 17(2)). Sessions must make voting papers available at least 14 days before the close of voting, collect signed voting papers, count votes and transmit results to the presbytery clerk (clause 17(5)-(7)). Those procedural duties are mandatory and structured.

Right of communicants to vote on union questions. Clause 16 grants communicants aged 16 and over on the roll a right to be asked two prescribed questions relating to whether their congregation should become part of the church resulting from a proposed union and whether they wish to remain in any continuing Presbyterian Church. Clause 17 sets out the qualifications and mechanics for that right, including the attestation by presbyteries and the requirement that only those on an attested voting register may vote (clause 17(4)).

Obligation on the General Assembly to provide safeguards for minorities. Clause 18 requires the General Assembly to provide “just and equitable safeguards” for minorities who do not concur in a union. It specifies that a commission be set up to handle disputes and protections, including retention of property by continuing congregations, provision of property and funds to minority groups, determination of specific items of general property, and provision for institutional requirements of a continuing church (clause 18(a)-(e)). That duty is both substantive and procedural.

Right of continuing congregations to retain property subject to commission decisions. Clause 18(b) gives continuing congregations a right to retain congregational property if at least one‑third of communicants participating in the vote have indicated their desire to continue, unless the commission determines otherwise for special reasons, in which case the commission must provide adequate property or a due and proper share of endowments. The text therefore provides a conditional right to retain property, with the commission empowered to vary outcomes.

Commission’s discretionary powers and obligations. The commission has discretion to arrange, subject to criteria of capacity and suitability, for minorities to be provided with church buildings, manses and other necessary buildings or funds (clause 18(c)). It may determine what items of general property are necessary for efficient functioning of a continuing church and what compensation should be payable (clause 18(d)). It must have regard to “just and equitable rights of minorities” and provide for certain listed requirements for continuing churches, such as theological training centres, administrative centres and schools (clause 18(e)(i)-(iii)). These are significant decision rights vested in the commission, subject to its obligations.

Duty of the Commission to be funded from proceeds. Section 6 authorises the Commission to give effect to its powers out of the proceeds of the property to which the Act applies. That is an express funding source and an operational duty to use proceeds in carrying out commission functions.

Duty of ministers and elders to subscribe to formulae. Ministers must sign the formula required by clause 5 at ordination, induction or appointment. Elders must sign the formula required by clause 6 at ordination and/or induction. These subscription duties are conditions of office under the Basis.

Rights of synods and presbyteries to structure representation. The Basis (Part II) prescribes entitlements to representation on the General Assembly and Commission of Assembly. For example, presbyteries elect commissioners in proportion to the number of charges and the commission of assembly has one minister and one elder from each presbytery for every fifteen charges, with presbyteries indicating which of their commissioners will be commission members (clause 8(2)-(4)). Synods have powers to appoint additional elders and determine bounds (clause 9). These are rights and duties allocating representation.

Preservation right for existing state codes pending a new code. Clause 14 of Part II preserves the pre‑existing state codes until a code of the Presbyterian Church of Australia is enacted, with certain adaptations. That gives state bodies a right to continue operating under their earlier rules pending a federal code.

Evidentiary consequence of Gazette notice. Section 2(2) establishes that the Gazette notice is evidence of the matters declared, which is a legal right conferred on the party relying on the notice and a practical burden on other parties who might contest the factual assertions made in the notice.

Overall, duties are concentrated on moderators, sessions, presbyteries, and the General Assembly to carry out prescribed procedural steps, while rights attach to communicants, congregations, and continuing churches, especially with respect to property and institutional provision. The Commission is granted broad discretionary rights to determine allocation and compensation, but it must do so with regard to the equitable rights of minorities and specific institutional needs set out in clause 18(e).

The Act contains no express criminal offences, pecuniary penalties or administrative penalty scheme. The legislative text is primarily declaratory and procedural, focusing on re‑allocation and governance of property and institutional structures rather than on coercive sanctions. Enforcement of rights and duties created by the Act and the Basis therefore occurs through the following legal and administrative mechanisms that the Act creates or implies.

