49 Obligations on health care facilities in relation to powers of attorney The person in charge of a health care facility must take all reasonable steps to ensure that— (a) each person receiving care at the facility is asked whether the person has an enduring power of attorney for personal care matters, health care matters or medical research matters; and (b) if a person has a power of attorney of that kind—a copy of the power of attorney is kept with the person’s records; and (c) a process is in place to periodically check the currency of powers of attorney kept.
