The regulation builds on, and gives effect to, several conceptually distinct elements of the Powers of Attorney regime. These are the prescribed form, the scope of the attorney’s authority, the commencement and endurance of powers, the role of prescribed witnesses and certifiers, and the interface with registration and third-party recognition.

Prescribed forms: Schedule 2 supplies two forms that are declared prescribed for the Act, s 8 (reg 5). Form 1 is titled "General power of attorney" and Form 2 is "Enduring power of attorney". Each form contains (a) background information and an “important information” section; (b) numbered clauses for appointment of attorneys, powers, conditions and limitations, commencement, signature/witnessing, and in the case of enduring powers, a prescribed witness certificate (Form 2, cl 6) and an attorney acceptance clause (Form 2, cl 7). The forms incorporate explanatory notes and completion guidance which the regulation makes part of the prescribed text by inclusion in Schedule 2.

Scope of authority: both forms state that the attorney may exercise authority conferred by the Powers of Attorney Act 2003, Part 2, to do anything the principal may lawfully authorise an attorney to do (Schedule 2, Form 1 and Form 2, cl 2). The forms also offer optional check-boxes to authorise particular statutory powers: reasonable gifts (Act, s 11(2)), conferring benefits on the attorney to meet their reasonable living and medical expenses (Act, s 12(2)), and conferring benefits on specified persons (Act, s 13(2)). The forms therefore map the Act’s statutory limits and optional permissive powers directly into the principal’s choices.

Commencement and endurance: Form 1 (general) contains commencement options including immediate operation, specified dates, operation while overseas, or other specified commencement; the default, where no clear selection is made, is immediate operation (Schedule 2, Form 1, cl 4). The stated legal effect in the background information is that a general power of attorney ceases if the principal loses mental capacity. Form 2 (enduring) expressly gives the principal the option and intent that the power continues if the principal lacks capacity; it also sets different commencement options including start on attorney acceptance, start on a medical certificate stating incapacity, or once the attorney considers assistance is needed; the default is that the instrument operates once the attorney has accepted the appointment by signing (Schedule 2, Form 2, cl 4).

Prescribed witnesses and certifiers: reg 4 prescribes the classes of persons who may certify copies under the Act, s 44(1)(a)(ii), and links the list to Schedule 1. Schedule 1, Part 1 lists domestic classes permitted to endorse documents within Australia, including accountants, Australian legal practitioners, bank managers, commissioners for taking affidavits, dentists, judges, magistrates, justices of the peace, medical practitioners, notaries public, pharmacists, principals of schools, registrars of local courts, and others. Schedule 1, Part 2 sets out a different list for documents endorsed abroad, including Australian Consular Officers (per Oaths Act s 26), commissioned defence officers, commissioners for taking affidavits, judges, justices, legal practitioners and notaries. For enduring powers, the prescribed witness certificate in Form 2, cl 6 requires the prescribed witness to certify that they explained the effect of the power to the principal and that the principal appeared to understand it; the certificate requires the witness to tick the appropriate witness category such as Australian legal practitioner, Registrar of Local Court, licensed conveyancer who has successfully completed a Minister-approved course, NSW Trustee and Guardian employee similarly trained, trustee company employee similarly trained, or a legal practitioner qualified in a country other than Australia if employed independently of any legal practitioner who is an attorney under the power (Schedule 2, Form 2, cl 6).

Recording, registration and third-party dealings: the forms and explanatory notes repeatedly emphasise practical interfaces. They warn that if an attorney signs documents affecting real estate, the power of attorney may need to be registered at the NSW land registry operated by NSW Land Registry Services (Schedule 2, Forms 1 and 2, Important information and notes about land registry). The forms also spell out duties for attorneys (keep funds separate, keep reasonable accounts, not benefit unless authorised, act honestly and in principal’s best interests), and note that failure to comply may attract civil or criminal penalties (Schedule 2, cl 6-7 of forms and "Attorney responsibilities" in Form 1).

Defaults and evidentiary rules: the Schedule 2 forms contain default rules where a principal fails to select an option or selects inconsistent options. For example, where multiple attorneys are appointed and no selection is made about joint or joint-and-several appointment, the forms state the principal’s intention is for attorneys to act jointly and severally (Schedule 2, Forms 1 and 2, appointment clauses). Similarly, defaults apply to commencement in both forms. The regulation therefore combines prescriptive text with built-in default interpretative aids that operate as presumptive intentions of the principal.

