Presbyterian Church of Australia Act 1901

The Act rests on two legal concepts: statutory recognition of a denominational instrument, and the attachment of property rights to ecclesiastical standards and decisions.

Statutory recognition of an internal church instrument. The Act incorporates the Scheme of Union into WA statutory law by making the Scheme the operative instrument for WA Church property and governance upon satisfaction of the commencement conditions (s 2, s 3). The Schedule reproduces the Scheme in full. The Scheme establishes (among other things) a supreme standard (Scripture) and a subordinate standard (the Westminster Confession of Faith read with a declaratory statement) (Schedule, Basis of Union I-II). The Scheme then creates internal organs and rules: a representative General Assembly with legislative, administrative and judicial functions (Schedule, Articles I-IV), a Judicial Commission with specified composition and apparently final internal jurisdiction (Schedule, V), a Board of Missions (Schedule, VII), and a College Committee and Theological Halls with uniform training standards (Schedule, VIII).

Attachment of property and office to doctrinal conformity. Section 3 brings church properties within the reach of the Scheme; they “shall be held subject to the provisions of the said Scheme of Union.” Section 4 makes adherence to the Scheme’s standards the condition for continued possession of church hereditaments, estates, temporal privileges and equitable rights (s 4(2)). Therefore, doctrinal conformity and ecclesiastical government rules are not merely internal ecclesiastical matters; they are made express statutory conditions for property entitlement.

Procedural entrenchment and internal finality. The Scheme imposes high thresholds for altering the subordinate standard (Schedule, III), and it gives the Judicial Commission finality for specified internal appeals (Schedule, V(1)-(2)). The Scheme also provides a limited exit mechanism for congregations refusing a change to the basis: if a congregation refuses to acquiesce it may either be allowed to retain its property or the General Assembly may “deal in such other way with the said property as to the Assembly may seem just and equitable” (Schedule, IV). That mechanism effectively creates an internal law of property settlement and exceptions controlled by church organs.

Representation and distribution of control. The General Assembly is to be representative, with equal numbers of ministers and elders and a specified method for electing representatives (Schedule, III). The constitution of the Judicial Commission is specified in numbers and nominative quotas by State Assemblies (Schedule, V(3)). The Board of Missions and Theological arrangements are likewise governed by specified nomination and reporting rules (Schedule, VII-VIII). These details allocate decision rights across the constituent local Assemblies and the General Assembly.

Limits in the Act. The Act contains built‑in limits: the last sentence of s 3 preserves other trusts “save as aforesaid”; s 4(3) protects ministers and office‑bearers in office at the time of an alteration by allowing them to remain if they adhere to the prior standard; and the Scheme gives local Assemblies autonomy preserved “not be further interfered with than is needful to give effect to the basis of union and the articles of agreement” (Schedule, XI).

These concepts together form a statutory framework that transforms internal denominational arrangements into matters with statutory property effect for Western Australian Presbyterian entities once the formal commencement step is taken.

The Act identifies multiple classes of actors and allocates entitlements and obligations among them.

Presbyterian Church in Western Australia and its congregations. Section 3 declares that all “hereditaments, estates, and temporal privileges, and all equitable rights belonging to the Presbyterian Church in Western Australia, and the congregations thereof, or held on behalf of or in connection with such Church and congregations or bodies connected therewith” are subject to the Scheme of Union on commencement. That phrase is broad: it covers legal and equitable interests in land, chattels, and temporal privileges held by the WA Church and by congregations or connected bodies. The property‑related entitlement of these bodies therefore becomes conditional on the Scheme.

Ministers, elders and office‑bearers. The Act and the Scheme regulate ministerial admission, training, and subscription to standards. Ministers and elders are required to subscribe to a Formula at ordination or induction (Schedule, VI). Section 4(2) makes adherence to the Scheme’s standards the condition of continued possession of property rights for the Church, congregations and office‑bearers. Section 4(3) grants a saving for ministers or office‑bearers in office at the time of an alteration to the subordinate standard: such persons may remain office‑bearers and retain rights so long as they adhere to the earlier standard, or to any part of an alteration they approve.

