21 Death of recipient before completion of payments under agreement

(1)  Where a prepaid funeral agreement provides for payment by instalments and the recipient dies before the payment of the final instalment, the person carrying on the funeral business must supply funeral services as if the final instalment had been made.

Penalty:  Fine not exceeding 50 penalty units.

(2)  Subsection (1) does not affect the liability of any personal representative of the recipient for any amount due under the agreement.