Continuity and procedural repeal: reg 6 expressly repeals the 2016 regulation and carries forward any acts or things that had effect immediately prior to repeal (reg 6(1)-(2)). The regulation therefore avoids procedural gaps in documentary and certifier status that would otherwise flow from repeal.

Taken together, the regulation’s main concepts are procedural standardisation, evidentiary clarity for witnesses and certifiers, preservation of prescribed statutory powers and optional gift/benefit permissions, and operational guidance for interaction with land registration and third parties.

The regulation creates obligations, choices and practical effects for a defined set of participants in the powers of attorney ecosystem. The principal, the attorney (and substitute attorneys), prescribed witnesses and certifiers, third-party recipients of powers (banks, land registries, registrars), and institutions that maintain or process powers of attorney are all affected.

Principals: any natural person creating a power of attorney in New South Wales who uses the prescribed forms in Schedule 2 is directly governed by the regulation’s procedural text. The forms set out the defaults principals will be taken to intend if they omit ticks, and they flag that a general power ceases on loss of mental capacity while an enduring power continues after loss of capacity (Schedule 2, Forms 1 and 2). Principals who wish their attorney to have particular statutory authorities (gifts, conferring benefits) must select the relevant check-boxes; the forms map those choices to the relevant Act sections (Act, ss 11(2), 12(2), 13(2)).

Attorneys and substitute attorneys: attorneys nominated under the forms are affected in multiple ways. For enduring powers the attorney must accept the appointment before acting (Form 2, cl 7: "Before acting as your attorney, the attorney, including any substitute attorney, must sign the acceptance in clause 7"). The forms stipulate attorney responsibilities (keep principal’s money separate, maintain accounts, not benefit unless authorised, act in best interests, act honestly) and warn of civil or criminal penalties for breaches (Schedule 2, attorney responsibilities and acceptance clauses). Substitute attorneys exercise authority only if the original attorney vacates office; the forms provide mechanics and recommend attaching documentary evidence of the vacancy to assist third parties (Schedule 2, notes on substitute attorneys and attorney vacates office).

Prescribed witnesses and certifiers: Schedule 1 and Schedule 2, cl 6, draw a line between who may witness and who may certify documents. Schedule 1, Part 1 prescribes domestic classes who can endorse documents for the purposes of the Act, s 44(1)(a)(ii), including a wide professional mix (legal practitioners, accountants, bank managers, medical practitioners, pharmacists, school principals, registrars, justices). Schedule 1, Part 2 prescribes classes who may endorse documents within a foreign country and includes consular officers as defined by the Oaths Act 1900, s 26. For enduring powers the prescribed witness categories in Form 2, cl 6 include specific training requirements for licensed conveyancers and certain institutional employees (those "who has successfully completed a course of study approved by the Minister"), signalling an administrative gate around who may certify comprehension and voluntariness.

Third parties and institutional recipients: banks, NSW Land Registry Services, registrars of Land Registry Office, and other entities that will be presented with powers of attorney are affected indirectly. The forms explicitly advise that certain documents affecting real estate must be registered with NSW Land Registry Services and provide contact numbers for NSW LRS (Schedule 2, Important information). The regulation supplies a standardised format and prescribed witness signatures that third parties can rely upon when deciding whether to act on a power of attorney; they therefore affect the evidentiary threshold required by those entities.

Court and tribunal actors: the forms reference the Civil and Administrative Tribunal and the Supreme Court concerning appointment of guardians for health and lifestyle decisions (Schedule 2, background information for both forms and cross-reference to Guardianship Act 1987). This signals that courts and tribunals are participants in the broader decision-making architecture even though the regulation itself does not alter their roles.

Administrative agencies and professional bodies: the NSW Trustee and Guardian is repeatedly referenced as a source of information and as an institutional actor (Schedule 2, Further information and prescribed witness categories). The Minister’s role is implicated in approving courses of study for certain categories of prescribed witnesses (Form 2, cl 6 witness tick-box options referencing "successfully completed a course of study approved by the Minister").

Foreign authorities and consular officers: Schedule 1, Part 2 explicitly includes Australian and British Consular Officers exercising functions in the country where the document is executed or witnessed, operating via the Oaths Act 1900. This affects principals and attorneys who execute or witness powers overseas and expect local consular endorsement to satisfy NSW evidentiary requirements.

Land registry operators and registrars: the forms include a "LAND REGISTRY OFFICE USE ONLY" marker and direct contact details for NSW LRS, making clear that land-related transactions are subject to registration obligations and that NSW LRS is an intermediary third party who will rely on the prescribed forms and witnesses when processing instruments affecting land.