Statutory effect on property title and trusts. The primary enforcement mechanism is the statutory conversion of property holdings once the prescribed conditions are met and the Gazette notice is published (s 2(1)). The legal effect of that statutory conversion is to make the Basis the controlling constitutional instrument for property administration; this operates through property and trust law channels because trustees, title-holders and courts must give effect to the statute and the specified Basis. Section 3 preserves existing trusts but subjects them to the new governance structure. Consequently, disputes over administration, title or beneficial entitlement will be litigable in civil courts, with the Act and the Basis as governing documents and with the Gazette notice treated as evidence (s 2(2)).

Commission determinations as instruments of internal enforcement. Clause 18 empowers the commission with authority to resolve disputes about property allocation between continuing congregations and the church to result from a union. The commission is to provide just and equitable safeguards and may order retention of property, provision of property or funds, or allocation of certain items of general property to a continuing church (clauses 18(b)-(d)). The commission’s determinations are the internal administrative mechanism for enforcement of minority protections. Although the Act does not specify judicial review standards, decisions of ecclesiastical commissions and courts are generally subject to civil judicial review in courts for jurisdictional errors, procedural fairness and compliance with statutory mandates. The Act itself does not set an internal appeal route beyond the commission.

Procedural obligations with evidentiary consequences. The detailed voting and roll‑purging procedures in clause 17 create administrative obligations whose non‑compliance may affect the validity of any vote on union. Courts or internal church tribunals adjudicating disputes about the validity of a union vote would rely on compliance with the clause 17 procedures. The Act does not prescribe penalties for failure to comply, but non‑compliance may render votes procedurally defective and expose those decisions to challenge.

Interaction with civil courts and existing statutes. Section 3 references the Presbyterian Church Act 1908 and related Acts, indicating that the Synod’s powers are to be exercised “as are contained in that Basis of Union and in the Presbyterian Church Act 1908, and the Acts with which that Act is to be read”. Enforcement of those powers where they touch on property rights will be conducted in civil courts interpreting the Act and prior legislation. The Gazette notice is admissible as evidence (s 2(2)), which reduces factual disputes about whether the statutory trigger has occurred.

No express summary or criminal sanctions for non‑observance. The Act does not create enforcement devices like injunctive powers, fines, or criminal liabilities to ensure compliance with the Basis. Instead, enforcement will operate through ordinary civil law remedies for breaches of trust, contract or statutory obligation and through the internal mechanisms (commission, general assembly, synods) the Basis sets up.

Funding of enforcement mechanisms from proceeds. Section 6 permits the Commission to use proceeds of the relevant property to give effect to its powers. That enables the Commission to resource its activities, including providing property or funds to minorities, as clause 18 contemplates. The Act therefore supplies an internal funding mechanism that facilitates implementation and compliance with commission determinations.

In short, enforcement is largely structural and civil: the Act creates statutory authority and administrative procedures that bind trustees and church bodies once the formal triggers occur, but it relies on civil adjudication for disputes and internal commissions for allocation and protective decisions. There are no express penal provisions or criminal penalties in the Act.

The Act is drafted as an instrument that operates in the intersection of ecclesiastical constitutional arrangements, trust law, property law and pre‑existing statutory regimes. The text contains multiple express cross‑references and implicit interactions. The main interaction pathways are these.

Continuity with earlier Presbyterian Acts. The preamble and s 3 explicitly connect this Act to the Presbyterian Church of Australia Act 1901 and the Presbyterian Church Act 1908, and notes amendments to the latter (preamble paragraphs (b)-(d), s 3). Section 3 provides that the Synod’s powers are those contained in the Basis and in the Presbyterian Church Act 1908 and “the Acts with which that Act is to be read”, making the earlier statutory regime an operational context for property administration under the new Basis. Consequently, legal advisers must read the 1970 Act in conjunction with the 1901 and 1908 statutes and their amendments to determine the full suite of powers and constraints.

State enabling Acts required. The Act makes its conversion of property contingent on enabling Acts from the Parliaments of the other States (s 2(1)(b) and s 4(1)(b)). That creates a federated interplay: the WA Act will have effect only when its sister States enact complementary provisions enabling the Basis. The compilation notes also list other relevant Acts and the need to consult the Acts as passed for uncommenced provisions, indicating that the implementation is an inter‑jurisdictional exercise and that the Act’s practical effect depends on coordination with other state legislation.

