25Leave of absence deemed to have been granted

#### 25 Leave of absence deemed to have been granted (1) Where: (a) a person deemed to have been appointed an officer in the Australian Postal Commission Service under this Part; or (b) a person employed by the Australian Postal Commission in accordance with section 23, was granted leave of absence for a period commencing on or before the commencing day and ending on or after that day, he or she shall be deemed to have been granted leave of absence by that Commission in accordance with the By‑laws made under the Postal Services Act 1975 or in accordance with the Commonwealth Employees’ Furlough Act 1943‑1973 or the Maternity Leave (Australian Government Employees) Act 1973, as the case requires, for a period commencing on the commencing day and ending on the last day of that first‑mentioned period and for the purpose for which he or she had been granted that first‑mentioned leave of absence and, if he or she was paid by Australia salary or allowances in respect of any leave after the commencing day, the payment shall be deemed to have been made by the Australian Postal Commission in respect of the leave that is deemed to have been granted to him or her under this subsection. (2) Where: (a) a person deemed to have been appointed an officer in the Australian Telecommunications Commission Service under this Part; or (b) a person employed by the Australian Telecommunications Commission in accordance with section 23, was granted leave of absence for a period commencing on or before the commencing day and ending on or after that day, he or she shall be deemed to have been granted leave of absence by that Commission in accordance with the By‑laws made under the Telecommunications Act 1975 or in accordance with the Commonwealth Employees’ Furlough Act 1943‑1973or the Maternity Leave (Australian Government Employees) Act 1973, as the case requires, for a period commencing on the commencing day and ending on the last day of that first‑mentioned period and for the purpose for which he or she had been granted that first‑mentioned leave of absence and, if he or she was paid by Australia salary or allowances in respect of any leave after the commencing day, the payment shall be deemed to have been made by the Australian Telecommunications Commission in respect of the leave that is deemed to have been granted to him or her under this subsection.