Taken together, the regulation affects both private actors (principals and attorneys) and institutional actors (registers, banks, courts, the NSW Trustee and Guardian, professional certifiers). The regulation standardises the evidentiary inputs these stakeholders must accept or evaluate when presented with a power of attorney in the prescribed form.

The regulation embeds, in the text of the prescribed forms, a set of duties for attorneys and corresponding rights or choices for principals. Those duties and rights are grounded in the forms’ clauses and their cross-references to the Act.

Attorney duties (as specified in the forms)

• Keep the principal’s money and property separate from the attorney’s money and property (Schedule 2, Form 1 "Attorney responsibilities", Form 2 acceptance clause reciting the same duty). The forms add the qualification that this does not apply where ownership is joint or where joint bank accounts operate (Important information).
• Keep reasonable accounts and records of the principal’s money and property (Schedule 2, Form 1 "Attorney responsibilities"; Form 2 acceptance clause). The forms state accountants' fees and record-keeping costs may be recoverable from the principal (Important information).
• Not benefit from being an attorney, unless expressly authorised by the principal (Schedule 2, Form 1 "Attorney responsibilities" and Form 2 acceptance clause). The forms furnish an optional tick-box for the principal to authorise the attorney to confer benefits on themselves to meet reasonable living and medical expenses, or to authorise gifts (Schedule 2, Form 1 and Form 2, cl 2 additional powers referencing Act, ss 11(2), 12(2), 13(2)).
• Always act in the principal’s best interests and act honestly in all matters concerning the principal’s legal and financial affairs (Schedule 2, both forms contain express obligations and acceptance clauses reiterate them).
• Comply with statutory and common-law obligations implied by the Act; though the regulation provides template wording, the forms expressly refer to the Powers of Attorney Act 2003, Part 2 as the source of the attorney’s authority (Schedule 2, cl 2).

Attorney responsibilities are presented with a clear compliance risk note: "Failure to do so may incur civil and/or criminal penalties." The regulation does not quantify penalties in its own text; it locates liability risk in the broader legal framework by warning of civil and criminal consequences.

Principal rights and choices

• Choice of form: principal can select General (ceases on incapacity) or Enduring (continues on incapacity). Form 2 includes explicit wording that the principal intends the instrument to continue if they lack capacity (Schedule 2, Form 2, cl 2).
• Choice over who acts and how: the principal chooses one or more attorneys, can nominate substitute attorneys, and can stipulate whether attorneys act jointly, jointly and severally, or by majority where three or more attorneys are appointed (Schedule 2, appointment clauses and Notes for completion).
• Choice on additional powers: the principal decides whether to authorise reasonable gifts, authorise benefits to the attorney, or authorise benefits to named persons by ticking the relevant boxes (Schedule 2, Forms 1 and 2, cl 2). The forms refer to the relevant Act sections for these powers.
• Choice on commencement mechanics: the principal can set the commencement to be immediate, to commence on a specified date, on a medical certificate, upon attorney acceptance, or while overseas, or another alternative, subject to the default rules set out in the forms (Schedule 2, Forms 1 and 2, cl 4). The forms state the default outcome if no option is selected or if options are inconsistent.
• Right to revoke: the general form notes that the principal may revoke a general power of attorney, and recommends giving written notice to the attorney and other third parties; the enduring form notes that revocation is only possible while the principal retains mental capacity and will not be possible after loss of capacity (Schedule 2, Important information). These are statements of legal consequence rather than new substantive rights created by the regulation.

Witness and certifier qualifications and duties

• Prescribed witnesses who certify enduring instruments must complete a specific certificate attesting that they explained the effect of the power to the principal and that the principal appeared to understand it (Schedule 2, Form 2, cl 6). The certificate requires the witness to confirm they are a prescribed witness and that they are not an attorney under the instrument.
• Schedule 1 enumerates the professional and official categories that may endorse documents domestically (Part 1) and overseas (Part 2), thus constraining who may properly verify or authenticate signatures or copies for purposes of the Act, s 44(1)(a)(ii).

Registration and third-party reliance rights

• The forms instruct that certain powers of attorney affecting real estate must be registered at NSW Land Registry Services; this creates a procedural right for third parties and registries to require registration for certain transactions to proceed, and for NSW LRS to rely on the presence of prescribed forms and witnesses (Schedule 2, Important information). The forms emphasise that they are for NSW use only and that interstate or overseas recognition is not guaranteed.

