56 Penalty for carrying on business etc. while unlicensed (a) the person carries on a business of a stevedore; and (b) the business is carried on within a designated port; and Ports Management Act 2015 56 (c) the person does not hold a licence under this Part authorising the person to do so. (2) In any proceedings for an offence against subsection (1), an averment by the prosecutor in a complaint or information that a specified person did not hold a licence under this Part at the time when the offence was committed is evidence of the fact so averred.
