34 Who is eligible to sign an enduring power of attorney at the direction of the principal? (1) A person is eligible to sign an instrument creating an enduring power of attorney at the direction of the principal if the person— (b) is not a witness to the signing of the instrument; and (c) is not an attorney under the enduring power of attorney. (2) To avoid doubt a person is not excluded from being eligible to sign an instrument creating an enduring power of attorney at the direction of the principal merely because the person is an employee of an attorney for the principal who signs the instrument while the person is acting in the ordinary course of that employment.