Trust and property law. Section 2 operates directly on “interests in property” and s 3 preserves and conditions existing trusts. That places the Act squarely within property and equity law. Trustees, beneficiaries, registries and courts will interpret how a trust is to be administered given the new directive that trusts be held subject to the Basis once the Gazette notice is published. If a trust instrument contains contrary provisions, courts will have to reconcile trust terms with the new statutory direction; however the Act’s text preserves the manner and purposes of trusts (s 3), which is a protective rule. Section 5 also deals with gifts and wills, deeming certain after‑notice gifts to be interests to which s 2 or s 3 applies, thereby interacting with succession law.

Evidentiary interaction with administrative law. The Gazette notice is declared to be evidence of the matters it asserts (s 2(2)). That creates an administrative law interaction: registries and courts will accept the Gazette notice as evidence of union and the coming into operation of enabling Acts. It simplifies proof in litigation or registration contexts, but courts will also retain jurisdiction to examine whether statutory prerequisites were properly met.

Internal ecclesiastical law. The Basis uses internal procedures like the Barrier Act procedure for referral of constitutional changes to synods and presbyteries (Schedule Part I, clause 7) and detailed voting and commission processes (Part III, clauses 15-18). Those internal rules will bind church courts and courts may be asked to enforce compliance with them where they have legal ramifications for property rights or corporate identity. The Act therefore overlays statutory support on the internal law of the church.

Education and institutional law. Clause 18(e)(iii) requires provision for schools for boys and girls in specified circumstances. Decisions about ownership and operation of such schools will interact with education law, governance of incorporated entities and possibly charitable institutions law, depending on the governance structure of any school. The Act does not create new education obligations but confers authority on the commission to determine who holds or is compensated for such institutions.

Unincorporated associations and corporate law. The Act addresses boards, committees and councils “however constituted” (s 2(1)), so it reaches unincorporated bodies that hold property. If those bodies are incorporated (for example, schools or hospitals), then corporate law and property registration regimes interact with the Act because title or trusts may be held by corporate entities. The Act does not create or alter corporate personality, but it alters the constitutional regime to which corporate trustees may be subject.

No express override of general law beyond property subjectivity. The Act does not attempt to displace general civil or criminal law. It operates by statute to govern the disposition and holding of church property and to structure internal church governance. Disputes arising under the Act will thus be litigated in the ordinary courts applying statutory interpretation, trust and property law principles, and principles of administrative law where relevant to the commission’s decisions.

Territorial and timing interactions. The Act’s operation depends on concordant action across States. Section 4 permits Part III’s early implementation subject to State Acts and a Gazette notice. That creates potential temporal interaction where some parts of the Basis may be in force before others, which could produce staggered legal effects across jurisdictions and bodies.

In sum, the Act is designed to sit alongside and to be read with earlier Presbyterian statutes and with trust and property law. It depends on cooperative legislative action in other States to trigger full operation, and it creates procedures and evidentiary rules that will inform civil litigation and administrative decision‑making.

The legislative compilation recorded in the materials identifies two formal amendment events and some notes about commencement.

Original enactment. The Presbyterian Church of Australia Act 1970 was assented to on 30 November 1970 and commenced on 30 November 1970, except for section 7 which has not come into operation (Compilation table).

1972 Amendment Act. The Presbyterian Church of Australia Act Amendment Act 1972 (No. 2 of 1972) amended sections of the 1970 Act. The marginal notes in the main text indicate that s 3 was amended by No. 2 of 1972 s 2 and s 4 was amended by No. 2 of 1972 s 3. The compilation table records the Amendment Act’s assent on 8 May 1972 and its commencement on the same date. The textual annotations in the Schedule and sections 3 and 4 reflect those legislative amendments.

2010 formatting standardisation. The Standardisation of Formatting Act 2010 (No. 19 of 2010) effected formatting changes. The compilation table records that s 4 of that Act amended the Schedule heading and that the reprint as at 25 October 2002 includes the earlier amendments. The 2010 standardisation commenced on 11 September 2010 for the relevant provision.

Uncommenced provision. Section 7 of the 1970 Act has not been brought into operation. The compilation notes indicate that s 7 was not in operation at the date of compilation and that notice pursuant to s 7(2) is required for its commencement. The precise content of s 7 in the Act as passed is indicated to be uncommenced, and practitioners must consult the Acts as passed on the WA Legislation website for the text and for any subsequent commencement notices.