Local Assemblies and Presbyteries. The Scheme preserves local Assemblies’ autonomy within limits (Schedule, XI). Representation to the General Assembly and nomination rights for the Judicial Commission and other bodies are allocated among local Assemblies and Presbyteries: e.g. the Judicial Commission composition ties nomination quotas to State Assemblies (Schedule, V(3)), and General Assembly representatives are to be chosen with one‑quarter representation by each local Assembly with election fractions (Schedule, III).

The General Assembly and Judicial Commission. The General Assembly of the Presbyterian Church of Australia, and the Judicial Commission constituted under the Scheme, are made binding authorities for the WA Church (s 3). The General Assembly is given legislative, administrative and judicial functions, and the Judicial Commission is specified to hear appeals and give final decisions in defined classes of cases (Schedule, IV-V).

Donors, treasurers and mission committees. The Board of Missions and local committees are assigned roles over funds and mission work. Local treasurers hold money raised for heathen missions “for the General Assembly” but the Board controls disbursement subject to local Assembly responsibility for agencies within their bounds (Schedule, VII(3)-(5)). Those who give to local missions, and treasurers who administer such funds, are materially affected by the restrictions on the Board’s use of locally raised funds without local consent.

The State Parliaments of other Australian colonies. The Act cannot commence until several other State Parliaments pass Acts giving effect to the Scheme (s 2(1)(b)). The Act therefore affects those State Parliaments in that the WA Act’s operation is contingent on legislative action elsewhere.

Third parties and civil courts. While the Act creates internal finality (Schedule, V(2)), it does not itself provide civil penalties or expressly oust civil jurisdiction. The Act therefore affects parties who may be asked to recognise or enforce internal church determinations , for example conveyancers, trustees, insurers and civil courts asked to determine property or trust questions which the Act makes conditional on adherence to denominational standards. The Act contemplates internal resolution and property consequences, but whether and how civil courts will respond is not stated in the Act.

In short, the Act affects the WA Church’s corporate and congregational property holders, office‑bearers, denominational organs that exercise governance, local treasurers and donors, and indirectly the courts and third parties who deal with church property and trust rights.

The Act and the Scheme impose duties, rights and procedures across doctrinal subscription, governance, property entitlement, finance and training. The following are the primary duties and rights set out in the text.

Duty to establish commencement conditions. The Act will not operate until the formal pre‑conditions are met: signatures to a deed poll by Moderators of the other State General Assemblies, enabling Acts in other State Parliaments, and a Gazette notice signed by the WA Moderator (s 2(1)(a)-(c)). The production of the Gazette copy is conclusive evidence of compliance (s 2(2)).

Right and duty to hold church property subject to the Scheme. On commencement, property of the WA Church and congregations is to be held subject to the Scheme of Union (s 3). This creates a statutory right of the General Assembly and the Judicial Commission to determine matters in accordance with the Scheme, and a corresponding duty on WA Church bodies to accept those determinations as binding (s 3: “All decisions of the General Assembly... or the Judicial Commission... shall be binding on the Presbyterian Church in Western Australia and its Judicatories, and on all congregations and members of the said Church, and on all properties of the Church”).

Entitlement conditioned on doctrinal adherence. Adherence to the standards in the Scheme is made the condition of continued possession of hereditaments, estates and equitable rights (s 4(2)). The standards are those in the Scheme, the subordinate standard being the Westminster Confession of Faith read with the Schedule’s declaratory statement (Schedule, Basis of Union I-II). The subordinate standard may be altered in accordance with the Scheme’s prescribed procedure (s 4(1); Schedule, III). Thus a right to property is linked to both present and future conformity.

Saving for incumbents. Section 4(3) creates a specific right for ministers or office‑bearers in office at the time of an alteration to the subordinate standard: such persons may remain and retain their rights if they adhere to the earlier standards or to those parts of the alteration they approve.

Subscription requirement for ministers, elders and probationers. The Scheme prescribes a Formula to be signed by ministers and elders at ordination or induction, and by probationers on receiving licence (Schedule, VI). The Formula is a declaration of ownership and acceptance of the subordinate standard, the purity of worship practised, and the Presbyterian government, coupled with a promise to adhere to them.