Defaults as interpretative rights

• The forms declare certain defaults that operate as the principal’s intended choice where the principal has omitted a selection. For example, absent an explicit selection on the mode of appointment, attorneys are treated as appointed jointly and severally (Schedule 2, appointment clauses). These built-in defaults reduce uncertainty for third parties and for courts by signalling the principal’s intended default arrangements.

In summary, the regulation operationally secures duties for attorneys through prescribed wording, clarifies the principal’s menu of choices and the legal consequences of those choices, defines who may act as witnesses and certifiers, and ties registration and third-party recognition to these procedural standards. The forms are the mechanism through which rights are exercised and duties are enforced; the regulation does not specify penalties or enforcement processes in detail but embeds liability warnings and cross-references to the Act.

The regulation itself contains only general references to potential liability and does not create or schedule discrete offences or penalties. Its enforcement architecture therefore relies on the Powers of Attorney Act 2003 and other existing legal and administrative processes.

Regulation-level statements: Both the general and enduring prescribed forms include repeated warnings that failure by an attorney to comply with duties "may incur civil and/or criminal penalties" (Schedule 2, Form 1 "Attorney responsibilities"; Form 2 acceptance clause and related text). The regulation does not quantify penalties, nor does it specify administrative sanctions or a prosecutorial pathway within its own text.

Delegation of enforcement to the Act and other instruments: Because the regulation prescribes forms and classes of witnesses under the Act (reg 4 and reg 5), the relevant statutory offences and civil remedies that apply to misconduct by attorneys will be those contained in the Powers of Attorney Act 2003 and other applicable legislation referenced in the forms. The regulation repeatedly cross-references the Act as the substantive source of powers and duties (Schedule 2, cl 2 referencing the Act, Part 2, and referencing ss 11(2), 12(2), 13(2) for specific powers). Readers must therefore consult the Act to determine the specific civil remedies (for example, equitable remedies, account and restitution claims) and criminal offences that may apply to dishonest or unauthorised conduct by attorneys. The regulation itself does not purport to alter those substantive enforcement mechanisms.

Evidentiary and practical enforcement levers

• Prescribed witness certificate for enduring powers (Form 2, cl 6) acts as an evidentiary safeguard. The requirement that the prescribed witness certify that the principal appeared to understand the effect of the enduring power makes the instrument better able to withstand later challenges to validity on the grounds of lack of capacity or undue influence. This evidentiary feature is an upstream enforcement tool because it increases the transaction costs of later litigation challenging the instrument.
• Registration requirements for instruments affecting real estate (Schedule 2, Important information referencing NSW Land Registry Services) create a separate administrative enforcement point. Land registries can refuse to register or accept instruments that do not meet registration requirements, which practically prevents an attorney from exercising land-related powers until registration is complete.

Third-party reliance and refusal: Banks and other third parties are given practical discretion whether to accept a power of attorney. The prescribed forms, witness certification, and registration provide a standardised evidentiary basis for third parties to rely on. The regulation therefore creates an enforcement landscape in which non-compliance (for example, lack of prescribed witness certificate or lack of registration for land dealings) can result in third-party refusal to transact, creating practical impediments that are effectively enforcement mechanisms outside criminal or civil court remedies.

Administrative remedies and institutional oversight: The forms and notes point principals and users to the NSW Trustee and Guardian, the Office of the Registrar General, Land Registry Services, and to legal advisers, suggesting those agencies are the operational nodes for complaints, revocation advice, and questions about registration. The regulation itself does not create a complaint or oversight mechanism, but it channels potential enforcement or remedial action to the usual administrative and judicial routes by signalling the relevant institutional actors.

Limitations in the regulation: The regulation does not specify who investigates breaches, which agency prosecutes or brings civil claims, or any cap on penalties. It instead takes a prescriptive-document approach: providing standardised instruments and expecting enforcement to be carried out through the Act and the broader legal system. Practitioners should therefore consult the Powers of Attorney Act 2003 and other relevant statutes and regulations to identify the precise civil or criminal provisions that can be invoked against an attorney.

In practice, enforcement will be a mix of administrative prevention (refusal by registries and banks to accept defective instruments), civil remedies (accounting, injunctions, restitution), and criminal prosecutions where the facts engage relevant criminal offences. The regulation strengthens enforcement indirectly by standardising forms, witness certificates and procedural defaults that increase the evidentiary threshold required to prove later challenges to validity or impropriety.