Cross‑references to other Acts. The compilation notes list other relevant Acts that interact with the 1970 Act: the Presbyterian Church of Australia Act 1901, the Presbyterian Church Act 1908, the Presbyterian Church Act Amendment Act 1919, and the Presbyterian Church Act Amendment Act 1924. Those earlier statutes were part of the historical structure that the 1970 Act builds upon or modifies.

No further amendment history is recorded in the materials supplied. The Schedule itself contains internal amendment procedures for the Basis of Union: clause 7 of the Basis prescribes that proposed changes to the Basis, including amendments to the subordinate standard or declaratory statement, must be remitted to synods and presbyteries and require the consent of a majority of synods, three‑fifths of presbyteries and three‑fifths of the members of the general assembly present when the final vote is taken. That is the internal constitutional amendment procedure for the church’s own law, which is distinct from parliamentary amendment of the statute.

Practitioners should check updated consolidated versions and WA Government Gazettes for any subsequent statutory amendments, commencement notices for s 7, and any State Acts in other jurisdictions that were passed to enable the Basis, since the Act’s practical operation depends on intergovernmental coordination reported outside the Act’s text.

The Act and the Schedule as provided contain no reported litigation or case law. The legislative text does not cite any judicial decisions, and the compilation materials do not identify any judicial consideration of the Act. Accordingly, based on the material before you there is no litigation history recorded in the statute itself.

That absence of recorded cases in the supplied materials does not mean disputes have not arisen in practice. Because the Act changes the statutory basis for property holdings and creates administrative commissions with powers over property allocation, it is plausible in general that disputes about trusteeship, the validity of Gazette notices, compliance with clause 17 voting procedures, and commission determinations could be litigated in civil courts. However, the source document supplies no names of cases, no reported decisions, and no judicial interpretations to cite. The Schedule itself envisions commission determinations and internal church handling of disputes (clause 18), suggesting an expectation that many disputes will be resolved through those internal mechanisms before or instead of litigation.

If litigation occurs, the likely legal issues that courts would be asked to resolve, derived from the text of the Act and the Basis, could include:

• Whether the statutory preconditions for s 2 or s 4 operation were satisfied prior to publication of the Gazette notice. Section 2 requires a deed executed by multiple Moderators and enabling State Acts, and s 2(2) treats the Gazette notice as evidence of the matters declared. Courts would need to consider the sufficiency of evidence and the requirements of the enabling provisions.

• Construction and effect of trust instruments in light of s 3. Courts would be asked to reconcile trust deeds with the statutory direction that trusts be held “in the same manner and for the same purposes” but subject to the Basis and the Synod’s powers.

• Validity of union votes and compliance with clause 17. Disputes over the roll purging process, certification, attestation, ballot form or counting might be justiciable if they affect property or membership rights.

• Review of commission determinations. If the commission makes allocations or compensation orders under clause 18, affected parties may seek judicial review on procedural fairness grounds or challenge the commission’s jurisdiction or compliance with statutory obligations.

None of these issues are adjudicated in the source document. Practitioners should search case law databases and court records for any post‑1970 litigation that interprets the Act or the Basis and should monitor the Gazette for notices under s 2 and s 4 which, once published, may have generated litigation that would be reported outside the Act text.

The Act contains several operational and legal traps for practitioners, trustees, congregations and drafters of wills. These are not novel policy criticisms but practical points of legal friction inherent in the text.

Triggering events are multi‑party and sequencing dependent. The conversion to the Basis requires a sequence of acts: (1) deed executed by the Moderators of the General Assembly and all State General Assemblies declaring agreement to adopt the Basis (s 2(1)(a)); (2) Parliaments of each other State passing enabling Acts in operation (s 2(1)(b)); (3) a Gazette notice by the WA Moderator declaring the union and that each Act is in operation (s 2(1)(c)). Failure in any link of this chain prevents the statutory conversion. That makes the Act practically vulnerable to coordination failure across States. The compilation notes explicitly record that at the date of compilation no notice under s 2(1)(c) had been published, a factual point with material significance for practitioners attempting to advise on current legal status.