General Assembly’s powers. The General Assembly is the supreme court of the Church with legislative, administrative and judicial functions “supreme with regard to the doctrine, worship, and discipline of the Church” and other matters including missions and training (Schedule, Articles I-IV). It may meet biennially as a rule, but more often if necessary (Schedule, II). The Assembly has powers to appoint the Judicial Commission, Board of Missions, assessors, committees and other organs specified.

Judicial Commission’s jurisdiction and finality. The Judicial Commission hears and finally decides appeals in specific categories: appeals from local Assemblies regarding proposed judicial process, and references after evidence has been taken in lower courts (Schedule, V(1)). The Scheme states the Commission’s decisions “being final are not subject to review” and requires reporting of decisions to the General Assembly and the relevant local Assembly (Schedule, V(2)).

Composition and quorum rules. The Scheme prescribes numerical and nominative rules for representation and appointment: e.g. the Judicial Commission’s composition is fixed at thirty‑six members, with state nomination quotas; sixteen form a quorum for it (Schedule, V(3)). The General Assembly is to be representative with equal numbers of ministers and elders and a method for electing one‑fourth of its members from each local Assembly (Schedule, III).

Financial duties and rights. The Scheme establishes a fund for the working expenses and some travel costs of the General Assembly, to be contributed to by local Assemblies in proportions the General Assembly determines (Schedule, XII). Local Assemblies’ treasurers hold money collected for missions for the General Assembly, but the Board of Missions controls disbursement subject to local responsibilities (Schedule, VII(3)). Local Assembly consent is required before the Board applies locally raised money to other missions (Schedule, VII(3)).

Theological training standards. The Scheme requires a uniform system of theological training, specifies recognised Theological Halls, minimum professor numbers and course content, sets either degree or equivalent entry standards, and provides for common entrance and exit examinations and a College Committee to oversee standards (Schedule, VIII).

Reporting duties. Local Assemblies must forward full and definite reports to the General Assembly on home missions, Sabbath schools, and the state of religion and morals, and the General Assembly may issue recommendations and originate new home mission schemes in conjunction with local Assemblies (Schedule, X).

Right to dissent and possible property retention. If a congregation refuses to acquiesce in a change to the basis of union, the General Assembly is empowered either to allow that congregation to retain all its congregational property, or to otherwise deal with the property as seems just and equitable (Schedule, IV). That is an explicit right the Assembly may grant, but the granting is discretionary.

These provisions create interlocking duties and rights: doctrinal subscription triggers the right to hold property; internal adjudicative structures have final internal authority; local funds, training and missions are subject to central coordination under prescribed rules; and incumbrances for incumbents and dissenting congregations are provided by specific saving clauses.

The Act itself does not create criminal offences or civil penalty regimes. Enforcement and consequences under the Act are predominantly ecclesiastical, property‑based and procedural rather than penal in the statutory criminal sense.

Internal finality and binding effect. The primary enforcement mechanism created by the Act is internal recognition and binding effect of denominational decisions. Section 3 makes decisions of the General Assembly of the Presbyterian Church of Australia, and the Judicial Commission constituted under the Scheme, binding on the WA Church, its Judicatories, congregations, members and church properties. The Scheme’s Judicial Commission clause states that the Commission’s decisions “being final are not subject to review” and are to be reported to the General Assembly and local Assembly (Schedule, V(2)). That language is an internal finality mechanism: decisions of the Church’s own courts and commissions bind members and property according to the Scheme.

Property consequences as enforcement. The Act links property entitlement to doctrinal adherence (s 4(2)). Because the right to possess church hereditaments, estates and equitable rights depends upon adherence to the Scheme’s standards, non‑conformity can lead to loss of entitlement to church property. The Act does not set out a precise civil enforcement process for transferring or seizing property; rather, it makes adherence a statutory condition of continued possession and leaves the institutional processes of the Church to apply the Scheme (s 3, s 4). The Scheme contains internal mechanisms for dealing with congregations which refuse to acquiesce (Schedule, IV).