The regulation is explicitly designed to operate in the architecture of existing statutes and agencies. It cross-references the Powers of Attorney Act 2003 repeatedly and makes tactical references to other laws and administrative instruments. The effects of these cross-references are procedural and evidentiary, not substantive changes to other statutes.

Primary statutory nexus: The regulation flows from and gives form to the Powers of Attorney Act 2003. Reg 3 defines "the Act" as the Powers of Attorney Act 2003 (reg 3). Reg 4 prescribes persons for the purposes of Act, s 44(1)(a)(ii), and reg 5 prescribes forms for Act, s 8. The forms in Schedule 2 repeatedly reference the Act for substantive powers and statutory limitations (Schedule 2, Form 1 and Form 2, cl 2). Therefore the regulation is operationally subordinate to the Act; it provides the prescribed instrumental means by which principals and attorneys engage the Act’s substantive provisions.

Guardianship Act 1987: Both forms explicitly state that an attorney under either a general or enduring power cannot make decisions about lifestyle or health; those decisions can only be made by a guardian, whether an enduring guardian appointed by the principal or a guardian appointed by the Civil and Administrative Tribunal or the Supreme Court (Schedule 2, background information for Forms 1 and 2). The forms therefore reference the Guardianship Act 1987 as governing non-financial decision-making, thereby delineating the respective spheres of authority under the powers-of-attorney regime and guardianship law.

Oaths Act 1900 and consular definitions: Schedule 1, Part 2 includes "Australian Consular Officers, or British Consular Officers, within the meaning of the Oaths Act 1900, section 26" as persons who may endorse documents executed abroad. This cross-reference ensures that consular officers’ capacity to authenticate or endorse instruments overseas aligns with the definitions and functions set out in the Oaths Act.

Subordinate Legislation Act 1989: Reg 2 contains an explanatory note referencing the Subordinate Legislation Act 1989, s 10(2) and its effect on the prior regulation. The note states that this regulation repeals and replaces the 2016 regulation, which would otherwise be repealed by that Act on a given date. The interaction is procedural: the 2024 regulation ensures continuity and occupies the subordinate-law space that would have been vacated by automatic repeal of the earlier regulation.

Land registration and property law: The forms instruct that powers affecting real estate may need to be registered at the NSW land registry operated by NSW Land Registry Services and provide contact details for NSW LRS (Schedule 2, Important information). This is an operational cross-check with land law and land registration practice. It places a procedural requirement on attorneys dealing with land-transaction documents to meet registration requirements under land law as administered by NSW LRS.

Administrative approvals and ministerial functions: Form 2, cl 6's prescribed witness categories include "Licensed Conveyancer who has successfully completed a course of study approved by the Minister", "NSW Trustee and Guardian employee who has successfully completed a course of study approved by the Minister", and "A trustee company employee who has successfully completed a course of study approved by the Minister". Those entries insert a ministerial administrative function, approval of courses of study, into the regulation’s operational fabric, meaning that the minister’s approval decisions will affect who can act as a prescribed witness for enduring instruments.

Interstate and international recognition: The forms explicitly warn that they are for NSW use only and that principals should not assume that other states, territories or foreign jurisdictions will recognise these instruments (Schedule 2, Important information). This places the forms within the federal structure and international private law context; third-party recognition of NSW-prescribed forms remains subject to other jurisdictions’ laws and comity. The regulation therefore interacts with the rules of private international law and with the law of other Australian states and territories by warning users to check cross-jurisdictional recognition.

Courts and tribunals: The forms refer to the Civil and Administrative Tribunal and the Supreme Court in the context of guardianship appointments, thereby interacting with judicial processes for appointment of guardians and for resolving disputes about capacity, revocation, or attorney misconduct.

In short, the regulation interacts primarily through procedural alignment and cross-references: it relies on the Powers of Attorney Act 2003 for substantive powers and liabilities; it interacts with guardianship law for non-financial decision-making; it aligns evidentiary rules with consular and oaths law for offshore execution; it ties into land registration processes for property dealings; and it embeds ministerial course-approval as a gatekeeper for some prescribed witness categories. The regulation itself leaves substantive enforcement and the full legal consequences to the Act and to other existing statutory frameworks.

This regulation is a replacement instrument: it expressly repeals the Powers of Attorney Regulation 2016 and takes effect on publication. The text provides two specific pieces of amendment history information.