Evidentiary weight of the Gazette notice. Section 2(2) states a notice in force under s 2(1)(c) or s 4(1)(c) “is evidence of the matters declared in the notice”. Parties may assume the Gazette notice is conclusive, but the Act phrases it as evidence rather than conclusive proof. If the preconditions were not in fact met, litigation could still arise challenging reliance on the notice. The drafters give primacy to a public administrative act but do not eliminate judicial inquiry.

Retention of trusts but subject to new governance. Section 3 preserves the way trusts are held and for the same purposes prior to the notice, yet simultaneously subjects them to new Synod powers under the Basis and the powers formerly exercised by the WA General Assembly (s 3(a)). Practically, trustees may have to reconcile trust instruments that specify local trustee or congregational autonomy with an emergent Synod authority that has statutory backing. This creates the legal friction point where existing trustee duties must be read against new governance directives.

Post‑notice gifts and timing traps. Section 5 deems certain gifts, devises and declarations of trust that “come into operation” after the Gazette notice to be interests to which s 2 or s 3 applies if the instrument’s terms are such that the pre‑notice rules would have applied had the interest existed earlier. Drafting errors in wills or instruments could therefore unintendedly fold new property dispositions into the post‑notice statutory regime. Executors and testators should be alert to this timing interaction.

Commission discretion and uncertainty for minorities. Clause 18 gives the commission broad discretion to determine property allocation, compensation and institutional provisions for continuing churches. The commission comprises equal numbers from both sides plus three independent persons (clause 18(a)). While the Act requires the commission to have regard to “just and equitable” rights, it does not specify judicially enforceable standards for those determinations nor set precise valuation rules. Affected congregations may face uncertainty over what constitutes an “adequate and suitable” property provision or a “due and proper share of endowments” (clause 18(b)-(d)). This is a practical risk for minorities that the commission process is intended to manage but which could create contentious litigation if parties dispute fairness.

Detailed procedural burdens on sessions and presbyteries. Clause 17 prescribes a sequence: purge communion rolls, produce duplicate certified voting registers, presbytery attestation, sessions to make voting papers available 14 days before close, voter signature requirements and transmission of counts to the general assembly clerk. That degree of administrative formality can be a trap for local church officers who do not follow steps precisely; failure to follow the procedures may invalidate votes or expose the process to challenge.

Partial implementation under s 4. Section 4 allows the implementation of Part III in advance of the entire Basis. Partial implementation can create asynchronous legal effects: property may become subject to Part III arrangements while other parts of the Basis remain unimplemented. Clause 4(2) attempts to adapt references to Synods and to empower the General Assembly under the 1901 Scheme to act, but a staggered implementation can still produce transitional ambiguity about jurisdiction and applicable codes.

Subscription requirements for ministers and elders. Ministers and elders must sign the admitted formulae (clauses 5-6). These subscription requirements are conditions of office and can affect staff recruitment, employment relations and potential disputes if persons decline to subscribe or wish to dissent on doctrinal points.

No express penal enforcement mechanism. The Act creates duties but does not set out penalties or summary enforcement mechanisms for non‑compliance with procedural rules, leaving redress to civil litigation and internal mechanisms. Parties may thus face protracted dispute resolution rather than quick statutory enforcement.

Uncommenced provision and legal uncertainty. Section 7 remains uncommenced in the cited compilation. Its future content and effect might change the operational landscape if brought into force. Practitioners should check the current status.

Interplay with existing state codes. Clause 14 preserves former state codes pending a federal code being enacted, which means a patchwork of rules may continue to apply across jurisdictions and even within WA until a new code is enacted. That complicates uniform compliance and administration.

In short, the principal operational gotchas are sequencing and coordination risks, evidentiary assumptions about the Gazette notice, procedural strictness for votes, commission discretion over property allocation, and timing traps for gifts and wills. These are matters to manage by careful procedural compliance, precise drafting and early engagement with State legislative processes and the commission’s procedures.

Compliance with the Act requires attention at multiple levels: state legislative action, formal deeds by moderators, administrative compliance in congregations, trustee reviews of documents, and preparations for commission processes. The following practical steps flow directly from the Act and the Basis.

1. Confirm the statutory trigger status.

   • Check whether the deed required by s 2(1)(a) has been executed by the Moderators listed in s 2(1)(a).
   • Confirm whether each other State Parliament has passed an enabling Act enabling effect to be given to the Basis of Union (s 2(1)(b)). The compilation notes list the relevant older Acts; verify any new enabling Acts have been enacted.
   • Verify whether the Moderator of the General Assembly of the Presbyterian Church in Western Australia has published the Gazette notice required under s 2(1)(c) or s 4(1)(c). The Gazette notice is the legal trigger and is evidence under s 2(2).