Internal judicial procedure. The Scheme specifies categories of cases the Judicial Commission will hear (Schedule, V(1)) and disqualifies prosecutors or appellants who are members of the Commission from adjudicating in their own case (Schedule, V(4)). The Commission must report evidence to the General Assembly and local Assembly, and the Commission’s decisions are final internally (Schedule, V(2)). The Judicial Commission’s procedural rules operate as an ecclesiastical enforcement process for disputes over discipline, doctrine, and the propriety of judicial processes in lower courts.

Financial enforcement through control of funds. The Board of Missions has authority to disburse funds held by local treasurers for missions, subject to the rule that local funds cannot be diverted without local Assembly consent (Schedule, VII(3)). This central control over mission funds is an enforcement lever over mission policy and financial allocation.

No statutory civil penalties or enforcement machinery. The Act does not provide for fines, imprisonment, or statutory pecuniary penalties. The Act instead places reliance on internal denominational governance to enforce adherence and applies statutory weight to those internal acts in respect of property and entitlement.

Unspecified interface with civil courts and property law. The Act makes internal denominational decisions binding as between church bodies and property in WA; however the Act does not expressly state how civil courts are to treat those internal decisions. The textual finality of the Judicial Commission is an internal rule, and the Act does not create a privative clause ousting external judicial review. Consequently, if a dispute about property, trust interpretation or the validity of an internal process reaches civil courts, the Act does not itself prescribe civil enforcement mechanisms or procedural steps for civil courts. The Act’s finality clause must be read as an internal ecclesiastical finality rule, and any civil enforcement would depend on trust and property law, and on civil courts’ approach to ecclesiastical questions, none of which the Act itself addresses.

In summary, enforcement under the Act is carried out through denominational institutions, with property consequences and internal adjudicative finality the principal levers. No criminal penalties are created and the Act leaves the civil law interface for property and trust enforcement unspecified.

The Act is explicitly framed to operate in a federated legislative context and to interact with pre‑existing Western Australian legislation and trust instruments.

Primacy over earlier WA enactment to the extent stated. Section 3 begins with “notwithstanding anything contained in the said Act numbered 20 or in any deed, declaration, or statement of trust,” and then makes WA Church property “held subject to the provisions of the said Scheme of Union.” The Act therefore operates to displace inconsistent provisions of an earlier WA statutory instrument (the Act numbered 20 referred to in the Preamble; historically that was the Presbyterian Church Act 1884) insofar as those provisions would prevent the Scheme taking effect. That displacement, however, is limited: the section finishes by stating “Save as aforesaid, the trusts upon which such properties of the Church respectively are held shall not be affected or varied by this Act.” The Act therefore overrides prior statutory or deed provisions only to the extent necessary to make church properties subject to the Scheme of Union, but otherwise leaves trusts intact.

Contingency on other States’ legislation. The Act requires that the Parliaments of New South Wales, Queensland, South Australia, Tasmania and Victoria pass Acts giving effect to the Scheme before this WA Act comes into operation (s 2(1)(b)). The consequence is that the Scheme as a federated denominational instrument is to be enacted across multiple jurisdictions and the WA Act’s operation is expressly contingent on that cross‑jurisdictional legislative alignment. This creates an interdependence between State statutes.

Internal church finality versus civil review. The Scheme declares internal finality for decisions of the Judicial Commission (“being final are not subject to review,” Schedule, V(2)). The Act makes such decisions binding on church bodies and properties (s 3). The Act does not, however, expressly oust civil jurisdiction or provide a statutory privative clause in relation to civil courts. The text therefore raises an interactional question: the Scheme’s internal finality is clear as church law and as internal governance under the Act, but the Act does not state whether, or to what extent, civil courts are to treat those church decisions as conclusive in civil litigation over property or trusts. The Act’s text leaves the civil law interface open, beyond the statutory declaration of binding effect within the Church.