• Repeal of the 2016 regulation: Reg 6(1) states "The Powers of Attorney Regulation 2016 is repealed." This is an explicit repeal rather than a saving as to the whole instrument, and the regulation hence becomes the operative subordinate instrument for powers of attorney matters in New South Wales.
• Savings continuity: Reg 6(2) provides a transitional saving: "An act, matter or thing that, immediately before the repeal of the Powers of Attorney Regulation 2016, had effect under that regulation continues to have effect under this regulation." This clause preserves existing legal effects of documents and actions done under the 2016 regulation, avoiding vacuum or invalidation of earlier acts.

Commencement context: Reg 2 states that the regulation commences on the day it is published on the NSW legislation website. The reg 2 note adds contextual information: the 2016 regulation would otherwise have been repealed on 1 September 2024 under the Subordinate Legislation Act 1989, s 10(2); this regulation repeals and replaces the 2016 regulation (reg 2 note). That note supplies the administrative rationale for timing, though it is a note rather than operative language.

No other amendments are recorded within the text of the regulation itself. The instrument does not include a schedule of prior amendments to this regulation because it is a new replacement regulation that repeals a prior instrument. The only legislative history explicitly preserved in the text is the existence of the 2016 regulation and the saving clause that carries prior effects forward.

Practical effect of the repeal: Any forms, lists of prescribed certifiers, or procedural devices that were set out in the 2016 regulation are replaced by the new Schedule 1 and Schedule 2 in this regulation. The savings clause prevents invalidation of documents created under the 2016 instrument by continuing their effect under the new regulation.

Ministerial and administrative approvals: The regulation introduces or retains categories of prescribed witnesses that depend on ministerial approval of courses of study (see Schedule 2, Form 2 cl 6). The amendment history does not set out those course approvals; those functions are left to Ministerial administrative action post-enactment if required. Any future amendments to this regulation would likely focus on the lists in Schedule 1 and the wording or categories in Schedule 2, but no such amendments are recorded in this instrument.

In summary, the amendment history as captured by this regulation is a clear replacement of the 2016 regulation, with express savings to maintain continuity of effect, and immediate commencement on publication.

The regulation itself does not record any litigation history. It contains no references to cases, court determinations, or legal challenges. The Schedule 2 forms include language that anticipates litigation risks, references to evidentiary value of witness certificates and warnings about penalties, but there is no text or schedule recording past or pending litigation that concerns the forms, the prescribed lists of certifiers, or the repeal of the 2016 regulation.

What the instrument does show is an attempt to reduce litigation risk by standardising evidentiary practice:

• Enduring powers require a prescribed witness certificate in the form set out (Schedule 2, Form 2, cl 6). That certificate requires the witness to certify that they explained the effect of the instrument to the principal and that the principal appeared to understand it. Such procedural requirements are designed to strengthen the defence of instruments against later challenges based on capacity, undue influence or improper execution.
• The forms include explicit warnings and default interpretative rules to reduce later disputes about intent (for example, defaults on joint and several appointments where no clear selection is made) (Schedule 2, Forms 1 and 2, appointment clauses). These defaults reduce ambiguity and the consequent need for judicial interpretation.

Because the regulation is procedural and prescriptive about forms, much litigation that might arise around powers of attorney will still occur under the Powers of Attorney Act 2003, guardianship law, or general equitable principles, rather than under the regulation itself. The regulation’s role is to provide a standard instrument that, if followed, reduces dispute friction; but absence of compliance with the prescribed form or witness certificate remains a factual and legal point that courts may adjudicate.

Practitioners seeking litigation history must therefore consult court records and decisions under the Powers of Attorney Act 2003 and related guardianship and property disputes. The regulation contains no annexed schedule or notes of judicial interpretation, nor does it assert any precedential effect. It is silent on litigation outcomes, remedies applied by courts, or appellate rulings. Consequently, the regulation’s own text provides no litigation narrative.

The regulation standardises forms and certifiers, but several potential practical pitfalls arise from the text itself. These are procedural snares and evidentiary risks that practitioners, principals and attorneys should watch for.

1. Witness and certifier categories differ by location

• Schedule 1 makes a sharp distinction between persons who may endorse documents within Australia (Part 1) and those who may endorse documents within a foreign country (Part 2). The lists are not identical. For example, pharmacists, school principals, and postal managers appear in the domestic list but not in the foreign list (Schedule 1, Part 1 v Part 2). If a document is executed overseas and endorsed by a person who is not in Schedule 1, Part 2, the endorsement may not meet the requirement referenced in Act, s 44(1)(a)(ii) and the document’s evidentiary value in NSW could be diminished.