2. Trustees and conveyancers: review trust instruments and titles.

   • Immediately review trusteeship deeds, constitutions, trust instruments and property titles to identify any clauses inconsistent with administration under the Basis.
   • Where possible, record advice to trustees that trusts are to be held in the same manner and for the same purposes post‑notice, but will be subject to the Synod’s powers as provided in s 3. Prepare for any requests from the Synod or commission once the notice is published.

3. Drafting wills and gifts: manage timing risk under s 5.

   • For donors and testators, counsel on the effect of future Gazette notices: gifts that “come into operation” after a notice may be deemed interests to which s 2 or s 3 applies if the instrument’s terms match the described condition (s 5). Consider express clauses in wills addressing intended recipients or trustees in the event of constitutional change.

4. Prepare sessions and presbyteries for voting procedures.

   • If a proposed union is being put to congregational communicants, ensure sessions purge communion rolls by the date prescribed, prepare duplicate voting registers certified by the moderator and clerk (clause 17(1)-(2)), and comply with presbytery attestation (clause 17(3)).
   • Ensure voting papers are available not less than 14 days before close of voting, that voters sign and return papers prior to close (clause 17(5)-(6)), and that sessions count votes and transmit results promptly to the clerk of the presbytery and onward to the clerk of the general assembly (clause 17(7)).

5. Plan for potential commission processes if a union is approved.

   • If the General Assembly resolves to enter into a union under clause 15 and clause 18 activates commission arrangements, prepare documentation demonstrating congregational membership figures, endowments and property valuations, and any arguments for what constitutes an “adequate and suitable” allocation under clause 18(b)-(e).
   • If a congregation anticipates being a continuing congregation, assemble evidence of capacity to continue as an ecclesial body because the commission will be required to assess capacity under clause 18(c).

6. Ensure compliance with subscription duties for ministers and elders.

   • Ministers and probationers must sign the formula in clause 5 at ordination/induction. Elders must sign the formula in clause 6. Ensure ordination and induction processes capture those signatures and retain records.

7. Coordinate with other State churches and legal advisers.

   • Because the Act depends on enabling Acts in other States, coordinate with counterparts in other jurisdictions to monitor legislative developments and harmonise implementing measures.
   • Engage with legal counsel experienced in trusts and property law to design compliant implementation steps and to advise trustees on transitional obligations.

8. Administrative preparations for Synod and General Assembly bodies.

   • Synods should prepare to exercise powers in relation to property as provided by the Basis and the Presbyterian Church Act 1908 and related Acts (s 3).
   • General Assembly and commission secretariats should prepare administrative systems to record decisions, manage funding (s 6) and evidence required under the Basis.

9. Record keeping and public notice.

   • Keep tight records of all deeds, approvals, session registers, certification and presbytery attestations because these documents will be central in any internal or civil adjudication over the validity of votes and property allocations.
   • Monitor Gazette publications and retain copies of notices, which are evidentiary under s 2(2).

10. Contingency planning for partial implementation under s 4.

    • If Part III is implemented in advance, review how Synod references are to be read (s 4(2)(b)) and how the General Assembly constituted under the 1901 Scheme may exercise Part III powers (s 4(2)(a)). Be prepared for transitional arrangements, including potential federal oversight of continuing congregations under s 4(3).

11. Funding and administrative resources for the Commission.

    • If you are involved with the Commission, plan for funding use from property proceeds pursuant to s 6, and ensure transparent financial procedures for allocation of proceeds to meet commission determinations.

12. Litigation preparedness.

    • Where a congregation or trustee anticipates dispute with the commission or other church bodies, prepare litigation strategies grounded in trust law and the statutory text, focusing on compliance with clause 17 procedures, statutory prerequisites for s 2 operation and the commission’s obligations under clause 18.

These compliance steps convert the statutory and procedural requirements into practical actions. They prioritise verification of the statutory trigger, precise administrative compliance with roll and voting procedures, thorough review of trust instruments for compatibility with the Basis, and proactive engagement with the commission processes that will govern minority rights and property allocation.