Interaction with trust and property law. By attaching property entitlement to adherence to ecclesiastical standards (s 4(2)), the Act creates a statutory condition that will influence legal characterisation of trusts and conveyances involving church property. The Act itself preserves other trusts “save as aforesaid” (s 3). The consequence is that the Act may require civil lawyers and trustees to consider the Scheme when advising on title, trust terms, conveyancing or asset security involving WA Presbyterian property, because the rights recognised in civil law may be affected by the statutory requirement that property be held subject to the Scheme.

Financial and charitable law interface. The Scheme’s rules on mission funds (Schedule, VII(3)) create allocation rules for funds raised for missions. If the WA Church and its local Assemblies are charities or hold funds under charity law, those rules will need to be reconciled with charity regulatory obligations and the duties of trustees under civil law. The Act does not address regulatory compliance with charity law or income tax law; it prescribes internal allocation rules that must be implemented consistently with external regulatory duties where applicable.

Historical legislative amendments and repeals. The Notes show that the earlier WA Act number 20 (the 1884 Act) was later repealed by the Presbyterian Church Act 1908 (note 2), and the compilation table lists later relevant Parliament Acts (Presbyterian Church Act 1908, Amendment Acts 1919 and 1924, and the Presbyterian Church of Australia Act 1970) (Notes). The Act has also been subject to formatting amendments in 2010 (see compilation table). Those successive statutory instruments will determine the present legal matrix in which the Scheme operates; the text here discloses that interactional history but not its present detailed effect.

In sum, the Act imports a denominational instrument into WA statute, displaces inconsistent prior statutory and deed provisions to the extent needed to implement the Scheme, conditions property entitlement on doctrinal adherence, and leaves the detail of interaction with civil trust, property and charity law to be reckoned with in practice.

The Act as compiled contains a limited number of documented amendments and related statutory references in the Notes and Compilation table supplied with the text.

Standardisation of Formatting Act 2010 amendments. The compilation table and marginal notes record that certain headings and sections were amended by the Standardisation of Formatting Act 2010. Specifically, s 2 and s 4 were amended by No. 19 of 2010, s 51, and the Schedule heading was amended by s 4 of that Act (Compilation table and marginal note lines). The compilation table also records the reprint as at 25 October 2002 and a reissue date related to the 2010 Act (commencement 11 September 2010 for those amendments, Gazette 10 September 2010 p. 4341).

Original enactment and commencement. The Act received assent on 9 October 1901 and commenced on 8 November 1901, the Gazette for which is cited at Gazette 8 Nov 1901 p. 4483 (Compilation table). Section 2 contains a historical commencement mechanism tied to signature of a deed poll by moderators of the State General Assemblies and enabling legislation passing in the other States. The Gazette notice requirement is itself recorded in the compilation table as the operative commencement event on 8 November 1901 (see s 2(c) and Gazette reference).

Subsequent related Acts. The Notes list a number of Acts described as “other relevant Acts”: Presbyterian Church Act 1908; Presbyterian Church Act Amendment Act 1919; Presbyterian Church Act Amendment Act 1924; Presbyterian Church of Australia Act 1970 (Notes, item 3). The Act numbered 20 referred to in the Preamble and s 3 (the Presbyterian Church Act 1884) was repealed by the Presbyterian Church Act 1908 (Note 2). The compilation table indicates that the text in the current reprint includes amendments made by other written laws referred to in the table.

Limitations of the available amendment record. The supplied text does not list later amendments that may exist beyond those entries in the compilation table, nor does it recite the text of the 1908, 1919, 1924, or 1970 Acts. The compilation material confines the expressed amendments to formatting and heading changes effected in 2010 and records the historical repeal of the 1884 Act by the 1908 Act. The Schedule heading note indicates the heading was amended in 2010 (see heading amended: No. 19 of 2010 s. 4).

Practical point for advisors. The Act’s text, the compilation table and the notes together show that the Act has a long legislative history and that later Presbyterian statutes and amendment Acts exist elsewhere in the WA statute book. Any practitioner advising on present law should consult the later Acts flagged in the Notes and confirm whether further amendments or consolidations post‑dating the compilation exist, and check whether the Scheme has been brought into effect under the commencement provisions (s 2), because the Act only becomes operative when the conditions are satisfied.