2. Enduring witness certificate strictness

• Form 2, cl 6 requires a prescribed witness to certify that they explained the effect of the enduring power to the principal and that the principal appeared to understand it. The prescribed witness must also certify they are not an attorney under the instrument. The witness categories include specific training requirements for certain categories (licensed conveyancers, NSW Trustee and Guardian employees, trustee company employees must have "successfully completed a course of study approved by the Minister"). Failures to use a properly prescribed witness or to complete the certificate fully may expose the instrument to challenges on capacity or undue influence.

3. Defaults can produce unintended legal effects

• The forms set default interpretations where selections are omitted or inconsistent. For example, if a principal appoints multiple attorneys but fails to tick the joint/joint-and-severally boxes, the default is attorneys acting jointly and severally. A principal who intended an exclusively joint appointment but neglected to tick the correct box will find the attorneys can act individually. The forms explicitly state the principal's purported intention in such cases (Schedule 2, appointment clauses). Practitioners should not rely on defaults; explicit choices are safer.

4. Enduring power revocation and incapacity timing

• The forms make clear that an enduring power cannot be revoked after the principal loses mental capacity (Schedule 2, Form 2 "Background information" and "Important information"). If a principal intends that the power cease on incapacity, they must use a general power of attorney and not an enduring form. Misunderstanding this distinction is a frequent trap.

5. Registration requirement for land dealings

• The forms warn that powers used for real estate transactions may need to be registered with NSW LRS (Schedule 2, Important information). Failure to register when required will prevent property transactions from proceeding or create later disputes about title and authority. The forms do not define which documents or land dealings require registration; parties must check with NSW LRS and the relevant property law.

6. Cross-jurisdictional recognition is not guaranteed

• The instruments are for use in NSW only and the forms caution principals that other Australian states or foreign jurisdictions may not recognise them (Schedule 2, Important information). Principals who engage in interstate or international transactions must not assume automatic recognition; separate instruments or additional formalities may be needed.

7. Training and ministerial approvals create a layer of administrative dependency

• Several prescribed witness categories for enduring instruments require completion of a Minister-approved course. The regulation does not itself list approved courses or provide a schedule of approvals. Until the Minister approves courses, those categories may be practically narrower; or institutions may lack clarity about whether their employees meet the prescribed witness test.

8. Third-party discretion and banks

• The forms serve as a standardized instrument but third parties, such as banks, retain discretion whether to accept a power of attorney. The regulation does not bind private institutions to accept the form; it simply prescribes wording and witnesses that should make acceptance more straightforward. Nevertheless, practical refusals may occur if institutions doubt capacity, suspect fraud, or apply stricter internal rules.

9. Costs of record-keeping may be recoverable from the principal

• The Important information notes state that the cost of providing and maintaining records by the attorney "may be recoverable from you." That introduces an economic externality; an attorney facing protracted record-keeping obligations may seek recovery from the principal’s estate or assets. Principals should be aware of this potential charge.

10. The regulation gives no details of enforcement pathways or penalties

• While the forms warn about civil and criminal penalties, the regulation does not specify which provisions apply or which agencies will enforce them. Practitioners must consult the Act for enforcement specifics, which creates a compliance research step that might be overlooked in transactional practice.

These "gotchas" are not bugs in the sense of illegality, but they are practical compliance and evidentiary issues that increase risk if not addressed. In transactional or estate planning practice, confirm witness categories before execution, ensure correct ticking of options, obtain and retain appropriate documentary evidence of vacancy where substitutes are appointed, register land-related instruments with NSW LRS when required, and obtain legal advice before creating enduring instruments.

Below is a practical compliance checklist and procedural steps grounded in the regulation’s text and the forms in Schedule 2. This is aimed at practitioners, registrars, and institutional staff who must accept, certify, or rely on powers of attorney in New South Wales.

1. Choose the correct form

• Determine whether the principal needs a General power of attorney (use Form 1) or an Enduring power of attorney (use Form 2) as prescribed in Schedule 2 and reg 5. Use Form 1 if you want the power to cease on loss of mental capacity; use Form 2 if you want the power to continue after loss of capacity (Schedule 2, Forms 1 and 2 background information and cl 2).

2. Complete appointment details carefully

• Insert full names and addresses of principal, appointed attorneys, and substitute attorneys where applicable. If appointing multiple attorneys, ensure the principal clearly selects whether they are to act jointly, jointly and severally, or jointly with termination on death/resignation by a co-attorney as set out in the appointment clauses (Schedule 2, Forms 1 and 2 appointment sections). Avoid leaving these boxes blank; the forms supply a default (jointly and severally) but it may not reflect the principal’s intention.