The legislative text and accompanying Notes provided do not include, cite or summarise any court decisions concerning the Act, the Scheme of Union, or disputes under the Scheme. No cases are named or described in the source material supplied.

What the Act itself does provide that touches on litigation or review is internal procedural finality for ecclesiastical adjudication. The Scheme states that the Judicial Commission’s decisions “being final are not subject to review” and requires reporting of its decisions to the General Assembly and the local Assembly (Schedule, V(2)). This is an internal church finality rule which makes decisions conclusive within the ecclesiastical framework created by the Scheme.

The absence of recorded litigation in the supplied text leaves open, but does not resolve, several litigation‑relevant questions that might arise in practice:

• Interaction between the Scheme’s internal finality and civil courts’ jurisdiction. The Act imposes binding effect of internal denominational decisions on WA church bodies and properties (s 3), and the Judicial Commission’s decisions are described as final (Schedule, V(2)). The Act does not include an express civil‑law privative clause barring civil challenges. Whether a civil court would entertain a challenge to an internal church determination that has property consequences, and on what grounds (e.g. trust interpretation, breach of fiduciary duty, want of jurisdiction, denial of natural justice), is not addressed in the Act and is therefore an open question for litigation in the absence of authority.

• Enforcement of property consequences in civil courts. The Act makes property entitlements conditional on adherence to doctrinal standards (s 4(2)). If a congregation or office‑bearer refuses to recognise an internal determination that affects property, enforcement of any transfer, reallocation or removal of possession would likely require civil law mechanisms (e.g. trust variation, alienation, injunction). The Act does not spell out the civil procedural steps to effect property changes. The extent to which civil courts will give effect to the Scheme’s internal determinations when asked to adjudicate title or trust questions is not addressed in the text.

• Procedural fairness and internal adjudication. The Scheme sets internal rules for the Judicial Commission, including disqualification of parties who act as adjudicators in their own cases (Schedule, V(4)). Whether internal procedures comply with civil standards of procedural fairness in matters that intersect with civil rights is an issue that civil courts have considered in other contexts; however the Act provides no guidance on how a conflict would be resolved.

Because the supplied material contains no reported cases, practitioners must search doctrinally and jurisdictionally relevant case law and subsequent legislation or consolidation sources to determine whether civil courts have treated the Scheme’s provisions (in WA or other states) as conclusive, or whether disputes have been litigated. The text here gives no litigation history to cite.

This Act contains several provisions whose practical consequences may surprise practitioners, donors, trustees, property lawyers and ministers unless they read the text carefully.

1. Property made subject to an internal denominational instrument notwithstanding prior deeds. Section 3 begins with a broad “notwithstanding” clause: on commencement, all properties of the WA Church and congregations “shall be held subject to the provisions of the said Scheme of Union,” notwithstanding the earlier Act numbered 20 or any deed or statement of trust. Practitioners must note that the Act can alter the legal regime affecting property despite existing deeds, subject to the Act’s final sentence that other trusts are not affected “save as aforesaid.” The practical boundary between what is “subject to the Scheme” and what constitutes an unaffected trust requires close textual and factual analysis.

2. Doctrinal conformity tied to property entitlement. Section 4(2) conditions “continued possession in all time coming” of hereditaments, estates and equitable rights on adherence to the Scheme’s standards. That is not merely rhetorical: it is a statutory linkage between belief/discipline and property rights. For trustees and conveyancers, this means that title documentation or trust advice should expressly account for the Scheme once the Act is in force.

3. Ministers in office are protected but only if they adhere to the earlier standard. Section 4(3) allows ministers and office‑bearers in office at the time of a subordinate standard alteration to continue and retain rights provided they adhere to the pre‑alteration standards, or any part of the alteration they approve. The saving is limited to incumbents in office at the time of the change. New appointees will be subject to the revised standard.

4. High threshold for altering the subordinate standard. The Scheme requires changes to be remitted to local Assemblies and Presbyteries and then to be approved by a majority of local Assemblies, three‑fifths of the Presbyteries of the whole Church, and a majority of three‑fifths of the members present when the final vote of the General Assembly is taken (Schedule, III). That is a comparatively high procedural barrier that can make change difficult and can create incentives for procedural manoeuvring.

5. Discretionary remedy for dissenting congregations is not automatic. If a congregation refuses to acquiesce in a change, the General Assembly is empowered either to allow the congregation to keep its property or to “deal in such other way” with the property as seems “just and equitable” (Schedule, IV). That power is discretionary; the Scheme does not create an automatic right for dissenting congregations to retain property.

6. Judicial Commission’s internal finality may not foreclose civil claims. The Scheme describes the Judicial Commission’s decisions as final and not subject to review (Schedule, V(2)). That finality is internal to the Church as an adjudicative body. The Act does not state that civil courts will be barred from adjudicating related civil claims. Parties should not assume that statement alone prevents civil litigation over property or trust issues.

7. Representation mechanics are uncommon. The method for electing General Assembly representatives is described in a compressed way: “each local assembly shall be represented by one‑fourth of its members, to be elected , three‑fourths by the Presbyteries and one‑fourth by the local Assembly itself” (Schedule, III). In practice, this creates a mixed electoral mechanism with quotas that may be unfamiliar and that can generate disputes about counting and eligibility.

8. Local funds for missions have restricted use. The Scheme provides that money raised by local Assemblies for heathen missions “shall be held by their respective treasurers for the General Assembly” and disbursed at the Board of Missions’ order, but local responsibility for supporting agencies remains and the Board cannot apply local money to other missions without local consent (Schedule, VII(3)). This mixture of central control and local consent creates administrative complexity for treasurers and donors.

9. Training and entry standards for ministry are centralised. The Scheme prescribes recognised Theological Halls, minimum academic prerequisites and common entrance and exit exams (Schedule, VIII). Candidates who lack prescribed qualifications may be admitted only in specified exceptional circumstances. Localities with differing educational resources must adapt to this central standard.

10. The Act’s commencement conditions are cross‑jurisdictional. The WA Act only becomes effective after Acts are passed by several other States and a Gazette notice is published (s 2). Historical or practical uncertainty about whether other States have enacted corresponding provisions may create ambiguity as to whether the Scheme applies at any given time.

Practitioners should beware that these features are embedded in plain statutory and Scheme text, and cannot be ignored in property dealings, ministerial appointments, trust administration, mission funding, or when advising congregations considering dissent or change.

Compliance under this Act is predominantly institutional and process‑driven. The following checklist sets out concrete steps and record points that WA Presbyterian bodies, office‑bearers, treasurers, conveyancers and legal advisers should attend to if the Act has come into operation or may come into operation.

1. Confirm commencement. Before taking any action under the Scheme, confirm that the Act has come into operation in WA by checking (a) whether the Moderators of the General Assemblies of New South Wales, Queensland, South Australia, Tasmania, Victoria and Western Australia have signed the required deed poll (s 2(1)(a)), (b) whether each specified State Parliament has passed an Act giving effect to the Scheme (s 2(1)(b)), and (c) whether the Gazette notice signed by the Moderator of the WA General Assembly has been published (s 2(1)(c)). Obtain and retain a copy of the Gazette notice purporting to be signed by the Moderator, which is conclusive evidence (s 2(2)). Recordkeeping of these documentary proofs is essential because the Gazette notice is conclusive under the Act.

2. Review trust and title documents. For each hereditament, estate and equitable interest held by the Church or its congregations, have a lawyer examine deeds, statements of trust and transfer instruments to determine whether their terms are consistent with the property being held “subject to the Scheme of Union” (s 3). If inconsistencies exist, obtain advice on whether and how the Scheme’s operation affects transaction risk, including covenants, encumbrances and third‑party rights. Note that s 3 contains a saving: “Save as aforesaid, the trusts upon which such properties of the Church respectively are held shall not be affected or varied by this Act.” Ensure advice documents how the Scheme interacts with existing trust obligations.