3. Specify powers explicitly

• If the principal wants the attorney to have power to make gifts, to confer benefits to the attorney for living/medical expenses, or to confer benefits on specified persons, tick the relevant boxes. Each option references the relevant sections of the Powers of Attorney Act 2003 (Schedule 2, cl 2 referencing Act, ss 11(2), 12(2), 13(2)). If these boxes are left blank, such powers are not expressly authorised.

4. Set conditions and limitations if required

• If the principal desires limits (for example, permitting the attorney only to sell a particular property or only to handle shares), insert those conditions in the "Conditions and limitations" clause. If none are desired write "NIL." Specific conditions should be drafted carefully to avoid ambiguity.

5. Choose commencement method

• Tick the commencement option required (immediate; specified date; upon attorney acceptance; upon medical certificate; while overseas; or other specific commencement). Note the default rules in the forms: if no option is selected, the forms specify a default commencement (Schedule 2, Form 1 cl 4 default; Form 2 cl 4 default).

6. Witnessing and prescribed witness certificate (enduring)

• For general powers: ensure the signature of the principal is witnessed as required by the Act and local practice. For enduring powers: the prescribed witness must complete the certificate at Form 2, cl 6, certifying that they explained the effect of the power to the principal and that the principal appeared to understand it, and must tick their witness category from the prescribed list (Schedule 2, Form 2, cl 6). Confirm the witness is not an attorney under the instrument. For enduring instruments, the attorney must sign the acceptance in cl 7 before acting.

7. Check witness eligibility

• For Australian execution, confirm the witness is included in Schedule 1, Part 1. For documents executed or witnessed abroad, confirm the witness falls within Schedule 1, Part 2. For enduring powers, also check the specialized witness categories and any training or Minister-approved course requirements (Schedule 2, Form 2, cl 6).

8. Registration for land transactions

• If the attorney will sign documents affecting real estate, contact NSW Land Registry Services to determine whether the power needs to be lodged for registration (Schedule 2, Important information quoting NSW LRS contact numbers). Ensure copies and registration meet NSW LRS requirements to avoid rejected transactions.

9. Keep and maintain records

• Attorneys must keep funds separate and maintain reasonable accounts and records (Schedule 2, "Attorney responsibilities"). Practically, this means establishing a separate trust or client account, keeping receipts and ledgers for transactions done on behalf of the principal, and maintaining copies of the power and any relevant correspondence. The forms state record-keeping costs may be recoverable from the principal.

10. Revocation procedures

• If revoking a general power of attorney, notify the attorney and any known third parties, preferably in writing, so they can cease to act (Schedule 2, Important information). Note that the enduring power cannot be revoked after the principal loses capacity.

11. Attach evidentiary documents where necessary

• Where substitute attorneys are intended to step in, or where vacancy must be established, attach documentation evidencing the death, resignation, bankruptcy, incapacity or other grounds for vacancy to help satisfy third-party institutions (Schedule 2 notes on attorney vacates office). This reduces administrative friction and risk of refusal by third parties.

12. Advise third parties proactively

• Where banks, investment managers or other institutional third parties are aware of the instrument, provide them with certified copies or originals and notify them of any revocation. Use witnesses and certifiers from Schedule 1 to provide the appropriate certification.

13. Cross-jurisdictional checks

• If the principal expects the power to be used interstate or overseas, confirm recognition in the other jurisdiction or arrange a separate power under that jurisdiction’s laws. The forms caution that they are for NSW use only, and cross-jurisdictional recognition is not guaranteed (Schedule 2, Important information).

14. Training and Ministerial approvals

• If relying on witness categories that require completion of a Minister-approved course (licensed conveyancer, NSW Trustee employee, trustee company employee), verify that the person has completed the relevant course approved by the Minister. The forms require witness categories to be ticked and include the training precondition where applicable.

15. Legal advice and documentation retention

• The forms advise obtaining legal advice before signing. Practitioners should document advice given, retain signed originals, and maintain electronic copies in secure storage. Where agents (e.g., solicitors) prepare the form, maintain file notes of the principal’s instructions, proof of capacity at the time of execution, and witness details.

Following these steps will align practical behaviour with the procedural and evidentiary standards the regulation sets. The regulation’s primary compliance levers are the proper use of the prescribed form, use of appropriately prescribed witnesses and certifiers per Schedule 1, and compliance with registration requirements where land is involved. Legal counsel should be sought on any uncertainties particularly concerning capacity, revocation timing, complex conditions, or cross-border transactions.