3. Ensure doctrinal subscription where required. Ministers, elders and probationers must sign the prescribed Formula at ordination or induction (Schedule, VI). Ensure ordination and induction procedures include a contemporaneous execution and retention of that Formula. For those in office at the time of any proposed alteration to the subordinate standard, keep accurate records of their status and any declaration of adherence to the earlier standard, to preserve the saving in s 4(3).

4. Prepare for internal governance and representation procedures. Local Assemblies and Presbyteries should implement processes to elect General Assembly representatives in accordance with the Scheme (Schedule, III), and to make nominations to the Judicial Commission and Board of Missions in line with the quotas specified (Schedule, V(3); VII(1)). Keep minutes and roll calls to substantiate representative elections and nominations, and ensure the names of nominees and the basis of their nomination are recorded.

5. Comply with Judicial Commission rules in disputes. If involved in an internal dispute likely to go to the Judicial Commission, document procedural compliance, preserve evidence, and ensure that any party who is a member of the Commission does not adjudicate in their own case (Schedule, V(4)). Be aware that the Commission’s decisions are stated to be final internally (Schedule, V(2)), and prepare to report decisions to the General Assembly and local Assembly as required.

6. Follow funding and mission fund rules. Treasurers must segregate and hold money raised for missions in accordance with Schedule, VII(3). Do not allow local mission funds to be used by the Board of Missions for other missions without written consent of the local Assembly. Establish clear accounting and consent procedures to evidence local Assembly approvals.

7. Ensure theological training and candidate eligibility rules are followed. The Scheme contains minimum academic and training requirements for candidates for licence and ordination (Schedule, VIII). Ensure candidate records (university degrees, examination results, certificates) are maintained, that recognised Theological Halls are involved where required, and that Theological Hall Committees and College Committee arrangements operate as the Scheme prescribes.

8. Maintain clear records of any changes to the subordinate standard. The Scheme prescribes a remitted process for alterations (Schedule, III). If any proposal to revise or abridge the subordinate standard is tabled, ensure it is remitted to local Assemblies and Presbyteries as required, and maintain vote records demonstrating that the required majorities were obtained (majority of local Assemblies, three‑fifths of Presbyteries of the whole Church, and three‑fifths of members present at the final General Assembly vote).

9. If a congregation objects to a change, commence the process early. Schedule, IV requires the General Assembly to make a discretionary decision either to allow retention of property or otherwise deal with property justly. Congregations intending to claim the protections of Schedule, IV should give timely notice, assemble evidence of their refusal to acquiesce, and prepare submissions on the question of property disposition to the General Assembly.

10. Obtain external legal advice before altering trust and conveyancing practice. Because the Act modifies the statutory regime applicable to church property and ties possession to ecclesiastical standards (s 4(2)), seek external legal advice when selling, mortgaging or otherwise transacting in church property. Conveyancers should confirm that any transaction documents reflect the Scheme’s effect where necessary, and trustees should ensure that their decisions comply with both ecclesiastical rules and civil trust duties.

11. Keep donors and stakeholders informed. Given the restrictions on the use of locally raised mission funds (Schedule, VII(3)), provide clear donor communication and written consents if funds are to be diverted. Ensure that local Assembly approvals are formally recorded prior to any reallocation.

12. Audit corporate and charitable compliance. If the Church or its congregations hold charitable status, verify that implementation of the Scheme remains consistent with charity regulation, reporting obligations and trustee duties under civil law. The Act does not alter external regulatory duties; compliance with charity law, taxation and reporting requirements remains necessary.

13. Keep legislative and case law under review. The Act references other Presbyterian Acts and later amendments (Notes and Compilation table). Practitioners should monitor subsequent legislative changes and any judicial determinations interpreting similar provisions or the interface between ecclesiastical finality and civil courts.

By following these concrete steps , verifying commencement, aligning trust and title records, implementing subscription and training procedures, recording representative and voting processes, segregating mission funds, and obtaining proactive legal advice for property transactions , denominational actors and their legal advisers can make compliance practicable and reduce the risk of procedural or property disputes.
